Re: Requested Exemption from Hotel Moratorium
Dear Supervisor, Krupski and Town Board Members:
The North Fork Environmental Council does not support the application of the developer of the proposed hotel
complex in Mattituck for an exemption to the town's current hotel/motel moratorium.
Considering that Southold Town is currently undergoing a crucial, long overdue zoning update, it would be un-
wise for the town to grant such a waiver, especially considering the size and scope of the project and the potential
cumulative effect on the town traffic and infrastructure.
We urge you to reject this application and complete the Zoning update before additional hotels or motels are
built.

Good morning,
Unfortunately, I will not be able to participate in person
this afternoon at the public hearing and may not be able to
join via Zoom, so I would like to add the following
comments for the record . (These comments are on my
own behalf. )
I wish to reiterate and reaffirm some of the comments
made at the initial hearing, that

a) The Town of Southold has embarked on changing the
code and despite the claims of the attorneys for the Hotel
that they will follow new changes, their application should
be allowed to proceed only once the code is in place. It will
be an extraordinary waste of limited Town resources to
allow the application to start, only to have revisions
submitted once the new code takes effect. This would also
apply to extending the moratorium for another 12 months.
b) The statement that the property owner contributes to
the character of Mattituck, when their current flagship
property is a virtual heat island with next to no vegetation,
rings hollow.
c) The owner also has plans to construct 2 warehouses
adjacent to the Capital One Bank branch on Main Road .
Since they already have vacant property at the former
Capital One HQ building, why not use that for a
warehouse? In fact, they could even move Renee's to the
Capital One HQ site and have all of their retail operations
at one location, rather than building a warehouse within
the HALO of Mattituck hamlet.
d) I question how they will fill the rooms during the winter
months. Will the rooms be rented to other municipalities,
such as New York City, to deal with overcrowding at
shelters?
e) While not every guest may egress from an event at the
same time, regardless, when an event ends, the volume of
cars entering our roads which have hardly been widened

since Colonial times will contribute to the traffic nightmare
on our roads.
f) Will the hotel, should it be built, have a limit as to the
number of weddings like is set for The Enclaves?
g) While many of the population of Greater New York think
of beaches when they hear the North Fork, as we all know,
public beaches for non-resident use are next to non-
existent in Southold Town, with the exception of County
parks. If constructed, will hotel guests assume they have
access to the beaches of the Mattituck Park District, which
are for the exclusive use of property owners and long-term
renters? Assuming of the 81 rooms, half of the guests wish
to use the beaches. With children, that could potentially
mean over 100 people wanting to use the beach on any
given Summer day. Our beaches are not equipped to
handle such a large volume.
In closing, I do not support that the applicant be given a
waiver. I thank you in advance for your time.

As the current Town Board Members, you have pledged to support the Southold
residents who elected you, safeguarding them from those agents of change who
threaten our North Fork way of life.
All the CPF funds spent to preserve open spaces will not neutralize the blight of
the views of hotels lining Main Road. Recently, it seems that developers catering
to tourists have been favored over local residents. Granted, local businesses and
our economy profit from tourist dollars, but this benefit does not extend to the
rest of us who must contend with the increased stress of traffic and other
disrupions to our daily living. Tourists have a right to share what we cherish, but
not the right to dominate.
Truly, the needs of the entire local community outweigh the needs of individual
property owners/developers. It's about investment: developers want us to
believe that they are contributing to the betterment and economy of Southold,
but ultimately, they are investing in themselves and personal profits at the
expense of the rest of us. Resident Southolders invest day in and day out in our
community through taxes, community activities, civic involvement, patronizing
local businesses, and personally enriching our town and helping it flourish on
many levels.
I am not anti-tourist as I recognize their valuable contributions to our local
economy. I am not anti-developer for this cannot be a stagnant Southold. I am
pointing out that progress has been out of balance for some time now and needs
to be addressed and amended before what we cherish is gone forever. To that
end, a total moratorium on new applications would be best, while a careful
assessment of current hotel and big house density is conducted, highlighting their
impact on our water, environment, and traffic, and also allowing the ZBA to
update the laws balancing present local development with future preservation of
the qualities that distinguish us as the North Fork.

