SETTING OF THE-NEXT PLANNING BOARD MEETING Chairman Wilcenski: The first order of business is to Monday, November 6, 2023 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting James H. SITE PLAN APPLICATIONS APPROVAL EXTENSION: Chairman Wilcenski: Purita Winery - This Site Plan is for the alteration and expansion of existing buildings into a new winery totaling 6,304 sq.. ft. which includes 267 sq. ft. of office, 347 sq. ft. of retail, 3,249 sq. ft. of tasting room, 671 sq. ft. of storage area, 1,770 sq. ft. of production area and stone terrace with 25 parking spaces on a 3.7431-acre parcel in the A-C Zoning District. The property is located on the n/s/o Old North Road, approximately 286 ft. w/o County Road 48, known as 19110 Old North Road, in Southold. SCTM#1000-51-3-4.11 James H. Rich III: Mr. Vice-Chairman, I offer the following: WHEREAS, this Site Plan is for the alteration and expansion of existing buildings into a new winery totaling 6,304 sq. ft. which includes 267 sq.,ft. of office, 347 sq. ft. of retail, 3,249 sq. ft. of tasting room, 671 sq. ft. of storage area, 1,770 sq. ft. of production area and stone terrace with 25 parking spaces on a 3.7431-acre parcel in the A-C Zone located on the n/s/o Old North Road, approximately 286 ft. w/o County Road 48, known as 19110 Old North Road, in Southold. SCTM#1000-51-3-4.11; and WHEREAS, on March 10, 2008, the Planning Board granted Approval for a period of three (3) years to the Site Plan entitled "Renovations and Additions to the Purita Winery", prepared by Nancy L. Steelman, R.A., originally dated October 8, 2007 and last revised March 7, 2008; and WHEREAS, on March 10, 2011, the Site Plan Approval expired; and WHEREAS, on April 21, 2015, the Planning Board sent the applicant a notice that Site Plan Approval had expired and requesting a response in writing or the application would be considered withdrawn; and Southold Town Planning Board Public Meeting - October 16, 2023 - Page 3 WHEREAS, on May 22, 2015, Nancy Steelman, agent, submitted a letter requesting an Extension of Site Plan Approval; and WHEREAS, on July 6, 2015, the Planning Board determined the expired Site Plan was in compliance with current rules and regulations and granted an extension to January 14, 2017 with two (2) conditions; and - WHEREAS, on August 6, 2015, Nancy Steelman, agent, submitted sufficient information and revised plans to satisfy the two (2) conditions listed in the approval extension resolution; and WHEREAS, on January 14, 2017, the Site Plan approval extension expired; and WHEREAS, on March 21, 2017, Nancy Steelman, agent, submitted a letter requesting an Extension of Site Plan Approval; and WHEREAS, on April 10, 2017, the Planning Board determined the expired Site Plan was in compliance with current rules and regulations and granted an extension of approval to October 10, 2018; and WHEREAS, on October 26, 2018, Nancy Steelman, agent, submitted a letter requesting an Extension of Site Plan Approval; and WHEREAS, on November 5, 2018, the Planning Board granted an extension of site plan approval for eighteen (18) months until May 5, 2020; and WHEREAS; on May 5, 2020, the site plan expired; and WHEREAS, on July 23, 2021, Abigail Wickham, authorized agent, submitted a site plan approval extension request; and WHEREAS on August 23, 2021, the Planning Board determined the expired Site Plan was in compliance with current rules and regulations; and WHEREAS, on September 13, 2021, the Planning Board granted an extension of site plan approval for two (2) years until September 13, 2023; and WHEREAS, on September 9, 2023, Ural Talgat, architect/agent, submitted a site plan approval extension request; and WHEREAS on October 16, 2023, the Planning Board determined the expired Site Plan was in compliance with current rules and regulations; therefore be it Southold Town Planninq Board Public Meeting — October 16, 2023 — Page 4 RESOLVED, that the Southold Town Planning Board grants an Extension of Site Plan Approval for eighteen (18) months from October 16, 2023 to April 13, 2025 on the Site Plan entitled "Renovations and Additions to the Purita Winery", prepared by Nancy L. SET HEARING & SEQRA CLASSIFICATION: Chairman Wilcenski: Cell Tower at Albertson Marine —This proposed