PROPERTY FACTS/DESCRIPTION: The applicant's property is located at the northerly end of Summit .Lane. T]re lot is shown as Lot.11 on the Map of Summit Estates,Section 2, and is,presently improvcd with a foundation (see Building Permit 28558-z which authorized commencement" of construction for a new house with a setback of 40 ft. from the front property line at its closest point). BASIS OF APPLICATION: Building Department's. September 27, 2002 Notice of Disapproval which stopped work regarding Building Permit 28558-z for a foundation at less than 40 feet from the,front property line. FINDINGS OF FACT The.Zoning Board of Appeals held a public hearing on this application on December 12, 2002, at which time written and oral evidence were presented. Based upon an testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The relief requested is 2.4 feet within a front yard area for an "as built"' foundation, located at 37.6' instead of 40' from the front line at its closest point (see survey updated September 20,2002 prepared by Young& Young, L.S.) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is primarily being developed with new homes 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than a variance. The property is a non-conforming lot i ' consisting of 30,000 square feet in a R-40 district. The,alleged difficulty,has been self-created and is related to errors in measurements by the applicant. 6. No evidence has been submitted to suggest that thel relief granted willhave an adverse impact on physical or environmental conditions in the neighborhood. &, Grant of tbeM1 reque sted relief is the minimum necessary,and adequate to enable the applicant td enjoythe benefit of anew foundation for a house, while preserving and protecting the character of the neighborhood and the.health, safety and welfare of ` the community. The response to Mr. Boufis' query and the justification for the connector bracket is as follows: The purpose of the prefabricated Simson, or equal, rafter connector at the ridge beam is to reduce the possibility, and probability, of the roof from being split apart or lifting at the center from internal wind pressure as well as the positive verse negative external wind pressure due to high winds. In essence, the connector aids in maintaining the I� ridge and rafter connector as a single compression unit when upward pressure creates a positive pressure at the interior of the attic or roof framing. This "device" does not eliminate the collar tie which serves a similar but different static load transfer device and is.therefore not redundant.