Resolution No. ZSR-24-31 of the Suffolk County Planning Commission
Pursuant to Sections A14-14 to thru A14-25 of the Suffolk County Administrative Code
WHEREAS, pursuant to Sections A14-14 thru A14-25 of the Suffolk County Administrative Code, a
referral was received on April 26, 2024 at the offices of the Suffolk County Planning
Commission with respect to the application of"Town of Southold 12 Month Moratorium
on New Resorts, Hotels, or Motels" located in the Town of Southold
WHEREAS, said referral was considered by the Suffolk County Planning Commission at its meeting
on June 5, 2024, now therefore, be it
RESOLVED, pursuant to Section A14-16 of the Suffolk County Administrative Code and Section 239-
m 6 of the General Municipal Law, the referring municipality within thirty (30) days after
final action, shall file a report with the Suffolk County Planning Commission, and if said
action is contrary to this recommendation, set forth the reasons for such contrary action,
Be it further
RESOLVED, that the Suffolk County Planning Commission Approves the local law by the Town of
Southold enacting a moratorium on the review, approval and/or Issuance of all permits
for or relating to new development of resorts, hotels or motels, with the following
condition:
1. The requested twelve (12) month moratorium shall be limited to an initial duration of
six (6) months. The Town shall return to the Suffolk County Planning Commission at
the half way point of three (3) months (i.e., September 2024) to report on progress of
their comprehensive zoning update, and again at the conclusion of the six (6) month
period (i.e., January 2025)to note if additional time for the moratorium is warranted.
Reason: From one perspective, a moratorium is the most extreme land use action that a
municipality can take, as it suspends completely the rights of owners to use their property
per current allowable regulations for a certain timeframe. The Town has noted that they
are in the process of a comprehensive zoning update that should be complete by March
2025. The Commission believes it is important that the Town update the Commission on
its progress within the first three (3) months, and after the six (6) months to discuss the
need for an extension, so that the Town can end this moratorium at the appropriate time
that allows suitable development to continue.

Please read into the record
Dear Supervisor and Town Board Members:
I am writing to express my appreciation for the ongoing efforts to review and update our Town's zoning
code, particularly as it relates to the goals set forth in the updated Comprehensive Plan.This proactive
approach will sharpen the tools needed to preserve what makes the North Fork unique and prevent it
from succumbing to the same fate as the overdeveloped South Fork.
It does concern me, however,
that you are limiting the proposed moratorium to only hotel, motel, and
resort development. While I understand the reasoning behind this decision, it appears to overlook the
broader issue at hand. Individual applications, no matter how seemingly benign, are -contributing to the
gradual erosion of the identity of each of our communities within the Town.
The moratorium as proposed fails to consider speculative residential subdivisions, Hamptons-sized
residences, and renovations that ignore the appropriateness of location,. This for me spell's a death by
1,000 cuts of the North Fork as we've known it. A more inclusive enactment is appropriate in the face of
the ever-increasing appetites of developers and private individuals. Expanding the moratorium to
encompass all new development applications until the zoning code update is complete would better
ensure that future development aligns with the values and vision outlined in the Comprehensive Plan,
11, urge the Planning Department, in collaboration with the zoning consultants and the Town's Zoning
Update Advisory Committee,to reevaluate and devise a broader moratoria plan the Board's
consideration and the public's approval.
Let's get this right and save what's left!

