In April of this year,I applied for a building permit with Southold town 1. 4 building department. At that time the permit was rejected,and I was advised that I would have to apply for a variance with the board of appeals, in order to proceed with any addition to my home. On May 23,20031 remitted to the appeals board a check for$ 150.00(see attached receipt)so that a hearing could be held on the variance to my properly for construction. As advised by your office a new survey of my property was taken on 8-13-2003 by John C. Ehlers N.Y. S. UC. NO 50202. The survey was taken back to the building department,by my son Edward A.Vidulich on 8-26-2003 who was then advised that a variance would not be needed due to the fact that the survey provided showed that my property was under the allotted 20,000 square feet needed to have a valance heard. I immediately reapplied on 8-26-2003 for a building permit which was reviewed and;granted to me on.8-27-2003. In lieu of the above stated circumstances,and the fact that I do not need to seek a variance from the board of appeals,and that no action was ever taken or heard in this matter,I respectfully request that the $ 150.001 submitted for the appeal be reimbersed. The new sketch that was submitted (prepared by Penny Lumber) confirms a different setback than that applied to at the Building Department. It will be necessary to provide the Building Department with a new survey with the amended distance to the property line, in order that they may consider amending their Notice of Disapproval. Since thenew survey has not been ordered for submission, we are not authorized to advertise your application for the September 25, 2003 hearing calendar. Please advise when the surveys are available, and furnish seven prints with seven copies of the amended Notice of Disapproval. When received, a new hearing date may be scheduled. Thank you.
