This meeting is public. The Planning Board may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. SETTING OF THE--NEXT PLANNING BOARD MEETING Chairman Wilcenski: The first order of business is to Monday, December 4, 2023 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting James H. SITE PLAN APPLICATIONS APPROVAL EXTENSION: Chairman Wilcenski: East End Tick & Mosquito Pest Control —This Site Plan is for the proposed conversion of an existing building to a single-family dwelling with an attached business office with six (6) parking stalls on 0.25 acres in the Limited Business (LB) Zoning District. The property is located at 36570 Route 25, ±420' s/w/o of the corner of Skunk Lane & State Route 25, Cutchogue. SCTM#1000-97-3-2 James H. Rich III: Mr. Chairman, I offer the following: WHEREAS, this Site Plan Application is for the proposed conversion of an existing building to a single-family dwelling with an attached business office with six (6) parking stalls on 0.25 acres in the Limited Business (LB) Zoning District; and WHEREAS, on January 8, 2018, the Planning Board granted approval with conditions, including one to be met prior to the Chairman endorsing)the site plan, to the Site Plan shown on the survey for SCTM#1000-97.-3-2, prepared!by John T. Metzger, LLS, dated November 1, 2012 and last revised March 1, 2017; and WHEREAS, on August 22, 2019, the applicant obtained,Highway Work Permit #20191078547 from the New York State Department of Transportation (NYSDOT) as required by condition of approval; and WHEREAS, on August 22, 2019, the applicant submitted a letter requesting an Extension of Site Plan Approval and provided reasoning that obtaining the Highway Work Permit from the NYSDOT took longer than anticipated; and WHEREAS, at a Work Session held on September 9, 2019, the Planning Board reviewed the application and determined that the expired Site Plan was in compliance Southold Town Planning Board Public Meeting — November 6, 2023 — Page 3 with current rules and regulations and granted an extension of eighteen months to March 9, 2021; and WHEREAS, on March 9, 2021, the site plan approval extension expired; and WHEREAS, the applicant submitted a letter requesting an Extension of Site Plan Approval and provided reasoning as detailed in the May 3, 2021 staff report; and WHEREAS, at a Work Session held on May 3, 2021, the Planning Board reviewed the application and determined that the expired Site Plan was in compliance with current rules and regulations and granted an extension of eighteen months to September 5, 2022; and WHEREAS, on September 5, 2022, the site plan approval extension expired; and WHEREAS, on October 12, 2023, Eligio Lopez, current owner, submitted a letter requesting an Extension of Site Plan Approval for the purpose of activating the expired site plan and obtaining a Certificate of Occupancy (CO); and WHEREAS, at a Work Session held on November 6, 2023, the Planning Board reviewed the application and determined that the expired Site Plan was in compliance with current rules and regulations and granted an extension of six months to May 4, 2024; therefore be it RESOLVED, that the Southold Town Planning Board grants an Extension of Site Plan Approval for six (6) months from November 6, 2023 to May 4, 2024 to the Site Plan shown on the survey for SCTM#1000-97.-3-2, prepared) by John T. Southold Town Planning Board Public Meeting — November 6, 2023 — Page 4 WAIVE HEARING & SEQRA CLASSIFICATION: Chairman Wilcenski: Handy Pantry Amended —This amended site plan is for the removal of an existing concrete (non-retaining) wall where there exists a +/- 9,600 sq. ft. retail and office building on a 2.11 acre parcel in the Hamlet Business Zoning District. The property is located at 12250 NYS Route 25, Mattituck. SCTM#1000-63-3-15 Martin Sidor: WHEREAS, this amended site plan is for the removal of an existing concrete wall (non- retaining) where there exists a +/- 9,600 sq. ft. multi-use building on a 2.11acre parcel in the Hamlet Business Zoning District, Mattituck; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(1) "maintenance or repair involving no substantial changes in an existing