THIS INDENTURE, made the I �p day of ' ;1 in the year 2023,by and between
DANIEL DIVINEY and SUZANNE DIVINEY, his wife, residing at 160 Fifth Street, Unit 6,
Greenport, New York 11944, ("Grantor"), and
DANIEL DIVINEY and SUZANNE S. DIVINEY, residing at 160 Fifth Street, Unit 6,
Greenport, New York 11944, as Co-Trustees of THE DANIEL DIVINEY REVOCABLE
TRUST, and SUZANNE S. DIVINEY and DANIEL DIVINEY, residing at 160 Fifth Street,
Unit 6, Greenport, New York 11944, as Co-Trustees of THE SUZANNE S. DIVINEY
REVOCABLE TRUST, as Tenants in Common ("Grantee").
WITNESSETH, that the Grantor, in consideration of ten dollars and other valuable
consideration paid by the Grantee, does hereby grant and release unto the Grantee and the heirs
or successors and assigns of the Grantee forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, near Greenport, County of Suffolk and
State of New York,bounded and described as follows:
BEGINNING at a locust post on the Easterly line of Bay Road, distant 763.22 ft. Southerly
measured along said Easterly line of Bay Road and along the Easterly line of Inlet Lane from the
Southerly line of Manhanset Avenue, said point of beginning being the Southwesterly corner of
land, now or formerly of Eugene and Ruth Spalinger; and from said angles to said Easterly line
of Bay Road, North 86 deg. 38' 40" East 172 ft. more or less, to ordinary high water mark of
Gull Pond Inlet or Cutter; then Southerly along said high water mark to a point 125.0 ft.
Southerly from the Northerly boundary line hereinabove described when measured at right
angles thereto and to the Northerly boundary of land conveyed by Michael J. Capuano and Lois
H. Capuano to George and Mary Witanko by deed dated June 4, 1956 and recorded in Liber
3706 pg 500; Thence along said land of Witanko and again at right angles to said Easterly line of
Bay Road South 85 deg. 38' 40" West 144 ft. more or less to an iron pipe on said Easterly line of
Bay Road; and Thence along said Easterly line of Bay Road North 4 deg. 21' 20" West 125 ft. to
the point of Beginning.
SAID PREMISES being known as and by the street address 400 Bay Road, Greenport,New
York.
SAID PREMISES BEING the same premises conveyed to the parties of the first part herein by
Deed dated October 22, 2010 and recorded in the Office of the Suffolk County Clerk on
January 21, 2011 in Liber 12649, Page 227 which deed was subject to a Life Estate for
Virginia F. Martin, who died on June 9, 2020.
TOGETHER with all right, title and interest, if any, of the Grantor in and to any streets and
roads abutting the above described premises to the center lines thereof;

TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to said
premises;
TO HAVE AND TO HOLD the premises herein granted unto the Grantees, the heirs or
successors and assigns of the Grantees forever.
AND the Grantor, in compliance with Section 13 of the Lien Law, covenants that the Grantor
will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
AND the Grantor covenants as follows: that said Grantor is seized of the said premises in fee
simple, and has good right to convey the same; that the Grantee shall quietly enjoy the said
premises; that the said premises are free from encumbrances, except as aforesaid; that the
Grantor will execute or procure any further necessary assurance of the title to said premises; and
that said Grantor will forever warrant the title to said premises.
IN WITNESS WHEREOF, the Grantor has duly executed this deed the day and
year first above written.
