RESOLVED,the Town Board of the Town of Southold hereby authorizes and directs Supervisor Albert J.
Krupski,Jr.,to execute the Subrecipient Agreement(SUBA96965/1181292/2)for the period October 1,
2022 through September 30,2024, between the Research Foundation for the State University of New
York and the Town of Southold, in the amount of$98,000.00 for the Goose Creek Stormwater

Terms and Conditions
1.. PTE hereby awards a cost reimbursable subaward,(as determined by 2 CFR 200.331),to Subrecipient.The Statement of Work
and budget for this Subaward are as shown in Attachment 5.In its performance of Subaward work,Subrecipient shall be an
] independent entity and not an employee or agent of PTE.
j 2. Subrecipient shall submit invoices not more often than monthly and not less frequently than quarterly for allowable costs
j incurred.Upon the receipt of proper invoices,the PTE agrees to process payments in accordance with this Subaward and 2
1 CFR 200.305.All invoices shall be submitted using Subrecipient's standard invoice,but at a minimum shall include current and
i cumulative costs(including cost sharing),breakdown by major cost category,Subaward number,and certification,as required in
2 CFR 200.415(a). Invoices that do not reference PTE Subaward number shall be returned to Subreci ient.]nvoices and
questions concerning invoice receipt or payments shall be directed to the party's Contact,shown in
Attachment 3A.
3. A finafsJgiI2MkatAWi:aWgVve costs incurred,including cost sharing,marked"FINAL"must be submitted to PTE's
Financial J Contact,as shown in Attachment 3A,not later than 60 days after the final Budget Period end date..
The final statement of costs shall constitute Subrecipient's final financial report.
4, All payments shall be considered provisional and are subject to adjustment within the total estimated cost in the event such
adjustment is necessary as a result of an adverse audit finding against the Subrecipient.
S. Matters concerning the technical performance of this Subaward shall be directed to the appropriate party's Principal Investigator
as shown in Attachments 3A and 3B.Technical reports are required as shown in Attachment 4.
6. Matters concerning the request or negotiation of any changes in the tormseditions or amounts cited in this Subaward,and
,any requiring riot approval,shall be directed to the PTE's liuthatized t7fticial Contact and the Subrecipient's

7. The PTE may issue non-substantive changes to the Budget Period(s)and Budget I Bilaterally Unilateral
modification shall be considered valid 14 days after receipt unless otherwise indicated by Subrecipient when sent to
Subrecipient's AutFibrized Official Contact,as shown in Attachment 3B..
a. Each party shall be responsible for its negligent acts or omissions and the negligent acts or omissions of its employees,officers,
or directors,to the extent allowed by law.
9. Either party may terminate this Subaward with 30 days written notice.Notwithstanding,if the Awarding Agency terminates the
Federal , rminate in accordance with Awarding Agency requirements.PTE !ace shall be r cte'd to the
Authorized Officlat' Contact,and Subrecipient notice shall be directed to the Authorized Official Contact as
Shown in Attachments 3 and 3B.PTE shall pay Subrecipient for termination costs as allowable under Unl orm Guidance,2

10. By signing this Subaward,including the attachments hereto which are hereby incorporated by reference,Subrecipient certifies
that it will perform the Statement of Work in accordance with the terms and conditions of this Subaward and the applicable terms
of the Federal Award,including the appropriate Research Terms and Conditions("RTCs")of the Federal Awarding Agency,as
referenced in Attachment 2.The parties further agree that they intend this Subaward to comply with all applicable laws,
regulations,and requirements.