Plan, which sets a long-awaited and ambitious course for future of planning,

ensure that the code is in conformance with the Comprehensive Plan so that it
can be implemented to achieve the community's vision for the Town's future,
with a target date for completion in March 2025. The Town of Southold has
documented significant development pressure in the form of newly proposed
hotels/motels and resorts. If approved prior to the adoption of the underway
zoning code amendments, these proposal will likely undermine the zoning code
update process and negatively impact the environment and community
character that the comprehensive plan so clearly set out to protect.
Conclusion
In an effort to protect the integrity of the Comprehensive Plan Update and the
Town's active zoning code evaluation and implementation strategy we strongly
urge the Suffolk County Planning Commission to approve the Town's request
for a temporary moratorium. We appreciate your time and consideration of our

As an architect with over 32 years in the public sector, I am writing in support of a broader
development moratorium as the Town of Southold works on the zoning update, expected to
be completed by 2025. This moratorium should be carefully defined so as to limit development
pressure from new resorts, hotels, and motels, as well as new commercial development,

variances. Such a pause will allow for a clear path forward for such developments in
alignment with the goals of the Comprehensive Plan once the Zoning Update is complete.
Should the Town enact a moratorium, it should clearly identify the types of applications and
entitlements that would not be considered during the moratorium period. In addition, the Local
Law enacting the moratorium should include a clearly stated exceptions and/or variance
section that specifies the procedure and enumerates the findings required for granting such a
request.

Dear Supervisor Krupski and Members of the Town of Southold Town Board:
The undersigned requests that this letter be incorporated into the public record concerning
proposed Local Law to Impose an Interim or Temporary Suspension on the Review, Approval
and/or Issuance of all Permits for or Relating to Resorts, Hotels or Motels (the "Proposed
Moratorium"). For background, me, my wife Kristen and our children maintain a residence in
Orient, and own and operate (through North Road Hotel LLC)the small business known as Hotel
Moraine, a family-owned and family-focused resort motel located at 62005 Route 48, Greenport,
New York 11944 (the "Property"), as well as other small, agricultural businesses in the Town of
Southold(the "Town").
Please let this letter serve to request that the Town Board:
(i) take a harder look at and reconsider adoption of the Proposed Moratorium, and the
basis thereof given the data and facts set forth herein;
(ii) to the extent the Town Board is prepared to proceed with adoption of the Proposed
Moratorium, please consider expanding the exclusions to include:
a. applications by existing resort hotels and motels located within the Town's
Resort Residential (RR) District and the Hamlet of Greenport that have public
sewer and water service; or, in the alternative
b. the undersigned's Pending Applications (as hereinafter defined) to expand
Hotel Moraine, a hotel use that has existed for over 60 years at the Property and
has public water and public sewer service; or, in the alternative
(iii) to the extent the foregoing is not acceptable to the Town Board, grant a variance
post haste in order to allow the undersigned to proceed with the Pending
Applications and such other permits and/or approvals required thereunder.

A Hard Look
A moratorium is an unnecessary action by the Town Board given that:
• the Town is not facing an imminent increase in development pressure for this
particular use;
• the Town's boards and departments have exhibited over the years that the requisite
hard look is taken for each and every application submitted;
• focus should be on preserving and developing single- and multi-family housing in
order to ease the housing crisis on the North Fork; and
• the Town's Resort Residential (RR) District' is unlikely to be substantively
modified as part of the Town's rezoning.
Anecdotal data, including that included herewith, should be analyzed in considering whether such
a moratorium is warranted. This data will show that a moratorium on hotels and motels is
inconsistent with the foregoing and, in fact, serves to increase pressure on housing.
Supply &Demand,Hotels,Motels and Short-term Rentals
Focus should be paid to increasing hotel/motel density where public sewer and water are available,
and enforcing short term rental laws.As of April 14,2024,the number of rentals listed on AirBNB
in the Town of Southold totals 210 and in Greenport totals 170, for a total of 380 listings,many of
which are private residences and do not have applicable permits.Furthermore,the Town has issued
—1,095 rental permits since inception of the permit program,approximately 75%of which continue
to be renewed. Consider that the number of hotel/motel rooms in the Town of Southold totals
—2932 and in the Village of Greenport totals —142, for a total of—435 rooms. Notably, the total
number of hotel/motel rooms in the Town's RR District totals only 198. Compare these figures to
the thousands of day trippers who visit the North Fork during the high seasons. It is evident that a
moratorium on hotels/motels will not achieve the intended purpose of the Proposed Moratorium.
It is worth noting that, in season, most hotels and motels require a 2-3 night minimum, reducing
turnover and traffic, and are otherwise highly regulated by the Town, Suffolk County Comptroller
(i.e., pay a 5.5% hotel motel tax — an increase of 2.5% as of June 1, 2023) and Suffolk County
Department of Health Services (i.e., food service permits, temporary residence permits, pool
permits, sanitary and water permits, as applicable, and related inspections), among other agencies
(i.e.,NYS State Liquor Authority,NYS Agriculture & Markets, etc. and related inspections).
Anecdotal Data-Analysis of Town's Comprehensive Plan and Town Uses
The Town's Comprehensive Plan contemplates development of hotels and motels within the
Town's RR District and only a few lots located therein remain available for hotel/motel use.
According to the Town's Comprehensive Plan,only 83 acres out of a total of approximately 33,350