structure or facility"; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; Mia Jealous-Dank: Second. SUBDIVISIONS CONDITIONAL SKETCH PLAN DETERMINATION: Chairman Wilcenski: Smyth Standard Subdivision This standard subdivision proposes to subdivide a 3.68-acre improved parcel into 3 lots; where lot 1 equals 1.01 acres, lot 2 equals 1.46 acres and lot 3 equals 1.21 acres in the R-40 Zoning District. The property is located at 29330 NYS Route 25, Cutchogue. SCTM#1000-102-6-23.1 Mia Jealous-Dank: Mr. Chair: WHEREAS, this standard subdivision proposes to subdivide a 3.68-acre improved parcel into 3 lots; where lot 1 equals 1.01 acres, lot 2 equals 1.46 acres and lot 3 equals 1.21 acres in the R-40 zoning district; and WHEREAS, on July 11, 2022, the Southold Town Planning Board granted a Conditional Sketch Plat Approval upon the map entitled, "Clustered Standard Subdivision for John and Margaret Smyth", prepared by Kenneth M. Woychuck Land Surveying, dated February 17, 2020 and last revised May 4, 2022; and WHEREAS, the Conditional Sketch Plat Approval expired on January 11, 2023; and WHEREAS, on July 26, 2023, the applicant requested more time to submit the Preliminary Plat application due to requirements from the Zoning Board of Appeals related to the conditions of the variance relief received; therefore, be it RESOLVED, that Conditional Sketch Plat Approval is hereby extended to November 6, 2024. Southold Town Planning Board Public Meeting — November 6, 2023 — Page 6 Chairman Wilcinski: NFBG Subdivision —This standard subdivision proposes to subdivide 28.9 acres into 3 lots where Lot 1 is 5 acres and includes a 2-acre development area and 3 acres of open space, Lot 2 is 19.63 acres upon which development rights have been sold, and Lot 3 is 4.17 acres and includes a 1.64-acre development area and 2.55 acres of open space in the AC Zoning District. The property is located at 2458, 2462 Elijah's Lane, Cutchogue. SCTM#1000-108-8-6.3, 6.4 & 6.5 James H. FINAL PLAT DETERMINATION: Chairman Wilcinski: Walsh Park Standard Subdivision —This proposal is for a Standard Subdivision of a 3.82-acre parcel into three lots, where Lot 1 is 0.59 acres and contains two residential dwellings and a sewer easement, Lot 2 is 2.16 acres and contains a sewer and water easement and Lot 3 is 1.08 acres and contains two residential dwellings, a right of way and water easement. The property is located on the Southold Town Planning Board Public Meeting — November 6, 2023 — Page 7 southeast side of Winthrop Avenue, at the intersection of Equestrian Avenue on Fishers Island, in the Hamlet Density Zoning District. SCTM# 1'000-9-10-10 Martin Sidor: WHEREAS, this proposal is for a Standard Subdivision of a 3.82-acre parcel into three lots, where Lot 1 is 0.59 acres and contains two residential dwellings and a sewer easement, Lot 2 is 2.16 acres and contains a sewer and water easement and Lot 3 is 1.08 acres and contains two residential dwellings, a right of way and water easement; and WHEREAS, the applicant for this subdivision is Walsh Park, a non-profit group on Fishers Island that provides affordable housing to residents; and WHEREAS, all conditions outlined in Conditional Final Approval granted on November 7, 2022 have been met; and WHEREAS, the Planning Board finds that this Final Plat application is ready for a determination pursuant to Town Code §240 Subdivision of land; therefore be it RESOLVED, that the Southold Town Planning Board has agreed to defer the requirements for the installation of street trees to the Residential Site Plan application expected to be submitted for Lot 2; Mia Jealous-Dank: Second. Public Hearings Continued by Court Reporter Jessica DiLallo PUBLIC HEARING Chairman Wilcenski: 6:01 PM -Cell Tower at Albertson Marine—This proposed wireless facility site plan is for a ±150' above grade level (a.g.1.) concealment pole, including antennas, cables, and related equipment for two wireless carriers (Verizon and DISH) and Southold Fire District's emergency communications, along with a ±2,450 sq. ft. equipment compound on a ±0.95-acre parcel with a±10,800 sq. ft. existing boat storage warehouse, in the Marine II Zoning District.
