Dear Mr. & Mrs. Ottomanelli:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 17, 2024 regarding the above matter:
WHEREAS, JOSEPH & KRISTINA OTTOMANELLI applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated January 24, 2024,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: as-built 10'x15' patio located near
edge of wetlands to be removed and not replaced; seven (7) trees to remain; and
WHEREAS, a Public Hearing was held by the Town.Trustees with respect to said
application on March 20, 2024, and again on April 17, 2024, at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the project complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,"
RESOLVED, that the Board of Trustees APPROVE the application of JOSEPH &
KRISTINA OTTOMANELLI for the as-built 10'x15' on-grade irregular shaped bluestorie
dry-set patio located near edge of wetlands to be removed and not replaced; construct
an 18'x44' in-ground pool with a 1,845sq.ft. stone pool patio that has an outdoor kitchen
area; install a drywell for pool backwash; install ±483 linear feet of 4' high pool
enclosure fencing with gates; install a pool equipment area with evergreen screening;
install a 10'x12' pool house with a 4'x6' outdoor shower; install a buried 1,000 gallon
propane tank; install a generator; install a 4'x80' stone path to dock; all existing trees in
the buffer area to remain; and to establish and perpetually maintain an irregularly
shaped vegetated non-turf buffer area with a minimum distance of 25' along the
landward edge of wetlands using native vegetation; with the condition that seven (7)
trees remain; and as depicted on the site plan prepared by North Fork Pool care, last
updated on April 8, 2024, and stamped approved on April 17, 2024.
Permit to construct and complete project will expire three years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee Joseph&Kristina Ottomanelli 2223 Indian Neck Lane, Peconic,New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the.said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any.rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Southold Trustees,
We reside at 2221 Indian Neck Lane. Our neighbors at 2223 Indian Neck Lane,Joseph and Kristina
Ottomanelli, are applying for a permit to build a pool sited 15 feet from our property line. We are unable
to attend tomorrow evening's meeting in person, so we write with a heartfelt request that we hope will
be incorporated into the approval:
Currently, all the coniferous (evergreen)tree and bush screening at the property line between our two
houses is entirely on our property, 2221.There are no evergreen trees or bushes for screening
whatsoever on the 2223 side of the the property line. We planted all the bordering evergreen trees and
hedges at considerable expense and with sensitivity to indigenous species and to the wetlands.
We respectfully request that the Board attach to any approval for this new pool the requirement that
our neighbors(a)commit to planting a row of reasonably sized evergreen trees(minimum 6" caliper or
greater, if possible) on their side of the property line between their new pool, deck and ourselves and
(b) that they construct a 6'tall acoustic barrier with natural wood fencing facing our property along the
length of the new pool and deck area.
The pool will be extremely close to where we enjoy privacy, peace and quiet, and it would be hugely
beneficial to have plantings and acoustic barrier that will allow some sound and visual boundary that is
aesthetically pleasing and appropriate to preserving the more rural and less suburban feel of Southold
that we all cherish.
Please note that we are sending this to you having received no notice for tomorrow's hearing by certified
mail or otherwise.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, I recommend that the proposal is
INCONSISTENT with LWRP Policies and with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The as-builts were constructed without a Board of Trustee review or permit.
6.3 Protect and restore tidal and freshwater wetlands.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are
avoided.
1. Maintain buffers to achieve a high filtration efficiency of surface runoff.
2. Avoid permanent or unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
The removal of 7 trees does not meet this policy. Trees provide beneficial
functions and values in buffers (nutrient filtration, wildlife habitat, food source,
etc.)
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

At the meeting of the Southold Town Conservation Advisory Council held on Wed., March
13, 2024, the following recommendation was made:
Moved by Maggie Merrill, seconded by Carol Brown, it was
RESOLVED to NOT SUPPORT the application of JOSEPH & KRISTINA OTTOMANELLI
to legalize existing 10'X 15' on grade irregular blue stone dry set patio; construct 18'X 44'
proposed in-ground pool with drywell, stone pool patio with outdoor kitchen area, 10'X 12
pool house with 4'X 6' outdoor shower. Pool equipment behind pool house and 483 If 4'
high pool fence with two (2) 4' outswing doors and one (1) 8' outswing door. Install buried
1000 gal. propane tank and generator behind pool house. Remove seven (7) trees that
are either dead or dying or too close to the proposed pool. Establish a 10' vegetated non-
turf buffer north of the fixed dock. The area southerly of the fixed dock to remain treed and
a non-turf area.

Yes it would be for the patio. Legalizing the existing structure will require as-built fees as the original structure was a
deck in a different configuration when the house was constructed. It appears that the deck was removed and a patio
was constructed within the past+/-6 years and now you are requesting to legalize it.

In reviewing your project description I see you are asking for a permit for as-built structure(s). Due to this request as-
built fees are due. Please submit a check for$1,250.00 at your earliest convenience.
Also,there is a proposed path to the dock on the plans. Please email me the details/dimensions of said path so that it
can be added to the application.
The plans do not show top/bottom of bank which need to be depicted as the Board will take jurisdiction from top of
bank. If the wetland boundary line is not top of bank all setback lines need to be adjusted and the plans do not show the
100'from top of bank which needs to be added.
Please have the dry well for the pool be labeled as such. There is a dry well seaward of pool, but it does not have a
specific call-out for the pool so it is not clear if that is for the pool.
In order to be considered for the March Hearings the above requested needs to be submitted by end of day Wednesday,

I was a very close friend of Michael Kimack, with whom I trust you are familiar. Sadly,'
Michael passed away on March 17th, the day before he was scheduled for triple-bypass
cardiac surgery. I had visited Michael at South Shore University Hospital the previous day,
having at his direction retrieved the enclosed three (3) proof of mailings from his home for
his signature. The plan was that I would bring then to attorney Brian Andrews today,who I
was informed is very familiar with Mike's signature and would acknowledge the three as a
Notary Public, and then drop them off at your office. Michael was very concerned that
these be timely submitted in advance of tomorrow's hearing, for he wished to avoid his
clients incurring any further delays. In some respects, to the best of my knowledge, this
was my friend's last annunciated dying wish.
is light of Michael's untimely and completely unexpected demise, Mr.Andrews was
understandably disinclined to notarize the forms. Is any case, I wish to leave them inyour
hands and to your discretion of whether your will waive the technicality and accept the
documents.

assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other'ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt

Waterfront Revitalization Program. A proposed action will. be evaluated as to its sinifcant
beneficial and adverse effects.upon the coastal area(which includes all of Southold Town).
