Telephone(631)765-1889 Fax(631)765-1823 Conservation Advisory Council Town of Southold MINUTES Wed., February 7, 2024 4:30 PM Conference Room and Zoom Online Platform A meeting of the Southold Town Conservation Advisory Council was held Wed., February 7, 2024 in the Town Hall Conference Room and via Zoom. Present were: Inga Van Eysden, Acting-Chairperson John Stein, Member Carol Brown, Member—Zoom Maggie Merrill, Member Shannon Wright, Member Jocelyn Kaelin, Student Member Brian Mealy, Town Board Liaison Liz Gillooly, Trustee Liaison Glenn Goldsmith, Trustee Lauren Standish, Secretary Absent: Caroline Burghardt, Chairperson John Chandler, Member Guests: Gwynn Schroeder, Gov. Liaison Officer Anne Murray, NFEC CALL TO ORDER Inga Van Eysden called the meeting to order at 4:30pm. NEW BUSINESS The CAC members congratulated Jocelyn Kaelin, a student from Southold High School, on her recent appointment to the CAC. 2 Moved by Maggie Merrill, seconded by Inga Van Eysden, it was RESOLVED to APPOINT Carol Brown as Vice-Chairperson to the Conservation Advisory Council for a 2-year term, effective immediately. Vote of Council: Ayes: All Motion Carried REPORTS Maggie Merrill attended a PEP/Sea Grant workshop on January 24th.which focused on the examination of process. They will be bringing the workshops to each municipality in the near future. Carol Brown will be attending a PEP Conference in Albany, an Education Day on the Environment. Carol Brown attended the Board of Trustees meeting held on January 17th. She educated the board on the importance of buffers and on the subject of tree removal. The DEC has recently updated their sea level rise data, and should be considered when reviewing future wetland permit applications. CLIMATE SMART COMMUNITIES John Stein met with Laura Arena in the Accounting Dept. to obtain information on PSEG usage as a pledge element. He also met with DPW to obtain information on the fleet maintenance emissions schedule. John expects to receive a compost report from Jim Bunchuck within the next 2 weeks. Inga Van Eysden thought it would be helpful if the group could review the pledge elements and them divide them up. Maggie Merrill is interested in working on pledge element#7. Carol Brown and Jocelyn Kaelin will work on the education component. APPROVAL OF MINUTES Moved by Maggie Merrill, seconded by John Stein to Approve the Minutes of January 10, 2024. RECOMMENDATIONS —WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Maggie Merrill, seconded by Inga Van Eysden, it was RESOLVED to NOT SUPPORT the application of BEN & CHRISTINA HANSEN to construct a two-story single-family dwelling with attached deck, driveway, sanitary system and well. 3 Located: 305 Narrow River Rd., Orient. SCTM#26-3-11 Inspected by: John Stein, Maggie Merrill, Inga Van Eysden The CAC does Not Support the application as submitted, due to the proposed location in a flood zone, the recent changes in sea level rise predictions, and the potential run-off from this project. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of 1460 THE STRAND LLC for a proposed 20'X 40' in-ground pool to be installed in rear yard with 4' wide patio surrounding. Install a 15' wide non-turf buffer planted with native, non-fertilizer dependent vegetation landward of the top of the bluff. Legalization of the stairs down the bluff along with the existing platforms: 4'X 6' platform at top of stairs, 14'X 6' platform, 14'X 5' platform, and a 23'X 8' platform. Located: 1460 The Strand, East Marion. SCTM#30-2-66 Inspected by: John Stein, Maggie Merrill, Inga Van Eysden The CAC does Not Support the application because the proposed pool is too close to the top of the bluff, and the setbacks are not in compliance with Ch. 275. The last step on the beach stairs should be retractable and parallel to the shoreline. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by Inga Van Eysden, it was RESOLVED to SUPPORT the application of DUNNE LIVING TRUST to remove TX 10' wood ramp, remove 102 If of existing wood bulkhead, and remove existing hot tub. Install 102 If. of new vinyl bulkhead in same location and raised 25" to match height of southerly adjoining bulkhead. Reclamation dredging may be required. Install approx. 65 If. of stone retaining wall at 2' above top of new bulkhead with approx. 10' return along southerly property line. Backfill area between new raised bulkhead and base of new retaining wall with clean fill. Establish approx. 40 If. of 10' wide vegetated non-turf buffer and approx. 60 If. of gravel non-turf buffer 10' wide to match width of southerly gravel non-turf buffer, Install approx. 280 sf. of blue stone patio. Backfill landward of new retaining wall with approx. 