Debarment,Suspension,and Other Responsibility Matters(2 CFR 200.214 and 2 CFR 180)
By signing this Subaward,the Subrecipient Authorized Official certifies,to the best of his/her knowledge and belief that
neither the Subrecipient nor its principals are presently debarred,suspended,proposed for debarment,declared
ineligible or voluntarily excluded from participation in this transaction by anyfederal department or agency, in accordance
with 2 CFR 200.213 and 2 CFR 180.
Audit and Access to Records
Subrecipient certifies that it will provide PTE with notice of any adverse findings which impact this Subaward.
Subrecipient certifies compliance with applicable provisions of 2 CFR 200.501-200.521. if Subrecipient is not required to
have a Single Audit as defined by 200.501,Awarding Agency requirements,,,or the Single Audit Act,then Subrecipient
will provide notice of the completion of any required audits and will provide access to such audits upon request.
Subrecipient will provide access to records as required by parts 2 CFR 200.837 and 200.338 as applicable.
Program for Enhancement of Contractor Employee Protections(41 U.S.0 4712)
Subrecipient is hereby notified that they are required to:inform their employees working on any federal award that they
are subject to the whistleblower rights and remedies of the program;inform their employees in writing of employee
whistleblower protections under 41 U.S.0§4712 in the predominant native language of the workforce;and include such
requirements in any agreement made with a subcontractor or subgrantee.
The Subrecipient shall require that the language of the certifications above in this Attachment 1 be included in the award
documents for all subawards at all tiers(including subcontracts,subgrants,and contracts under grants, loans,and
cooperative agreements)and that all subrecipients shall certify and disclose accordingly.
Use of Name
Neither party shall use the other party's name,trademarks,or other logos in any publicity,advertising, or news release
without the prior written approval of an authorized representative of that party.The parties agree that each party may use
factual information regarding the existence and purpose of the relationship that is the subject of this Subaward for
legitimate business purposes,to satisfy any reporting and funding obligations,or as required by applicable law or
regulation without written permission from the other party. In any such statement,the relationship of the parties shall be
accurately and appropriately described.
Prohibition on Certain Telecommunication and Video Surveillance Services or Equipment
Pursuant to 2 CFR 200.216,Subrecipient will not obligate or expend funds received under this Subaward to:(1)procure
or obtain; (2)extend or renew a contract to procure or obtain;or(3)enter into a contract(or extend or renew a contract)
to procure or obtain equipment,services,or systems that uses covered telecommunications equipment or services(as
described in Public Law 115-232, section 889)as a substantial or essential component of any system, or as a critical
technology as part of any system.

The Town of Southold is currently carrying out a plan to remove direct stormwater discharges to the
Peconic Bays.For the FY21 Bipartisian Infrastructure Funds(BIL)allocated to the Peconic Estuary
Partnership,$98,000 will be used to complete the discharge removal in the sub-catchment of Goose
i Creek,Southold.

the PEP-BIL funding(041,042,and 046)are indicated.
Of the seven outfalls in the Goose Creek sub-catchment,four of them(outfalls 043,044,045,and 047)
are"minor"outfalls and will be eliminated by the Town of Southold using existing sources of
funding. The remaining outfalls(outfalls 041,042&046)are"major,"requiring extensive drainage to be
installed at the current outfall locations and upstream of the outfalls to ensure that localized flooding of
the road does not occur. The Town of Southold will complete the work utilizing existing staff and Town
resources for all salary and fringe associated with the personnel.The funding will be utilized to purchase
materials for installation of the drainage structures. The proposed,outfall elimination projects will
entail:
,Oiatfalf041(Glenn Road)—Installation of four drainage systems on Glenn Road and Shepard Drive for a
total of eight catch basins and 72 vertical feet of 8'diameter leaching pool. The exact location and
capacity of each system will be determined based on field conditions(utility location,depth to
groundwater encountered,etc.)at the time of installation. Upon completion,the outfall pipe will be
permanently eliminated by cementing it shut with brick and concrete. ESTIMATED COST—$23,400
bti fall 042 iWin Bayview Road)—Installation of five drainage systems on Main Bayview Road between
Grange Road and Baywater Avenue for a total of ten catch basins and 124 vertical feet of 8'diameter
leaching pool. The exact location and capacity of each system will be determined based on field
conditions(utility location,depth to groundwater encountered,etc.)at the time of installation. Upon

completion,the outfall pipe will be permanently eliminated by cementing it shut with brick and
concrete. ESTIMATED COST—$37,300

