THIS CERTIFIES that the replacement of existing wood bulkhead(f 178'total including
returns)with a new vinyl bulkhead using Helix anchors along_8 F of the eastern section of bulkhead(due
to close proximity of dwelling)and using a tieback/deadmen system for the western 67' section of
bulkheading;new bulkhead to be 1.5' higher than existing; bulkhead to have a straighter f30'west return
which is also the east wall of the ramp; increasing ramp surface by 62sq.ft. for a new total of 274sq.ft. and
replacement of exiting boat ramp planking; installation of a French drain at top of ramp to mitigate run-
off_into the buffer area; removal of existing upper retaining wall and not replace; removal of existing
lower and construction of a 138' long retaining wall using 4"x4"treated lumber with a deadman system
and raised an additional 1.5' in height with a f 12' long west return and a±12' long buried east return;
approximately 557 cubic yards of soils excavated and replaced during construction; approximately 135

to raise the existing grade; installation of a 4'wide set of wooden stairs from retaining wall to buffer area;

DECLARATION OF COVENANTS
THIS DECLARATION made this 5th day of September, 2024, by LesterA and Ethna
'Lay, residing at 370 Williamsburg Drive, Southold NY 11971, hereinafter referred to
as "DECLARANT (S) ":
W I T N E S S E T H
WHEREAS, DECLARANT (S) is/are the owner (s) of certain real property located
on 370 Williamsburg Drive., Southold, Town of Southold, County of Suffolk, State
of New York, described in the Suffolk County Tax Map as District 1000, Section
78, Block 5, Lot 9 which is more particularly bounded and described as set forth
in Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the "Trustees") pursuant
to Chapter 275 of the Town Code of the Town of Southold or its successor, and
various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT (S) therefore made application to the Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake certain
regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake
such regulated activities, the Trustees required that a 10 foot wide "non-turf
buffer" adjacent to and landward edge of the bulkhead; and
WHEREAS, the DECLARANT has considered the foregoing and has determined that
the same will be for the best interests of the DECLARANT and subsequent owners of
the Property.
NOW, THEREFORE, the DECLARANT (S) do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted
activities there shall be established and perpetually maintained A TEN
FOOT WIDE NON-TURF BUFFER AREA ALLONG THE LANDWARD EDGE OF THE BULKHEAD
"non-turf buffer" as defined by Chapter 275 of the Town Code, to wit:
"A designated area where turf grass, pesticides and fertilizers are not

permitted." and as depicted on the site plan last dated March 2024 and
stamped approved on 4/17/24, see Exhibit "A" attached; and
2) These covenants shall run with the land and shall be binding on the
DECLARANT (S) , his/her/their heirs, assigns, , purchasers, or successors in
interest and may only be modified after a public hearing and upon
resolution of the Trustees.

Dear Mr. Ruben:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 17, 2024 regarding the above matter:
WHEREAS, Howard Ruben on behalf of LESTER & ETHNA LAY applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated January 31, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 17, 2024, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project,,as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of LESTER & ETHNA LAY to

TERMS AND COINDITIONS
The Permittee Lester&Ethna Lay, 370 Williamsburg Drive, Southold,New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit!'and the said Permittee will, at his or her own
expense'defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,toll the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained. i
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if,I in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.

8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is CONSISTENT with LWRP
Policy 6 and, therefore, CONSISTENT with the LWRP provided the following is considered:
1. Turbidity controls compliant with Chapter 275.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Hello Elizabeth,
The western return of the bulkhead (@ 30' ) is also what"could be labeled as the eastern return of the
ramp, they are one and the same. I believe the replacementbulkhead will be tied to the neighboring
western bulkhead and there will not be a return.
The length of the new retaining wall will be about 138'. The new retaining wall will have a western
return section of @ 12' bordering the buffer adjacent to the ramp. The return on the east end of the
retaining wall will also be 12' but will be buried.
If I am not mistaken, in the past, prior to an application hearing (for this one, April 17), notices for the
pending event have to be posted to or delivered to adjacent property owners. If this is the case is the
Town preparing an original for me to copy and post? If so when and how will I be getting it? Thank

