SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPE1`T1' FACTS/DESCRIPTION:The parcel is a non-conforming 23,070 square foot parcel located in an R-40 zoning district. The parcel runs 100.00 feet fronting North Bayview, Road along the Easterly property line, runs 225.06 feet on the North side, runs 105.07 feet on the West side, and 225.00 feet on the South side. The parcel is improved with a one-story frame house with an attached deck, and a frame shed. All is shown on a survey by John C Ehlers L.L.S. last revised January 14, 2021. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15; and the Building Inspector's uct an accessory at 1) February 16, 2021 Notice of Disapproval based on an application for a permit to constr garage; located in other than the code permitted rear yard; located at: 4370 No. Bayview Road, Southold, NY. SCTM No. 1000-79-2-4.3. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage in the front yard where code requires accessory garages to located in the rear yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 6,2021 at which time written and oral evidence was presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Latin° ,267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing dwelling is setback 94.9 feet from the street and there is vegetative screening along the street making the existing house difficult to see. The proposed garage will not be visible from the street. The proposed accessory garage will be located 50 feet from the street which conforms to the required minimum setback of a principal structure. 2. Town LaN 1267-b(31(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue,other than an area variance. The applicant could build the garage in a code conforming rear yard location. However, there are houses on both sides of the existing dwelling, the two side yards have limited access to the rear yard,and placing the garage in a front yard location will have Iess impacts on the neighbors than if it were in a code conforming rear yard location. 3. Town La-%t' S4267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 100% relief from the code. However, the applicant shall maintain the existing vegetative screening and plant additional evergreen screening in front of the garage so it is not visible from the street. 4. To-,,vn Law 4267-b(3)(h)(4). No evidence has been submitted to suggest that a variance in this residentia, community will have an adverse impact on the physical or environmental conditions in the neighborhood. The. applicant must comply with Chapter 23 6 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self1created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the ge while preserving and protecting the character of the applicant to enjoy the benefit of an accessory gara neighborhood and the health, safety and welfare of the community.