Outfall 046(Waterview Drive)— Installation of one drainage system at the intersection of Cedar Drive
and North Bayview Road Extension consisting of three catch basins and 32 vertical feet of 8'diameter
leaching pool. Installation of one drainage system at the intersection of Cedar Drive and Waterview
Drive consisting of two catch basins and 16 vertical feet of 8'diameter leaching pool. Installation of an
f additional 16 vertical feet of 8'diameter leaching pool at the location of the existing drainage system on
Waterview Drive and connection of these structures to the existing catch basins. Installation of one
drainage system approximately 225'down gradient of the existing drainage system on Waterview Drive
t consisting of two catch basins and 24 vertical feet of 8'diameter leaching pool. Installation of two
additional drainage systems on Waterview Drive in the vicinity of the outfall consisting of a total of four
catch basins and 32 vertical feet of 8'diameter leaching pool will also occur. The exact location and
capacity of the final two systems will be determined based on field conditions(utility location,depth to
groundwater encountered,etc.)at the time of installation. Upon completion,the outfall pipe will be
completely removed. These systems total eleven catch basins and 120 vertical feet of 8'diameter
leaching pool. ESTIMATED COST—$37,300

Attachment 1 - Project Description.
4 The PEP 2020 Comprehensive Conservation Management Plan (CCMP) guides the
priorities of the organization and, as such, all projects and plans detailed in this workplan
relate directly to the actions established to achieve our four goals: strong partnerships and
engagement, clean waters, resilient communities prepared for climate change, and a healthy
ecosystem with abundant, diverse wildlife. The Infrastructure Investment and Jobs Act (IIJA
or"bipartisan infrastructure law"or BIL) passed the U.S. Senate in August 2021 and the U.S.
House of Representatives in November 2021. President Biden signed it into law on
November 15, 2021. This legislation provides an additional $132 million to the 28 NEPs over
five years in addition to regular appropriations. For the PEP this results in an additional
$909,800 annually from FY22 to FY26 to carry out work that accelerates and more
extensively implements the 2020 CCMP, ensures benefits'reach disadvantaged
communities, and builds the adaptive capacity of ecosystems and communities.
I Three projects will be executed under the FY22 BIL funding. These projects are:
1. Meetinghouse Creek Wetland Restoration - construction phase of a green infrastructure
for stormwater management and climate change adaptation project. This project will
construct a 1.2-acre stormwater wetland to treat stormwater runoff and create additional
capacity to manage increased flooding.
2. Sag Harbor Stormwater Management-installation of two green infrastructure projects,
which are outlined in the Village of Sag Harbor's Water Quality Improvement Project Plan.
The two installations will include rain gardens and road amendments for increased
stormwater capacity and road re-grading and amendments with the use of impervious
pavement.
3. Goose Creek Sub-catchment Discharge Elimination - completion of the discharge removal
in the sub-catchment of Goose Creek, Southold, NY. Three major outfalls will require
extensive drainage to be installed at the current outfall location and upstream of the outfall to
ensure that localized flooding of the road does not occur. The activities under each project
are:
1. Meetinghouse Creek Wetland Restoration - activities include the construction phase of a
green infrastructure for stormwater management and climate change adaptation project.
This project will construct a 1.2-acre stormwater wetland to treat stormwater runoff and
create additional capacity to manage increased flooding. The restoration of this stormwater
wetland has four objectives: 1)to improve water quality in the Meetinghouse Creek sub-
catchment; 2)to provide increased coastal resiliency by increasing storm water capacity in
this sub-catchment using restored wetland function and increasing capacity to a 100-year
stormwater flood level; 3) create increased coastal resiliency in a New York State
designated Environmental Justice area; and 4) provide increased education about climate
change and coastal adaptation using green infrastructure to the community.Additionally,
wetland restoration increases the ecological quality of the habitat and improves plant and
wildlife diversity.

