I Not incorporating the NOA or any additional documentation to this Subaward. i ` I I F I E £ I 4 I I .Town of Southold"Scape_ofWork for PEP-BIL Funds FFY2021 I The Town of Southold is currently carrying out a plan to remove direct stormwater discharges to the Peconic Bays.For the FY21 Bipartisian Infrastructure Funds(BIL)allocated to the Peconic Estuary Partnership,$98,000 will be used to complete the discharge removal in the sub-catchment of Goose i Creek,Southold. i yt N! 041 042 Figure 1:The seven outfalls in the Goose Creek Subcatchment in Southold,outfalls to be eliminated with the PEP-BIL funding(041,042,and 046)are indicated. Of the seven outfalls in the Goose Creek sub-catchment,four of them(outfalls 043,044,045,and 047) are"minor"outfalls and will be eliminated by the Town of Southold using existing sources of funding. The remaining outfalls(outfalls 041,042&046)are"major,"requiring extensive drainage to be installed at the current outfall locations and upstream of the outfalls to ensure that localized flooding of the road does not occur. The Town of Southold will complete the work utilizing existing staff and Town resources for all salary and fringe associated with the personnel.The funding will be utilized to purchase materials for installation of the drainage structures. The proposed,outfall elimination projects will entail: ,Oiatfalf041(Glenn Road)—Installation of four drainage systems on Glenn Road and Shepard Drive for a total of eight catch basins and 72 vertical feet of 8'diameter leaching pool. The exact location and capacity of each system will be determined based on field conditions(utility location,depth to groundwater encountered,etc.)at the time of installation. Upon completion,the outfall pipe will be permanently eliminated by cementing it shut with brick and concrete. ESTIMATED COST—$23,400 bti fall 042 iWin Bayview Road)—Installation of five drainage systems on Main Bayview Road between Grange Road and Baywater Avenue for a total of ten catch basins and 124 vertical feet of 8'diameter leaching pool. The exact location and capacity of each system will be determined based on field conditions(utility location,depth to groundwater encountered,etc.)at the time of installation. ESTIMATED COST—$37,300 i Outfall 046(Waterview Drive)— Installation of one drainage system at the intersection of Cedar Drive and North Bayview Road Extension consisting of three catch basins and 32 vertical feet of 8'diameter leaching pool. Installation of one drainage system at the intersection of Cedar Drive and Waterview Drive consisting of two catch basins and 16 vertical feet of 8'diameter leaching pool. Installation of an f additional 16 vertical feet of 8'diameter leaching pool at the location of the existing drainage system on Waterview Drive and connection of these structures to the existing catch basins. Installation of one drainage system approximately 225'down gradient of the existing drainage system on Waterview Drive t consisting of two catch basins and 24 vertical feet of 8'diameter leaching pool. Installation of two additional drainage systems on Waterview Drive in the vicinity of the outfall consisting of a total of four catch basins and 32 vertical feet of 8'diameter leaching pool will also occur. The exact location and capacity of the final two systems will be determined based on field conditions(utility location,depth to groundwater encountered,etc.)at the time of installation. Upon completion,the outfall pipe will be completely removed. These systems total eleven catch basins and 120 vertical feet of 8'diameter leaching pool. ESTIMATED COST—$37,300 k ! The Infrastructure Investment and Jobs Act (IIJA or"bipartisan infrastructure law"or BIL) passed the U.S. Senate in August 2021 and the U.S. House of Representatives in November 2021. President Biden signed it into law on November 15, 2021. This legislation provides an additional $132 million to the 28 NEPs over five years in addition to regular appropriations. For the PEP this results in an additional $909,800 annually from FY22 to FY26 to carry out work that accelerates and more extensively implements the 2020 CCMP, ensures benefits'reach disadvantaged communities, and builds the adaptive capacity of ecosystems and communities. I Three projects will be executed under the FY22 BIL funding. These projects are: 1. Meetinghouse Creek Wetland Restoration - construction phase of a green infrastructure for stormwater management and climate change adaptation project. This project will construct a 1.2-acre stormwater wetland to treat stormwater runoff and create additional capacity to manage increased flooding. 2. Sag Harbor Stormwater Management-installation of two green infrastructure projects, which are outlined in the Village of Sag Harbor's Water Quality Improvement Project Plan. The two installations will include rain gardens and road amendments for increased stormwater capacity and road re-grading and amendments with the use of impervious pavement. 