1 CELL TOWER AT ALBERTSON MARINE
2 CHAIRMAN WILCENSKI : We have one
3 public hearing . The Public Hearing is
4 for Cell Tower at Albertson Marine . The
5 proposed wireless facility site is for
6 150 foot tall above grade level
7 concealment pole, including antennas,
8 cables and related equipment for two
9 wireless carriers , which are Verizon and
10 DISH and the Southold Fire District ' s
11 emergency communication's , along with a
12 +/- 2 , 450 square foot equipment compound
13 on a . 95 acre parcel, with a +/- 10 , 800
14 square feet of existing boat storage
15 warehouse in the M2 Zoning District .
16 The property is located at 61405 New
17 York State Route 25 in Southold, SCTM
18 #1000-56-3-15 .
19 At this time, what I ' d like to do
20 is have the team, Greg Alvarez and his
21 team present to the Board with the
22 technical information on the cell tower,
23 and at the end of his team' s
24 presentation, we ' ll see if any of the
25 Board members have any questions for the
November 6, 2023 Planning Board 3
1 team. And then after that , we will open
2 it up to the floor . And any questions
3 that are brought up by the public will
4 give Greg and his team a chance to
5 answer those at the end . Greg, it ' s all
6 yours .
7 GREG ALVAREZ : Thank you, Mr .
8 Chairman, Members of the Board. My name
9 is Greg Alvarez from Amato Law Group,
10 666 Old Country Road, Garden City, New
11 York, here on behalf of the
12 co-applicants on the marine towers ,
13 Verizon, Wireless , DISH Wireless , and
14 Southold . Thank you very much for your
15 time this evening . Before I begin, I ' d
16 just like to submit my original notice
17 package . I know I had e-mailed it to
18 the Planning staff . So I ' m going to
19 submit that .
20 CHAIRMAN WILCENSKI : You can bring
21 that up .
22 GREG ALVAREZ : Great . So let me
23 first just give you a quick overview,
24 and then yeah, we do have a few folks
25 here this evening to speak on the
November 6, 2023 Planning Board 4
_ 1 application . Try to keep ourselves as
2 concise as possible . But as you
3 mentioned, there are some technical
4 considerations as part of the
5 applications . So we just like to make
6 sure that we provide that information
7 for the Board and the public . So first
8 off, the applicants . So just so you
9 have an idea of who the folks are behind
10 me this evening . First', we have Elite
11 Towers . They are a tower company that
12 construct the existing wireless
13 facilities throughout the New York
14 region . We -- they as part of this
15 application, would serve in that role .
16 So they would construct the pole and the
17 equipment compound and then manage it
18 for the company wireless users . For
19 those users , first off, would be Verizon
20 Wireless and DISH Wireless , and two
21 commercial subscriber based providers
22 that have wireless services . They ' re
23 consuming utilities in the State of New
24 York and they hold FCC ,licenses to
25 operate within New York and the U . S . As

1 part of their charge under the FCC, they
2 are required to provide reliable and
3 consistent service across their user
4 geography, and that does include this in
5 the United States . Southold Fire
6 District is the other and user here .
7 And they would be located here, and also
8 an FCC licensee . And they would operate
9 their own wireless communications
10 facility to further their charge as a
11 first responders for the Southold
12 community. And so they, would be
13 positioned on one of the pole as well .
14 So tonight we ' re asking for specifically
15 a Site Plan Special Exception approval .
16 That ' s under 280-71 of the Town ' s
17 Wireless Ordinance . We are subject to
18 various criteria that ' s set forth within
19 the wireless code and within the zoning
20 code as well, in terms of the underlying
21 zoning requirements . So we ' re asking
22 for some waivers here under that
23 wireless ordinance . I ' ll just go
24 through it real quick. The first one is
25 under 287G . That involves the fall zone,

-- 1 where 200% fall zone is required.
2 However, in the event that a applicant
3 provides a structural report that
4 confirms that the structure itself of
5 the pole will be constructed for all
6 required standards and specifications
7 that that can be submitted in support of
8 the fall waiver . We did submit in our
9 submission, a structural report prepared
10 by Carpenter & Cross , the structural
11 engineers who work for the intended
12 fabricator of the particular pole . It
13 was on September 22nd of this year . And
14 they did state that very same thing .
15 That they would be subject to all
16 Federal , State and Local structural
17 requirements , also the NCTIA-222 , which
18 is the site early industry specific
19 standards . Particularly for these sorts
20 of poles . And of course, it would be
21 built all of those as well . The other
22 thing is that they mentioned within the
23 report, is that the tower itself, in
24 that unlikely event of potential error
25 on the part of the pole, although our

1 manufacturers have never experienced
2 such an instance, that has been designed
3 so that to further comply with the fall
4 zone . That it ' s created so that if
5 there is any instance that would created
6 in the pole at any time, it would have
7 an ( inaudible) point in the pole . So
8 that it would prevent a fall failure .
9 Again, it ' s never really happened in
10 connection with these manufacturers . So
11 we ' re confident in the construction of
12 the pole . The other variances that
13 were -- I 'm sorry, the waivers that
14 we ' re seeking this evening, one actually
15 does relate to variances . 280-70 . i . 1 ,
16 where you have to abide by the
17 underlying zoning requirements . And
18 that ' s the Marine II . So on October
19 5th, we ' ve already appeared before the
20 Zoning Board of the Appeals and
21 requested area variances as the lot size
22 and rear yard setback. And that
23 decision is pending the proceedings .
24 We ' re also asking for a waivers for
25 280-70 . i . 2 , that relates to maximum

