THOMAS COLLINS), who died on the loth day of October, 2022,
party of the first part,and
NANCY A. COLLINS, residing at 24 Hollywood Place, Huntington, New York 11743, and THOMAS
P. COLLINS III, residing at 31 Bankside Drive, Centerport, New York 11721, as Trustees
of the Disclaimer Trust under Article Seventh of the Last Will and Testament of THOMAS
P. COLLINS a/k/a THOMAS PATRICK COLLINS II,
party of the second part,
WITNESSETH,that whereas letters testamentary were issued to the party of the first part by the Surrogate's Court,Suf folk
County,New York,on the 7th day of August, 2023,and by virtue of the power and authority given by said last will and
testament,and/or by Article 11 of the Estates,Powers and Trusts Law,and inconsideration of zero ($0) dollars paid by the
parry of the second part,does hereby grant and release unto the party of the second part,the distributees or successors and assigns
of the party of the second part forever, a fifty percent (50%) interest as tenant-in-common in and
to
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,lying and being
at East Marion, Town of Southold, County Suffolk and State of New York, known and
described as Lot #67, on a certain map entitled "Map of Section 3, Cleaves Point", filed
in the Office of the Clerk of the County of Suffolk on August 9, 1977 in Liber 8266 cp
23.as filed map no. 4650.
BEING AND INTENDED TO BE the premises conveyed by deed dated June 29, 1977 to THOMAS
COLLINS and NANCY COLLINS, his wife, recorded in the Suffolk County Clerk's Office on
July S. 1979, in Liber 8653 page 407. References in this deed to "THOMAS P. COLLINS
a/k/a THOMAS PATRICK COLLINS II" shall mean and include the said grantee THOMAS
COLLINS in the foregoing deed dated June 29, 1977, and references in this deed to
"NANCY A. COLLINS" shall mean and include the said grantee NANCY COLLINS in the
foregoing deed dated June 29, 1977.
THIS DEED sets forth and confirms the devise of decedent THOMAS P. COLLINS a/k/a
THOMAS PATRICK COLLINS II's fifty percent (50%) undivided interest in the subject
property to the Trustees of the Disclaimer Trust under Article Seventh of the duly
probated Last Will and Testament of THOMAS P. COLLINS a/k/a THOMAS PATRICK COLLINS II
(Surrogate's Court, County of Suffolk, File No. 2022-4479), as a result of the
Renunciation by decedent's spouse, NANCY A. COLLINS, which Renunciation was filed with
the Surrogate's Court, County of Suffolk, on June 30, 2023.
TOGETHER with all right,title and interest,if any,of the party of the first part,in and to any streets and roads abutting the above
described premises to the center lines thereof;TOGETHER with the appurtenances,and also the estate which the said decedent
had at the time of the decedent's death in said premises,and also the estate therein,which the party of the first part has or has
power to convey or dispose of,whether individually,or otherwise;TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part,the distributees or successors and assigns of the parry of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises
have been incumbered in any way whatever,except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word"party"shall be construed as if it reads"parties"whenever the sense of this indenture so requires.
