Jr., Member Madeline Brisotti, Junior Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS None REPORTS None APPROVAL OF MIN UTES Moved by Don Wilder, seconded by Tom Schlichter to Approve the Minutes of September 23, 2003. 2 DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder. seconded by Drew Dillingham, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the YVetland Permit application of ROSEMARY AVOLESE for an as-built split-rail fence along the south line of the proPerty (right of way). Located: 4270'Wunneweta Rd., Cutchogue. SCTM#111-14-25 Vote of Council: Ayes: All Metien Cai'ried Moved by Drew Dillingham, seconded by Tom Schlichter, it was RESOLVED to TABLE the Wetland Permit application of RICHARD HEFFERNAN to remove the existing 30'X 30' two-story frame dwelling and 15'X 30' deck. Construct a new 38'X 42' two-story frame dwelling and 33'X 31' wood deck and 20'X 22' detached garage. Remove the existing septic system and install a new septic system approx. 140' landward of the AHW. Located: 730 West Shore Dr., Southold. SCTM#80-1-48.1 The CAC Tabled the application because the project was not staked. Vote of Council: Ayes: All Motion Carried PAUL TOMBARI to rebuild an existing timber pile bulkhead including thirteen new bulkhead support pilings, remove one boulder, construct a new 75 sf. of fixed deck and install a new 12'X 30' float with an associated ramp. Also install a new 6'X 20' "L" float on an existing floating dock system all waterward of the apparent high tide line. Located: The Gloaming, Fishers Island. SCTM#10-10-1 The CAC did not make an ~nspection, therefore no recommendation was made. LEONARD ORR to remove one of two fixed wood pile and timber piers, 80 (+/-) If. X 7' wide. Reconstruct the remaining 80 (+/-) If. X 7' wide fixed wood pile and timber pier and replace an existing float with a new 8'X 20' float waterward of the apparent high water line. Located: Private Rd., Fishers Island SCTM#-4-7-14 The CAC did not make an nspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Tom Schlichter it was 3 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of STEPHEN A. CUBELLS to cut phragmites to 12" and maintain phragmites at 12" height. Located: 2475 BayAve., Mattituck. SCTM#144-4-5 The CAC recommends Disapproval of the application because cutting the phragmites would be destroying the wetlands. Vote of Council: Ayes: All Motion Carried rMOVed by Drew Dillingnam, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of WILLIAM W. ARCHER to raise the existing residence, construct a new foundation, infill corner of footprint with new one-stow addition, new Second floor oger existing, new siding, roofing, windows, and DISAPPROVAL of the proposed location of the sanitary system. Located: 855 Kimogenor Point Rd., New Suffolk. SCTM#116-6-24.1 The CAC recommends the septic system be moved to the east side of the house. Vote of Counci!: Ayes: All Motion Carried Moved by Don Wilder, seconded by Drew Ditlingham, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of HENRY VON ELM to construct a second-story addition, enclosed screen porch, and foyer to the existing single-family dwelling. Located: 3534 Peconic Bay Blvd., Laurel. SCTM#128-6-5 The CAC recommends Approval of the application with the condition that a 20' non-turf buffer and swale is installed in order to prevent run-off from lawn chemicals. ~/ote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Drew Dillingham, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of SETH & BARBARA EICHER to repair the exiSting wood stairs on the bluff and repair the existing deck. Located: 17915 Soundview Ave., Southold. SCTM#51-1-6 NOTE: All other proposed activities are beyond 100'. 4 The CAC recommends Approval of the application with the Condition the stairs are repaired inkind/inplace, and there is no disturbance to the bluff, which will cause present or future damage to the bank. The CAC recommends Disapproval of the use of CCA ~treated wood. Vote of Council: Ayes: All .Motion Carried ~. KEVIN &ALEXANDRA R. O'MARA request a Wetland Permit to construct beach !stairs fr,o.m top of bluff to beach and plant beach grass and other plants on bluff. '.LoCated. 14345 Oregon Rd., Cutchogue. SCTM#72-2-2.1 The CAC did not make an ~nspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Drew Dillingham, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of WILLIAM & MARY STEELE for a 12'X 28' expansion to the rear of the existing dwelling and to change the roof contour to provide full dormers. Located: 1895 Leeton Dr. Southold. SCTM#58-2-10 The CAC recommends Approval of the application with the Condition that no construction should take place, which reduces the distance to the wetlands. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Drew Dillingham, it was RESOLVED to recommend to the Southold .Town Board of Trustees DISAPPROVAL of ~he Wetland Permit application of JOHN DEGENNARO to remove eight trees and clear land of brush for re-planting with salt tolerant trees. No soil will be added or removed. Located: 2213 Indian Neck Lane. Peconic. SCTM#86-5-10.1 The CAC recommends Disapproval of the application because the disturbed areas should be restored to the previous condition. Vote of'Council: Ayes: All Motion Carded Moved by Don Wilder, seconded by Drew Dillingham, it was 5 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOANNE WOODLE to remove trees and brush and replant area with salt tolerant trees and brush. Located: 2025 Ir~dian Neck Lane, Peconic. SCTM#86-5-9.4 The CAC recommends Disapproval of the application because the disturbed areas should be restored to the previous condition Vote of Council: Ayes: All Motion Carded PAUL JESELSOHN & FRANCIS DEBOIS to demolish an existing single-story dwelling and construct a new two-story dwelling within the existing footprint. Located: 55 Bay Ave., Greenport. SCTM#43-4-45 The CAC did not make an inspection, [herefore no recommendation was made. Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Tow~ Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JAMES N. GEMMILL to remove 10.1' X 7.3' section of existing porch on west side of house; construct new one-story addition, 10.1'X 18.7' on west side of house. Remove existing mechanical equipment from existing house crawl space and relocate to proposed one-story addition. Rebuild 490+/- sq rft. of existing porch in same footprint, including a new foundation. The existing roof of the porch will remain. Located: 2025 Smith Rd., Peconic. SCTM#98-4-19.2 The CAC recommends Approval of the application with the Condition that no trees are removed and hay bales are placed down before the project begins. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of the CUTCHOGUE-NEW SUFFOLK PARK DISTRICT to construct a covered wood gazebo 24'X 12'. Located: 9430 Skunk Lane, Cutchogue. SCTM#104-8-6.1 The CAC recommends Approval of the application with the Condition that a path is installed at the opening in order to avoid trampling of the grass. Vote of Council: Ayes: All d Motion Carried Moved by Don Wilder, seconded by Nicholas Dickerson, itwas RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOHN CHAPMAN to install an in-ground swimming pool. Located: 2700 Arrowhead Lane, Peconic. SCTM#98-2-20.1 The CAC recommends the pool be installed in the location of the existing lawn area. Fuithermore, a swale should be installed during installatJon and the drainage for the poolshould be connected to the existing sanitary system. A revised plan should include a landscaping plan that would surround the pool. Vote of Counci!: Ayes: All Motion Carried Moved by Nicholas Dickerson, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of STEPHEN SACHMAN to replace inkind/inplace 75' linear ft. of existing bulkhead and 4'X 58' wood steps. Located: 4705 Nassau Point Rd, Cutchogue. SCTM#111-9-9 The CAC recommends the bulkhead be replaced using vinyl sheathing. The CAC recommends Disapproval of the use of CCA treated wood. Vote of Coun oil: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF AMENDMENT TO PERMIT APPLICATIONS Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of FRANK MARTORANA to Amend Permit #5456 to allow the construction of a house with a different footprint, but which would be constructed within the same building envelope shown in the original proposal, and for a One-Year Extension to Permit #5456. Located: 3500 Deep Hole Dr., Mattituck. SCTM#115-17-9&10 The CAC recommends Approval of the application with the Condition a line of hay bales or silt fence is placed down before the project begins. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Drew Dillingham, it was ~ESOLVED to recommendto the Southold Town Board of Trustees APPROVAL WITH CONDITON of the Amendment application of THOMAS & PATRICIA FRENZ to Amend Permit #5103 to construct a 4'X 176' timber fixed dock, a 4'X 15' extension, and ;an~8" pile and pulley system. Vote of Council: Ayes: All Metion Carried Moved by Drew Dillingham, seconded by Don Wilder. it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of MARIA PROIS to Amend Permit #4862 to attach a 31'X 15' deck to the existing 8'X 10' deck. Located: 1405 Bayview Ave., Southold. SCTM#52-5-12 The CAC recommends Disapproval of the application because the applicant is in violation of Permit #4862. The permit required drywells be installed and no drywells were found on tl~e property. The application should not be reviewed until the violation has been satisfied. Vote of Council: Ayes: All Motion Carried WILLIAM D. REED to Amend Permit #5461 to allow for the construction of a single- family dwelling, deck, driveway, sanitary system and grading. The proposed dwelling and deck shall be smaller than the originally approved dwelling. Located: R.O.W. off of Peninsula Rd., Fishers Island. SCTM#10-3-12 The CAC did not make an inspection, therefore no recommendation was made. GLORIA & ROBERT PROFETA to Amend Permit #4678 to construct a second-story addition over and within footprint of existing one-story dwelling and enclose existing screened porch. Located: 1060 Little Peconic Bay Rd., Cutchogue. SCTM#111-14-16 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of BARBARA & JOSEPH ISABELLA to Amend Permit #5626 to resheathe (below lower whaler) approx. 80 linear ft. of existing tiniber bulkhead with vinyl sheathing and backfill sinkholes behind bulkhead with up to (I 0 cy. of dean sand to be trucked in from an upland soume. ~Located: 1855 West View Dr., Mattituck. Located: 3300 Peconic Bay Blvd., Laurel. SCTM#128-6-7 The CAC -ecommends Approval of the application with the Condition a 15' non-turf buffer is installed landward of the first bulkhead. Vote of Council: Ayes: All Motion Carried The next regular meeting of the Conservation Advisory Council has been scheduled for Monday, November 17, 2003 at 6:00 PM at Down's Farm Preserve.