1 height . Typically your permitted 80
2 feet . We are proposing a 250 feet here,
3 and that ' s why we have our folks here
4 tonight to talk more specifically about
5 the technical side of the application to
6 show that not only the carriers , but the
7 fire district is in great need of
8 service in this area . 287 . i . 3 relates
9 to a minimum distance to residential
10 properties . Technically, we do have
11 residential zoned properties just to the
12 north, but the nearest residential
13 structure is over 500 feet , which is the
14 measure within that waiver . So we ' re
15 seeking that here . And then 72 , I ' m
16 sorry, 287-286 and 287 , 289 relates to a
17 height, which is the same waiver as the
18 maximum. And this relates to 300 feet
19 to a scenic road or the adjacent to
20 residential . So they ' re all kind of
21 related in terms of the waivers we ' re
22 asking for here tonight . Also, 287-262 ,
23 which allows this Board to grant those
24 waivers . So that ' s what we ' re talking
25 about . We ' ve also appeared before the

1 -- on October 18th before the Town
2 Trustees seeking wetlands application
3 approval , which was granted. We ' re just
4 waiting for that final approval from
5 that Board . And then the one final
6 additional item that would be part of
7 this application is that we hope will be
8 a Negative Declaration of Environmental
9 Quality Review Act . We understand that
10 the Zoning Board had recommended that
11 ( inaudible) action, so we can support
12 that designation as well . So history of
13 the property of the property or I 'm
14 sorry, history of the application . We
15 first filed back in January. So we ' ve
16 been working since then with the
17 Planning Department and the Town ' s
18 wireless consultant City, State on the
19 review of the application . There ' s been
20 a lot of back and forth to make sure
21 that we provided all the information
22 that ' s required under the code . So
23 finally, on August 9th, we did file with
24 this Board specifically for the
25 materials that were a result of that

1 discussion . There was some further

2 discussion and then finally on
3 October 24th, we were being able to have
4 this Board, here before you tonight . So
5 just to talk briefly about why we ' re
6 here . So it really, boils down to one
7 word. And that ' s as you can sense from
8 the wireless carriers who are here this
9 evening, and the fire district, they ' re
10 both -- they ' re all in need of better
11 equipment . That ' s really what they ' re
12 trying to -- trying to ,spark it . Now
13 for the wireless carriers -- as for the
14 wireless carriers , they ' re certainly
15 seeking to provide day to day service
16 for their subscribers, like their daily
17 needs in terms of phone and data, but
18 also related to the fire districts
19 charge, that they would also be able to
20 serve better than 911 needs of
21 subscribers of the area . So it all goes
22 hand in hand and that ' s supposed to be
23 achieved by this project . Just to give
24 you a sense of what the -- what we call
25 a gap there is within the area . The

1 nearest , for instance, in terms of the
2 Verizon Wireless system, the nearest
3 neighboring sites are approximately
4 three miles away . It doesn ' t sound like
5 a lot , but when you understand that the
6 capacity of a particular site, even a
7 site that we ' re proposing here can
8 propagate maybe a mile . That gives you
9 an idea of how far this gap really is .
10 We ' re gonna have some masks to show you
11 a little bit more on each panel on that .
12 The property itself, as, mentioned, 61405
13 Main Road, it ' s about -- it ' s almost an
14 acre and it ' s located on the north side
15 of Main Road, approximately 1600 feet
16 west of Old Main Road. It ' s zoned
17 Marine II . And it is currently occupied
18 by one building and the associated
19 storage that takes place on the property
20 as part of the sales storage and repair
21 business . That ' s known as Albertson ' s
22 Marine . So on the property itself, it ' s
23 only a portion of it . The adjoining
24 lots are also part of that process , or a
25 part of that business . In the area,

1 it ' s a mix of commercial and marina type
2 uses , residential, agricultural and
3 preservation . Just to the north, we
4 have the preserve . But the nearest
5 residence, as I mentioned, is over 500
6 feet away. So let ' s talk a little bit
7 about the build. I see we have the
8 drawings up on the screen . If you can
9 go to the second page . Yes . So that is
10 it the overall site plan . And if you
11 can direct your attention to the
12 northerly part of the property, sort of
13 the rectangle with the circle around it,
14 and you see sort of the little circles
15 that go around the rectangle itself,
16 that ' s the location of the facility .
17 Within it, will be the pole itself,
18 along with the equipment area . That the
19 equipment area is that will serve the
20 ground equipment for each of the
21 carriers and the fire district . If we
22 can jump just quickly to Page 11 . Okay,
23 that ' s it . That ' s the elevation page,
24 Page 11 . Okay . So here is the
r 25 elevation, which shows the equipment

1 compound at its -- at its base . And
2 here is the whole design, which would be
3 a concealment pole that has the antennas
4 within the canisters at the top of the
5 concealment portion . That ' s where the
6 carriers will go . So Verizon Wireless
7 will go at the very top . DISH right
8 there . And then the intention would be
9 to allow for the other carriers , which
10 generally considered would be T-Mobile
11 and AT&T, would be located below there
12 as well . So up here are the antennas
13 that are proposed for being Fire
14 District, and those would serve the
15 needs of the community, and allow for
16 the communication system to be more
17 reliable . And we ' ll just talk about
18 that in just a minute . Now, if you can
19 jump back to Page 8 . Sorry to jump
20 around a little bit . Want to show you a
21 detail of the compound area . That ' s it .
22 So here you can see it 'a little bit more
23 in detail and right here you can see the
24 pole right in the middle, the Fire
25 District . Ground equipment would be

1 right there . And then these four areas
2 are designed to be occupied by each of
3 the four carriers . The' site right here,
4 we ' re showing Verizon Wireless on this
5 particular plan . We also sent in
6 another set of plan where a DISH will be
7 located in this spot . On the edge here,
8 you ' ll see two lines of proposed
9 landscape buffering . They ' re proposed
10 to be Arborvitaes . Consistent with your
11 code . The necessary landscaping that
12 will be located. So taking together, we
13 believe that this design, which we ' ll
14 receive a few more details on with our
15 team here, that we meet the legislative
16 intent of this department . So that the
17 Town has adopted . It ' s meant to balance
18 the need that ' s within the community for
19 wireless services . Balance against the
20 aesthetic considerations that certainly
21 we want to consider as well . So we ' ve
22 located this particular compound in the
23 rear, behind the existing building,
24 which is approximately 35 to 40 feet .
25 And set against from the road, where the

