September 27, 2023,Notice of Disapproval based on an application for a permit to construct an accessory in-ground
swimming pool,at; 1) located in other than the code permitted rear yard; located at 2240 Bay Shore Road, Greenport,
NY. SCTM9 1000-53-4-26.1.
RELIEF Ra1 'ESTED: The applicant requests a variance to construct am 18 feet by 44 feet accessory swimming
pool located in the side yard, where a rear yard location is required,
ADDITIONAL INFO RMA-'1`0'N! During testimony at the public hearing, the representative for the applicant stated
that the subject property was merged with the adjoining vacant lot to form the current tax lot. Merged lots 1000 53-
4-25 and 1000-53-4-26 formed tax lot 1000-53-4-26.1. There is a pre-C/O for the existing house and a subsequent
deck addition. The representative informed the Board that the pool equipment will be located in a conforming
location and that the dry well will be located west of the swimming pool.

The Zoning Board of Appeals held a public hearing on this application on December 7, 2023„ at which time written

and oral evidence were presented. Based upon all testimony, documentation,, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning, Board finds the following f-4 U 11 8A farts to be true a d
relevant and makes the following findings:
I. Town Law§267-1a b)(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties, Due to the shape of the lot,and the existing location of the house,
the pool cannot be sited in the rear yard. Many homes in the neighborhood have accessory swimming pools. The
accessory pool is proposed in the only feasible location, and with fencing and evergreen screening in the front will
not produce any undesirable change in the character of the neighborhood.
2. Town Law §267-b(3)(b)JD. The benefit sought by the applicant cannot be achieved by some method feasible
for the applicant to pursue,other than ail area variance. The lot is non-conforming, and the house is set to the side
of the lot, which leaves no conforming location for an accessory swimming pool due to rear yard setbacks.
3. L. The variance granted herein is mathematically substantial, representing I 00% relief
from the code. However, due to the recent merger of the lots, the: proposed pool will meet all required setbacks for a
principal structure. The pool will also be screened from the road with evergreens and will be open to above,

community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
