We would like to voice our opposition to the application submitted by DHC Land, LLC for a dock permit. Having the Peconic Land Trust be able to conserve the farm has been a win for all concerned. However,with a commercial Oyster Farm Business being planned and developed,we now have not only the land but the waterway to be concerned about. We have lived here for over 50 years and our neighbors and ourselves have seen the many changes of not only the area but of the erosion happening around Deep Hole Creek. A dock of these proportions is not in keeping with the surrounding landscape and in our opinion should not be approved. Project includes the construction of a 4'wide x 150' overall length fixed pier consisting of a 4'x 6' upper platform,4'x 26'steps,4' x 112'fixed pier and steps down to a 6'x 20'fixed pier T-section.All decking to be thru-flow for entire structure,electric and water service to be provided to end of pier. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with LWRP Policy 11.6 and, therefore, CONSISTENT with the LWRP; which states: 11.6 Promote aquaculture. Aquaculture is a desired water-dependent use in Southold. Aquaculture of economically important species can not only provide additional economic opportunities, it can relieve pressure on and enhance wild stocks that may be adversely affected by pollution, loss of habitat, over-fishing, or other factors. Aquaculture is encouraged for the purpose of restoring native stock and reseeding the creeks and bays; with the primary objective of providing for local economic opportunities, both commercial and recreational in nature, but at a scale appropriate for the resource itself and the marine environment in which the operation is located. The siting of aquaculture facilities within inland portions of creeks should take into account and mitigate negative environmental impacts on the native ecology. The placement of aquaculture facilities within open waters also should be sited so that existing fishery resources are not negatively impacted. More specifically, the effect on finfish of the loss of habitat resulting from aquaculture operations should be a major consideration in any leasing program within the Peconic Bays. Finally, the Town supports the continued activities of the Plock Shellfisher Preserve and the Suffolk County Marine Environmental Learning Center at Cedar Beach County Park in the area of promoting sustainable aquaculture. A. Encourage and promote aquaculture of economically important species. B. Protect native stocks from potential adverse biological impacts due to aquaculture. Biological impacts to be addressed include direct displacement, competition, introduction of disease, exposure to antibiotics, animal wastes, and potential loss of genetic integrity as well as loss of habitat. The proposed dock to facilitate, encourage, and promote aquaculture supports this policy. The following is recommended to preserve the ecology and health of Deep Hole Creek: 1. Prohibit CCA or other harmful treated wood products in design. This will reduce potential bioaccumulation in shellfish species. 2. Create and maximize non-disturbance buffers from the top of the bank, landward, to protect water quality. Incorporate the existing vegetation with the buffers. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The applicant proposes to install a large 161'fixed pier with accompanying T-shaped fixed pier, upper platform, steps, ramps and davit arm for hoisting materials and crates.This type of construction is far in excess of the neighboring docks and will present itself as a large commercial intrusion into an otherwise quiet and serene residential creek. The proposed use will likely involve the operation and long-term overnight storage of large commercial vessels capable of transporting and hoisting large crates, totes and other commercial aquacultural gear. These types of commercial fishing craft are not presently found within Deep Hole Creek and will radically alter the nature and character of this environmentally sensitive area. The davit hoists and ramps proposed are indicative of the applicant's need to move large volumes of material in and out of the creek.The noise, odors and other related disturbances created by these commercial activities are incompatible with the adjoining residential uses. Opening sensitive creeks to these types of for-profit uses creates a hazardous precedent for other commercial and industrial development and should be rejected by both the Trustees as well as the Town Planning Board. To be clear, I am not objecting to DHC's right to build a residential dock,just the commercial features of the dock. The applicant—DHC Land—advises that they intend to operate a commercial oyster farming facility on the premises—an aquaculture facility- and have requested to build non-residential features on their dock- namely a 4x26 ramp on the bluff, a platform, and a davit on the dock. The ramp is in addition to the set of stairs, so they are proposing an 8 foot wide disturbance on the bluff in order to accommodate commercial oyster farming operations. However, they have not yet obtained site plan approval from the Planning Board to operate an aquaculture facility on the premises, as required by the Town Code. Southold Town Code §280-13 A. (7)provides that land based aquaculture facilities are a permitted use, so long as they meet the following standards: (a) The land-based aquaculture operations shall be on a parcel that is at least seven acres, owned by the land-based aquaculture operator. (d)Any land-based aquaculture operation shall be entitled to a retail area not more than 10% of the gross floor area of the structure in which the land-based aquaculture takes place for the direct marketing of its products. Because the applicant has not received site plan approval from the Planning Board to operate a land based aquaculture facility, I do not believe the Trustees should grant those aspects of the application seeking features to be used in the operation of an aquaculture facility. I have no objection to DHC building the proposed dock without the commercial features of the dock such as the ramp and the davit. In addition, it is important to note that the applicant may not receive approval from the Planning Board to operate an aquaculture operation at the premises. Although it is a single lot of approximately 14 acres, it is my understanding that only about 2 acres can be built on, or used for anything other than farming. The site was acquired from the Peconic Land Trust and approximately 12 acres contains restrictive easements, which I understand, prevent the 12 acres from being used as an aquaculture operation. Therefore, the applicant intends to "squeeze" its operation onto a 2 acre site, not a 7 acre site as required by § (e) above. Indeed, the intent behind requiring aquaculture facilities be located on at least 7 acres was to ensure that aquaculture operations were not located in a residential neighborhood. Deep Hole Creek is a residential neighborhood with most houses on .25 acre to a .5 acre lots. It is the exact type of neighborhood that §(e) was designed to protect from commercial operations, and for this reason, I do not believe the Planning Board will approve the site's use for aquaculture. I am also concerned that the applicant will seek to use any approval by the Trustees of commercial dock features as an argument to the Planning Board that the "Trustees approved aquaculture" at the site. I have received calls from several of my neighbors about this application and they are all extremely upset about the prospect of a commercial oyster farming operation being operated out of a residential creek. But for the fact that many residents do not have notice of the application and are in Florida, I believe there would be at least two dozen letters such as this one. For these reasons, I urge you to modify the application to only allow non-commercial features (no ramp, no davit, etc.), and wait to see if the Planning Board ever grants site plan approval. In addition, to the extent that the Trustees are even considering granting the commercial features of the dock, I think that they should provide the residents of the creek additional notice to weigh in on this matter.