wireless facility site plan is for a ±150' above grade level (a.g.1.) concealment pole, including antennas, cables, and related equipment for two wireless carriers (Verizon and DISH) and Southold Fire District's emergency communications, along with a ±2,450 sq. ft. equipment compound on a ±0.95-acre parcel with a ±10,800 sq. ft. existing boat storage warehouse, in the Marine II Zoning District. The property is located at 61405 NYS Route 25, Southold. McKeon, N.Y.S. Licensed Professional Engineer, last revised 6/15/23 (Sheet Z-02 last revised 8/30/23); and "DISH Wireless Site ID: NYNYCO2239A" prepared by Jeremy K. McKeon, N.Y.S. SUBDIVISIONS CONDITIONAL SKETCH PLAN DETERMINATION/SEQRA CLASSIFICATION: Chairman Wilcenski: Apodiacos Standard Subdivision —This proposal is for a Standard Subdivision of a 3.26-acre parcel into four lots, where Lot 1 is .92 acres and contains an existing house, Lot 2 is .92 acres and Lot 3 is 1.22 acres. A fourth lot includes an existing right-of-way easement across the property and equals .20 acres. The property is located at 4260 Main Road, Green port.' SCTM#1000-35 James H. Rich III: Mr. Chair, I offer the following: WHEREAS, on October 28, 2021, the applicant submitted a Standard Subdivision Application for review by the Southold Town Planning Board; and Southold Town Planning Board Public Meeting — October 16, 2023 — Page 6 WHEREAS, this is for a Standard Subdivision of a 3.26=acre parcel into four lots, where Lot 1 is .92 acres and contains an existing house, Lot 2 is .92 acres and Lot 3 is 1.22 acres. A fourth lot includes an existing right-of-way easement across the property and equals .20 acres.; and WHEREAS, a map from 1986 in Town Records indicates that there is a 50' right of way connecting Wiggins Lane across the parcel that still is effect; and WHEREAS, on May 16, 2023, the applicant submitted a yield plan (mislabeled sketch plan) that conforms to the bulk schedule of the R-40 Zoning District showing the 50- wide right-of-way connecting Wiggins Lane and 3 proposed lots; and WHEREAS, at their work session on August 7, 2023, the Planning Board found the application to be complete; and WHEREAS, the Planning Board has determined the proposed action to be Unlisted as it does not fall within the Type I or Type II actions pursuant to the State Environmental Quality Review Act (SEQRA) 617.5; and WHEREAS, all requirements of Article V Sketch Plat have been met; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is an Unlisted Action under SEQRA as described above; Mia Jealous-Dank: Second. Woychuck Land Surveying, dated February 1, 2020 and last revised April 1, 2023, with the following conditions: 1. Submit a complete Preliminary Plat Application with a Preliminary Plat containing the following corrections and additions: a. CONDITIONAL FINAL PLAT DETERMINATION EXTENSION Chairman Wilcinski: Peconic Onwego Standard Subdivision —This Standard Subdivision proposes to subdivide a 3.65-acre parcel into 2 lots. Lot 1 equals 2.73 acres and Lot 2 equals 0.92 acres in the Limited Business and Residential Office Zoning Districts. The property is located at 32900 County Road 48, Peconic. SCTM#1000-74-4- 14.3 Mia Jealous-Dank: WHEREAS, this Standard Subdivision proposes to subdivide a 3.65-acre parcel into 2 lots. Lot 1 equals 2.73 acres and lot 2 equals .92 acres in the Limited Business and Residential Office Zoning Districts; and WHEREAS, on September 13, 2022, the Southold Town Planning Board hereby grants Conditional Preliminary Plat Approval upon the map entitled "Standard Subdivision of Peconic Onwego" prepared by Kenneth M' Woychuck Land Surveying dated February 16, 2020 and last revised June 6, 2022, with conditions; and WHEREAS, on September 11, 2023, the approval expired; and WHEREAS, on September 20, 2023 the applicant's agent requested an extension by email; therefore, be it RESOLVED, that the Southold Town Planning Board hereby retroactively extends Conditional Preliminary Plat Approval from September 11, 2023, to March 11, 2024. FINAL PLAT DETERMINATION: Chairman Wilcinski: Forbes & Cohen Resubdivision —This resubdivision proposes to transfer 4,240 sq. ft. from SCTM#1000-27-3-6.2 (Lot 1) to SCTM#1000-27-3-6.2 (Lot 2) in the R-80 Zoning District. Following the transfer Lot 1 will be decreased from 634,565 sq. ft. to 630,325 sq. ft. and remain conforming in the zoning district. Lot 2 will be increased from 11,717 sq. ft. to 15,957 sq. ft. and become less nonconforming in the zoning district. The property is located at 1455 & 1075 Narrow River Road, Orient. SCTM#1000-27-3-5 & 6.2 James H. Rich III: Mr. Chairman, I offer the following: WHEREAS, this proposed resubdivision will transfer 4,240 sq. ft. from Lot 1 to 2 in the R-80 Zoning District. Following the transfer Lot 1 will be decreased from 634,565 sq. ft. to 630,325 sq. ft. and remain conforming in the Zoning District. Lot 2 will be increased from 11.717 sq. ft. to 15,957 sq. ft. and become less nonconforming in the Zoning District, and WHEREAS, on December 2, 2022, the applicant submitted a resubdivision application for review by the Southold Town Planning Board; and WHEREAS, on February 6, 2023, at their Work Session, the Planning Board reviewed the application and found it incomplete with the following items to be submitted immediately: 1. ZBA decision (creating non-conforming lot sizes); 2. Certificate of Occupancy; 3. Proof of Lot Recognition; 4. Submission of draft deeds with new legal descriptions; and WHEREAS, on March 20, 2013, the Zoning Board of Appeals (ZBA) requested comments for consideration of a lot area variance as shown in ZBA Application #7782; and WHEREAS, on May 31, 2023, the Planning Board responded to the ZBA's request for comments supporting a variance for a non-conforming lot in the R-80 Zoning District; and WHEREAS, on June 15, 2023, a grant of area variance was issued by the ZBA; and Southold Town Planning Board Public Meeting — October 16, 2023 — Page 9 WHEREAS,, on July 24, 2023, at their Work Session, the Planning Board found the resubdivision application complete and determined that!the proposed action meets all the necessary requirements of Town Code §240-57 for a resubdivision application; and WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulation's, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law; and WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public health, safety and general welfare,,and therefore, are eligible for a waiver: a. Sketch Plat Review b. Existing Resources Site Analysis Plan (ERSAP) c. Yield Plan d. Primary & Secondary Conservation Area Plan e. Preliminary Plat Review f. Preliminary and Final Public Hearings; and WHEREAS, this application is EXEMPT from review by'the Local Waterfront Revitalization Program as no new development potential will come as a result of this resubdivision; and WHEREAS, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5(c)(16) the granting of individual lot line adjustments are listed as a Type II Action; and WHEREAS, the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; and WHEREAS, the applicant has submitted new deeds for the parcel boundaries and the metes and bounds match the January 2023 survey, and, WHEREAS the Southold Town Planning Board found that this Final Plat application is ready for a determination outlined below pursuant to Town Code §240 Subdivision of land; and WHEREAS, pursuant to the resubdivision Policy set by the Planning Board in February 2011, this application is eligible for a decision from the Planning Board prior to receiving approval by the Suffolk County Department of Health Services (SCDHS) as it meets the following criterion set forth in that policy: Southold Town Planning Board Public Meeting —October 16, 2023 — Page 10 • Where no new development potential will be created in the parcel to which the land is transferred; therefore, be it RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of certain provisions, hereby waives the following provisions of subdivision: a. Article V.- Sketch Plat Review; b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP); c. §240-10 (B):Yield Plan; d. §240-10 (C): Primary & Secondary Conservation Area Plan; e. Submit copies of the recorded deeds within six months of this decision, or if more time is needed, request an extension of the Final Plat Approval. 2. Property monuments for the new parcel boundaries shall be installed within six months of the date of this approval. Notification of installation shall be made to the Planning Department.
