Terry Set-Off Application SCTM #~s 1000-20-1-3.2, 3.3, & 3.4 As you may recall, in June 1999, the Planning Board issued a negative declaration with respect to the above referenced set-off application and issued conditional site plan approval subject to Suffolk County Depamnent of Health approval (Health Department). Enclosed please find cop~es of the title certification and proposed covenants and restrictions required by the Health Department for private wells. The covenants require the approval of the Town of Southold, since it owns the development rights to part of the entire parcel (SCTM #1000-20-1-3.2), and because the Health Department requires all declarants listed in the title certification to si~ the covenants. I would appreciate your arranging for Supervisor Cochran's execution of the covenants, and returning this original to me at your earliest convenience. The declarations set forth in the WHEREAS clauses contained herein shall be deemed and construed to be promises, covenants, and restrictions as if fully repeated and set forth herein. 9. If any section, subsection, paragraph, clause, phrase or provision of these covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid, or held to be unconstitutional, the same shall not affect the validity of these covenants as a whole, or any other part or provision hereof other than the part so adjudged to be illegal, unlawful, invalid, or unconstitutional. 10.