3. Goose Creek Sub-catchment Discharge Elimination - completion of the discharge removal in the sub-catchment of Goose Creek, Southold, NY. The activities under each project are: 1. The installation of two green infrastructure stormwater management areas have three objectives to: 1) improve water quality in Sag Harbor Cove and Sag Harbor Bay; 2) create increased coastal resiliency in a NYS designated Environmental Justice area that is prone to flooding and projected to experience increased precipitation; and 3) provide increased education about climate change, coastal adaptation I and stormwater management using green infrastructure to the community. j 3. Goose Creek Sub-catchment Discharge Elimination - activities under this project will complete the discharge removal in the sub-catchment of Goose Creek, Southold, NY. Three major outfalls will require extensive drainage to be installed at the current outfall location and upstream of the outfall to ensure that localized flooding of the road does not occur. The project aims to reduce stormwater pollution in the Peconic Estuary,which will improve water quality to a priority area under the Suffolk County Sub-watershed wastewater plan. This will also complete actions identified in the Peconic Estuary Partnership 2013 Goose Creek watershed plan. The anticipated deliverables and expected outcomes are: 1)the completion of a stormwater wetland, stormwater management installations and educational signages, 2) increase in the ecological quality of the habitat and improvement of plant and wildlife diversity, 3) provide a natural-based solution to stormwater management, 4) increase capacity for flood management and a community more engaged in climate change, potential adaptation solutions, and reduced burden of flooding, 5) green infrastructure installations to reduce pathogens and other surface water pollutants, 6) elimination of stormwater outfalls, and 7) an increased benefit to areas identified on the New York State Environmental Justice Area. The direct beneficiaries of this program include the general population throughout the Peconic watershed and its surrounding areas, schools, universities and other institutions of learning, environmental managers and policy makers and the participants in the Peconic Estuary Partnership. Three implementation projects will be covered under three separate subawards. These are: 1. Meetinghouse Creek Wetland Restoration ($602,300) - activities include the construction phase of a green infrastructure for stormwater management and climate change adaptation project. In accordance with 2 C.F.R. 200.329,the recipient agrees to submit an annual performance report to the U.S. Environmental Protection Agency(EPA)that include brief information on each of the following areas: 1)a comparison of actual accomplishments to the outputs/outcomes established in the assistance agreement workplan for the period;2)the reasons for slippage if established outputs/outcomes were not met;3)additional pertinent information, including,when appropriate, analysis and information of cost overruns or high unit costs;4)the methods to be used to effectively disseminate project information and/or continue the benefits of this project(although the project itself may not be continuing); and 5)materials generated in connection with project activities(e.g., workshop announcements, newspaper/newsletter announcements,articles or releases, press packets, pamphlets,etc.).All tangible products resulting from the project(curriculum, DVD,training materials, posters, etc.)shall be submitted electronically and in paper or hard format(if applicable) to the EPA Project Officer,or as a link to a site from which the products can be easily viewed and downloaded. PERFORMANCE REPORTING--FREQUENTLY The recipient agrees to submitan annual performance report electronically to the EPA Project Officer.The annual report is due November 15th of each year. B. BIPARTISAN INFRASTRUCTURE LAW(BIL)REPORTING BIL funds must beclearly tracked to the underlying appropriation in the law and the applicant must be prepared to report on the purpose of all obligations. EPA anticipates that there will be OMB requirements for tracking, reporting on, documenting, and conditioning BIL funds that will be unique. a. EPA intends to design a way to identify BIL projects within the existing NEP Online Reporting Tool (NEPORT)database where relevant, and to build a separate mechanism for reporting and tracking other required metrics for BIL funding. The NEPs shall report on the following for all projects using BIL funding: i. Project/activity name and location (fat/long); ii. Brief project description; iii. Lead implementer, partners and their roles; iv. Deliverables and completed activities; V. BIL