POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:

(1) Move pointer over "Government" on the Town website home page. You will find the title "Town
Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings and Agendas". or
(2) Go to "How Do I", in the right upper corner of the Town website home page, Choose "Access", then
"Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor's Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town's website. The meeting can be viewed live by going to the Town's website at
www.southoldtownny.gov <http://www.southtownny.goy> home page. Click on the "Government"tab, once
the drop down menu appears, under "Town Supervisor/Town Board", click on "Southold Town Board Minutes
and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on "Video". A recording of the meeting
will also air on Channel 22 and will be posted on the Town's website
Instructions and link to attend the meeting will be available on the Town's website or by calling the Town
Clerk's office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

website.

Sanitary Flow Credits -2425 Laurel Avenue LLC, F/K/A Messina
WHEREAS, on March 6, 2023, the Town of Southold acquired Fee Title to a parcel owned by 2425 Laurel
Avenue LLC, f/k/a Daniel Messina, as Contract Vendee; and
WHEREAS, said property is identified as SCTM 41000-55.-6-35, part of SCTM 41000-55.-6-36 and part of
SCTM 41000-56.-1-1 and is located at 705, 751 &2425 Laurel Avenue, Southold, New York, in the R-80
zoning district; and
WHEREAS, the entire parcel is 43.5582 acres as per a survey prepared by Nathaniel Taft Corwin III
Associates Engineering, Land Surveyor, last dated January 20, 2023; and
WHEREAS, said property is located within the Southold Union Free School District; and
WHEREAS, the deed recorded as part of the purchase prohibits the use of the property for any residential,
commercial, or industrial uses and prohibits the use of the property for anything other than preservation of open
space, passive recreation, or wetland protection; and
WHEREAS, as per Section 117-7 (Determination of Credits to be Deposited) of the Town Code, the Land
Preservation Coordinator provided the Town Board with a calculation of the sanitary flow credits available for
transfer from the above-mentioned parcel prior to the Town Board public hearing on the purchase; and
WHEREAS, fifty-three point one (53.1) sanitary flow credits are available to be placed into the Town SFC
Bank as a result of the acquisition of this buildable, non-subdividable property; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby places fifty-three point one(53.1)
sanitary flow credits into the Town SFC Bank from the Town's fee title acquisition of the property
formerly owned by 2425 Laurel Avenue LLC, f/k/a Daniel Messina, as Contract Vendee that is located at
705, 751 & 2425 Laurel Avenue, Southold, and identified as SCTM#1000-55.-6-35, part of SCTM#1000-
55.-6-36 and part of SCTM#1000-56.-1-1; and,be it further
RESOLVED that the Town Clerk shall enter this transfer of fifty-three point one (53.1) sanitary flow credits
into the Sanitary Flow Credit Log; and, be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the Land
Preservation Department, the Special Projects Coordinator and the Planning Department for inclusion into the
Town database and GIS system.

hours of the completion of the event;
5. No alcohol is to be served at the event as per Town Code. Alcohol is prohibited on all

