AN ACT in relation to authorizing the town board of the town of Sout-

1 Section 1. Notwithstanding any other provision of law to the contrary,
2 the town board of the town of Southold, county of Suffolk, is hereby
3 authorized to accept from GKLF, LLC, grantee, a petition for a refund
4 from the town real estate transfer tax, imposed pursuant to section
5 1449-bb of the tax law, with respect to a conveyance of real property
6 occurring on ]une 22, 2021 for the parcel conveyed to such grantee, with
7 such parcel having an address of 7800 Alvahs Lane in the hamlet of Cutc-
8 hogue, town of Southold, county of Suffolk, otherwise known as Suffolk
9 county tax map district 1000, section 101.00, block 01.00, lot 019.001.
10 If accepted, the application shall be reviewed as if the provisions of
11 paragraph (j) of subdivision 2 of section 1449-ee of the tax law had
12 been complied with before lune 22, 2021.
13 If satisfied that such grantee would otherwise be entitled to such
14 exemption if such grantee had complied with the provisions of paragraph
15 (j) of subdivision 2 of section 1449-ee of the tax law before lune 22,
16 2021, the town board of the town of Southold, may grant the refund. If
17 the refund is granted and such grantee shall have paid the town real
18 estate transfer tax, the town board, in its sole discretion, shall
19 provide for the refund of the tax paid.
20 § 2. This act shall take effect immediately and shall expire one year
21 after it shall have become a law when upon such date the provisions of

TITLE OF BILL:
An act in relation to authorizing the town board of the town of Sout-
hold, county of Suffolk, to accept from GKLF, LLC, grantee, an applica-
tion for a refund from the town real estate transfer tax paid pursuant
to section 1449-bb of the tax law for certain real property conveyed on
June 22, 2021; and providing for the repeal of such provisions upon
expiration thereof

This bill would authorize the town board of the town of Southold to
accept from GKLF, LLC, grantee, an application for a refund from the
town real estate transfer tax.
SWORY QE PROVISIONS:
Section 1. Authorizes the town board of the town of Southold to accept
from GKLF, LLC, grantee, a petition for a refund from the town real
estate transfer tax with respect to a conveyance of real property occur-
ring on June 22, 2021 for the parcel conveyed to such grantee located at
7800 Alvahs Lane, in the hamlet of Cutchogue, town of Southold, county
of Suffolk. Such petition shall be filed no later than one (i) year from
the effective date of this act.
Section 2. Effective date.
Subdivision 2(j) of Section 1449-ee of the law law provides an exemption
for certain conveyances of real property from the payment of the real
estate transfer tax where the entire parcel of real property is subject
to the development restriction of an agricultural district or individual
commitment, pursuant to article twenty-five-AA of the agriculture and
markets law.
A parcel of land located at 7800 Alvahs Lane, in the hamlet of Cutc-
hogue, town of Southold, was conveyed to GKLF, LLC on June 22, 2021.
However, the property was not eligible for the exemption at the time of
the closing. Subsequently, an application was made where the entire
parcel would be subject to the development restriction of an agricul-
tural district, pursuant to article twenty-five-AA of the agriculture
and markets law.
This bill authorizes the town board of the town of Southold to accept
from GKLF, LLC, grantee, a petition for a refund from the real estate
transfer tax payment no later than one (1) year from the effective date
of this act.

Re: Home Rule Message/ Southold Park District
Dear Supervisor Krupski and Members of the Town Board:
I represent the Board of Commissioners of the Southold Park District. The
Commissioners have requested New York State Senator Anthony Palumbo and Assemblyman
Fred Thiele to sponsor legislation amending the state legislation which created the Southold Park
District in 1907. Specifically, they have requested that the position of treasurer be made an
appointed position rather than an elected one. [Similar legislation was passed at the request of
the Mattituck Park District several years ago].
The Town Board should have received a request from Assemblyman Thiele for a Home
Rule Message from the Town of Southold. I am following up on that request to confirm that the
Board of Commissioners seeks this legislation, and is requesting the Town Board's support of it.

AN ACT to amend chapter 234 of the laws of 1907 relating to authorizing
the formation of a park district in the town of Southold, Suffolk
county, to acquire lands for park purposes, and to issue bonds there-
for, in relation to appointment of a treasurer by the park commission-
ers

1 Section 1. Sections 2, 3, and 4 of chapter 234 of the laws of 1907
2 relating to authorizing the formation of a park district in the town of
3 Southold, Suffolk county, to acquire lands for park purposes, and to
4 issue bonds therefor are amended to read as follows:
5 § 2. When such park district has been established in the manner above
6 provided, the legal voters thereof may elect three residents thereof to
7 be the park commissioners, one of whom may be a female over twenty-one
8 years of age, for a term of one, two, and three years respectively[,
9 m ]. The park commissioners 2haIL—ambl a treasurer in
10 such park district [ r ] who shall be entitled to
11 receive and have custody of the funds of the district and pay out the
12 same for the purposes herein provided for, on the order of the park
13 commissioners, which treasurer, before entering upon the duties of his
14 office, shall give such security as the board of park commissioners may
15 require.
16 § 3. The first election of such park commissioners and JORpointment of
17 jV&ti treasurer shall be called by the clerk of the town of Southold,
18 within thirty days from the formation of said district by the posting of
19 notices conspicuously of such election in at least four of the most
20 public places in said district and publishing the same in a newspaper
21 published therein for two weeks immediately preceding such election RK
22 ARpointment.
23 § 4. All subsequent elections and aRpointments shall be called in the
24 same manner by the clerk of the town of Southold, not less than thirty
25 days prior to the expiration of the term of office of any such commis-

TITLE OF BILL:
An act to amend the general municipal law, in relation to waiving school
taxes by a town, city, or county industrial development agency
PURPOSE:
This purpose of this bill is to prevent town, city, or county IDAs from
waiving taxes that would otherwise go to a school district.
SUMM PD " 5:
Section 1 creates a new section 889 of the General Municipal Law which
dictates that town, city, or county industrial development agencies may
not waive any taxes or enter into an agreement for payment in lieu of
taxes if such taxes would otherwise be received by the school district.
Section 2 is the effective date.
JUSTIFICATION:
The stated purpose of industrial development agencies, or IDAs, is to
incentivize economic development by attracting businesses and creating
new jobs. The incentives offered by IDAs often include the waiving of
all or some state or local taxes, including those taxes that would have
otherwise been received by the local school district or districts.
IDAs have been around since 1969, and since that time, they have offered
billions of dollars of incentives large multi-national corporations. The
only data the state receives regarding job creation and economic bene-
fits as a result of IDA activity is self-reported by the corporations,
and their exact effectiveness in this area is unknown.
The past two years have been very challenging for students and educators
alike. New York State is experiencing a teacher shortage, and many
schools lack the resources to attract and retain educators. State offi-
cials have estimated that NYS will need 180,000 new teachers in the next
decade.
This bill proposes a simple means of increasing funding to school
districts. While the impact of IDAs remains largely unknown, we cannot
overstate the importance of education and the impact of good teachers
and a strong school district. Preventing IDAs from waiving school taxes
will have a massive impact on our state' s children, and the amount of
money is negligible to the large, multi-national corporations that bene-
fit from agreements with IDAs.