1 concealment design as well . So all of
2 those factors going into it for those
3 considerations . One more point I ' d just
4 like to point out, as well , in
5 connection with these sorts of
6 applications . We do have a
7 representative here who talked further
8 about it for the question, but we have
9 submitted a report that shows that we
10 meet the FCC emission standards that are
11 required as part of the licensing that
12 goes with all of the carriers . And
13 based on the predictive calculations,
14 we ' re very low in terms of that emission
15 standard that we cannot exceed. So the
16 level is 100% . We ' re actually at 1 . 5%
17 for the air valves , which is on the
18 order of almost 100 times less than what
19 we ' ve been permitted to . But we come
20 nowhere close . So I just wanted to
21 point that out . So without further ado,
22 I ' d like to get this -- our other folks
23 here to talk a little bit more detail
24 about our height , our need, and just
25 further considerations that go into this

1 application . First , I have Andrew
2 Hintz , an RF engineer from Integrated
3 Wireless Technologies who has submitted
4 materials . And what I ' d say is, if we
5 can go to Number Two on the list , those
6 are the maps that he ' ll be using . So
7 Mr . Hintz to come forward, introduce
8 himself with us , with his credentials ,
9 and present his findings of the report
10 that he submitted to the record .
11 CHAIRMAN WILCENSKI : Thank you,
12 Greg, can you just also just write your
13 name . Anybody else that speaks? State
14 your name and write your name for the
15 record. Thank you .
16 ANDREW HINTZ : Good evening, folks .
17 Andrew Hintz . I am with Integrated
18 Wireless Technologies . While I would
19 love to be an electrical engineer, I do
20 not want to misrepresent myself . As
21 such though I am employed by Douglas
22 Knopper, who is partner and co-owner of
23 Integrated Wireless , who is an
24 electrical engineer . And that ' s all
25 material that comes out of our office .

1 So, we did want to speak to this evening
2 for the folks is the need for the 150
3 foot height . Well, (inaudible) would be
4 happy with whatever they were able to
5 obtain . The height is like when we talk
6 about our ethic, is an opportunity to
7 cover more area, more subscribers . The
8 150 foot height for this particular
9 project is driven by the Fire District .
10 We ' ve ran several maps 'and I want to
11 speak to why that 150 foot is required
12 for this project . What you ' re looking
13 at right now is representation of their
14 coverage out of the tower, which is
15 behind police headquarters . We refer to
16 that as the current DPW tower because
17 it ' s facing to the DPW properties . We
18 differentiate them from the Kings Tower
19 because we ' ve had that 'monopole right
20 next to the PD headquarters for three
21 months . So this particular tower, which
22 was the best available 'real estate at
23 the time of the original build up is to
24 the west end of the Fire District ' s
25 coverage district . So we ' re at

1 approximately 100 foot on the tower .
2 And it does probably reasonably well,
3 but as you look to the Fire District ' s
4 coverage areas in east, you see that it
5 fades quite quickly . So I 'm talking
6 about this area over here on Sound
7 Avenue and this area down here with
8 Paradise Point . So and these are known
9 coverage deficiencies from the Fire
10 District ' s original coverage area and
11 communication system. We ' ve considered
12 a lot of options . We ' ve considered
13 deploying with PDI at Fire Headquarters .
14 That ' s been cycled by the current owner
15 that exists there . And the failed
16 attempts to coordinate with them to
17 increase the level . That ' s the T-Mobile
18 at Fire Headquarters . This particular
19 project that Albertson Marine had been a
20 long sought out site for the Fire
21 District . We ' ll talk about it outside .
22 We ' ve been getting after this for about
23 seven years . So about three or four
24 years into that, the Fire District
25 decided they had to take action . That

1 action consisted of a second site out at
2 the Greenport of the old Cablevision
3 tower . So about two years ago, we
4 deployed communications equipment at
5 Greenport that we work in conjunction
6 with the equipment behind Southold Town
7 PD headquarters . That has increased
8 their coverage area significantly . They
9 have much greater coverage in the
10 Greenport area, which is mutual aid, and
11 also increased coverage for when they ' re
12 at the hospital . What it didn ' t do, is
13 it didn ' t completely close the gap on
14 Sound Avenue . So as the Chief will
15 attest to, there ' s still a dead area on
16 Sound Avenue, where they frequently have
17 motor vehicle crashes . So there ' s about
18 a mile stretch where these two sites
19 just didn ' t close the gap . On 25, I
20 believe the coverage is pretty good . We
21 experienced good coverage on our Route
22 25 end to end. The other thing which
23 probably did not sound when the
24 Greenport site is this Paradise Point .
25 Right here . You could see that there ' s

1 a lot of green, but there is still that
2 white shading, which means we have a
3 lack of coverage . Part of the biggest
4 concern is the fire department
5 membership that resides in that area .
6 There ' s a significant amount of response
7 coverage on day to day EMS runs and fire
8 emergencies that come out of that
9 peninsula . And those members can ' t
10 identify themselves as responding until
11 they ' re much further into their
12 response . I don ' t know if you ' re
13 familiar, but Suffolk County requires
14 that we coordinate being on a crew
15 within the first two minutes or else we
16 miss out . So if these people aren ' t
17 able to identify that they ' re responding
18 quickly, that call is being reactivated,
19 even though we have personal response .
20 I do want to mention that the natural is
21 skewed a little bit because they have
22 centered on the tower site . So where
23 Paradise Point was to the right on the
24 map . Now we find that Paradise Point is
25 centered here . So we do see that this