A Local Law entitled, "A Local Law to Impose an Interim or Temporary Suspension on the Review,
Approval and/or Issuance of all Permits for or Relating to Resorts, Hotels or Motels".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
SECTION 1. TITLE.
This local law shall be known as and may be cited as the "Interim Development Law for Resorts, Hotels
or Motels in the Town of Southold."
SECTION 2. AUTHORITY.
This local law is enacted pursuant to the Town of Southold's authority to enact local laws under the New
York State Constitution, Article IX, and the Laws of the State of New York including but not limited to Section
10 of the Statue of Local Governments, granting towns the power to adopt, amend and repeal zoning regulations
in the exercise of its functions,powers and duties.
SECTION 3. PURPOSE AND INTENT.
A. PURPOSE: MORATORIUM
This local law is hereby enacted to preserve the status quo in the Town of Southold on a temporary basis
while the Town conducts studies to review and consider amendments to those parts of the Town of Southold's
zoning legislation and comprehensive plan pertaining to resorts, hotels and motels in the Town. For this
purpose, the Town of Southold will gather information, make recommendations, and further review the Town's
plan for new resorts, hotels or motels in the Town. This process is intended to lead to the creation and adoption
of necessary amendments to the Town's zoning legislation, comprehensive plan, and other applicable Town
laws.
B. INTENT.
The Town Board finds and determines that the Town is under considerable pressure for the development
of new resorts, hotels and motels. The Town is an attractive location for new resorts, hotels and motels, because
of the variety of community attractions located within and close to the Town. Over the past several years the
Town has had six new hotels proposed. One is currently under construction, one is at the beginning of the site
plan process, and four are in the concept phase. There are two expansions at the beginning of the site plan
process - one for an increase in the number of rooms, and one for an addition of a restaurant.
The Town Board further finds and determines that unless reasonable interim measures are implemented,
significant resort, hotel or motel development may occur, and that development may undermine the
implementation of appropriate planning measures needed to protect the public interest and welfare and goals of
the Town. It is the intent of the Town Board to protect public health, safety and general welfare by enacting this
local law for a reasonable period. The Town is undertaking a comprehensive study to develop solutions and to
implement necessary amendments to the land use and zoning regulations to accomplish such goals.
It is the further intention of the Town Board to protect the public interest by preventing a race of
diligence between property owners, developers and the Town which could prejudice the integrity and objectives
of the proposed changes or result in a land use pattern that might be inconsistent with the intent of the
recommendations of the Town resulting from such study. The Town's existing procedures and laws should have
the practical effect of ensuring that new development and redevelopment are in accordance with the Town's
planning objectives. The practical reality, however, is that some of the land use regulations and procedures may
not have this effect. The Town Board finds it necessary to impose a moratorium on accepting, processing and
granting approvals or permits for resorts, hotels or motels, as hereafter provided. An integrated strategy that
takes into account the Town's available resources is needed. This moratorium will enable the Town to focus on
crafting and implementing a strategy that actually achieves its planning objectives.
The Town is currently in the process of a comprehensive zoning update project, and has hired a zoning
consultant to assist with this effort. The timeline for this project has been reaffirmed as being completed by
March 29, 2025. The review of resorts, hotels and motels will be included in this project. This is the rationale
for the 12-month moratorium.
SECTION 4. SCOPE OF THE REGULATIONS.
During the effective period of this law, neither the Planning Board, Zoning Board of Appeals, Town
Board, Town Building Department, or any member, employee, agent or independent contractor of any of the
foregoing Town bodies, shall accept for filing, accept for review, continue review, hold a hearing, make any
decision upon, or otherwise consider, any application for, or relating to, the development or redevelopment of
any property, parcel of land, building, or anything else, for a resort, hotel or motel, as defined in the Town
Code, including but not limited to documents relating to:
1. concept,preliminary or final approval of a subdivision plat,
2. site plan approvals,
3. special use permits,
4. conditional use permits,
5. use or area variances,
6. changes in zoning districts, or
7. permanent or temporary certificates of occupancy,
8. expansion of existing hotels, motels, or resorts.
regardless of the fact that an application has been submitted prior to the effective date of this local law.
The statutory and locally enacted time periods for processing and making decisions on all aspects of the
foregoing are suspended and stayed while this local law is in effect.
SECTION 5. EXCLUSIONS.
This Local Law Shall not apply:
1. To any person or entity who/which has, prior to the effective date of this Local Law, obtained all
permits required for such a resort, hotel, motel and, relying upon such permission, has undertaken
significant development of same.
2. To any application by a municipal corporation or special district or fire district.
SECTION 6. VARIANCE FROM THIS MORATORIUM.
Any person or entity suffering unnecessary hardship as that term is used and construed in Town Law
section 267-b (2)(b), by reason of the enactment and continuance of this moratorium may apply to the Town
Board for a variance excepting the proposed use from the temporary moratorium and allowing issuance of a
permit all in accordance with the provisions of the Southold Town Code.
SECTION 7. CONFLICT WITH STATE STATUTES AND AUTHORITY TO SUPERSEDE.
To the extent that any provisions of this local law are in conflict with or are construed as inconsistent
with provisions of New York State Town Law, this local law supersedes, amends and takes precedence over
New York State Town Law pursuant to the Town's municipal home rule powers, pursuant to Municipal Home
Rule Law § 10 and § 22, to supersede any inconsistent authority.
SECTION 8. SEVERABILITY.
If any clause, sentence, paragraph, section or part of this Local Law shall be adjudicated by any court of
competent jurisdiction to be invalid, the judgment shall not impair or invalidate the remainder of this Local
Law.
SECTION 9. EFFECTIVE DATE AND DURATION.
This local law shall take effect immediately upon filing with the Secretary of State.
Until twelve (12) months from the effective date of this Local law, after which this Local law shall lapse
and be without further force and effect and subject to any other Local Law adopted by the Town Board during

Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS)
facilities".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
L PURPOSE -Moratorium Extension
The Town recognizes that Battery Energy Storage System (BESS) facilities are a key
component to the viability and promotion of renewable energy sources, however, the
technology of these systems is still in its infancy. This moratorium is necessary to permit the Town to
undertake a thorough examination of these systems to identify any possible threats to public health,
safety and welfare as well as evaluate the potential for environmental degradation. These issues are of
great public concern and it is important that the potential for any risks is thoughtfully reviewed with in-
depth analysis and that mitigation measures are identified to ensure the continued protection of our
community and of our environment. Such findings will assist in the crafting of code that will determine
criteria for future siting, site design, safety requirements and all other elements that may be necessary for
approval.
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local Law 8-
2023, on January 31, 2023, with an effective date of April 11, 2023. The current moratorium is set to
expire on April 11, 2024.
The moratorium as enacted, is intended to provide sufficient time for the Town to undertake a thorough
examination of these systems to identify any possible threats to public health, safety and welfare as well
as evaluate the potential for environmental degradation.
Since the enactment of the moratorium, there have been multiple incidents involving BESS facilities. In
July of 2023, Governor Hochul formed an Inter-Agency Fire Safety Working Group to analyze data and
make recommendations for safety. In December 2023, the Governor released initial findings and as
recent as this month, the Governor released the initial recommendations. Governor Hochul also recently
published a Draft Fire Code Recommendations Report concerning which public comment has been
requested. As this process is not complete, the Town cannot adequately access the information and make
sound decisions in enacting code. Further, the Task Force assembled by the Town, consisting of seven
(7) representatives of the community, renewable energy industry, battery storage industry and
environmental/municipal organizations, has not finalized its recommendations or established an action
plan, which is intended to serve as a guide for the integration of battery energy storage systems into the
Town Code. Finally, the work of the Town's outside consultant, updating the Southold Town Code, has
not yet had the opportunity to incorporate the aforesaid recommendations, or identify regulations and/or
required amendments to the Town's Comprehensive Plan.
The Town's Task Force was timely assembled and has worked consistently to examine current safety
protocol standards and success rate in the application of new systems. Issues of public safety and risks
of fire incidents have been considered, including risks associated with equipment failure and/or human
error. The Task Force has also investigated equipment, personal safety gear and training. Additional
considerations of the Task Force include zoning classifications, separation distances, plant size,
minimum lot area, buffer requirements, lighting and security.
The Town Board wishes to be able to consider the proposals and recommendations of the Task Force,
Code Consultant and the State on these issues, including various alternatives to current zoning; as well
as implement public safety measures to insure the health, safety and welfare of the community. An
extension of the moratorium is necessary to complete this function. This extension is specific and
limited to BESS facilities only.
Given that the State's investigation is not yet concluded and the work of the Town's Consultant and
BESS Task Force is ongoing, the Town Board finds it necessary to extend the moratorium already in
effect, the terms of which remain unchanged and are set forth below. This action is necessary in order to
protect the character, public health, safety and welfare of the residents of the Town of Southold.
IL ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local Law shall
lapse and be without further force and effect and subject to any other Local Law adopted by the Town
Board during the twelve (12) month period, no agency, board, board officer or employee of the Town of
Southold including, but not limited to, the Town Board, the Zoning Board of Appeals, the Trustees, the
Planning Board , or the Building Inspector(s), issuing any building permit pursuant to any provision of
the Southold Town Code, shall issue, cause to be issued or allow to be issued any approval, special
exception, variance, site plan, building permit, subdivision, or permit for any use identified as a Battery
Energy Storage System (BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has,prior to the effective date of this Local Law, obtained all
permits required for such a facility and, relying upon such permission, has undertaken significant
development of such facility.
2) To any application by a municipal corporation or special district or fire district
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with the
provisions of Town Law this Local Law is intended pursuant to Municipal Home Rule Law to supersede
any said inconsistent authority.
V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in Town Law
section 267-b (2)(b), by reason of the enactment and continuance of this moratorium may apply to the