Lay Bulkhead Replacement Project
Sumary project description proposed bulkhead replacement, Lay property at 370 Williamsburg
Rd in Southold NY. (0.5510 ac). Site conditions include: residential wood frame house and
attached garage as well as a a covered porch and a covered brick patio, lawns and shrubs.
Replace old wood bulkhead with vinyl sheathing bulkhead along canal adjoining Corey Creek
(Approximately 178' includes returns (See site plan). The new bulkhead plan requires Helix
anchors where excavation was considered too close to the residence (eastern 81' of
replacement bulkhead). A tieback/deadmen system will be used for the western 67' run of the
bulkhead. See X section plans.
Replace boat ramp planking, straighten return, increasing ramp surface by 62 sq ft, new total
274 sq ft. A French drain will be installed at top of ramp to funnel turf runoff into the proposed
adjacent buffer area.
Remove upper retaining wall. The old lower retaining wall will be removed and rebuilt using
4"X4"treated lumber with a deadman system. Bulkhead and lower retaining wall will be raised
by 1.5' and backfilled to accommodate elevation increase.
Work will be conducted both landward and waterward of the bulkhead line. To minimize
sedimentation, excavation will occur prior to dismantling the old bulkhead wall. All old
bulkhead, ramp and retaining wall debris will be properly disposed of.
Approximately 557 cubic yards of soils will be excavated and replaced during construction
(disturbed area @0.056 ac, @ 10%of the project area ). To accommodate the higher bulkhead
and retaining wall, and the 10' buffer creation, @ 135 CY of additional fill will be placed
landward of the bulkhead line. All additional fill materials will come from an approved source.
Please note that the reconstructed landward retaining wall's new elevation will be @ 7'(1988
NAVD). This is about the same elevation as the highest stone terrace of the neighboring
(Groenfeld)property to the east(see photo).
There no wetlands within the immediate project activity area. Construction activities can be
scheduled to minimize temporary impacts to water quality by utilizing periods around low tide
to the extent possible.

Detailed Project Description Board o_ Trustees
The following project is proposed at the Lay property(0.5510 ac) located at 370 Williamsburg
Rd in Southold NY. Project: replace old wood bulkhead with vinyl sheathing bulkhead along
canal adjoining Corey Creek. Install about 178' of new bulkhead of which about 30 ft are returns
(See site plan). Site conditions include: residential wood frame house and attached garage as
well as a a covered porch and a covered brick patio, lawns and shrubs . At the southwest
terminus of the bulkhead is a wooden boat ramp. Bulkhead replacement includes
straightening the eastern ramp return increasing ramp surface by 62 sq ft,total ramp surface
becoming 274 sq ft. relocating this return increases the mouth of the ramp by about 3'. At the
top of the ramp a "French drain"will be installed to funnel turf runoff into the adjacent buffer
area. Other project site changes include: raising the entire bulkhead 1.5', and adding an
additional 1.5' of backfill elevation to support the higher bulkhead. A 10' wide non-turf surface
buffer (0.04 ac)will be established landward of all bulkhead structures (includes east side of
ramp return). The existing upper(most landward)wood retaining wall will be removed. The
lower retaining wall will be removed and rebuilt using 4"X4"treated lumber and a deadman
system The rebuilt retaining wall will also be raised 1.5' with an appropriate amount of back
fill. These coinciding increases in elevation are essential to stabilizing the new, higher
bulkhead and retaining wall. The new bulkhead plan calls for Helix anchors excavation was
considered too close to the residence (eastern 81' of bulkhead). A tieback deadmen system will
be used for the western 67' run of the bulkhead and includes the approximate 30' of the east
ramp return. See X section plans.
Project Action: Work to be conducted both landward and waterward of the bulkhead. To
minimize sedimentation into the canal, all excavation, including removal of both landward
retaining walls,will occur prior to dismantling of the old bulkhead wall. All dismantled
materials will be properly disposed of. Construction materials include 18'vinyl C-lock sheet
pile, wood piles (10" butt x 24' piles) and 6"X 6"wood whalers.
The new bulkhead occupies the same location as the bulkhead with the exception of the
change to the boat launch as described above. Project actions involve excavation and
replacement of a total of @ 557 cubic yards of soils (disturbed area @0.056 ac, about 10%of
the project area ). To accommodate the 1.5' increase in elevation of the replacement bulkhead
and the rebuilt lower retaining wall, and the construction of the non turf buffer, @ 135 CY of
additional fill will be needed. All additional fill soils and surface buffer materials will come from
an approved source. The buffer will be planted with appropriate non turf plant species post
construction. Please note that the reconstructed landward retaining wall-s new elevation will be