1 new site is not going to completely
2 cover Paradise Point by itself, but
3 we ' re not seeking to have a single site
4 cover any area in totality . We operate
5 under what ' s called Simulcast .
6 Simulcast is a method of mixing RF
7 sites . So that they give you up to 95
8 percent power coverage in that area, by
9 mixing the signal and overlap . So by
10 utilizing the two sites that we ' re going
11 to use, the Southold Town PD
12 headquarters site and the new model at
13 Albertson ' s Marine, we ' re confident that
14 we ' re going to cover at that 95
15 percentile, the entirety of the Fire
16 District ' s district . We ' re planning on
17 relocating equipment from Greenport into
18 this new site, but we expected the site
19 will continue to that shows cover
20 Greenport as the immediately new terrain
21 district to the east , as well as ,
22 Eastern Long Island Hospital . So the
23 other intended public safety use for
24 this structure is in long term to have a
25 PD receiver on that tower . The PD has

1 long worked to increase its coverage,
2 including inside this building as a
3 receiver on this building just to ensure
4 law enforcement safety . And they do
5 also have a coverage efficiency still in
6 that truck. So that would serve as a
7 set for them. And Southold Fire
8 actually has two channels that they
9 operate . A primary and a backup . With
10 that backup was their old paging system.
11 Now they rely just on the town-wide
12 paging system, and that other channels
13 of backup and still serve their fire
14 police group, to give them a clear
15 challenge . So, unless there ' s any
16 questions now, I ' ll stay till the end of
17 the presentation, so I can answer any
18 questions as they come up .
19 CHAIRMAN WILCENSKI : Thank you .
20 GREG ALVAREZ : Thank you . So next
21 we ' ll hear from the Verizon Wireless
22 perspective . We ' re going to talk a
23 little bit about their needs as well .
24 And the need at this site . So yes , you
25 can go to Number Three, and I ' ll

1 introduce Martin Lavin . He ' ll be here
2 from C-Square representing Verizon
3 Wireless and he prepared the report that
4 was submitted as part of the record . So
5 we ' ll be looking at that . So Mr . Lavin,
6 if you could step forward and introduce
7 yourself .
8 MARTIN LAVIN : Martin Lavin,
9 C-Square Systems on behalf of Verizon
10 Wireless . I am here today to discuss
11 the radio frequency . 32 years in this
12 very specific . As we see here, we have
13 the layout of the sites in the area .
14 And as you can see --

15 CHAIRMAN WILCENSKI : Excuse me, do
16 you have the pointer still there? The
17 laser pointer . Thank you .
18 MARTIN LAVIN : We, can see three
19 miles , four from, two miles . Three
20 miles from joining sites here . For them
21 to provide coverage in the middle of
22 this area . The next slide will show the
23 coverage as it sits right now . You can
24 see the green areas are in building
25 colons in the area . Areas are reliable

1 in-vehicle coverage and the white areas .
2 That ' s about five mile wide . As you can
3 see, there ' s only two reliable coverages
4 in that area . On to the next slide .
5 We ' ll see how this fills in . It fills
6 in with a very substantial portion of
7 the area . Three square miles of storage
8 area . 100 , 000 population . And almost
9 20 miles ( inaudible ) . If we drive to
10 100 feet of the highest , it ' s also
11 pretty much given by our wireless
12 coverage . If we drop from 150 to 130
13 feet in power, we would lose generally
14 about 350 of the coverage that ' s the
15 site provides . It ' s about one square
16 mile of 400 population . And that would
17 be, you know, quite a ( inaudible) .
18 GREG ALVAREZ : Thank you very much,
19 Mr . Lavin. Oh, I ' m sorry. If there ' s a

21 CHAIRMAN WILCENSKI : No, we ' re
22 going to hold the questions to the end.
23 We ' re going to write it down and we ' d .

25 GREG ALVAREZ : ( Inaudible) I wanted

- 1 him to speak as well about the sort of
2 day to day issues that 'they ' re
3 experiencing .
4 CHAIRMAN WILCENSKI : Excuse me, do

6 of technical information?
7 GREG ALVAREZ : Yes, we have one
8 more -- we have one more expert .
9 CHAIRMAN WILCENSKI : Can you do
10 that first?
11 GREG ALVAREZ : We can . All right .
12 At this time, I ' d like to introduce --
13 and this will be Slides 4 through 7 . So
14 there ' s a set of other maps that are
15 separated that are all parts of his
16 presentation . So if we can open those
17 in order . I have (inaudible) Mamon from
18 DISH Wireless , who is a senior planning
19 and organizational engineer . He
20 prepared the RS study associated with
21 DISH Wireless . I ask him to come
22 forward and speak, introduce himself,
23 presents credentials , and then provide
24 the results .
25 CHAIRMAN WILCENSKI : State your

1 name . You can sign when you finish .
2 MR. MOMAN : ( Inaudible ) My name is
3 ( inaudible ) Mammon, engineer with
4 ( inaudible ) . I 'm a full-time team
5 member, having worked in the RF
6 engineers since I do my research .
7 ( Inaudible ) . And before, which I have
8 also designed the network for regional
9 department . ( Inaudible) So FCC when it
10 advocated limited amount of frequencies
11 to DISH and gave it a mandate to build a
12 network by year 2023 . So needed target
13 notes about 200 of your population by
14 June 14 , 2023 . And then the next target
15 was 700 of your population . And with a
16 minimum number of speeds of 35
17 ( inaudible) per second .' So in order to
18 achieve these milestones and targets , we
19 designed the network vertically using
20 the computer simulations by making the
21 grid and putting the slides vertically
22 and looking at the coverage . And then
23 we turn on the (inaudible ) engineers to
24 identify existing towers , water tanks ,
25 buildings , roof tops , where we can to