2. Sag Harbor Stormwater Management- activities include the installation of two green
infrastructure projects, which are outlined in the Village of Sag Harbor's Water Quality
Improvement Project Plan. The two installations will include rain gardens and road
amendments for increased stormwater capacity and road re'-grading and amendments with
the use of impervious pavement. The installation of two green infrastructure stormwater
management areas have three objectives to: 1) improve water quality in Sag Harbor Cove
and Sag Harbor Bay; 2) create increased coastal resiliency in a NYS designated
Environmental Justice area that is prone to flooding and projected to experience increased
precipitation; and 3) provide increased education about climate change, coastal adaptation
I and stormwater management using green infrastructure to the community.
j 3. Goose Creek Sub-catchment Discharge Elimination - activities under this project will
complete the discharge removal in the sub-catchment of Goose Creek, Southold, NY. Three
major outfalls will require extensive drainage to be installed at the current outfall location and
upstream of the outfall to ensure that localized flooding of the road does not occur. The
project aims to reduce stormwater pollution in the Peconic Estuary,which will improve water
quality to a priority area under the Suffolk County Sub-watershed wastewater plan. This will
also complete actions identified in the Peconic Estuary Partnership 2013 Goose Creek
watershed plan. The anticipated deliverables and expected outcomes are: 1)the completion
of a stormwater wetland, stormwater management installations and educational signages, 2)
increase in the ecological quality of the habitat and improvement of plant and wildlife
diversity, 3) provide a natural-based solution to stormwater management, 4) increase
capacity for flood management and a community more engaged in climate change, potential
adaptation solutions, and reduced burden of flooding, 5) green infrastructure installations to
reduce pathogens and other surface water pollutants, 6) elimination of stormwater outfalls,
and 7) an increased benefit to areas identified on the New York State Environmental Justice
Area.
The direct beneficiaries of this program include the general population throughout the
Peconic watershed and its surrounding areas, schools, universities and other institutions of
learning, environmental managers and policy makers and the participants in the Peconic
Estuary Partnership.
Three implementation projects will be covered under three separate subawards. These are:
1. Meetinghouse Creek Wetland Restoration ($602,300) - activities include the construction
phase of a green infrastructure for stormwater management and climate change adaptation
project. This project will construct a 1.2-acre stormwater wetland to treat stormwater runoff
and create additional capacity to manage increased flooding.
2. Sag Harbor Stormwater Management($190,000)-activities include the installation of two
green infrastructure projects, which are outlined in the Village of Sag Harbor's Water Quality
Improvement Project Plan. The two installations will include'rain gardens and road
amendments for increased stormwater capacity and road re-grading and amendments with
the use of impervious pavement.

B. EXTENSION OF PROJECT/BUDGET PERIOD EXPIRATION DATE
EPA has not exercised the waiver option to allow automatic one-time extensions for non-research grants
under 2 CFR 200.308(d)(2).Therefore, if a no cost time extension is necessary to extend the period of
availability of funds the recipient must submit a written request to the EPA prior to the budget/project
period expiration dates.The written request must include: a written justification describing the need
for additional time,an estimated date of completion,and a revised schedule for project
completion including updated milestone target dates for the approved workplan activities. In
addition, if there are overdue reports required by the administrative and programmatic terms and
conditions of this assistance agreement,the recipient must ensure that they are submitted along with or
prior to submitting the no cost time extension request.

A. PERFORMANCE REPORTING AND FINAL PERFORMANCE REPORT
a. All recipients of grants or cooperative agreements awarded under Section 320 of the Clean Water
Act are required to comply with EPA's National Estuary Program Funding Guidance during the
performance period of this award.Any exemptions from NEP'Funding Guidance requirements must
be requested in writing and approved by the EPA Project Officer.
b. In accordance with 2 C.F.R. 200.329,the recipient agrees to submit an annual performance report
to the U.S. Environmental Protection Agency(EPA)that include brief information on each of the
following areas: 1)a comparison of actual accomplishments to the outputs/outcomes established in
the assistance agreement workplan for the period;2)the reasons for slippage if established
outputs/outcomes were not met;3)additional pertinent information, including,when appropriate,
analysis and information of cost overruns or high unit costs;4)the methods to be used to effectively
disseminate project information and/or continue the benefits of this project(although the project
itself may not be continuing); and 5)materials generated in connection with project activities(e.g.,
workshop announcements, newspaper/newsletter announcements,articles or releases, press
packets, pamphlets,etc.).All tangible products resulting from the project(curriculum, DVD,training
materials, posters, etc.)shall be submitted electronically and in paper or hard format(if applicable)
to the EPA Project Officer,or as a link to a site from which the products can be easily viewed and
downloaded.
C. The recipient additionally agrees to inform EPA as soon as problems,delays or adverse conditions
become known which will materially impair the ability to meet the outputs/outcomes specified in the
assistance agreement work plan
d. EPA may terminate the assistance agreement for failure to make sufficient progress so as to

