Minutes & Discussion Notes from Meeting held
Tuesday, March 19, 2024 at 7:00 p.m.
This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town
Hall Annex, 54375 Route 25 (Main Road), Southold, New York.
The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not
have access to a computer or smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected that the
Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of
discussing applications regarding proposed acquisitions of real property where publicity would substantially
affect the value thereof. The public is not allowed to attend, view, or listen to Executive Session.

Committee Minutes and Administration

Inquiries/Applications for Uses or Structures on Preserved Property
• Henry L. Ferguson Museum
SCTM# 1000-4.-5-5.10— Proposed Walking Trail
Lilly presented John Sepenoski's recommendations to the Committee regarding invasive species
management for the proposed trail installation. John noted that leaving viable invasive species cuttings
and seeds in place should not be considered consistent with the property's "Conservation Values," and
that cuttings/seeds should be removed and solarized or solarized in place. The Committee members
agreed John's management recommendations should be made a condition of approval, and noted that
the trails should be cut as soon as possible, before cuttings become viable.The Committee also discussed
the specific invasive species identified on the property, including oriental bittersweet, glossy buckthorn,
Japanese honeysuckle, Morrow's honeysuckle, black locust, porcelain berry, Tree of Heaven, and privet.
Committee members noted that Tree of Heaven is particularly difficult to remove because cutting without
removing the stump, or treating the stump with herbicide, will cause it to spread. Eric added that Tree of
Heaven is a host plant for the Spotted Lantern Fly. Lilly confirmed the recent NY Natural Heritage Project
inventory did not identify the Spotted Lantern Fly. The Committee directed Lilly to revise the Town's
conditional approval to reflect this discussion.
• Oregon Road Estate Vineyards LLC
SCTM# 1000-84.-1-4.5— Irrigation Well, Electric Meter, Shed and Deer Fencing
The Committee reviewed a referral from the Building Department regarding the installation of a new electric
meter, irrigation well, shed (less than 100 square feet), and deer fencing on property subject to a
development rights easement. While an existing meter, well, and shed previously serviced the vineyard
on the easement area, they are located on a lot that has since been separately conveyed and is no longer
connected to the farm operation. The new meter, well, and shed are located roughly 15 feet from west of
the existing infrastructure. Lilly showed an aerial of the approximate location and measurements of the
new meter,well, and shed, and explained that everything but the shed has been installed.The Committee
agreed that these are consistent with the applicable easement's terms.

The Land Preservation Committee has reviewed and discussed the applicant's request and finds it is
consistent with the terms of the Easement. The Committee directs the Land Preservation Executive
Assistant to send a letter to the applicant, Building, and Planning as necessary outlining its findings.

The Committee entered executive session to discuss comments from Land Preservation Special Counsel
and the Assistant Town Attorney.

applications, appraisals and current applications.

SCTM# 1000-69.-1-9.1 —Artist Residency& Proposed Art Walk (Follow Up from 2/6/2024 Meeting)
The Committee members reviewed their observation from the January site visit. The Committee members
noted that 2023 GIS aerials of the property reflect mowed paths roughly correlating to the proposed
Artwalk's concept design. Committee members also reviewed various paid events hosted on the easement
area unrelated to agricultural production, some of which promoted the sculptures and art installations on
the property. The Committee determined that the sculptures, artist residency, and any events related to
the sculptures or artist residency are not consistent with the easement's terms because they are not related
to agricultural production. The Committee also concluded that paid special events, including farm-to-table
dinners, are not consistent with the terms of the easement. The Committee determined that the storage of
aquaculture equipment is allowed as long as the area is not being rented for such storage, which would
be a commercial activity not consistent with the easement's terms.The Committee also confirmed that on-
farm composting is consistent with the terms of the easement,so long as the organic matter is not accepted
for a fee and the compost is not sold.The Committee stated the sculptures must be removed immediately.
The Committee divided the observed uses into two appendices. Appendix A consists of uses deemed
inconsistent with the easement terms, including sculptures/art installation, the artist's studio, farm-to-table
dinners and other paid special events, art-related events, and the proposed art walk. Appendix B consists
of uses deemed consistent with the easement terms, including the storage of aquacultural equipment and
on-farm composting.

The Land Preservation Committee reviewed the property uses listed in appendices A and B. The
property uses listed in Appendix A are inconsistent with the terms of the recorded easement. The
property uses listed in Appendix B are not in conflict with the terms of the easement. Sculptures must be
removed. The Land Preservation Committee directs the Land Preservation Executive Assistant to send a
letter to the owner consistent with this discussion.
