The inspection covered the framing for the alteration to the existing structures. The areas inspected included the first floor and roof of the existing building. The framing work included exterior and interior walls, floors ceilings and roof. The inspection results are: Items inspected included lumber type/grade, lumber size, dimensional spacing, framing connections, header sizes, bearing, continuity strapping and integration with the concrete foundation. The framing work was done according to approved plans and in compliance with the applicable sections of the IRC,NYS and Southold Town Building Codes. The inspection covered the interior plumbing roughing for the Drainage Waste and Vent System(DWV) and the Water Supply System(WS). The inspection results are: 1 —DWV—System was fully exposed and readily viewed. I observed all drainage and vent lines. System constructed as required.New installation is connected to the existing system. All construction was done in compliance with the applicable sections of the IRC, NYS and Town of Southold Building Codes. 2—WS—System was fully exposed,pressurized and readily viewed. I observed all hot and cold water supply lines. System constructed'as required. I On 4/6/23 I reviewed the latest revision of the project plans for the Single Family Residence (Bldg. 33) and Accessory Structure (Bldg. 35) renovation. The purpose of this effort was to determine if the proposed construction complies with the 2020 NYS Energy Conservation Code, in particular the applicable sections of the 2018 IECC. The proposed work has been determined to be located within an Existing Building, Code Section N1107 (R501) and ani"Alteration-2"as defined by the NYS Code. The elements reviewed for energy conservation include the exterior envelope,fenestration,hot water, lighting andlHVAC System. Review Basis: 2020 NYS Residential Building Code—Chapter 11-Energy Efficiency 2020 Energy Conservation Code of NYS Chapter 5-Existing Buildings (as referenced by residential code) To verify that the NYS ECC/IECC criteria have been met by the project deign the following information is provided and certified: Each additional Code Section has been individually addressed and the results are: Section 1109.1.1 (R503.1.1)Building Envelope states: Exception: The following alterations shall not be required to comply with the requirements for new construction provided that the energy use for the building is not increased: 2 — Existing ceiling, wall or floor cavities exposed during the construction provided that these cavities are filled with insulation. 1 C S I 5 — Roofs without insulation in the cavityand where the sheathing I g or insulation is exposed during reroofing shall be insulated either above or below the sheathing. The work designed for Single Family residence (33) and Accessory Structure (35), as stated in the Energy Analysis, and shown in the Project Drawings meets this requirement: I 1-After the Alteration the building will use less energy for routine operation. 2-All exposed cavities in the roof, ceiling,walls and floors will be 100% filled with insulation. I Although the Alteration Work for the Building Envelope meets all of the criteria of the 2020 NYS Residential Building Code and NYS ECC/IECC, applying the standard ResCheck program for energy analysis would not produce proper results. The proposed work is 100% Code compliant, but not applicable for input into ResCheck. i Section N1109.1.1.1 (R503.1.1.1)Replacement Fenestration states: When some or all of an existing fenestration unit is replaced with a new fenestration product, including sash and glazing, the fenestration product shall meet the applicable product requirements for U factor and SHGC as specified Table N1102.1.2 The Prescriptive Section N1102.1 (R402.1)of the Code: Windows-Doors/Glazed-Table N1102.1.2 (R402.1.2)requires a`V"factor of 0.32 The Thermatrue Doors have a"u"factor of—0.32 (or less) The Anderson 400 Series Doors have a"u"factor of- .032 The Anderson 200 Series Windows have a"u'Ifactor of- .032 I The proposed window and door replacement meets the Prescriptive requirements of the Code. Section N1109.1.2(R503.1.2)Heating and Cooling Systems states: New heating, cooling and duct systems that are part of the alteration shall comply with Section N1103. The HVAC Systems includes the new "split units"proposed for the Single Family Residence. The existing unit in the boathouse will remain. The system provided in the design is: Building Conditioned Space Proposed Unit Cottage 33 Multiple Rooms ComfortStar Unit— 1.5 Ton Rating 2 � J This proposed design for the HVAC System is compliant with all Installation and Equipment Performance Requirements. This finding is based upon the efficiency ratings and vast operational improvement of the newer systems. The proposed mechanical system meets the requirements of this Code Section. Section N1109.1.3 (R503.1.3) Service Hot Water Systems states: New service hot water systems that are part of the alteration shall comply with Section N1103.5 The Hot Water System includes the new electric units proposed for the Single Family Residence. The existing unit in the Accessory Structure will remain. The system provided in the design is: Building Service Area Proposed Unit Single Residence(33)Bath and Kitchen Energy Star Certified This proposed design for the Hot Water System is compliant with all Installation and Performance Requirements. This finding is based upon the efficiency ratings and vast operational improvement of the newer systems. The proposed mechanical system meets the requirements of this Code Section. Section N1109.1.4 (R503.1.4)Liahtine states: New lighting systems that are part of the alteration shall comply with Section N1104.1 The Interior and Exterior Lighting Systems will be new high-efficacy LED lamps. The lighting proposed for the buildings will be 100% LED, decreasing the amount of energy used, reducing the heat load and providing a longer unit life cycle. The exterior lighting proposed for the single residence and accessory structure area meets the code requirement for visibility while conforming to the Dark Sky requirements of Southold Town. The proposed lighting system meets the requirements of this Code Section. RESULTS: This proposed design for the Alterations to the Single Family Residence and Accessory Structure is compliant with the 2020 NYS Residential Building Code & 2020 Energy Conservation Code of NYS. The design meets the requirements of this Code Section as follows: -After the Alteration the building will be more compliant with the Code. -After the Alteration the building will use less energy for operational needs. - The Alterations do not create any hazardous conditions or overload any building systems. 