Michael Kimack on behalf of DUNNE LIVING TRUST requests a Wetland Permit to temporarily
remove existing 3'x10 adjustable ramp and 6'x70' floating dock, 102 linear feet of existing wood
bulkhead and 8.6'x8'x6' hot tub; install 102 linear feet of new vinyl bulkhead in same location and
raised 25" to match height of southerly adjoining bulkhead; perform reclamation dredging to be
done as required; reinstall existing adjustable ramp and floating dock; install approximately 65 linear
feet of stone retaining wall at±2' above top of new bulkhead with a ±10' return along southerly
property line (±75 linear feet) with stone steps (12sq.ft.); backfill area between new raised bulkhead
and base of new retaining wall with ±60 cubic yards of clean fill; install a 12'x18' in-ground pool in
approximately the same location as removed hot tub; install pool enclosure fencing; install a pool
drywell; install a pool equipment area; install a ±280sq.ft. blue stone patio O/E; backfill landward
side of new retaining wall with ±25 cubic yards of clean fill and reseed; remove three (3) trees; and
to establish and perpetually maintain an approximately 10' wide by 40 linear foot long northerly
vegetated non-turf buffer area and an approximately 10' wide by 60 linear feet of a southerly gravel
non-turf buffer area both along the landward edge of new bulkhead. Located: 1425 Gull Pond
Lane, Greenport. SCTM# 1000-35-4-11
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, I recommend that the proposal is
CONSISTENT with LWRP Policies and with the LWRP.
The proposal to install a 12'x18' in-ground pool in approximately the same location as removed hot
tub; install pool enclosure fencing; install a pool drywell; install a pool equipment area; install a
±280sq.ft. blue stone patio O/E is recommended as INCONSISTENT. The setback of the pool
and drywell are too close to marine waters. A minimum setback from a bulkhead (wetland)
to a pool is 50'.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS Planning Board
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in details list_ both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.

Remove 3 ft. x 10 ft. wood ramp. Remove 102 LF of existing wood bulkhead. Remove existing
8' 6'x 8'x 6" hot tub
Install 102 LF of new vinyl bulkhead in same location and raised 25 "to match height of
southerly adjoining bulkhead. Reclamation dredging as may be required.
Install approx. 65 LF of stone retaining wall at 2 ft. +/-above top of new bulkhead w/
approx. 10 ft. return along southerly property line. ( 75 LF+/- )w/stone steps ( 12 SF ).
Backfill area between new raised bulkhead and base of new retaining wall w/clean fill (60
cu.yds. +/-)
Establish approx.. 40 LF of 10 ft.wide vegetated non turf buffer and approx. 60 LF of gravel
non turf buffer 10 ft. wide to match width of southerly gravel non turf buffer.
Install 12 ft. x 18 ft. in ground pool ( 216 SF ) in approx.. same location as removed hot tub.
Install approx. 280 SF of blue stone patio O/ E.
Backfill landward of new retaining wall w/approx. 25 cu.yds of clean fill and reseed.