1 the ( inaudible ) today. But you can look
2 at the top very clear the green ones are
3 the towers , which are already on air .
4 And the blue one is the side which we
5 are proposing . So the -- but you look
6 at this one, 2100 feet ., So it ' s a
7 self-support tower in Peconic . And the
8 other side was 2141 . It ' s a 160 feet
9 guide tower in Greenport . So the
10 distance between the site below and
11 above is around 3 . 5 miles . So this
12 location fits perfectly equal distance
13 on both sides , then cover hopefully the
14 residential area, highway, inside the
15 buildings . And since the other sites
16 are already on there, so we have done a
17 drive test and we actually feel that it
18 does do match with what we had
19 assimilated before . And why we chose
20 ( inaudible ) ? Well, some are height and
21 average height for the ,network, besides
22 the level of drone, the same range, 120 ,
23 130 , 140 feet . If you go too high, like
24 200 feet, the site will be over
25 shooting . You have limited amounts of

1 frequencies, and they have to be reused.
2 We don ' t want that to be called
3 interference . We have ,lower and smaller
4 antennas at lower height, and we will
5 have limited coverage, ',and we will end
6 up with a low coverage gap . So it seems
7 to be an ideal height with the work on
8 the internet . And Michael is already
9 covered, most of --
10 JESSICA MICHAELIS : I ' m sorry . The
11 two of you can ' t speak at the same time
12 just because it gets transcribed. So --
13 MR. MOMAN : So there are a couple
14 of more slides . So we ',can put the --
15 look at the simulated coverage . So this
16 shows the coverage level being the
17 strongest and level weaker and orange
18 essentially on the street or highway in
19 vehicle coverage . So this is the area
20 we are planning to cover with our
21 proposed Tower . I ' m going to let you
22 move to the next slide,) please . The
23 coverage, how it looks 'like this on the
24 communication, and theinext one, you
25 will see the component coverage from the
November 6, 2023 Planning Board 2.9
1 policy plan . And so this will perfectly
2 turn all the gaps .
3 GREG ALVAREZ : Hence, if I may ask
4 a question?
5 JESSICA MICHAELIS: You just have

9 you could just describe how the site
10 will provide a -- in terms of distances ,
11 in terms of populations . I know you had
12 studied in your report the covered
13 objectives here . Could you describe
14 what -- what you -- how this particular
15 site, at this particular height will
16 meet the coverage needs of, you know --
17 CHAIRMAN WILCENSKI : You have to
18 state your name again before --
19 MR. MOMAN : ( Inaudible ) So, we did
20 one simulation at different heights , 160
21 feet , 130 feet, 110 feet and 90 feet .
22 So, taking 130 feet as our standard, if
23 we increase the height to 160 feet, we
24 got additional coverage of like 150 , but
25 if we use the height on 110 , we lost

1 around 320 of our coverage . With 170 ,
2 we are expected to provide service to
3 2 , 400 potential subscribers of people in
4 that vicinity . But if we move to 170
5 feet , we won ' t be able to provide
6 service to 2 , 400 and so on . 90% will be
7 able to provide . So the company also
8 looks at the number of subscribers that
9 a site can potentially cover, and also
10 we have 60-900 of the population . We
11 have to consider all these numbers .

17 So, actually, one second. So as I
18 mentioned -- Greg Alvarez from Amato
19 Law . We do have a few comments here,
20 who I just wanted to bring up in terms
21 of the day to day issues that they face .
22 Not just on the technical side, but just
23 on the day to day situations that
24 necessitated this need to go into the
25 second pole . So if he could step

1 forward for a minute and describe his
2 experience that would be most important .

4 THE CHIEF: Hi , Chief ( inaudible) .
5 Lot coverage is ( inaudible) firehouse,
6 in terms of vehicles , but you know, when
7 you ' re riding around back, you ' re riding
8 around front, that ' s what you need. But
9 anyway, the other thing is , we have a
10 public safety issue in ,this ( inaudible ) .
11 This Summer, a big tree fell on the
12 road, it ' s brought down the electric,
13 which also kills everybody ' s booster
14 that they have to have at home for their
15 cell phones . So, during that period of
16 time, if I myself were to have a heart
17 attack, I would die . We don ' t have the
18 proper coverage in the Town. And it ' s
19 not just on the north -- north of you,
20 but it ' s also part of what I do as a
21 family. I rode around with radio,
22 trying to see where we 'had covered, and
23 we had didn ' t have coverage and there
24 was a big gap . ( Inaudible ) .

2 technical and Greg ' s speak, then we will

5 GREG ALVAREZ : Again, Greg Alvarez
6 from the Amato Law Group . I ' d like to
7 mention two more folks that we do have
8 in attendance, but we ' ll rely on their
9 submission . So we have David Collins
10 from Pinnacle Group, who has submitted
11 an FCC compliance report . Presenting
12 the findings that I had mentioned
13 earlier in terms of making sure that we
14 are far below the FCC admissions , as
15 part of their licensing . If there are
16 any questions . You ' ll certainly hear
17 from them. Also, we have Tommy Negra
18 from Elite Tower who was charged at the
19 beginning of this process to do the lay
20 board. The investigation, to see where
21 the best location for this particular
22 facility would be . And it dates back to
23 2010 , where they ' ve gone out and their
24 team have gone out and spoken with
25 property owners and the community, who

1 might be interested . And based on that

2 process , and as it ' s captured in their
3 altering those sites , they ' ve also
4 submitted a part, of this application .
5 We ' ve arrived at this site in terms of
6 ideal, not only from the perspective of,
7 it ' s certainly fortuitous that when the
8 owner is also affiliated with the fire
9 district , which has been an great
10 synergy, but also in terms of technical
11 perspective . So I have two more folks
12 that I ' d like to just to talk about .
13 Things that we spoke about earlier in
14 terms of the wireless codes of deptims
15 (phonetic) that has to do with the
16 established considerations and
17 considerations of community. So first,
18 I have Michael Lynch, from Lynch and
19 Appraisal, who has prepared a report,
20 which he did submit to the ZBA that I ' d
21 also like to submit copies to this
22 Board . And he ' ll talklbriefly about his
23 study that he had undertaken as a line
24 appraiser and from the ,perspective of,
25 like I said, the established