There no wetlands within the immediate project activity area. With the appropriate Best
Management Practices (silt curtain/boom) it is unlikely that any significant impacts to any
adjacent tidal marsh will occur during construction. Project actions will create minor,
insignificant disturbances to the water column and to benthic areas immediately adjacent to
the bulkhead construction zone. Construction activities can be scheduled to minimize
potential impacts by utilizing periods around low tide to the extent possible.

At the meeting of the Southold Town Conservation Advisory Council held on Wed., March
13, 2024, the following recommendation was made:
Moved by Inga Van Eysden, seconded by Maggie Merrill, it was
RESOLVED to SUPPORT the application of LESTER & ETHNA LAY to replace 178'
bulkhead along west property line along the dredged canal. Project actions include
dismantling and removing the old bulkhead, returns and boat ramp with appropriate
material disposal. Rebuild with helix anchors, tie back vinyl sheet pile, wood piles (24'X
10") stabilize with 3-6"X 6" wood whalers. Excavate and replace 557cy. of soils to
accommodate bulkhead/ramp removal and replacement. Bulkhead will be raised 1.5'
requiring an additional 135 cy. of soils for stability. New bulkhead remains at location of
existing bulkhead. Ramp planks will be replaced. Ramp return will be straightened,
increasing ramp surface area. A gravel/sand surface buffer will extend landward 10' from

I dropped off multiple copies of the Lay application figures (site plan and X sections) in the Trustee
box. These figures are technically identical to those originally submitted. However, prior to my
submittal to the town I had discussed this project with the DEC, and they initially told me that treated
lumber could not be used for a bulkhead (?) My initial figures all had a statement reflecting
that. Soon after they corrected their initial statement stating that treated lumber can be used so long
as it is properly certified, washed etc. The figures I submitted with the Lay application still had the
statement claiming not treated lumber would he used in construction which is incorrect. The figures I
dropped off today, have that statement removed. Thank you. Howard Ruben

Lay Bulkhead Replacement Project
Detailed Project Description
The following project is proposed at the Lay property located at 370 Williamsburg Rd (0.5510
ac) in Southold NY. Project proposes to replace the deteriorating wood bulkhead with vinyl
sheathing bulkhead to protect the aforementioned property and structures, preventing bank
erosion and potential structural damage, as well as preserve water quality by minimizing
siltation to the canal which feeds into Corey Creek. The project will also help to maintain
navigation function and safety. Total linear footage of bulkhead to be replaced is
approximately 178', of which about 30 ft are returns (See site plan). Site conditions include:
residential wood frame house and attached garage as well as a a covered porch and a covered
brick patio, lawns and shrubs . At the southwest terminus of the bulkhead is a wooden boat
launch. The perimeter of the existing ramp is roughly triangular in shape. The northeast return
of the ramp bulkhead is angled. The project is also proposing to straighten out that bulkhead
return which would increase the footprint of the ramp by about 62 sq ft making the total
square footage of ramp planking 274 square feet (see site plan). This would also widen the
mouth of the ramp by about 2-3'. At the top of the ramp a "French drain"will be installed to
funnel turf runoff into the adjacent buffer area. All dismantled materials will be properly
disposed of. Other Project site changes include: raising the entire bulkhead 1.5' as is now
generally considered a standard improvement due to the potential of sea level rise this will
include an additional 1.5' of backfill elevation to coincide with the higher bulkhead. Other
proposed project changes include adding a 10'wide non-turf surface buffer landward of the
bulkhead (0.04 ac). Another proposed change is the removal of the upper(most landward)
wood retaining wall while raising the lower wood retaining wall 1.5' with an appropriate
amount of back fill (1.5'). These coinciding(+) changes in ground surface elevation are
essential to supporting and stabilizing the new, higher bulkhead.
Project Action: Work to be conducted both landward and waterward of the bulkhead.
Excavation and fill retention will be accomplished prior to dismantling the old bulkhead to
minimize sedimentation into the canal. Dismantle and properly dispose of old bulkhead
materials and replace them with @ 178' of 18' vinyl C-lock sheet pile,wood piles (10" butt x
24' piles) and 6"X 6"wood whalers. Approximately 81' of the replacement bulkhead will be
stabilized by helix anchors, likely of a minimum length of 20' but length may vary. Helix
anchors will be used where the residence is closest to the bulkhead in order to reduce the
extent of excavation proximal to the rear of the house. The helix anchor section will run from
the northern property corner to the southwest corner of the covered brick patio. (see site plan).
From the southwest corner of the brick patio to the northeast return of the boat ramp,the
bulkhead, @67 linear feet,will be anchored by 16' by 1' steel tie backs with 10" butt lay logs