reasonably ensure completion of the project within the project period, including any extensions.
EPA will measure sufficient progress by examining the performance required under the work plan in

conjunction with the milestone schedule,the time remaining for performance within the project

e. The recipient will submit annual Government Performance and Results Act(GPRA)reporting
information to EPA as specified in the annual program funding guidance by the date stipulated in
the annual funding guidance.
f. EPA will provide programmatic oversight and guidance regarding the annual workplan and recipient
products, including review and comment on QAPPs, reports related to environmental results,
habitat, environmental indicators,and leveraged funds, and revision and/or implementation of the
recipient's Comprehensive Conservation and Management Plan (CCMP). EPA participates in the
recipient's management conference,which oversees the tasks in the annual workplan, and assists
with program efforts when appropriate.

g. PERFORMANCE REPORTING--FREQUENTLY
The recipient agrees to submitan annual performance report electronically to the EPA Project Officer.The
annual report is due November 15th of each year.
B. BIPARTISAN INFRASTRUCTURE LAW(BIL)REPORTING
BIL funds must beclearly tracked to the underlying appropriation in the law and the applicant must be
prepared to report on the purpose of all obligations. EPA anticipates that there will be OMB requirements
for tracking, reporting on, documenting, and conditioning BIL funds that will be unique.
a. EPA intends to design a way to identify BIL projects within the existing NEP Online Reporting Tool
(NEPORT)database where relevant, and to build a separate mechanism for reporting and tracking
other required metrics for BIL funding. The NEPs shall report on the following for all projects using
BIL funding:
i. Project/activity name and location (fat/long);
ii. Brief project description;
iii. Lead implementer, partners and their roles;
iv. Deliverables and completed activities;
V. BIL funds spent on project implementation;
vi. Definition of disadvantaged communities used in the NEP;
vil. How BIL workplan tasks support BIL priorities and implement CCMP priorities;
viii. If applicable, any external constraints related to any/all workplan elements and how the
NEP addressed those constraints;and
ix. Important key environmental and programmatic accomplishments, completed workplan
activities, and noteworthy lessons learned, presented in enough detail to fully describe what
was accomplished, along with whatever substantiating data are available.
b. Close-Out Reports:After the final expenditure of BIL funds, NEPs shall provide a final narrative that
includes:

Total BIL awards received;
ii. All actions taken with BIL funding,specifically highlighting actions aimed at advancing equity
and climate priorities.
C. BUDGET AND ACCOUNTING
The recipient must provide a minimum cost-share/match of 50%of the total project cost to satisfy the
recipient required match under this program.The cost-sharing or matching regulations are available at 2
i CFR§§200.29 and 200.306. EPA's financial obligations are limited to the federal amount as shown on
Line 12 in its EPA approved budget on page 3 of the Award Agreement.
I a. Pursuant to 2 CFR 200.308(e),the recipient must notify and seek approval from the EPA Project
Officer in advance of any transfer of funds among direct cost categories,functions and activities if
the cumulative amount of such transfer exceeds or is expected to exceed 10 percent of the total
I budget as last approved by the U.S. EPA. In addition,and in accordance with 2 CFR 200.308(c),
the recipient must request prior approval from the U.S. EPA if there is a change to the scope or
objective of a project or program, or to the amount budgeted for participant support costs.
Accordingly, any change in the recipient's Indirect Cost Rate that results in a change to the scope,
objective,or participant support cost budget or exceeds 10 percent of the total budget must be
approved in advance by the U.S. EPA.To request this approval,the recipient must submit a
proposed re-budget and describe any changes in deliverables, scope, and objectives affected by
the proposed transfer.
b. Funds in the agreement may be used for outreach support.These funds are to: (1)cover travel for
the NEP Program Office, Management Conference members, or other associated stakeholders to
appropriate national and regional conferences, workshops, or meetings, (2)provide peer-to-peer
technical assistance to other NEPs or neighboring communities, and(3)bring in staff or
stakeholders from other NEPs or watershed programs to assist a NEP.The recipient is required to
attend all NEP national and regional meetings convened by EPA unless unforeseen circumstances
prevent the recipient from meeting this requirement.
D. CYBERSECURITY CONDITIONS
s
a. The recipient agrees that when collecting and managing environmental data under this assistance
agreement, it will protect the data by following all applicable State or Tribal law cybersecurity
requirements.
b. EPA must ensure that any connections between the recipient's network or information system and
EPA networks used by the recipient to transfer data under this agreement, are secure. For
purposes of this Section, a connection is defined as a dedicated persistent interface between an
Agency IT system and an external IT system for the purpose of transferring information.Transitory,
user-controlled connections such as website browsing are excluded from this definition. If the
recipient's connections as defined above do not go through the Environmental Information

