LOCATION: Central Avenue, Fishers Island,New York SCTM# 1000-10-1-9 ZONE: West Harbor,Fishers Island RELIEF REQUESTED: Appeal of Administrative Decision of the Board of Town Trustees under Chapter 111 of the Southold Town Code, for proposed installation of four(4) 4' x 20' floating finger docks, which are proposed to be seasonally removed, and one (1) 4' x 20' fixed wood pile and timber finger pier with ladders along the east side of the Trustee permitted west fixed floating main dock; each finger float/dock to have associated support, restraint, fender/tie off piles, and new water and electric utilities; and to retain and maintain the existing 8' wide by 18 linear foot long seasonal floating dock, an intermediate 12' wide by 84 linear foot long seasonal floating dock, and a 10' wide by 30 linear foot long seasonal floating dock at shore end, all off of the northeasterly side of existing Trustee permitted dock, and as depicted on the site plan prepared by Docko, Inc. last revised March 18, 2024, to be located within the Coastal Erosion Hazard Area. DETERMINATION: The determination of the Southold Town Board of Trustees is reversed and the application for a Coastal Erosion Hazard Area(CEHA) permit is hereby approved as a Type II action under SEQRA. PROCEDURAL HISTORY Upon the application of Fishers Island Development Company for a permit to perform certain improvements at the Fishers Island Yacht Club within a Coastal Erosion Hazard Area(CEHA), for the purpose of maintaining and improving the existing Sail Program Float, the Southold Town Board of Trustees conducted a public hearing on May 15, 2024 The record included the submissions of Docko, Inc. on behalf of the applicant, in addition,to the written comment of the Local Waterfront Revitalization Program(LWRP) Coordinator. On May 24, 2024, the application of Fishers Island Development Company for a CEHA permit was denied. Applicanf now appeals that determination to the Town Board, acting in its capacity as Coastal Erosion Hazard Board of Review. Unrelated to this proceeding, the record also indicates that the companion application of the applicant for a wetland permit to conduct the requested activity was approved by the Board of Trustees. In accordance with Town Code Section 111-25, Fishers Island Development Company appealed the denial of its request for a CEHA permit to the Town Board in its capacity as the Coastal Erosion Hazard Board of Review. The public hearing on this request was conducted on July 16, 2024. The record includes the underlying record of the Board of Town Trustees, in addition to the multiple written submissions of the applicant including its Application for Appeal dated May 31, 2024. The record also includes the testimony taken on behalf of the applicant at the time of the public hearing on appeal. On July 16, 2024, the Board voted unanimously to reverse the determination of the Board of Trustees and to grant the requested CEHA permit, under the specific considerations presented. DETERMINATION ON APPEAL Upon all of the evidence submitted and the testimony adduced at the public hearing conducted in connection with this application, and upon due deliberation thereon, the Town Board, in its capacity as the Coastal Erosion Hazard Board of Appeals, hereby finds as follows: FIRST: The Fishers Island Development Company proposes to perform certain improvements at the Fishers Island Yacht Club within a Coastal Erosion Hazard Area(CEHA), for the purpose of maintaining and improving the existing Sail Program Float. The proposed action will allow the existing Sailing Dock to be in closer compliance with code requirements through modifications which will make three of the five fingers of the dock_ removable on a seasonal basis. RESE W JUL 2 3 2024 SECOND: The Board of Trustees previously granted a Wetlands permit for the proposed action but denied the CEHA permit because of the location of the proposed activity within the Coastal Erosion Hazard Area. THIRD: The applicant is therefore before the Town Board seeking an appeal from the denial of the Board of Trustees dated May 24, 2024. As such, the application is considered under Section 111 of the Town Code. That Chapter designates the Town Board as the Coastal Erosion Hazard Board of Review, requiring it to decide appeals that the Trustees erred in applying the following criteria: A. No reasonable, prudent, alternative site is available. B. All reasonable means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activities design at the property owner's expense. C. The development will be reasonably safe from flood and erosion damage. