WITNESSETH 1. Grantor does hereby grant, transfer, bargain, and convey unto Grantee, in perpetuity, a Right of Way Perpetual Easement Appurtenant on and over the Grantor's Property as described in Exhibit "A" and more particularly depicted as the Easement Area in Exhibit"C". 2. The nature, character and extent of the Right of Way Perpetual Easement Appurtenant hereby granted is as follows : a. Grantee shall have the right to use, traverse, access, improve and maintain, said, Easement Area, that is comprised approximately of a 20 feet wide area upon the Grantor's Property that begins approximately 255 feet south of County Road 48 and the northwest corner of Grantor's property on the westerly side of Grantor's Property and then runs southerly to a certain stockade fence and then easterly to a certain gravel driveway and then southerly along a certain gravel driveway to Queens Lane, all of which is upon the Grantor's Property. b. The location of the Easement Area as detailed under Exhibit "C" shall not be changed without written consent of both parties, and/or their respective representatives. c. Any and all costs associated with the use of the Easement Area shall be borne solely by the Grantee. d. The Grantor shall not cause any activity, alteration, improvement or other impediment to the Easement Area that would otherwise impair or impede the Grantee from fully using and traversing the Easement Area in accessing Grantee's Property or the public roadway across the Grantors Property. e. Grantee agrees to forever, indemnify, save and hold the Grantor harmless from any, and all claims for property damage, and/or personal injury arising out of the use and enjoyment of said Easement Area by Grantee, it's heirs, successors, and assigns, invitees and trespassers to the extent not covered by insurance. 3. This Right of Way Perpetual Easement shall inure to the benefit of, and bind the parties, their heirs, successors, legal representatives, and/or assigns, and shall run with the land in perpetuity.