Exchange Network or EPA's Central Data Exchange, the recipient agrees to contact the EPA
Project Officer(PO)no later than 90 days after the date of this award and work with the designated
Regional/Headquarters Information Security Officer to ensure that the connections meet EPA
security requirements, including entering into Interconnection Service Agreements as appropriate.
This condition does not apply to manual entry of data by the recipient into systems operated and
used by EPA's regulatory programs for the submission of reporting and/or compliance data.
k
C. The recipient agrees that any subawards it makes under this agreement will require the subrecipient
to comply with the requirements in(b)if the subrecipient's network or information system is
connected to EPA networks to transfer data to the Agency using systems other than the
Environmental Information Exchange Network or EPA's Central Data Exchange.The recipient
willbe in compliance withthis condition: by including this requirement in subaward agreements; and
during subrecipient monitoring deemed necessary by the recipient under 2 CFR 200.332(d), by
inquiring whether the subrecipient has contacted the EPA Project Officer. Nothing in this condition
requires the recipient to contact the EPA Project Officer on behalf of a subrecipient or to be involved
in the negotiation of an Interconnection Service Agreement between the subrecipient and EPA.

E. COMPETENCY POLICY
Competency of Organizations Generating Environmental Measurement Data: In accordance with Agency
Policy Directive Number FEM-2012-02,Policy to Assure the Competency of Organizations Generating
Environmental Measurement Data under Agency-Funded Assistance Agreements, Recipient agrees, by
entering into this agreement,that it has demonstrated competency prior to award,or alternatively,where
a pre-award demonstration of competency is not practicable, Recipient agrees to demonstrate
competency prior to carrying out any activities under the award involving the generation or use of
environmental data. Recipient shall maintain competency for the duration of the project period of this
agreement and this will be documented during the annual reporting process.A copy of the Policy is

G. QUALITY ASSURANCE(UPDATED 1/31/2023)
Authority: Quality Assurance applies to all assistance agreements involving environmental information as
defined in 2,C.F:R:.§ 1'500.12 Quality Assurance.
The recipient shall ensure that subawards involving environmental information issued under this
agreement include appropriate quality requirements for the work.The recipient shall ensure sub-award

Quality Management Plan(QMP)
a. Prior to beginning environmental information operations,the recipient must:
i
i. Develop a QMP,
ii. Prepare the QMP in accordance with the current version of EPA's`Ouality Management.
Plan(OMP)Standard.Submit the document for EPA review, and
iii. Obtain EPA Quality Assurance Manager or designee (hereafter referred to as QAM)
approval.
iv. The EPA Quality Assurance Manager or designee(hereafter referred to as QAM)will
notify the recipient and EPA Project Officer(PO)in writing if the QMP is acceptable for
this agreement.
b.The recipient must submit the QMP within 90 days after grant award, and/or no more than
( 180 days after grant award.

c. The recipient must review their approved QMP at least annually.These documented reviews
shall be made available to the sponsoring EPA organization if requested. When necessary,
the recipient shall revise its QMP to incorporate minor changes and notify the EPA PO and
QAM of the changes. If significant changes have been made to the Quality Program that
affect the performance of environmental information operations, it may be necessary to re-
submit the entire QMP for re-approval. In general, a copy of any QMP revision(s)made during
the year should be submitted to the EPA PO and QAM,in writing when such changes occur.
Conditions requiring the revision and resubmittal of an approved QMP can be found in section
6 of EPA's Quality Management Plan (QMP)'.Standard.
Quality Assurance Project Plan (QAPP)

