HomeMy WebLinkAboutLP-02/06/2024 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, February 6, 2024 at 7:00 p.m. This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York. The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not have access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. Committee Minutes and Administration • Acceptance of LPC meeting minutes from January 9, 2024 MOTION made by Sam McCullough, seconded by Anne Murray, to accept the January 9, 2024 LPC meeting minutes. Motion carried: 4/0 (Eric wasn't present for the vote) • Next LPC Meeting Date: February 20, 2024 General Preservation • Chapter 70 —Status Update from 1/30 Town Board Work Session Lilly gave a brief summary of the January 30, 2024 Town Board work session discussion of Chapter 70. Board Member Greg Doroski, the new Agricultural Committee liaison, relayed that the Agricultural Committee's priorities include revised Chapter 70 to allow agricultural processing and retail on easement areas, and for the Board to take a position against enhanced easements that limit uses to food production. The Board discussed the need to review the Land Preservation and Agricultural Advisory Committees' past recommendations to decide how best to proceed. Committee members questioned when they would receive draft code for review. Lilly stated that, while the Town Attorney drafted Code revisions, that Code is not ready for Committee input because (1)the draft requires significant revisions, and (2)the Board has not yet decided how it will proceed. Lilly reaffirmed that both Committees will have an opportunity to review draft Code when appropriate. • Draft Open Space Guidelines Due to time constraints, the Committee tabled the discussion of open space acquisition guidelines for a future meeting. Lilly invited Committee members to review the draft guidelines and maps she previously distributed to determine if they need any further resources. Inquiries/Applications for Uses or Structures on Preserved Property • None Stewardship and Management • Treiber Farms LLC SCTM# 1000-69.-1-9.1 —Artist Residency and Proposed Art Walk (Follow Up from 11/28/2023 Meeting) The Committee reviewed notes and photos from the Land Preservation Committee members' February 2, 2024 site visit. The Committee discussed the uses observed during the site visit, including sculpture placements,aquacultural equipment storage, and on-farm composting, as well as uses displayed on social media, including on-farm special events, an artist residency, and a proposed art walk. The Committee reached agreement on whether all but one observed use constituted easement violations. Committee members disagreed on whether the placement of sculptures on the easement area was inconsistent with the easement's terms. Some Committee members asserted that the sculptures were clearly not related to agricultural production, and they expressed concern that allowing such use would be a slippery slope to further easement violations. Other Committee members asserted that the Committee has in the past allowed some private recreational use of the easement area, provided that use does not interfere with agricultural production. The Committee declined to pass a motion regarding any violations until they consult with the Town Attorney and Land Preservation Counsel. • General Monitoring Status Update Lilly provided an overview of the status of monitoring on Town development rights easements. The Town holds 162 development rights easements total, including 13 easements in partnership with NRCS, 24 easements in partnership with the State, and 125 easements with no funding partner. The Land Preservation Department will develop a plan to monitor Town easements, and Lilly requested that the Committee members provide their general availability monitoring duties. The Committee discussed monitoring priorities, including easements with complaints or violations and new owners since their last monitoring. While the NRCS- and State grant-funded easements have set monitoring schedules, the Committee suggested that the Department create a staggered monitoring schedule over three years for easements held solely by the Town, meaning roughly 1/3 of the easements would be monitored each year. Motion carried: 5/0 The LPC members entered into EXECUTIVE SESSION at 7:59 p.m. Meeting locked. o Lillian McCullough, Land Preservation Executive Assistant, gave updates on inquiries, new applications, appraisals and current applications. MOTION made by Eric Keil, seconded by Sam McCullough, to exit Executive Session. Motion carried: 5/0 EXECUTIVE SESSION ENDED at 8:22 p.m. Land Preservation Applications & Potential Applications -OPEN SESSION MOTION made by Eric Keil, seconded by Anne Murray to recommend to the Town Board that the Town commission an appraisal, for Application Number 2023-4, for the purposes of providing the market value of a development rights easement on all but 2.99±acres of the property, in accordance with a design as discussed by the Land Preservation Committee while in Executive Session, whereby the 8.59±acres will be prohibited from being further subdivided from the land subject to the easement and will remain linked to the larger parcel.
