ZIEGLER & KARL A. GROSKAUFMANIS SCTM# 1000-71-2-11.5 En-Consultants on behalf of JANICE H. ZIEGLER & KARL A. GROSKAUFMANIS requests a Wetland Permit to maintain and perform as-needed ordinary and usual maintenance on as-built 3'x12' hinged ramp and 6'x20' floating dock situated in an "I" configuration. Located: 112 Windjammer Drive, Southold. SCTM# 1000-71-2-11.5 The proposed action has been reviewed to Chapter.268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built structure was constructed without Board of Trustee review or permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the.proposed action. GROSKAUFMANIS 112 WINDJAMMER DRIVE SOUTHOLD,NY SCTM#1000-71-2-11.5 LWRP Policy 6 The applicants are seeking permission to maintain an existing floating dock and ramp hinged to an existing corrugated vinyl bulkhead, which was authorized by Wetlands Permit 6493 in 2006. In response to a separate application by the previous property owner in 2007, the Board of Trustees resolved to approve Wetlands Permit No. 6656 for a ramp and floating dock. However, issuance of the permit was conditioned upon payment of application fees and submission of revised plans depicting a proposed upweller the applicant indicated would be attached to the dock. As these conditions remained unsatisfied in'2013, the permit was suspended as incomplete at that time. Nevertheless, a review of historic aerial images indicate the ramp and float were installed by the prior owner between October 2008 and September 2009, where the dock remained in June 2021, when the applicants purchased the property. Learning that dock maintenance and repair work requires having a permit in their name and that the dock was not properly permitted, the current owners are seeking to properly permit the dock. To that end, the existing dock conforms to the dimensions of the previously authorized dock and to the "pier line" of the six (6) other similarly situated floating docks located along the bulkheaded easterly shoreline of the canal (see Figure 4). As the north side of the dock is physically separated from the neighboring property to the north by a wood groin on that property, only the south side of the.float is useable for dockage, and it has both sufficient space (7 to 8 feet between the float and southerly property line) and water depth(2.7 to 3 at mean low water). Maintenance of the existing dock would thus cause no changes to or have any adverse impacts on existing navigational conditions or otherwise affect the public and recreational use of the canal; would not create a "fragmentation of ecological communities" along the developed shoreline nor result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the adjacent tidal wetlands or surface waters of Southold Town. - SEE ATTACHED ADDENDUM- Attach additional sheets if necessary Policy 7.