acres of land in the Town of Southold is zoned RR3 (i.e., 0.25%) and far fewer acres have been
issued a special exception permit for hotel/motel uses and/or are used as a hotel/motel (i.e.,
—18.081 acres). Even fewer have access to and use of public sewer and water(i.e., —11.211 acres),
as most such properties are not within or proximate to a Village of Greenport Sewer District.4
The RR District located along the Long Island Sound and within the Hamlet of Greenport starts
with the Property and continues West to SCTM #1000-44.-2-17 (a cottage located to the West of
the Sound View Motel/Halyard Restaurant),and includes the following lots(shown in red in Figure
1 below). Notably, most of these lots are either already developed or have restricted development
due to other factors (i.e., wetlands, size, proximity to the bluff, etc.).

that many such properties are already developed (such as for condominiums and a union training
center),have restricted development due to other factors(i.e.,wetlands,size,etc.),or were recently

Achieving the Purpose of the Resort Residential(RR)District
As set forth in Section 280-34 of the Town of Southold Zoning Code (the "Zoning Code"), "[t]he
purpose of the Resort Residential (RR) District is to provide opportunity for resort development
in waterfront areas or other appropriate areas where, because of the availability of water and/or
sewers, more intense development may occur consistent with the density and character of
surrounding lands" (emphasis added).
ZoneCo, the Town's Zoning Consultant, states in the Town's Zoning Diagnostic Report, dated
September 20,2023,that"[t]his district is only mapped on approximately 83 acres and appears to
achieve the desired purposes for certain unique waterfront development patterns in the Town"
(emphasis added). The expanded use of an existing resort hotel and/or motel, such as Hotel
Moraine, is entirely consistent with and encouraged by the purpose of the RR District, as set forth
in Sections 280-34 and-35 of the Zoning Code.
Most importantly, given the foregoing, it is unlikely that the RR District will be modified during
the Town's rezoning effort.
History of Property
The Sunset Motel operated at the Property as a resort motel use for over sixty (60) years prior to
being redeveloped into Hotel Moraine in 2022-2023. The proposed expansion is possible based
upon the Property being located within the Town's RR District, being located within a Village of
Greenport Sewer District (VSD-01), having had public water service and having made a public
sewer service connection between the Property and the Village of Greenport in 2023,5 and is
consistent with the Southold Town Comprehensive Plan dated February 2020 and the Town of
Southold Local Waterfront Revitalization Program adopted November 30, 2004.
This redevelopment project commenced in 2022. Great care was taken by the undersigned to (i)
identify and acquire a site for redevelopment that was historically used for resort motel purposes
(i.e.,an infill project) and already located within an RR District, (ii)identify and acquire a site that
is served or has access to public water and sewer, (iii)select and execute a design that paid homage
to the area's rich agricultural history and character, and (iv) embark on a sustainable
redevelopment project.
5 Section 280-35(B)(4)(b)(2)of the Zoning Code provides that the maximum number of guest units shall be one(1)
per 4,000 square feet of land with public water and sewer. Based upon the Property having 144,622 square feet of
land, the permitted number of guest units is 35, as more particularly set forth in the Pending Applications and that
certain Notice of Disapproval,dated January 24,2024, issued by the Town's Building Department.

