DAVID J. CHABOT, residing at 135 Mockingbird Lane, Southold, New York 11971, party of the
first part, and
LOUIS LIBERTA and DONNA LIBERTA, husband and wife with right of survivorship, residing at
94 Rockywood Road, Manhasset, New York 11030-2513, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part,the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land,situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, known and designated as Lot No.55 on a certain map entitled, "Map of
Highpoint Meadows, Section Three", and filed in the Office of the Clerk of the County of Suffolk on March
19, 1990 as Map No. 8912, being bounded and described as follows:
BEGINNING at a point on the northerly side of Mockingbird Lane,said point being a distance of 139.46
feet measured in an easterly direction along the northerly side of Mockingbird Lane from the extreme
easterly end of the arc of a curve connecting the easterly side of Tuthill Road Extension with the northerly
side of Mockingbird Lane;
RUNNING THENCE North 34 degrees 03 minutes 40 seconds West, 109.89 feet to a point;
THENCE North 3 degrees 1 minute 11 seconds West 177.99 feet to a point;
THENCE North 88 degrees 56 minutes 32 seconds East, 72.61 feet to a point;
THENCE South 16 degrees 03 minutes 40 seconds East, 246.14 feet to the point on the northerly side of
Mockingbird Lane;
THENCE in a westerly direction along said land on an arc of a curve to the left having a radius of 230.00
feet to a length of 72.26 feet;
THENCE still along the northerly side of Mockingbird Lane, South 55 degrees 56 minutes 20 seconds
West, 5.54 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
3/21/12, recorded in Liber 12694 page 194 in the office of the Suffolk County Clerk on 5/23/12, and the
Grantor herein being the same party as the Grantee.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the parry of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of the same for any other purpose.The word"party"shall
be construed as if it read"parties"when ever the sense of this indenture so requires.