and 8" butt deadmen, in a traditional configuration. The boat ramp will be dismantled,the
planking replaced and will include an additional 62 sq ft related to the ramp's eastern angled
return becoming a straight return of approximately 27'. The mouth of the ramp will be widened
by approximately about 2-3'to the northeast, shortening canal bulkhead run by an equal
amount. At the top of the ramp a "French drain"will be installed to funnel turf runoff away
from the ramp into the adjacent buffer zone. All dismantled materials will be properly disposed
of.
The new bulkhead occupies the same location as the bulkhead with the exception of the
change to the boat launch as described above. No excavation is anticipated seaward of the
bulkhead line. However, it is inevitable that some soils will move into the canal during
construction. This will be minimized by performing excavation required and fill retention
behind the old bulkhead prior to removing it. Project actions include excavation and
replacement of a total of @ 557 cubic yards of soils (disturbed area @0.056 ac, about 10%of
the project area ). To accommodate bulkhead replacement/ramp reconstruction/upper
retaining wall removal and lower wall replacement including back fill to accommodate the new
elevations (raised by @ 1.5'). Additional fill/soils totalling @ 135 CY will be to raise the ground
levels behind the new bulkhead and lower retaining wall as discussed above. Included in this
135 CY are the materials needed for the non turf surface buffer(surface layer of sand or gravel
extending 10' landward of the bulkhead). All additional fill soils and surface buffer materials
will come from an approved source. The buffer will be planted with appropriate non turf plant
species post construction.
Because the bulkhead is adjacent to a dredged canal there no wetlands within the immediate
project activity area. With the appropriate Best Management Practices (silt curtain/boom) it is
unlikely that any significant impacts to any adjacent tidal marsh will occur due to project
activity. Construction activities will create minor, insignificant disturbances to the water column
and to benthic areas immediately adjacent to the bulkhead construction zone. Project actions
will be timed in such a way as to maximize construction activities of the greatest disturbance
during periods of low tides to the extent possible.

1. The proposed replacement of the deteriorated wood bulkhead with a new vinyl
bulkhead in the same location promotes this policy by preserving, maintaining
protecting, and enhancing the character this waterfront community along the

immediately seaward of the bulkhead construction area. There is no marsh vegetation
associated with the bulkhead.There is salt marsh south of the project site
(perpendicular to the line of the canal. It is highly unlikely that any significant impacts
will occur due to the proposed activity. Replacing the bulkhead will halt siltation into
the waterway that is now occurring due to bay water penetrating the bulkhead and
beginning to form washout areas. This proposed project is compliant with this policy.
3. General visual quality of the project site will be enhanced by removing deteriorated
bulkhead components and replacing them with new bulkhead materials of compatible
character to the neighboring bulkheads and general residential environment.These new
bulkhead materials are expected to deteriorate at a much slower rate than ordinary
wood thus maintaining enhanced visual quality for afar greater length of time. Impacts
to natural resources (vegetation/intertidal zone/WQ)will be minimized by
implementing Best Management Practices (BMPs)such as placing a boom/sediment
barrier seaward of the work area and conducting the most dispersive activities during
periods of low tide whenever possible. The proposed project is compliant with this
policy.

