Present were: Carol Brown, Co-Chairperson John Stein, Member Inga Van Eysden, Member Maggie Merrill, Member Shannon Wright, Member Liz Gillooly, Trustee Liaison Lauren Standish, Secretary Absent: Caroline Burghardt, Chairperson John Chandler, Member Jocelyn Kaelin, Student Member Brian Mealy, Town Board Liaison Guests: Gwynn Schroeder, Gov. Liaison Officer Anne Murray, NFEC CALL TO ORDER Carol Brown called the meeting to order at 4:36pm. NEW BUSINESS Carol distributed her inspection report for review. She asked that the members review and report back next month with any modifications. In the meantime, the form is ready for use. e 2 REPORTS Shannon Wright attended the Board of Trustees meeting held on February 14th and reported the meeting was business as usual. CLIMATE SMART COMMUNITIES John Stein is making progress with the submission of documents. Currently, he has submitted 44 and is expected to have another 60 submitted by April 5th. July is the goal. He suggested Maggie Merrill and others that are looking for additional information to contact Andrew Manitt. He's available to answer questions. OTHER BUSINESS Carol Brown and Inga Van Eysden met and reviewed the recent wetland permit applications for the monthly report. They expressed their concern with incomplete applications. The Board of Trustees should not accept applications that don't include information such as lot coverage and details of an interior renovations. Carol asked the council members to review the CAC's mission statement and prepare for a future appointment at a Town Board work session. Anne Murray mentioned that Councilwoman Jill Doherty is working on a tree code and asked the council members to think about other goals for next month's meeting. Maggie will start an e-mail thread. APPROVAL OF MINUTES Moved by Maggie Merrill, seconded by Inga Van Eysden to Approve the Minutes of February 7, 2024. RECOMMENDATIONS —WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Maggie Merrill, seconded by Inga Van Eysden, it was RESOLVED to NOT SUPPORT the application of DOUGLAS & DIANE ROBALINO LIVING TRUST to re-construct existing residence and install additional site improvements. Existing dwelling, garage and PVC pergola, wood decks, concrete walks, west side concrete patio and step stone walks. Masonry block walk, brick and asphalt driveway, and 10' dia. X 8' deep cesspool with shallow dome. Located: 1695 Bay Ave., East Marion. SCTM#31-9-21.1 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill The CAC does Not Support the application as submitted, and recommends an erosion control plan, and the installation of an I/A septic system. The CAC recommends the applicant contact Cornell and obtain a list of appropriate plantings for the area. 3 Vote of Council: Ayes: All Motion Carried Moved by Inga Van Eysden, seconded by Maggie Merrill, it was RESOLVED to SUPPORT the application of 220 FLORAL BLVD. CORP. to remove existing fixed wood walkway, wood ramp and floating dock. Install new fixed "L" shaped walkway 4'X 76' in length with thru-flow decking throughout with 11 sets (22 total) of min. 8" dia. pressure treated pilings. Install a 3'X 10' aluminum ramp (30 sf w/18 sf. over water). Install a 6'X 20' floating dock with marine grade decking and two (2) 10" dia. anchor pilings. Total of 442 sf. The new walkway will be installed at the same location at the bulkhead, as the existing walkway and extend less than 24 sf. seaward than the existing floating dock. Located: 1825 Gull Pond Lane, Greenport. SCTM#35-4-15 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of STAVROS PLITAS to remove and replace 54 If. of deteriorated timber bulkhead with new vinyl bulkhead in same location as existing and raised height of 12" above existing top cap elevation. Provide 10 cy. of clean sand fill behind bulkhead. Provide 10' wide non-turf buffer landward of bulkhead extending previously installed non-turf buffer. Located: 3105 Oaklawn Ave., Southold. SCTM#70-6-8 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill The CAC Supports the application with a 10' non-turf buffer planted with native vegetation. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of WILLIAM & MARIAM HALLOCK to install a 15'X 30' in-ground swimming pool, deck and fence, and 17'X 35' patio around the pool. Located: 1230 Clearview Ave., Southold. SCTM#70-9-56 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill The CAC does Not Support the application due to the projected sea level rise, the high water table, impaired water body, and the location of the property partially within a flood zone. ` 4 Vote of Council: Ayes: All Motion Carried Moved by Inga Van Eysden, seconded by Maggie Merrill, it was RESOLVED to SUPPORT the application of LESTER & ETHNA LAY to replace 178' bulkhead along west property line along the dredged canal. Project actions include dismantling and removing the old bulkhead, returns and boat ramp with appropriate material disposal. Rebuild with helix anchors, tie back vinyl sheet pile, wood piles (24'X 10") stabilize with 3-6"X 6" wood whalers. Excavate and replace 557cy. of soils to accommodate bulkhead/ramp removal and replacement. Bulkhead will be raised 1.5' requiring an additional 135 cy. of soils for stability. New bulkhead remains at location of existing bulkhead. Ramp planks will be replaced. Ramp return will be straightened, increasing ramp surface area. A gravel/sand surface buffer will extend landward 10' from the bulkhead (area @ .04 ac.). Located: 370 Williamsburg Drive, Southold. SCTM#78-5-9 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill The CAC Supports the application with a minimum 10' non-turf buffer planted with native vegetation. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of JOSEPH & KRISTINA OTTOMANELLI to legalize existing 10'X 15' on grade irregular blue stone dry set patio; construct 18'X 44' proposed in-ground pool with drywell, stone pool patio with outdoor kitchen area, 10'X 12 pool house with 4'X 6' outdoor shower. Pool equipment behind pool house and 483 If 4' high pool fence with two (2) 4' outswing doors and one (1) 8' outswing door. Install buried 1000 gal. propane tank and generator behind pool house. Remove seven (7) trees that are either dead or dying or too close to the proposed pool. Establish a 10' vegetated non- turf buffer north of the fixed dock. The area southerly of the fixed dock to remain treed and a non-turf area. Located: 2223 Indian Neck Lane, Peconic. SCTM#86-5-11.3 Inspected by: Inga Van Eysden, Carol Brown, Maggie Merrill The CAC does Not Support the application, and lacks an updated survey. The proposed hard-scaping is excessive and should be reduced, the proposed pool is too close to the side-yard, and the bluestone patio should be removed. Vote of Council: Ayes: All Motion Carried 5 Moved by Shannon Wright, seconded by Inga Van Eysden, it was RESOLVED to SUPPORT the application of MARK SCHWARTZ & LAUREN PRAUS for a proposed 18'X 8' shed with 18'X 6' deck on the west side of the building and 6'X 4' deck on the south side of the building. Located: 1360 Broadwaters Road, Cutchogue. SCTM#104-9-5 Inspected by: John Stein, Shannon Wright The CAC Supports the application and recommends relocation 10' landward in light of sea-level rise projections. Vote of Council: Ayes: All Motion Carried Moved by Shannon Wright, seconded by Maggie Merrill, it was RESOLVED to SUPPORT the application of ANDREW & ANDREA CURTO for the removal and replacement of 180 If. of existing timber bulkhead with new vinyl bulkhead in same location as existing and raised height of 8" above existing top cap. Removal and replacement of the existing docks, ramps and platforms in same exact location as existing consisting of a fixed dock with 2.5'X18' section leading to a 6'X 20' fixed dock "L" section and a second dock to east consisting of a 3'X 6' platform leading to a 3'X 9' ramp and then a 6'X 12' floating dock. All dock and platforms shall have untreated timber decking installed after replacement. Located: 560 Fisherman's Beach Road, Cutchogue. SCTM#111-1-16 Inspected by: John Stein, Shannon Wright The CAC Supports the application with the recommendation 5' of the stone is replaced with a buffer with native plantings. Vote of Council :Ayes: All Motion Carried Moved by Shannon Wright, seconded by Inga Van Eysden, it was RESVOLED to SUPPORT the application of NEAL & LISA ELKIN to construct an "L" shaped fixed timber dock (constructed with open-grate decking and equipped with water and electricity) consisting of a 4'X 64' fixed timber catwalk and 4'X 10' terminal (with ladder). Located: 105 Fleetwood Road, Cutchogue. SCTM#137-4-8 Inspected by: John Stein, Shannon Wright The CAC Supports the application with the recommendation the "L" shaped configuration is removed in order to maintain navigability, and lighting is dark-skies compliant. 6 Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Shannon Wright, it was RESOLVED to NOT SUPPORT the application of DHC LAND, LLC W/O WILL PECKHAM for the construction of proposed 4'X 161' overall length fixed pier with thru- flow decking on entire surface and consisting of 6'X 8' upper platform leading to two access methods, one being a 4'X 26' ramp and the other being 4'X 11' steps, 4'X 4' platform and 4'X 11' steps, both leading to 6'X 8' platform and then to a 4'X 117' fixed pier including 3 steps down to a 6'X 20' T-section fixed pier. Proposed fixed pier to include electric and water services to end and davit arm located on the fixed T-section to lift oyster totes and materials. The proposed dock is to be used for aquaculture activities specializing in oyster propagation. Located: 4180 New Suffolk Ave., Mattituck. SCTM#115-10-1 Inspected by: John Stein, Shannon Wright The CAC does Not Support the application because the scope of work appears to be a commercial operation in a residential area, and there are inconsistencies with the application. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Shannon Wright, it was RESOLVED to NOT SUPPORT the application of MAZI HOLDINGS LLC for the proposed construction of a staircase from top of bluff to beach adjacent to bulkhead consisting of a 2'X 4'X 8" stepping stone at top of bluff, then a 4'X 6' landing, 4'X 20' staircase, 4'X 10' landing, TX 10' aluminum liftable staircase. Relocate heavy rocks to allow installation of liftable aluminum staircase. Remove 13 cy. of vegetation and soil to create a flat area to the east of the staircase @ 10'X 12' filled with 5 cy. of course, sand @ 1' in depth. Proposed construction of a 30" X 16' wood retaining wall. Restore disturbed area under and to the sides of the new staircase 6'X 37' in length and remaining disturbed area landward of new wood retaining wall 5'X 12' with one layer of jute O/E, pinned and planted with American beach grass at 18" O.C. SCTM#99-3-13 Inspected by: John Stein, Shannon Wright, Carol Brown The CAC does Not Support any disturbance to the heavily vegetated low-lying area, unnecessary disturbance within the CEHA, and cutting along the hillside. Vote of Council: Ayes: All Motion Carried Inga Van Eysden will attend the Board of Trustees meeting scheduled for Wed. March 20, 2024. The next meeting of the Conservation Advisory Council is scheduled for April 10, 2024 at 4:30PM in the Conference Room.