Highlights include the 2022-2023 retirement of a 1960s era septic system and installation of a new
sewer pump station connected to the Village of Greenport public sewer, installation of adequate
storm drainage systems, removal of an aging heating oil UST, installation of extensive native
plantings and landscape buffers (consisting of thousands of new plantings) and other mitigating
factors, a building design and burial of all utility lines to open and preserve viewsheds,installation
of dark sky exterior light fixtures, upgrading all improvements to current building and energy
codes and incorporation of other sustainable elements, including courtesy bicycles, EV chargers
and complimentary water filling stations. The crowning achievement of the project was the
retirement of the 1960s era septic system on the bluff of the Long Island Sound and construction
of a new,sewer pump station connected to the public sewage treatment system owned and operated
by the Village of Greenport.
The above-referenced work required issuance of a number of permits and approvals, including
building permits by the Town of Southold Building Department, a Wetland Permit and
administrative amendment thereto by the Town Trustees, a variance and de minimus amendment
thereto by the ZBA, a Letter of Non-Jurisdiction from the New York State Department of
Environmental Conservation and various permits and licenses by the Suffolk County Department
of Health Services. This work was completed in 2023 and culminated in the issuance of certificates
of occupancy and operating permits, allowing the Property to re-open as Hotel Moraine in June
2023.
Pending Applications
The undersigned is seeking (i) a Special Exception Permit from the Town of Southold Zoning
Board of Appeals(the"ZBA")pursuant to Section 280-35(B)(4)of the Zoning Code, (ii) Site Plan
Approval from the Town of Southold Planning Board (the "Planning Board") and (iii) such other
permits and approvals required to expand the improvements at the Property, currently comprised
of twenty-one (21) resort motel units and accessory uses and improvements, as more particularly
described herein, to include:
• a resort motel building (10 units); and
• an addition to an existing resort motel building (4 additional units)
The Pending Applications are currently scheduled to be heard by the Planning Board at its May 6,
2024 work session and by the ZBA at its August 2024 public hearing.
As a small business owner and operator, please provide the relief requested herein so that we can

I am reading on your agenda for this morning the discussion of a Hotel Moratorium. For full disclosure,
our commercial fishing family business is completely dependent on the water and land-based
infrastructure. If you should move forward with this action, please include your M1,M11 and RR zoning
districts.

Dear Supervisor Krupski and Members of the Town Board,
I am writing to you on behalf of the North Fork Environmental Council, a fifty-year-old local
grassroots environmental organization.
Fourteen years ago the town decided to embark on a comprehensive plan. It was finally
adopted in September of 2020. During those years, the town experienced an unprecedented
surge in development, the loss of affordable housing and a huge increase in tourism and traf-
fic.
To its credit, the town board has hired a zoning consultant, convened a zoning advisory com-
mittee and is currently holding meetings with residents to align its outdated zoning code with
the comprehensive plan.
But that will not be enough. While the zoning meetings go on, lots are being clear cut, builders
are breaking ground and developers are buying up farmland.
With zoning under review, it's the perfect time for a town-wide building moratorium; to take a
pause and consider, as the East End Beacon put it, "what this place would look like if every-
thing that could be built here under the current zoning was actually built" here.
We appreciated your discussion this morning of a moratorium on hotels, but the NFEC feels
that a limited moratorium will not be enough to Save What's Left of Southold.
We believe that a 12-month carefully considered moratorium on all commercial development
and subdivisions, excluding single-family homes that do not need further approval, including
trustee permits, is vital.
With a moratorium in place, the town board, planners and the public will have time they need
to fully focus on the zoning effort. It will give us some breathing room to carefully evaluate
what we want this place to look like ten years from now.
Without a moratorium, we face pages of plans from more developers who care little for our
fragile environment or our fishing and farming heritage.
We know that all of you, as public servants, care deeply about Southold. Please consider put-
ting a 12-month moratorium in place and act before we are faced with another Enclaves dis-
aster.