25 cy. of clean fill and re-seed. Remove three (3) trees. Replace ramp with existing or new aluminum ramp at discretion of owner, and BE IT FURTHER RESOLVED to NOT SUPPORT the application to install 12'X 18' in- ground pool (216 sf.) in approx. same location as removed hot tub. SCTM#35-4-11 Inspected by: John Stein, Maggie Merrill, Inga Van Eysden 4 The CAC does Not Support the location of the pool on the bulkhead, which is out of compliance with Ch. 275. Vote of Council: Ayes: All Motion Carried Moved by Inga Van Eysden, seconded by John Stein, it was RESOLVED to SUPPORT the application of DONALD J. & PAMELA E. SCHNEIDER to construct 6.5'X 11.5' one-story addition to existing 1,063 sf. one-story dwelling, construct 4'X 7' wood stoop and 4'X 4' Bluestone pathway in place of existing 62.2 sf. deck, stairs and walkway, construct 121.5 sf. raised wood deck with 4'X 6' steps in place of existing 72.7 sf. deck and steps, and reconstruct (in-place) existing 119.1 sf. raised deck; replace existing septic system with new I/A sanitary system located outside of Ch. 275 jurisdiction; install stormwater drainage system; and establish a 10' wide non-turf buffer with native vegetation along top of bank. SCTM#52-2-31 Inspected by: John Stein, Maggie Merrill, Inga Van Eysden Vote of Council: Ayes: All Motion Carried ISLAND VIEW LANE HOMEOWNERS ASSOC., LLC for the replenishment to the wash- over areas of the eastern beach to a height which minimizes or eliminates the current and future wash-overs. The replenishment should be as gravel (3/4") placed above cobble- sized (4") native stone in 12" deep gabion mats. Gravel will re-set the natural condition of the eastern beach and the gabion blanket beneath the replenished materials to allow it to last. Add a planting of American beach grass plugs down into the replenished sand/gravels. Located: HOA Beach Private Lane, immediately south of Bay Shore Rd. HOMAN to remove existing bluff stairway from east end of property and construct a new 4'X 45' timber bluff stairway on west end of property, consisting of a 4'X 2.5' entry steps and 4'X 6' entry landing, 4'X 32' steps, 4.5'X 6' landing, 4'X 4' steps, and 4.5'X 6' landing at top of bulkhead, with relocated 2.8'X 14' removable aluminum steps to beach; and use native plantings to restore areas of existing vegetation disturbed or lost during removal of existing stairway and construction of new stairway. Located: 4630 Blue Horizon Bluffs, Peconic. Remove existing plywood to top of 6"X 6" whaler, cut poles to top of pilings along 75 If. of bulkhead. Remaining low sill bulkhead to remain to keep soils landward from eroding and washing away Spartina Alterna flora. Remove existing plywood from existing vinyl bulkhead and add new vinyl sheets, whalers and conventional tie back system, or substituted helical at contractors' discretion to raise top of bulkhead to +6' elevation to match height of easterly adjoining bulkhead. Construct 11 If. return along easterly property line to connect to existing concrete block wall. Construct new 82 If. of vinyl retaining wall with a 17' seaward extension to connect to existing (raised) vinyl bulkhead and an 18 If. return along the westerly property line to end at grade. Construct new fixed walkway and relocated floating dock with ramp. Create 10' non-turf buffer seaward of the new retaining wall and landward raised vinyl bulkhead. All activity seaward of the dwelling is out of compliance with Ch. 275. No change on number of bedrooms, use or occupancy. Located: 1400 Salt Marsh Lane, Peconic. SCTM#68-3-2 Inspected by: Shannon Wright Vote of Council: Ayes: All Motion Carried MARK MONTIFIORE & LISA MONTIFIORE to renovate and add 416 sf. to the ground floor and 997 sf. to the second floor of the existing dwelling. Addition to the dwelling will increase the bedroom count from 4 bedroom to 5. Second floor will create a new bedroom and bathroom. Construction includes new roofing and siding, and the existing 596 sf. deck will be rebuilt and reduced in size to 477 sf. Proposed I/A septic system will replace a conventional septic system and the new well will be abandoned and new waterline will be run from the street. Located: 4452 Peconic Bay Blvd., Laurel. SCTM#128-4-22.1&22.2 Inspected by: Shannon Wright There is not enough information to make a determination. The CAC does not have a recommendation at this time. FISHERS ISLAND YACHT CLUB to maintain the existing 1,000 sf. sailing program float and two accessory floats and install four 4'X 20' floating fingers east side of the west floating main dock, and one fixed wood pile and timber finger pier off the west main pier, each with associated support, restraint and fender/tie-off piles. Located: Central Ave., Fishers Island. SCTM#10-1-9 The CAC did not make an inspection, therefore no recommendation was made. e 7 Shannon Wright will attend the Board of Trustees meeting scheduled for Wed. February 14, 2024. The next meeting of the Conservation Advisory Council is scheduled for March 13, 2024 at 4:30PM in the Conference Room.