1 considerations . I ' ll bring this up .
2 CHAIRMAN WILCENSKI : Thank you .
3 MIKE LYNCH : Good evening, Chairman
4 and Members of the Board. Michael
5 Lynch, my business address is 15 Dewey
6 Street, Huntington . I am here as the
7 real estate expect . The standards , a
8 Special Exception with ,the Wireless Code
9 and the Marine II Zoning District code .
10 I was before the Zoning Board back in
11 September on this matter, the
12 presentation meeting also was there to
13 report . And with Mr . Alvarez submitted
14 my report for this Planning Board
15 meeting . So I ' ll try to be brief, with
16 my findings . As you know, it ' s over
17 close to 150 foot concealment tower is
18 located in the outskirts of the north
19 side of the Main Road. Approximately, a
20 third of a mile of Laurel Avenue in the
21 Hamlet of the Southold ., The property,
22 as you know, is just to the south side
23 of the Long Island Railroad . Right
24 away, the railroad itself is somewhat
r 25 elevated . And the site itself and the

1 pole would be sandwiched between the
2 railroad right-of-way and the large boat
3 shed, immediately to the south of the
4 site . So between the elevation of the
5 railroad and the boat shed . Immediately
6 south of the large storage of the boat
7 shed. The ground equipment would be
8 largely shielded from any passer-by on
9 Main Road, as well as, ithe nearest
10 residences to the east , to the west,
11 rather, as Mr . Alvarez pointing out .
12 Approximately, the nearest residential
13 structure is approximately 155 feet
14 away . The nearest residences are the
15 west , southwest on Budds Pond Road, and
16 north of that on Pond Avenue, the
17 residents actually be closest to that .
18 That abuts the railroad on the south
19 side . So the site again is a 150 foot
20 concealment pole . It ' s flanked on both
21 sides by Albertson Marine parcels . To
22 the west is the office building, retail
23 center . More boat supplies and outboard
24 and more boat sales . And to the east is
25 another parcel for boat storage . Other

-- 1 uses related to Albertson, include the
2 marina, which was just ',to the south .
3 East of each side, thelsouth side of
4 Main Road includes slips, boat ramps ,
5 etcetera . Other nearby uses include Mr .
6 Alvarez said, to the north side of the
7 railroad is a Town preserve . And to the
8 southwest of this , just outside of Main
9 Road is Town owned a land and preserve .
10 Other nearby use include a restaurant
11 that shuttered, a motel . And further
12 east is the Egypt Marine . As part of
13 the Special Exceptions ,'I what I looked at
14 was, of course, that this site will , in
15 the conservation of the property values,
16 I looked to see any impact that this may
17 have on the nearest residents in the
18 area . I ' ve been working on these sites
19 for fire districts and �Carrier ' s for the
20 past 20 years or so on ,the North Fork,
21 which include the East ,Marion,
22 Mattituck, Orient , and ''Orient Point Fire
23 Districts . I ' ve also worked on several
24 private poles over thelyears . Again, on
25 the North Fork . In my �report, I ' ve

- 1 outlined one study. On the third page
2 of the slide, so this is on the Cherry
3 Creek Golf Links , which is in the center
4 of just at the beginning of the North
5 Fork, heading east . And on this golf
6 course is a concealment pole, which is
7 130 feet tall . Just to the west of
8 that, I ' m sorry, to the east of that,
9 was a development that took place a few
10 years after the construction of the
11 concealing pole . That development is
12 known as the Highlands at Neve ' s , and
13 that was the immense construction around
14 2006 . What I did was, I looked at home
15 sales in that immediate development
16 adjacent against the 130 foot
17 concealment pole, which is largely
18 visible to the development of the
19 Highland at Neves . I looked at sales
20 running from 2006 to 2014 . 36 sales in
21 total . And I noted the price per square
22 foot of each, and I wrote again about
23 new construction primarily . And noted
24 that the median sale price per square
25 foot and average sale price was $197 or

1 $ 191 per square foot . If we go
2 approximately a mile and a half east of
3 that , there ' s another very, very similar
4 development by the same builder, called
5 the Highlands at Aquebogue . That also
6 is immediately adjacent to the golf
7 course, which is a around National Golf
8 Links . I looked at sales in that
9 development during the same time period.
10 Compared price per square foot on a
11 median average level . And what I found
12 is that the price per square foot, those
13 homes , again, also new construction,
14 adjacent to a golf course, very similar
15 in all respects ; however, there ' s no
16 concealment pole on the adjacent golf
17 course . So what I found was that during
18 the same time period, the price per
19 square foot was negligible between the
20 price per square foot . So in that
21 instance, in that example, I didn ' t find
22 a presence of a concealment pole within
23 relatively close proximity to a new
24 housing development, that would impact
25 to a sale price to the square foot . I

1 looked at another study, this time in
2 the Village of Southampton . If we go to
3 Page 7 . Page 7 and 8 . 1 This is a 165
4 conventional model, with exposed
5 antennas . It was constructed 2016 . In
6 the south of that , in the Village of
7 Southampton is an older development .
8 However, given the shortage of land in
9 the Village of Southampton, the huge
10 demand for homes in that Village . Many
11 of these homes have either been raised
12 and newly constructed homes have been
13 put up or homes have been substantially
14 rebuilt and sold. So what I did is , I
15 looked at sales that were one block
16 south of the commercial area . However
17 we ' re still in visibility of the 165
18 foot monopole . Primarily on the Pulaski
19 Street . Again, they ' re not facing
20 commercial ; however, the pole itself of
21 165 foot tower is visible in part from
22 their backyards of sales that I studied.
23 From approximately 5 years prior to the
24 -- I ' m sorry, 5 years subsequent to the
25 installation of that facility. I then

