(631) 765-1809 Southold 'Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 21, 2024 ZBA Application No.: 7880SE Applicants/Owners: 70 Deep Hole Drive, LLC/Brady Leiter Property Location: 70 Deep Hole Drive, Mattituck SCTM#1000-115-12-2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 25, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. REQUEST MADE BY APPLICANT: The Applicants-Owners requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 34,028.34 sq. ft. parcel located on the Residential R-40 Zoning District. The northerly property line measures 205.07 feet'and fronts New Suffolk Avenue, the easterly property line measures 126.68 feet and fronts Deep Hole Road, the southerly property line measures 217.50 (227 Deed) feet and the westerly property line measures 159.29 (182.79 Deed)feet. The parcel is improved with a one-story frame dwelling with basement and attached deck, and a two story frame garage, as shown on the survey map prepared by Vasiliy Suslin, LS, and last revised July 2, 2022. ADDITIONAL INFORMATION: The first floor of the garage contains a full set of stairs to the second floor with a new proposed door connecting the two. The board advised the applicant to remove the interior door so the only access to the second floor is via exterior door. The board requests same so the apartment doesn't end up being two stories which isn't allowed per the Code. The main dwelling will be used by the owner and the parents will be using the apartment over the garage. The board informed the owner that she can't rent the house if she has an accessory apartment leased and occupied by her parents. Further, the apartment can only be occupied by the parents. It cannot be used as a guest house any other time. The parents will use the apartment when they are here from Florida. Page 2, March 21,2024 ##7880SE,70 Deep Hole Drive, LLCBrady Leifer SCTM No. 1000-115-12.2 On March 19, 2024,(dated October 30, 2023)the applicant's representative submitted a letter that he originally submitted to the Town's Building Department, describing in detail his inspection of the existing septic system on the premises. Based upon the inspection, he noted that"to the best of his knowledge, belief and professional judgment, the Septic System, as installed, complies with the SCDOH requirements for a four(4) bedroom house." On May 11,2023,the Office of Wastewater Management,of the Department of Health Services(SCDHS) submitted an acknowledgement to the homeowner that the sanitary system replacement was completed in accordance with the SCDHS standards. In addition to his letters,the applicant's engineer submitted a revised plan, dated March 8,2024, showing the removal of an entry door which eliminated tenant's access to the garage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 7, 2024, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural/engineered plans prepared by Nicholas Mazzaferro, P.E., and last revised October 31, 2023, propose an accessory apartment with one full bathroom entirely on the second floor of the two-story building in the accessory structure with a conforming 565 square feet of livable floor area. On December 29, 2023, The Building Department's "Verification of Livable Floor Area" verified the livable floor area to be 538 sq. ft. 2. The dwelling unit complies with the definition of same in §280-4 of the code and Section 280-13(B)(13) of the Zoning Code. 3. The accessory structure does comply with the code requirement as defined in Section 280-13(B)(13)(e) of the Zoning Code which states the accessory structure must have been certified a minimum of three years prior to the establishment of the accessory apartment. The prior owners were issued a Certificate of Occupancy No: Z-22983 for the subject accessory structure dated May 4, 1994. 4.The applicant herein, has membership interest in the property as documented by Articles of Organization filed with the NYS Department of State on September 2, 2021, an Operating Agreement between 70 Deep Hole Drive, LLC and 728 Post Road, LLC, dated December 15, 2023, a Bargain and Sale Deed, dated September 14, 2021, and confirms that: occupancy of the residential structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. Brady Leifer, listed as a Member in the LLC Operating Agreement,will be the owner/occupant of the main dwelling and the owner's parents will occupy the accessory apartment as evidenced by a signed lease by Page 3,March 21,2024 ##7880SE,70 Deep Hole Drive, LLCBrady Leifer SCTM No. 1000-115-12.2 the applicant and her parents for a period of 24 months at$1 a month. The applicant asserted that no other person shall occupy the dwelling unit, and was asked to submit a legible birth certificate. 5. The owner's plan comply with the on-site parking requirements of three spaces,two for the principal dwelling and one for the accessory apartment, and provide for a total of 3 parking spaces as shown on a survey map prepared by Vasiliy Suslin, LS, and last revised July 2, 2022. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s)and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142(General Standards)and 280-143 (Matters to be Considered) specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. 2. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the Special Exception Permit as applied for as shown on survey map prepared by Vasiliy Suslin, LS, and last revised July 2, 2022, and architectural/engineered plans, Sheets A-2 thru A-4, last revised October 31 2023• and Sheet A-1, last revised March 8, 2024, all prepared by Nicholas Mazzaferro, P.E. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the Page 4, March 21,2024 ##7880SE,70 Deep Hole Drive, LLC/Brady Leifer SCTM No. 1000-115-12.2 accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. When the primary dwelling is not being occupied by the owners,the principal dwelling may not be rented to anyone else. 4. When the subject accessory apartment is not being occupied by the applicant's parents, as applied for,the accessory apartment may not be rented to or occupied by anyone else. 5. Per Town Code,the applicants may not rent the principal dwelling or apply for a permit to establish a bed-and-breakfast use as long as the accessory apartment approved herein exists. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. Suffolk County Department of Health Services approval is required for the addition of an accessory apartment in an accessory structure. 4. When the primary dwelling is not being occupied by the owners, the principal dwelling may not be rented to anyone else. 5. When the subject accessory apartment is not being occupied by the applicant's parents, as applied for, the accessory apartment may not be rented to or occupied by anyone else. 6. Per Town Code, the applicants may not rent the principal dwelling or apply for a permit to establish a bed-and-breakfast use as long as the accessory apartment approved herein exists.