4. The residence at 370 Williamsburg Drive is protected by a wooden bulkhead which
has begun to fail.The purpose of the bulkhead is to protect the property, infrastructure
and human lives. A properly functioning bulkhead also protects the waterway
(bay/canal)from environmental damage associated with bank erosion and siltation
from inundation and resulting loss of soils into the estuary. Any significant
sedimentation due to erosion could impact the both the ecosystems of water column as
well as the benthic community. A significant increase in sediment to the canal might
negatively affect the navigability of the boating channel adjacent to the bulkhead.
Further deterioration of the of bulkhead and eventual failure would facilitate rapid
erosion of the land behind the bulkhead putting the residence as well as neighboring
properties at increased flood risk as well weakening the structural integrity of the
structures foundation. It is also likely that rapid loss of sediments from behind a failed
bulkhead would negatively impact localized water quality, and the character and quality
of the adjacent intertidal benthos,for as long as the bulkhead remains in disrepair.This
would be especially apparent during storm events. Reconstruction of the bulkhead is
the most effective and affordable method of decreasing potential threats to life and
property as well as protecting the marine habitat at this location. Appropriate BMPs
(see#3) which may include recommendations from the trustees will be instituted to
minimize any negative impacts to natural resources. This proposed project is
compliant with this policy.
6. This proposed bulkhead replacement project is located within Reach 7 of the Town of
Southold Significant Coastal Fish and Wildlife Habitat designations. Ecological quality at
the construction site and adjacent to this proposed project will be protected and
maintained Significant losses or degradation are not anticipated, as avoidance and
minimization will be instituted whenever possible by using BMPs as previously
discussed. Environmental protection will be maintained by employing those regulations
and recommendations required by the town trustees. No significant impacts on
ecological components or ecological function are expected from project
implementation. There may be temporary negative impacts including localized
increases to turbidity, mechanical disturbance and redistribution of sediments
immediately adjacent to construction activity and construction noise both above and
below the surface of the canal. No fragmentation is expected. Project construction
will not significantly impair viability of the project site ecosystems or adjacent intertidal
or littoral"habitats.The project will not significantly impact any physical or chemical
parameters as they relate to tolerance limits of any fish, benthic or other wildlife
species. There are no known (State or Federal) rare or endangered species of plants or
wildlife expected to be present at or adjacent to the project area property. However, it
is possible that occasional transient individuals of listed species may visit the region
seasonally but any significant impacts are highly unlikely.
None of these previously listed impacts are expected to have significant or longterm
negative impacts to habitats of, or adjacent to,the project site. Intertidal organisms,
infauna and epifauna evolve various survival strategies to tolerate occasional large,
often rapid changes in turbidity, salinity, and sedimentation rates in areas susceptible
periodic high energy events. Finfish will migrate out of the area. Temporary impacts to
physical and chemical parameters from the construction activity of this project are not
expected to surpass the tolerance levels of the various marine organisms existing in
these habitats. Any negative benthic impacts are expected to be short term and
insignificant with full recovery of benthic diversity and density within a few months
after construction is completed. There will be no filling or dredging seaward of the
bulkhead alignment. To minimize sedimentation into the canal, excavation and
retention of fill will be accomplished prior to deconstruction of the old bulkhead. Back
filling will proceed after the new bulkhead is in place. Although it is highly unlikely, any
significant loss of adjacent marine marsh vegetation correlated to construction activity
will be mitigated for by replanting as recommended by the Trustees.

Trustees Permit Applications
To whom it may concern,
The enclosed Permit application materials are being submitted for the replacement of a failing
wooden bulkhead with a new bulkhead constructed of vinyl sheet pile,wood whalers and piles
at 370 Williamsburg Drive, Southold N.Y., 11971. The property is owned by Lester and Ethna
Lay. Construction includes the excavation and replacement of @ 557 cubic yards of soils as
well as an additional @ 135 cubic yards of clean fill soils. Additional soils will accommodate
raising the bulkhead 1.5', create a non-turf surface buffer, and backfill the area behind the lower
retaining wall which will replaced and raise 1.5' to support the removal of the(existing)upper
retaining wall. The proposed plan also includes replacement of the wood planking on)the existing
boat launch as well as straightening the north ramp return to increase the stability of this section
of bulkhead. This will widen the ramp at its mouth by about 3'. It will increase the surface of the
ramp planks by @ 62 square ft. There will also be the addition of a planted, non turf, surface
sand/gravel buffer 10' landward of the bulkhead for the length of the entire bulkhead including
the return discussed above. Within the application package is one original permit application and
3 copies each submittal document exclusive of the 2 stamped property surveys.