H. PAPERWORK REDUCTION ACT
The scope of work for this cooperative agreement includes a survey or other information collection of
identical information from 10 or more parties for the purposes of meeting EPA Government Performance
Results Act requirements.As provided by 5 CFR 1320.3(d), EPA is a sponsor of the information collection
for purposes of obtaining approval from the Office of Management and Budget for collecting information.
The recipient agrees to assist EPA in complying with OMB procedures at 5 CFR Part 1320 for obtaining
Information Collection Request authorization.The recipient may not collect information until EPA obtains
OMB approval.
NOTE: EPA has concluded that National Estuary Programs may use the Information Collection Request
approval received by the Headquarters office for their information collection activities related to annual
workplans, program evaluation, or Government Performance Results Act reporting.When collecting
information under this Information Collection Request(ICR),the ICR Reference#should be included:
201705-2040-001.The actual ICR justification is available upon request to the Project Officer.
I. DURC/IDURC
The recipient agrees to not initiate any life sciences research involving agents and toxins identified in
Section 6.2.1 of theUnited States Government Policy fot'lnstitutioriafOversighr'af Life Sciences Dual:Use
Rese ch of.Goncern(iDURCPolicy)until appropriate review and clearance by the recipient institution's
Institutional Review Entity(IRE).The recipient also agrees to temporarily suspend life sciences research
in the event that,during the course of the research project,the IRE determines that the life sciences
research meets the definition of DURC in theiDURCPolicy,and the recipient agrees to notify the EPA
Institutional Contact for Dual Use Research(ICDUR)(DURC cAefia.gov)of the institution's determination.
J. SUBSTANTIAL INVOLVEMENT
EPA will be substantially involved in this agreement. Substantial involvement by the EPA Project Officer
may include:
Participation in biweekly staff calls.
EPA participation in the Management Committee,which oversees the tasks in the annual
workplan, and assists with program efforts when appropriate.
Provide programmatic oversight and guidance regarding the annual workplan and
recipient products, including review and comment on QAPPs, reports related to

environmental results, habitat, environmental indicators,and leveraged funds, and
revision and/or implementation of the recipient's Comprehensive Conservation and
Management Plan.

K. EPA SUBAWARD POLICY REPORTING REQUIREMENT:
The recipient must report on its subaward monitoring activities under 2 CFR 200.332(d). Examples of
items that must be reported if the pass-through entity has the information available are:
Summaries of results of reviews of financial and programmatic reports.
Summaries of findings from site visits and/or desk reviews to ensure effective subrecipient
performance.
Environmental results the subrecipient achieved.
Summaries`of audit findings and related pass-through entity management decisions.
Actions the pass-through entity has taken to correct deficiencies such as those specified at 2
CFR 200.332(e), 2 CFR 200.208 and 2 CFR 200.339.This information should be included in
the annual report.
M. PRE-AWARD COSTS
In accordance with 2 CFR 1500.8,the grantee may charge pre-award costs incurred from October 1,
2022 to the actual award date provided that such costs were contained in the approved application and all
costs are incurred within the approved budget period.
L. EPA NEP FUNDING GUIDANCE
All recipients of grants awarded under Section 320 of the Clean Water Act are required to comply with
ERKs FFY2021-2024 National Estuary Program Funding Guidance during the performance period of this
award.Any exemptions from NEP Funding Guidance requirements must be approved by the EPA Project
Officer.
M. BUY AMERICAN, BUILD AMERICA(BABA)
Effective May 14, 2022:
The recipient is subject to the Buy America Sourcing requirements under the Build
America, Buy America provisions of the Infrastructure Investment and Jobs Act (IIJA)

These sourcing requirements require that all iron, steel, manufactured products,and
construction materials used in Federally funded infrastructure projects must be produced

