PROPERTY LOCATION: 3660 Fox Ave/Ave. B, Fishers Island, & Fox Ave, Fishers Island SCTM# 1000-6-2-17.3 and newly merged lots 1000-6-2-18 and 1000-6-2-17.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 27, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property consists of SCTM No. parcels 1000-6-2-17.2, 1000-6-2-18, having been merged by deed, is nonconforming and measures 62,895 sq. ft.; and 1000-6-2- 17.3 is a nonconforming lot measuring 69,427 sq. ft. All lots are split zoned parcels located in an LB Zoning District and R-80 Zoning District. The combined parcels measure 508.00 feet along the westerly property lines, 96.11 feet along the northerly property lines, fronting Avenue B, 194.00 feet, a total of 600.28 feet along the easterly property lines and a total of 303.21 feet along the southerly property lines fronting Fox Avenue. SCTM No. 1000-6-2-18 parcel is improved with a building that consists of a shop and a residence as shown on survey prepared by Craig P. Bigger, LS, last revised June 26,2023. ADDITIONAL INFORMATION: Comments from the Southold Town Planning Board were requested by the Board of Appeals and received on January 31,2024 stating that the Planning Board considered the split zones, parcel location, surrounding community character,existing build-out, and location of structures and vegetation on the parcels and is not opposed to the proposed action. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-14 and the Building Inspector's October 12,2023 Notice of Disapproval based on an application for a lot line change(and merge lots);at; 1)proposed merged lots, 17.2 and 18,are less the code required minimum lot size of 80,000 square feet; 2) proposed merged lots 17.2 and 18 are less than the minimum lot depth of 250 feet; 3)proposed lot 17.3 is less than the code required minimum lot size of 80,000 square feet; 4)proposed lot 17.3 is less than the minimum lot depth of 250 feet; located at: Fox Avenue, 3660 Fox Avenue, Avenue B, Fishers Island, NY. SCTM No. 1000-6-2-17.2, 6-2-17.3 &6-2-18.1 RELIEF REQUESTED: The applicant requests variances for a lot line change that will result in two existing non-conforming lots to remain as non-conforming lots. However,the lots will have different non- conforming dimensions than the current non-conformity. Proposed lot 1000-6-2-17.3 requires a minimum lot size of 80,000 square feet and lot depth of 250 feet. Following the proposed lot line change this lot will be non-conforming measuring 53,081 square feet with a lot depth of 194 feet. Proposed lot 1000-6-2-17.2 and 1000-6-2-18 (merged by deed) requires a minimum lot size of 80,000 square feet and lot depth of 250 feet. Following the proposed lot line change, this lot will be non- conforming measuring 62,895 square feet with lot depth of 193.16 feet. Additionally,the proposed lot line change is contingent on lots 17.2 and 18 being properly merged and registered with the Clerk of Suffolk County and the Town of Southold. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 12023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1.Town Law X267-b(3)(b)(1). Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed lot line change squares off lot 18/17.2 and removes the flag area of lot 17.3. Each of the proposed lots has road frontage and the proposed transfer does not amend the Limited Business or Residential zoning districts on these split zoned parcels. Therefore,the proposed lot line change will not result in loss of access or functionality. Combined lot 17.2 and 18 is improved with an existing residence and shop.The lot line change will not be discernable and therefore will be an improvement on the character of the neighborhood. 2.Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Neither of the split zoned subject lots conforms to current zoning or meets the needed square footage to maintain two lots under current zoning. Any proposed lot line change will require the benefit of variance relief. 3. Town Law X267-b(3)(b)(3). The variances granted herein for the non-conforming lot size of proposed merged lots 1000-6-2-17.2, 1000-6-2-18 and a portion of 1000-6-2-17.3 is mathematically substantial, representing 21.5%relief from the code. The variances granted herein for the non-conforming lot depth of the proposed merged lots is mathematically substantial, representing 23% relief from the code. The variances granted herein for the non-conforming lot size of proposed lot 1000-6-2-17.3 is mathematically substantial, representing 34% relief from the code. The variances granted herein for the non-conforming lot depth of proposed lot 1000-6-2-17.3 is mathematically substantial, representing 22.4% relief from the code. However,the proposed lot line change makes the lots more symmetrical than the current layout and lots 1000-6-2-17.2, 1000-6-2-18, and a portion of 1000-6-2-17.3 becomes less nonconforming to code. 4. Town Law 4267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. a Page 3, February 15,2024 #7873,Z&S Contracting, Inc. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Datites,seconded by Member Lehnert, and duly carried,to GRANT the variances as applied for, and shown on a survey prepared by Craig P. Bigger L.L.S., last revised June 26,2023. SUBJECT TO THE FOLLOWING CONDITION: 1) The lot line change requires approval from the Southold Town Planning Board. PROPERTY FACTS/DESCRIPTION: The entire area within which the three"parcels exist as single and separate parcels consists 2.12 acres, with frontage along Avenue B and Fox Avenue. The property is improved with existing buildings as shown on the 3/28/03 survey prepared by Richard H. Strouse, L.S., as updated 2/6/07 for the proposed change In boundary lines of the parcels. BASIS OF APPLICATION, Zoning Code Section 280-114, based on the Building Inspector's April 9, 2007 Notice of Disapproval concerning proposed re-arrangement of lot lines for three existing nonconforming lots. The rearrangement of lot lines will change the size of nonconforming lots. Land area shown as #14 with an existing dwelling will be Increased In size, Lot 15 with an existing dwelling will be increased in size. Land area shown as 17.1 will be reduced In area to 69,428+/- square feet. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 2, 2007, at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting variances for rearrangement of lot sizes, modified at the boundary lines with an adjoining parcel, without creating any new building sites. The lands are located in zones R40, R80,and partly In LB. i Page 2—August 16,.2007 ZB File No.6043—Alfred B.Grebe, CM No.6-2-14,15,16&17.1 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No new building site Is being created, and the owner is merely altering his boundary line with an adjoining owner. The applicant wishes to increase the square footage of two lots (#14 and #15)to make them less non-conforming, and to decrease the square footage of lot#17.1 to make It slightly more non conforming, without creating any other lot and reference to a former lot#16 will no longer exist. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcels are located in different residential zone districts(R-40, R-80)and the LB district zone to the south(17.1). 3. The variances granted herein are not substantial. The variance will allow Lots 15 and 14 to become more conforming by including a portion of adjacent land, and Lot 17.1 less conforming, without creating additional building lots. 4. The difficulty has been self-created. The nonconformity of the three parcels existed prior to the creation of the R-40, R-80 district lot size requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse Impact on the physical or environmental conditions in the neighborhood. Grant the variance stating that lot 14 would become less nonconforming from 10,000 square feet to 11,786 square feet of total lot size, and less nonconforming from 101 feet in width to 117 feet in width.The nonconforming depth of 74 feet will remain. Lot 15 becomes less nonconforming from 8,926 square feet to 11,029 square feel;width from 75 feet to 83 feet' and depth from 100 feet to 120 feet. Lot 16 will no longer exist because it was merged with the adjacent lots noted above; no new lot will be created. Lot 17.1 will change from Its present nonconforming size of 71,025 square feet to 69,428 square feet. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of lot size modifications, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman,and duly carried,to Grant the variance, as applied for, according to the survey submitted by CME Associates Engineering, dated 3/08107, revised by Richard H. Strouse, L.S.on 2/6107.
