EASEMENT AGREEMENT
THIS INDENTURE made this 5'h day of December, 2023, by and between Claude R.
Carlson residing at 675 Ackerly Pond Lane, PO Box 693, Southold, NY 11971 (hereinafter
referred to as "Grantor"), and Claude R. Carlson and Tracy Lynn O'Lear residing at 675 Ackerly
Pond Lane, PO Box 693, Southold, NY 11971 (hereinafter referred to as "Grantee").
WHEREAS, Grantor owns certain improved lands situate at 1675 Lower Road,
Southold, NY 1071, Suffolk County Tax Map No. 1000-069.00-05.00-013.002, more fully
'described in the deed annexed hereto as Exhibit"A" and made a part hereof("Grantor's
Property"); and
WHEREAS, Grantee owns certain improved lands situate at 675 Ackerly Pond Lane,
Southold, NY 11971, Suffolk County Tax Map No. 1000-069.00-05.00-013.004 more fully
described in the deed annexed hereto as Exhibit"B" and made a part hereof(Grantee's
Property"); and
WHEREAS, there currently exists on Grantor's property certain improvements that
benefit Grantee's property including ornamental plantings and trees, landscaping, and fencing
(the "Improvements").
WHEREAS, Grantee is desirous of an Exclusive Easement over a 1,462 square foot
portion of Grantor's property depicted as Easement Area on the Survey of Grantor's property
prepared by D'Amaro Engineering and Surveying, P.C., on October 4", 2023, a copy of which is
attached hereto as Exhibit "C" to allow the Improvements benefitting Grantee's property to
remain in perpetuity, and to provide adequate space for ingress and egress to the southern end of
Grantee's property and additional parking. The metes and bounds description of the Easement
Area are more fully described in Exhibit "D" annexed hereto ("Easement Area"); and

WHEREAS, Grantor, for good and valuable consideration, is desirous of conveying an
Exclusive Easement to Grantee over the Easement Area so that Grantee can have exclusive,
undisturbed access to and use of the existing improvements on Grantee's property that lie within
the Easement Area, and for ingress, egress and parking.
WITNESSETH:
1. Grantor does hereby grant, transfer, bargain, sell and convey unto Grantee, in
perpetuity, an Exclusive Easement, on, over and under the Easement Area on Grantor's property
depicted on Exhibit "C" annexed hereto and more fully described in Exhibit "D"annexed hereto.
2. The nature, character and extent of the Easement hereby granted is as follows:
A. Grantee shall have the exclusive right to use, traverse, access, improve,
maintain, and park vehicles upon said Easement Area comprised of 1,462 square-feet along the
northwestern end of Grantor's property and Grantor, its heirs, successors and assigns hereby
waive any right to use, traverse, access or improve the Easement Area without the express
permission of Grantee.
B. The location of the Easement Area described in Exhibit "D" shall not be
changed without the consent of both parties and their respective representatives.
C. Grantee also agrees to indemnify, save and hold Grantor harmless against
any and all claims for property damage and/or personal injury arising out of the use and
enjoyment of said Easement by the Grantees; their heirs, successors and assigns, invitees and
trespassers to the extent not covered by.insurance.
3. This Agreement shall inure to the benefit of. and bind, the parties, their heirs,
successors, legal representatives and/or assigns, and shall run with the land in perpetuity.

DESCRIPTION OF EASEMENT:
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being located at Southold, County of Suffolk, State of New York and being more
particularly bounded and described as follows:
BEGINNING at a point on the northerly property line of land now or formerly of Claude R. Carlson as
described by deed recorded in the Suffolk County Clerk's Office at Liber 12198 Page 967 (Tax Lot
13.2), where said property line is intersected by the property line dividing land now or formerly of
Claude R. Carlson and Tracy Lynn O'Lear, tenants in common, as described by deed recorded in the
Suffolk County Clerk's Office at Liber 13070 Page 393 (Tax Lot 13.4) to the west, and land now or
formerly of Zvi Edelman and Hannah Simons, husband and wife, as described by deed recorded in the
Suffolk County Clerk's Office at Liber 13076 Page 680 (Tax Lot 10) to the east, distant the following
three (3) courses and distances from a line connecting the westerly side of Lower Road with the
southerly line of Ackerly Pond Road(aka Ackerly Pond Land, Bowery Lane) having a length of 47.40
feet:
