Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-builts are INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. We had received a building permit and were proceeding with the construction work as the house was outside the 100' bluff setback. The rear deck was intended to-remain"as is"with minimal-remedial-work. However, when the deck construction was further exposed,there were a number of framing issues discovered(including the lack of footings for the deck posts and a deteriorated deck structure) and a decision was made that it would be safer to rebuild in its current form and location. When the building'department did their framing inspection,they halted the deck work pending Trustee review and to ensure that the deck was still outside the 100' bluff setback. We had the deck work resurveyed on December 19th, 2023 (attached)to demonstrate that the reconstructed deck is still outside of the 100' bluff setback.
