Our property is 1400 Naugles Drive. The home was purchased in 2019.At that time, an updated survey of 1400 Naugles was done and is attached along with the survey of 1450 Naugles provided to us and aerial photographs.There was a property encroachment issue that was discovered during the survey process in 2019. More specifically,we were told that there is a fence encroachment of 4.6 feet and a partial shed encroachment of 3.4 feet which can be seen on aerial photos.An affidavit was presented to 1450 Naugles Drive to sign at the time of the home purchase allowing continued use of the property while acknowledging no claim to the property.The affidavit was refused, and the issue remains unresolved creating an issue if We ever need to sell our home.We would like to resolve this issue in the easiest way possible. To be clear, at present, we are not objecting to allowing this variance. However, we are challenging the validity of the current survey as there is now and shed and fence on our property.
