McNULTY requests a Wetland Permit to remove and replace in- place approximately 205 linear feet of existing timber bulkhead with vinyl bulkhead, and backfill with up to 100 cubic yards of clean sandy fill to be trucked in from an approved upland source; remove and replace in-place as needed +4'x32' section of existing +10'-15.6'x32' deck adjacent to bulkhead; existing 11.8'x13.3' shed to remain; temporarily relocate 2.5'x7' metal ladder to remain; revegetate disturbed portions of naturally vegetated bluff slope with native plantings; and establish and perpetually maintain a 10' wide non-turf buffer along the top of the bluff. SCTM# 1000-117-3-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. The proposal to construct approximately 83 linear feet of low-profile vinyl groin in-place of existing 87 linear foot timber groin is recommended as INCONSISTENT. Photos show that the groin interrupts the sand flow along the shoreline— reducing the beach sand accumulation and width downdrift. It is recommended to evaluate the best design of the groin to further policies 4 and 6. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. McNULTY 189 OLD HARBOR ROAD NEW SUFFOLK,NY SCTM#1000-1147-3-3.1 Policy 4 For the purpose of maintaining the property's historical method of protection against erosion and flooding and maintaining the stabilized shoreline, the project proposes the in-place replacement of an existing timber groin and bulkheading that pre-date 1977 and the Trustees'jurisdiction over erosion control structures along the Town's bayfront. As the upland property has been stabilized by the bulkhead for close to 50 years, there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location; and without maintenance of the bulkhead, the subject and adjacent properties would be exposed to potentially severe flood and erosion damage.And together with the surrounding groins and inlet jetties to the north and south, the subject groin has historically contributed to the stabilization and retention of the beach along this developed shoreline. Consistent with the permit standards for groins set forth in Section 275-11(C)(1),the replacement groin will be constructed in the same location but 4 feet shorter in length, so as not to extend farther seaward than mean low water (MLW); and with a low-profile design(i.e., its landward end will be set 12 inches lower than the existing groin; and its seaward end will be elevated no higher than 18 inches above the elevation of MLW). Thus, consistent with Policy 4. the project will enable the bulkhead and groin to continue providing flood and erosion protection without causing adverse impacts to the ---surrounding properties or beachfront. - - - - - - - The proposed replacement bulkhead and groin will be constructed with vinyl sheathing in place of existing treated timber sheathing, which provides a potential water quality benefit through reduction of treated timber located in and adjacent to surface waters;any disturbed portions of the naurally vegetated bluff slope will be replanted with native vegetation;and a 10'wide non-turf buffer will be established along the top of the bluff. Thus,consistent with Policy 5,the project will maintain the historically existing site conditions without causing adverse impacts to the surrounding beach or bluff ecosystem.