1 compared sale prices of homes just
2 further to the south in that same
3 development . Again, either new
4 construction or substantially rebuild
5 homes that were sold. What I found was ,
6 whether the homes were ',within site of --
7 partially in site of the 165 foot tower
8 versus those that were not, there was no
9 difference in price per square foot . So
10 the presence of that particular
11 facility, which again, it ' s exposing,
12 because on this instance, the DISH with
13 Verizon, there would be no difference .
14 So, in sum, again, in the studies that
15 I ' ve looked at over the years , I haven ' t
16 found that with a facility that ' s
17 designed such as this , given the
18 proximity to the nearest residences and
19 other conditions in the immediate area,
20 I haven ' t found that there is any
21 adverse impact in property values . So
22 with respect to the Special Exception,
23 again, these are outlined in our report,
24 there will be a conservation of property
25 values . And with respect to the

_ 1 appropriateness and compatibility of the
2 neighborhood again, givlen the design of
3 the structure, its visibility, its
4 location with respect t',o adjacent uses
5 and based on Zoning, there will be,
6 again, no impact .

8 GREG ALVAREZ : Greg Alvarez, from
9 Amato Law Group . And m,y final presented
10 this evening is David 'Wortman, who is a
11 planner with the VHB and he will present
12 the findings of the additional report,
13 and the planning digitall considerations
14 at this time . You can ibringout Number
15 9 of the list .
16 DAVID WORTMAN : Good evening,
17 Chairman, Members of the board. My name
18 is David Wortman, I ' m the senior
19 environmental manager for VHB with
20 offices at 100 Motor Parkway in
21 Hauppauge . VHB was retained by the
22 applicant to prepare Part One of a long
23 Environmental Assessment Form, which has
24 been submitted to thisBoard since June
25 7 , 2023 . And additionally, VHB was

1 retained to review the proposed wireless
2 communications facility from a Planning,
3 Zoning and land use perspective . The
4 results of our work were presented with
5 a written report entitled the Planning,
6 Zoning, and Visual Impact Analysis for
7 the State of 2023 . That had also been
8 sent to the Board for its consideration .
9 The major developments of that report
10 included a detailed description of the
11 proposed facility and its environment
12 setting . A review of the consistency of
13 the proposed facility with various
14 applicable requirements and code ,
15 including those application standards ,
16 the permanent requirements , and so on,
17 found in Chapter 28 of the code . And
18 additionally, our report includes an
19 assessment of the potential visual
20 impact . We ' ve performed three separate,
21 but complementary studies . First , a
22 view shed model was developed based on
23 the specific design parameters of the
24 facility and its location, as well as ,
25 available data on topography, the

1 presence of the structure and tree
P ,
2 cover in the surrounded community. And
3 that model predicts where the facility
4 would be expected to be built . Next, . a
5 one mile visibility study was performed.
6 Also sometimes referred to as a crane
7 test, wherein a crane was positioned at
8 the proposed facility location and
9 raised to the height of the pole . And
10 all publicly accessible', areas within a
11 one mile radius for traivel to confirm
12 whether that reference, the crane, was
13 in fact visible or not . That work also
14 serves to ground trees ,) the view shed
15 while which is not lim "ted . Last, a
16 series of photographic simulations were
17 developed from 19 viewpoints throughout
18 the surrounding community, which were
19 identified in consultation with your
20 Planning Department . And I will just
21 note that the crane test and the
22 photographs for the simulations ,
23 etcetera, were performed in early April
24 of this year . I raised that because
25 it ' s noteworthy that the vegetation

1 would not get on the trees . So,
2 conservative analysis during what we
3 call the park. And oficourse,
4 visibility during the rest of the year
5 was just present . The ', results of these
6 analyses are, as I mentioned, presented
7 within the written report that I
8 submitted to the Board ., I think you ' re
9 on the screen here . Well, I won ' t
10 summarize all those points tonight , but
11 I do want to just draw your attention to
12 a few key points , and then of course,
13 I ' ll be putting it in for you . So as
14 you ' ve already heard from others and as
15 documented in the record before you,
16 there ' s a need for the proposed height
17 of facility . The effectiveness of the
18 facility, meeting the communication with
19 the area . The visual impacts of the
20 proposed facility at that proposed
21 height are directly relevant to the
22 relief and the approvals that we ' re here
23 to seek from you all- And what the
24 visual impact analysis that I ' ve
25 described demonstrate that proposed

1 facility will be skewered from you from
2 large portions of the surrounding area .
3 Primarily that ' s due presence of mature
4 and dense vegetative cover throughout
5 the area . And the areas that have or
6 will have the greatest visibility of the
7 proposed facility will be limited to the
8 handful of areas where there are large
9 open spaces that afford unobstructed
10 views towards the top of the structure .
11 They ' re visible here on the Figure 6,
12 what ' s shown on the screen here in those
13 sort of fuchsia purple ,paint color . And
14 as I said, they ' re really from areas
15 where you have large open areas and
16 views are not obstructed by the presence
17 of mature vegetation . To characterize
18 those, you ' ll see they ' re certainly
19 concentrated about both in the harbor
20 and as well on the opposite shore or the
21 east side of the pond . We ' ve got this
22 piece of property that ' s a mile away.
23 So just to put that in perspective, more
24 views from there would consist of would
25 be, you know, rather slender structure

1 given the concealment design at a great
2 distance of 1 , 000 feet or less . So from
3 these areas where visibility is
4 expected, the benefits of that
5 concealment design and the other
6 attributes of the facility are very
7 important . The wireless communication
8 antennas of Verizon Wireless , DISH
9 network, as you ' ve heard, will bye
10 concealed within the pole, and will not
11 be protruding from the pole on the port
12 arms , as you would expect from a
13 traditional monitor . Also, the proposed
14 pole is intended to be painted in a pale
15 blue/grey color that would be intended
16 to blend with its surroundings , meaning
17 really the sky. So then further
18 minimized visibility of the structure
19 for many of these areas where views are
20 on the structure, where at least some
21 visibility . So these design measures
22 are intended to minimize the visual
23 impact of the facility . The benefits of
24 this design are demonstrated by the
25 various photographic simulations that

1 were prepared, that are actually in an
2 appending space . The viewpoints studied
3 for that purpose, there are nine of
4 them. And again, they ''were identified
5 --

7 from Amato . Just to point out where the
8 open seas are, if you pull up 4 , which
9 goes appendices . And then open up the
10 photographing scene . Thank you .

