Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 20, 2024 regarding the above matter:
WHEREAS, EN-Consultants on behalf of NEAL & LISA ELKIN applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated February 2,
2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP due to noncompliance to Chapter 275 of the Southold
Town Code, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the use of a silt boom during
construction the establishment of a 10' wide non-turf buffer along the landward edge of
the existing sand and filter cloth; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 20, 2024, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of NEAL & LISA
ELKIN to construct an "angled U-shaped fixed timber dock (constructed with open-
grate decking and equipped with water and electricity), consisting of a 4' x 66' fixed
timber catwalk and angled 4' x 10' terminal platform (with ladder); and establish a 10-
foot wide vegetated non-turf buffer in place of existing sand and filter cloth; and as
depicted on the site plan prepared by EN-Consultants, received on March 20, 2024, and
stamped approved on March 20, 2024.
Permit to construct and complete project will expire three years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee NEAL& LISA ELKIN 105 Fleetwood Road Cutchogue,New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

electricity), consisting of a 4'x64' fixed timber catwalk and a 4'x10' terminal platform (with ladder).
Located: 105 Fleetwood Road, Cutchogue. SCTM# 1000-137-4-8
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, I recommend that the proposal is
INCONSISTENT with LWRP Policies and with the LWRP.
The proposed action is located within a New York State Department of State Significant Fish
and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic
Estuary Critical Natural Resource Area.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the LWRP and listed policy standards provided below..
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions
The applicant fails to prove that the action meets the following requirements § 275-11 Construction
and operation standards C. 2 (d) of the Southold Town Code:
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife
habitats;
The proposed action is located within a New York State Critical Environmental Area. At the
discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-
2) may be subject to more stringent requirements than detailed in this section. Such requirements
may include, but are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width of non-disturbance buffers. It is recommended that in the event
the action is approved, a significant non-disturbance buffer encompassing the wetland vegetation
be established to mitigate the local impacts from the dock structure.
[11] Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the dock
will minimize cumulative impacts; and
The construction method has not been identified. § 275-11 Construction and operation standards
requires that all intertidal construction and excavation employ the installation of a silt boom that will
retain all suspended sediments within the immediate project area.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge
of waste and rubbish, electrical service and water service.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Attached for the Trustees review at their work session today is a revised project plan for Elkin,which depicts a slightly
relocated and reconfigured dock and a 10-foot wide vegetated non-turf buffer in place of a portion of the existing sand
area adjacent to the wetlands. You'll note that the overall length of the catwalk increased by 2 feet on its landward end due
to its reorientation,resulting in a total length of 66 rather than 64 feet.
If the Board finds that this plan conforms to what they had in mind with respect to the changes discussed during field
inspections,I will provide you with a revised project description tomorrow,so please let me know.

The proposed dock is located along a developed shoreline surrounded by numerous Trustees-approved
dock structures to the west,east and north, including an "L"-shaped floating dock on the adjacent property
to the east(Wetlands Permit No. 7041,2009); a fixed dock structure located two properties to the west
(Wetlands Permit No. 3671, 1988); a"T"-shaped floating dock located directly across the creek to the
north(Wetlands Permit No. 8940, 2017); and an "U-shaped floating dock located three properties to the
east(Wetlands Permit No. 7584,2011). There is also a floating dock with no apparent permit record
located three properties to the west.
Compliant with Town Code Section 275-11(C)(2)(b)(2),the proposed dock and associated watercraft
having a maximum berth of 7 feet would encroach upon no more than approximately 29 feet or one-third
of the approximate 88-ft width of the waterway. The proposed seaward extent of the dock is also
consistent with Section 275-1 l(C)(2)(c)(1)(c)with respect to existing pier lines. Due to the narrow,
approximately 30-foot width of the parcel's shoreline, it is not possible to maintain a 15-foot clearance
from the laterally extended property lines pursuant to Section 275-11(C)(2)(a)(5). Therefore, given the
Trustees' discretion to allow for different clearance based on"navigational or other reasons,"the dock's
location and alignment have been specifically designed to optimize separation distances from the nearest
dock to the east,whose watercraft need not travel west and in front of the proposed dock to dock or
launch from that structure; and from the waterfront of the adjacent property to the west, so as not to
interfere with the neighbor's access to waters or potential dock construction on that property.
The dock design is otherwise consistent in all ways with the Trustees'policies and the "construction and
operation standards" for docks set forth by Town Code Section 275-11(C)(2). For example, because the
dock cannot reach 30 inches of water depth within the above referenced waterway encroachment
limitations, an"U-shaped fixed dock is proposed to avoid potential bottom disturbance by a float; and
the entire dock structure will be constructed with untreated, light-penetrating, open-grate decking and
elevated at least 4 feet above the grade of vegetated wetlands to allow tidal marsh vegetation to continue
growing beneath it.
For all the reasons stated above, the proposed dock would not adversely impact navigation; create a
"fragmentation of ecological communities" along the developed shoreline; result in the physical loss,
degradation, or functional loss of ecological components; or otherwise adversely impact the adjacent tidal
wetlands or surface waters of Eugene Creek.

l, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town,of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig f cant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

The proposed dock is located along a developed shoreline surrounded by numerous Trustees-approved dock stuctures to the west,east
and north, including an "L"-shaped floating dock on the adjacent property to the east(Wetlands Permit No. 7041,2009);a fixed dock
structure located two properties to the west(Wetlands Permit No. 3671, 1988);a"T"-shaped floating dock located directly across the
creek to the north(Wetlands Permit No. 8940,2017);and an"L"-shaped floating dock located three properties to the east(Wetlands
Permit No.7584,2011). There is also a floating dock with no apparent permit record located three properties to the west. Thus,
consistent with Policy 3,the dock would be harmonious with the visual quality of the surrounding environs.

The proposed dock is located along a developed shoreline surrounded by numerous Trustees-approved dock stuctures to the west,east
and north. Because the dock cannot reach 30 inches of water depth within the seaward encroachment limitations allowed by code,an
"U-shaped fixed dock is proposed to avoid potential bottom disturbance by a float. And the entire dock structure will be constructed
with untreated,light-penetrating,open-grate decking and elevated at least 4 feet above the grade of vegetated wetlands to allow for tidal
marsh vegetation to continue growing beneath it. Thus, consistent with Policy 6,the project would not create a"fragmentation of
ecological communities"along the developed shoreline;result in the physical loss,degradation,or functional loss of ecological
components;or otherwise adversely impact the adjacent tidal wetlands or surface waters of Eugene Creek.

Compliant with Town Code Section 275-11(C)(2)(b)(2),the proposed dock and associated watercraft having a maximum berth of 7 feet would
encroach upon no more than approximately 29 feet or one-third of the approximate 88-11 width of the waterway. The proposed seaward extent of the
dock is also consistent with Section 275-11(C)(2)(c)(1)(c)with respect to existing pier lines. Due to the narrow,approximately 30-foot width of the
parcel's shoreline,it is not possible to maintain a 15-foot clearance from the laterally extended property lines pursuant to Section 275-11(C)(2)(a)(5).
Therefore,given the Trustees'discretion to allow for different clearance based on"navigational or other reasons,"the dock's location and alignment
have been specifically designed to optimize separation distances from the nearest dock to the east,whose watercraft need not travel west and in front of
the proposed dock in order to dock or launch from that structure;and from the waterfront of the adjacent property to the west,so as not to interfere
with the neighbor's access to waters or potential dock on that property. Therefore,consistent with Policy 9,the proposed dock would not adversely
impact navigation or otherwise affect the public and recreational use of Eugene Creek.