Equipment: In accordance with 2 CFR 200.313,when original or replacement equipment acquired under
this agreement is no longer needed for the original project or program or for other activities currently or
previously supported by EPA,the recipient must request disposition instructions from the EPA project
officer. Disposition instructions will be one of the following:
1. Items of equipment with a current per unit fair market value of$5,000 or less may be retained, sold
or otherwise disposed of with no further obligation to the EPA.
2. Except as provided in§200.312 Federally-owned and exempt property, paragraph (b),or if EPA
fails to provide requested disposition instructions within 120 days, items of equipment with a current
per-unit fair-market value in excess of$5,000 may be retained by the recipient or sold. EPA is
entitled to an amount calculated by multiplying the current market value or proceeds from sale by
EPA's percentage of participation in the cost of the original purchase. If the equipment is sold,the
EPA may permit the recipient to deduct and retain from the Federal share$500 or ten percent of
the proceeds,whichever is less,for its selling and handling expenses.
3. The recipient may transfer title to the property to the Federal)Government or to an eligible third
party provided that,in such cases,the recipient must be entitled to compensation for its attributable
percentage of the current fair market value of the property.
4. In cases where a recipient fails to take appropriate disposition actions, EPA may direct the recipient
to take disposition actions.
Federal Funding Accountability and Transparency Act(FFATA)Reporting Requirements for Sub-award
and Executive Compensation. Purpose: To describe new Federal reporting requirements for EPA
assistance agreement recipients. If,during the preceding fiscal year, a prime recipient or sub-recipient (a
"prime"recipient is the recipient of record,the entity to which the Federal government makes an award;

N.Signage
The recipient is required to place a physical sign displaying the EPA logo at the construction site for this
project in an easily visible location that can be directly linked to the work taking place.The sign must be
maintained in good condition throughout the construction period. In cases where the construction site
covers a large area (e.g., lead service line replacement or septic tank repair/replacement projects), a
sign should be placed in an easily visible location near where the work is being performed (e.g.,entrance
? to the neighborhood, along a main road through town, etc.).Signage costs are considered an allowable
j grant expense, provided the costs associated with the signage are reasonable. Additionally,to increase
public awareness of projects serving communities where English is not the predominant language,
assistance recipients are encouraged to translate the language on signs(excluding the EPA logo or seal)
into the appropriate non-English language(s).The costs of such translation are allowable grant
expenses, provided the costs are reasonable.
Procuring Signs: Consistent with section 6002 of RCRA,42 U.S.C.6962, and 2 CFR 200.323, recipients
are encouraged to use recycled or recovered materials when procuring signs.
EPA Logo:The recipient will ensure that signage displays the EPA logo. The EPA logo must not be
displayed in a manner that implies that EPA itself is conducting the project. Instead,the EPA logo
must be accompanied with a statement indicating that the recipient received financial assistance
from EPA for the project.

D. BUDGET AND ACCOUNTING
1. Under the Waiver Authority provisions of the Infrastructure Investment and Jobs Act(IIJA, or
"bipartisan infrastructure law"),the Assistant Administrator for EPA's Office of Water has waived the
50% non-federal cost share requirement of the CWA Section 320 for assistance agreements funded
under the FY 2022 and FY 2023 IIJA.
2. Pursuant to 2 CFR 200.308(e),the recipient must notify and seek approval from the EPA Project
Officer in advance of any transfer of funds among direct cost categories, functions, and activities if
the cumulative amount of such transfer exceeds or is expected to exceed 10 percent of the total
budget as last approved by the U.S. EPA. In addition, and in accordance with 2 CFR 200.308(c),the
recipient must request prior approval from the U.S. EPA if there is a change to the scope or objective

of a project or program, or to the amount budgeted for participant support costs. Accordingly, any
change in the recipient's Indirect Cost Rate that results in a change to the scope, objective, or
participant support cost budget.or exceeds 10 percent of the total budget must be approved in

and describe any changes in deliverables, scope, and objectives affected by the proposed transfer.

3. Funds in the agreement may be used for outreach support. These funds are to: (1)cover travel for
the NEP Program Office, Management Conference members, or other associated stakeholders to
appropriate national and regional conferences, workshops, or meetings, (2) provide peer-to-peer
technical assistance to other NEPs or neighboring communities, and (3) bring in staff or stakeholders
from other NEPs or watershed programs to assist a NEP. The recipient is required to attend all NEP
national and regional meetings convened by EPA unless unforeseen circumstances prevent the