12 Wortman with VHB . So the total of nine
13 viewpoints were identified as part of
14 the simulations package . It ' s
15 noteworthy that, among ''ithose, the
16 proposed facility was not expected to be
17 visible . We present the structure,
i
18 development, education,', and other
19 structures to the project . Ultimately,
20 no simulation prepared �for there . It
21 couldn ' t be . But, like, for example,
22 here, you ' re showing -I So viewpoint
23 number two, which is taken from along
24 Main Road, we ' re facing northeast
25 towards the proposed location . Here in

1 the presence of dense vegetation, some
2 of which is Evergreen . It was expected
3 to obscure as the pole . The old arrow
4 has been added. For context to see from
5 this perspective, where would the top of
6 that is . And so what we can see from
7 here is , Number One, certainly views are
8 obstructed in the direction of the pole .
9 And Number Two, that at this height from
10 along Main Road, the pole would be
11 rather low on the front . If I can ask
12 you to scroll to Viewpoint 7 ? So here,
13 yeah, freeze there for just a moment .
I
14 So here we can have with the existing
15 conditions view facing southeast toward
16 the pole location, across the pond. And
17 if you scroll to the next page, we
18 identify that the proposed facility will
19 be visible . Clearly, it ' s not prominent
20 on the horizon . Well, I ' ll use the
21 pointer is , you ' ll see is a very narrow
22 structure that peaks just above the
23 existing tree line, which is again
24 painted in a pale blue color to blend
25 with its background and surroundings .

=- 1 And again, the benefits of the
2 concealment pole are concealed here .
3 Whereas the antennas are not protruding
4 from the structure, but I concealed it a
5 little bit . And given this sort of
6 system, it means that limited lighting
7 which the facility would have been above
8 the tree line . The model called the
9 proposed facility would not have a
10 significant visual impact in the
11 existence of this location given the
12 most important design capabilities . And
13 something else to mention is that at the
14 ground level, we ' ve heard a little bit
15 about this already today, but the
16 proposed facility has the benefit of
17 being located at the rear of this
18 property . Setback substantially,
19 approximately 174 feet 'on the roadside
20 along Main Road . And we ' ve heard a
21 little bit about this already today, the
22 storage building, 35 plus feet in
23 height . And that ' s actually the lower
24 portion and the ground based equipment
25 would be pulling the screen from you,

1 not visible again . From other
2 directions , the design includes the use
3 of fencing and evergreen screening
4 through the proposed that equipment
5 compound. Obscure views from other
6 directions . It means it ' s noteworthy
7 that there are no prior residents that
8 are within the immediate use of that
9 facility . Nonetheless , in accordance
10 with the Board, the extent that the
11 facility could accommodate that
12 additional screening . With that , again,
13 I ' m happy to answer any further
14 questions you may have regarding the
15 planning analysis and what it will
16 impact on . Thank you .

21 like to ask the Board if they have any
22 questions for any of the testimony given
23 by the technical team?

25 of a comment, but it is a question . On

2 Levin . It seems that the is still
3 uncovered; is that correct? It ' s
4 largely, the area is largely still not
5 covered by the cell tower?
6 GREG ALVAREZ : As to the fire
7 district or the --
8 MEMBER JEALOUS-DANK: It seemed
9 like either of the sides presented full
10 coverage on those, that area, which
11 seems to be part of your original
12 argument that was so important .
13 GREG ALVAREZ : So first if I could
14 have Mr . Levin come to the floor .
15 MEMBER JEALOUS-DANK: That was the
16 slide . Seems it ' s still lacking
17 coverage .
18 ANDREW HINTZ : Andrew Hintz ,
19 Integrated Wireless Technologies . Well,
20 we have to be able to have a look at the
21 both maps to show the simulcast of the
22 coverage . And so right now we ' re
23 looking at the existing trend site,
24 which shows significant depreciation of
25 coverage, specifically over the east end

1 of that peninsula . And some towards the
2 south . If we go to the next map . So
3 that Paradise Point peninsular is now
4 right here . When you show this site,
5 increases greatly the coverage along
6 this northeast edge, as well as , gains
7 us coverage to the south . We do still
8 show some coverage lacking in this area,
9 but that ' s gonna be the area that we ' re
10 covering by the structure today, if we
11 go back up . So we see that area, that
12 little strut of land to the south at
13 that point, plus over this right here is
14 coming off of this site . So we can ' t
15 talk through there . So, there seems to
16 be a high site of dirt right here,
17 shadowing, where we ' re talking about the
18 surrounding . But by utilizing the two
19 sites together in conjunction to each
20 other, we ' re getting coverage from this
21 vantage point into this area . And then
22 from the Albertson ' s Marine site, we ' re
23 going to significantly penetrate this
24 area and then capture this ridge right
25 here . If you scroll back down . You ' ll

1 see how that was done . But we expect to
2 see significant increase improving
3 coverage . Like I said, that same range
4 is right here . We expect to see that a
5 significant improvement coverage when we
6 use these two sites together . We never
7 expect a hundred percent coverage .
8 While we ' re talking about public safety
9 radio, we ' d be naive to represent people
10 to our customers , and fire district,
11 that we can give them in home coverage
12 to the 950 . All of our maps are
i
13 portable radio coverage, back to street
14 site . Meaning outside of the
15 structures . So when we talk about the
16 Chief has a back up full back
17 communications plan, every mobile radio .
18 They will have mobile communications
19 from this out there . And we expect to
20 see a vast improvement of portable radio
21 coverage outdoors to in the fire