3 This certification statement is provided in conformance with Section R105.2.2, Written Statement of the 2020 ECC of NYS. Based upon my review in April 2023 of the design documents: To the best of my knowledge, belief and professional judgement such plans or specifications are in compliance with the Energy Code. Note — This statement and certification is being provided because the use of the ResCheck Software program will not produce accurate results for this project. "Must provide documentation from the Town Trustees regarding the as-buildproposed work for any structure within 100'of wetland boundary" The Town Trustees visited the site on February 7, 2023, and determined that a wetland permit application was needed only to legalize: (1) ground disturbance within their 100- foot jurisdiction, (2) an as-built concrete slab I adj acent to an existing retaining wall on Lot 10, (3) a proposed refuse collection area next to the public road on SCT 045-06-08, and (4) the placement of an existing shed that is potentially on the border of Town property and SCT 045-06-08. The Trustees have a long-standing policy not to require a wetland permit for renovations to an existing structure (commercial or residential) if there are no additions. This has been confirmed on multiple occasions and site visits with various members of the Board; it was once again confirmed during the February 7 on-site meeting. As such, the renovation work to all the cottages and the motel across the properties are not a part of the application and do not require their permission. I submitted eight (8) applications to the Trustees on February 13, 2023, one (1) for each lot, and we have a scheduled hearing on March 15, 2023. I have been in touch with the DEC about the proposed renovations to the motel and cottages since April 2022. Their stated policy regarding the cottages throughout the Silver Sands property is that a permit would not be required if there was to be no additions. I did apply for a non jurisdiction letter from DEC for Lots 13, 14 and 15 based upon there being a bulkhead in place since April 1977. The DEC issued a non- jurisdiction letter for those lots on July 27, 2022 (Appendix A). As no additions have been made and the fact that we have a non jurisdiction letter for Lot 15, we do not require DEC approval for our proposed scope of work to the cottage or boathouse. As an aside, DEC did require a permit for the proposed work on the motel building (Lot 11.),which was applied for and received on July 29, 2022 (Appendix B). 2. Records indicate this was a single-family dwelling (Building#33) conversion to motel use is as-built—must apply for site plan approval -- with Planning & Special Exception to ZBA (along with additional variances) to legalize use (and requires Health Dept. approval) OR revert use back to a single-family dwelling but you will be required to obtain a Town rental permit every 2 years,-and must rent the house for more than 2 weeks at a time to comply with the Town Rental Law- Chapter 207 Cottage 33 and Boathouse 35 have never operated as a residence, and they have always been part of the motel complex as rental units. The Suffolk County Department of Health Services has granted a Temporary Residence (TR) permit to the Silver Sands Resort for 40 units (Appendix C). The Temporary Residence Unit regulates "temporary residences" such as hotels and motels, and cottage colonies. "Temporary Residences" are facilities maintained primarily for overnight occupancy by 10 or more people but are not intended to be occupied by the same persons in excess of 180 consecutive days. The TR permit for the Silver Sands covers all lots that comprise the "Resort", which includes but is not limited to the buildings on Lots 9 and 11-15. The motel building (Lot 11) has 21 units and the buildings on Lots 9 and 12-15 account for an additional 17 units (38 total). I am also including a letter from Darline Duffy (Appendix D), who was one of the previous owners of the Silver Sands Motel as well as a long-standing Southold Town Tax Assessor. Ms. Duffy's direct, personal knowledge of the properties dates to 1975. She confirms that all lots currently associated with the Silver Sands have been zoned Resort Residential (RR) since before that time and that all the dwellings on Lots 9 and 11-15 have been used exclusively for short-term transient housing. "Nonetheless, we recognize that the Property Tax Bill.(Appendix E) designates Cottage 33 as a "l Family Res" and would like to note that, our application does not propose changing the use to a motel. Our permit applications for Cottage 33 and Boathouse 35 are limited to upgrading doors and windows only. The existing sewer system has served the motel and all the cottages for some decades. There has been no activity regarding the system that has or will require any permit from the Suffolk County Health Department. The County only responds to an application and in this case,none is needed or forthcoming. 4. A cost analysis is being provided from an engineer that indicates each cottage's renovation costs does not exceed the 50% of assessed valuation. Therefore,no zoning variance will be required. 6. Edward's parents built the original motel in 1957 and he and I had been together since 1975.1 inherited my husband's ownership in the motel and surrounding properties,which I sold to the current owners in 2022.I also served as a Southold Town Assessor from 1991-2014,through which I had intimate knowledge of real property and its taxable status within the Town of Southold, including the Silver Sands properties. I can attest that all the cottages and homes on the various properties that comprised the Silver Sands have always been rented to guests and were never used as permanent residential housing since at least 1975.To the best of my knowledge, all the properties that are currently part of the Silver Sands have been zoned Resort Residential since at least 1975 as well.Of course,the Silver Sands Motel (on SCTM.1000-047-02-11) itself was built in 1957.Furthermore,the cottage on SUM 1000-047-02-09(aka#34)was at one point called the Windward Shore Motel before it was incorporated into the Silver Sands,and the cottages on SUM 1000- 047-02-14(aka#s 101-108),which date back to 1930,were;at one time called the Silvermere Beach Houses.. All the dwellings on these properties, as well as the ones,on SCTMs 1000-047-02-121 -13, and -15, were rented out to guests for many decades.