L Purpose
The purpose of this amendment is to ensure the Town's inclusionary zoning results in attainable housing being
built in new subdivisions. The change removes the option to buy out or provide other property or build
elsewhere, all options which have never been implemented, and have proven to not be practical.
§ 240-10 Technical requirements.
B. Yield plan.
(2) Standard subdivision. A yield plan shall be prepared for a standard subdivision in accordance with the
requirements of this section and shall include a requirement to provide affordable housing.
(c) Affordable housing requirement. Every new standard residential subdivision involving the creation of five
or more lots shall comply with the requirements herein to provide affordable housing
[1] Twenty percent of the lot yield as determined pursuant to § 240-1OB(2)(a) and(b) shall be set aside as
moderate-income family dwelling units (MIFDUs), as defined, created and administered under the
provisions of the Affordable Housing District, §§ 280-24 through 280-33 of this Code. Each MIFDU shall
be created subject to covenants and restrictions as set forth at§ 280-30 or through another mechanism
approved by the Town Board that will keep units perpetually affordable. The number of MIFDU units
required in a subdivision shall be rounded up to the next whole number if the fractional requirement is 0.50
or greater, and shall be rounded down to the next whole number if the fractional requirement is less than
0.50.

[32] Fee waiver. An applicant shall receive a waiver of all application fees, building permit fees, plan review
fees, inspection fees, park and playground fees and such other development fees and costs attributable to
the MIFDUs built in the subdivision. A waiver may not be granted for sanitary flow credits purchased
pursuant to the provisions of Chapter 117.
[43] Phasing of construction. The applicant shall provide to the Planning Board a phasing plan that provides for
the timely and integrated development of the affordable housing units as the subdivision is built out. The
phasing plan shall provide for the development of the MIFDUs concurrently with the market rate units.
Building permits shall be issued for dwelling units within the subdivision based on the phasing plan. The
phasing plan may be adjusted by the Planning Board when necessary in order to account for different
financing and funding environments, economies of scale, and infrastructure needs applicable to the
development of the market rate and the MIFDUs. The phasing plan shall also provide that the MIFDUs
shall not be the last units to be developed in the applicable subdivision.
[54] Exterior appearance. The exterior appearance of the MIFDUs shall be visually compatible with the market
rate units in the development. External building materials and finishes shall be substantially the same in
type and quality for MIFDUs and market rate units.
[65] Appeal. A developer of any project subject to the requirements of this chapter may appeal to the Town
Board for a reduction, adjustment or waiver of the requirements based upon the absence of any reasonable
relationship or nexus between the impact of the development and eithef the atnotmt of foe ehafged of the
inclusionary requirement.

Elect to Purchase/SEQRA -McCall Development Rights
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of the purchase of
a development rights easement on a certain parcel of property owned by McCall Family Holdings Limited
Partnership, LLLP on the 26 h day of March 2024, at which time all interested parties were given the
opportunity to be heard; and
WHEREAS, said property is identified as part of SCTM 41000-115.-7-13.2. The address is 19500 Route 25,
Mattituck, New York. The property is situated on the southerly side of Route 25, on the corner intersecting with
westerly side of Locust Avenue. The property is located within the Agricultural-Conservation (A-C) Zoning
District; and
WHEREAS, the proposed acquisition is for a development rights easement on part of the property, consisting
of approximately 14.76± acres (subject to survey) of the 16.79± acre parcel. The 2.03±-acre Reserve Area will
remain linked to, and be prohibited from being subdivided from, the area subject to the easement. The exact
area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and
the property owner; and
WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase price is
$71,000 (seventy-one thousand dollars) per buildable acre, estimated at$1,047,960.00 (one million, forty-seven
thousand, nine hundred sixty dollars) for the 14.76±-acre easement. Purchase price will be adjusted at time of
closing based on final survey acreage determination, plus acquisition costs; and
WHEREAS, the property is listed on the Town's Community Preservation Project Plan List of Eligible Parcels
as property that should be preserved due to its agricultural value; and
WHEREAS, the purchase of the development rights on this property conforms with the provisions of Chapter
17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review)
of the Town Code and Local Waterfront Revitalization Program ("LWRP") and the LWRP Coordinator has
recommended that this action is consistent with the LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition, and
recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold purchase the
development rights on this agricultural land; and,
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted Action pursuant to
the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and Regulations;
and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form for this project
that is attached hereto; now, therefore, be it