funds spent on project implementation; vi. Definition of disadvantaged communities used in the NEP; vil. How BIL workplan tasks support BIL priorities and implement CCMP priorities; viii. If applicable, any external constraints related to any/all workplan elements and how the NEP addressed those constraints;and ix. Important key environmental and programmatic accomplishments, completed workplan activities, and noteworthy lessons learned, presented in enough detail to fully describe what was accomplished, along with whatever substantiating data are available. b. Close-Out Reports:After the final expenditure of BIL funds, NEPs shall provide a final narrative that includes: 4T-96235922-0 Page 10 Total BIL awards received; ii. All actions taken with BIL funding,specifically highlighting actions aimed at advancing equity and climate priorities. C. BUDGET AND ACCOUNTING The recipient must provide a minimum cost-share/match of 50%of the total project cost to satisfy the recipient required match under this program.The cost-sharing or matching regulations are available at 2 i CFR§§200.29 and 200.306. EPA's financial obligations are limited to the federal amount as shown on Line 12 in its EPA approved budget on page 3 of the Award Agreement. I a. Pursuant to 2 CFR 200.308(e),the recipient must notify and seek approval from the EPA Project Officer in advance of any transfer of funds among direct cost categories,functions and activities if the cumulative amount of such transfer exceeds or is expected to exceed 10 percent of the total I budget as last approved by the U.S. EPA. In addition,and in accordance with 2 CFR 200.308(c), the recipient must request prior approval from the U.S. EPA if there is a change to the scope or objective of a project or program, or to the amount budgeted for participant support costs. Accordingly, any change in the recipient's Indirect Cost Rate that results in a change to the scope, objective,or participant support cost budget or exceeds 10 percent of the total budget must be approved in advance by the U.S. EPA.To request this approval,the recipient must submit a proposed re-budget and describe any changes in deliverables, scope, and objectives affected by the proposed transfer. b. Funds in the agreement may be used for outreach support.These funds are to: (1)cover travel for the NEP Program Office, Management Conference members, or other associated stakeholders to appropriate national and regional conferences, workshops, or meetings, (2)provide peer-to-peer technical assistance to other NEPs or neighboring communities, and(3)bring in staff or stakeholders from other NEPs or watershed programs to assist a NEP.The recipient is required to attend all NEP national and regional meetings convened by EPA unless unforeseen circumstances prevent the recipient from meeting this requirement. D. CYBERSECURITY CONDITIONS s a. The recipient agrees that when collecting and managing environmental data under this assistance agreement, it will protect the data by following all applicable State or Tribal law cybersecurity requirements. b. EPA must ensure that any connections between the recipient's network or information system and EPA networks used by the recipient to transfer data under this agreement, are secure. For purposes of this Section, a connection is defined as a dedicated persistent interface between an Agency IT system and an external IT system for the purpose of transferring information.Transitory, user-controlled connections such as website browsing are excluded from this definition. If the recipient's connections as defined above do not go through the Environmental Information 4T-96235922-0 Page 11 Exchange Network or EPA's Central Data Exchange, the recipient agrees to contact the EPA Project Officer(PO)no later than 90 days after the date of this award and work with the designated Regional/Headquarters Information Security Officer to ensure that the connections meet EPA security requirements, including entering into Interconnection Service Agreements as appropriate. This condition does not apply to manual entry of data by the recipient into systems operated and used by EPA's regulatory programs for the submission of reporting and/or compliance data. k C. The recipient agrees that any subawards it makes under this agreement will require the subrecipient to comply with the requirements in(b)if the subrecipient's network or information system is connected to EPA networks to transfer data to the Agency using systems other than the Environmental Information Exchange Network or EPA's Central Data Exchange.The recipient willbe in compliance withthis condition: by including this requirement in subaward agreements; and during subrecipient monitoring deemed necessary by the recipient under 2 CFR 200.332(d), by inquiring whether the subrecipient has contacted the EPA Project Officer.