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects. [Southold Town Code § 111-20] AVAILABLE, REASONABLY PRUDENT ALTERNATIVE SITES FOURTH: The Board accepts the testimony offered on behalf of the applicant that the proposed development is required to ensure the continued viability of the Sail Program Float and its continued use as such. ALL REASONABLE MEANS OF MITIGATION HAVE BEEN INCORPORATED FIFTH: The Board notes that the applicant's plan will provide water column diversity and shelter for fish habitats and will maintain waterflow and circulation. As a result, applicant asserts fish habitats and tidal wetlands vegetation at the shoreline will be unaffected by the development proposal. In this regard, applicant's representatives contend that all reasonable means of mitigation have been incorporated into the development plan. Rn/ ® E C E V E FJU L 2 3 2024 Snuthold Town THE DEVELOPMENT WILL BE REASONABLY SAFE FROM FLOOD AND EROSION DAMAGE. SIXTH: According to applicant's representatives, the proposed action will strengthen the interconnecting floating dock to preserve the floating dock against damage from waves and to preserve existing coastal features, and resources, specifically tidal wetlands grass. Upon consideration of the record, the Board is satisfied that the proposed development plan is intended to be reasonably safe from flood and erosion damage. THE RELIEF REQUESTED IS THE MINIMUM NECESSARY SEVENTH: In determining the minimum relief necessary, applicant must establish that the size and scale of the development proposal in a protective area is the minimal relief necessary to overcome the hardship or practical difficulty. Fishers Island Development Company seeks to take action to strengthen the sailing dock in question by bringing it in closer conformance with code requirements, and to provide for better accessibility for its users. The Board accepts that the proposed action is the only method of achieving those goals. As such, the Board finds the proposed activity to represent the minimal relief necessary. CONCLUSION In accordance with the powers vested with this Board pursuant to §220-24 of the Code, as the Coastal Erosion Hazard Board of Review, to hear, approve with modification or deny requests for variances or to affirm, wholly or partly, or modify the order, requirement, decision, or determination of the Administrator,by written decision, after public hearing, the Board hereby concludes as follows: The Administrative determination of the Board of Trustees is hereby reversed. Applicant's request for a Coastal Erosion Hazard Area Permit to conduct the work identified herein is hereby approved. Therefore, upon motion duly made and seconded, the members of the Board present and having voted to reverse the determination of the Board of Trustees and to grant the appeal, the application for a Coastal Erosion Hazard Area Permit is hereby granted as a Type II action under SEQRA. Thank you, Keith Dear Mr. Krupski, Since you were the Trustee that conducted most of the hearing for the Fishers Island Yacht Club last night, I just wanted to write you a follow-up note. I believe that I made a tactical error in my presentation by not challenging Coastal Erosion Zone Regulations application to this project. I believe that the regulations state that a dock structure in the Coastal Erosion Zone of more than 200 feet must be removable in order to comply with the regulations. The simple fact is that we can make these floating finger docks removable by using hinges instead of rigid connections. i For the record, I will say right now that we can make those floating finger docks hinged so that they can be removed. The only one I would leave rigid is it one at the far northerly end where it is close to the end of the existing main float/dock. By doing so the two rigid finger docks would comprise an area of approximately 160 ft.2. Less than the 200 foot requirement. The remaining three floating fingers could be removable and, therefore, we would comply with both the area and the removability aspects of the regulation. Is there any way that the decision from last night could be modified in order to accommodate this design feature which I believe is accessible by the regulations? Would you please give me a call on this so we can discuss the best way to move forward? Thanks. Thank you, Keitli Neilson,P.E. Indicate the physical nature of the material to be dredged (i.e. sand, silt, clay, etc.) and provide estimated percentages of the various constituents if available. For beach nourishment projects, grain size analysis data is required. Not Applicable. 6. Describe th.: .:rethod of dredged material conta rent (i.e. hay bales, embankment, bulkhead, etc.) and whether return flow from the dewatering/disposal site would reenter any waterway. Also indicate if there would be any barge overflow. Not applicable. MOORING FACILITIES Answer the following if your project includes the construction or rehabilitation of recreational mooring facilities. 1. It is generally recommended that any fixed piers and walk ramps be limited to four feet in width, and that floats be-limited to eight feet in width and rest at least two feet above the waterway bottom at mean low water. Terminal floats at private, non- commercial facilities should be limited to 29 feet in length. If you do not believe your proposal can meet with these recommendations, please provide the reason(s). The new fingers will be 4 feet wide. 2. Using your plan view, show to scale the location(s), position(s) and size(s) (including length, beam and draft) of vesse/(s) to be moored at the proposed facility, including those of transient vesse/(s) if known. Vessels are 15-24 feet long. 3. For commercial mooring sites such as marinas, indicate the capacity of the facility and indicate on the plan view the location(s) of any proposed fueling and/or sewage pumpout facilities. If pumpout facilities, are not planned, please discuss the rationale below and indicate the distance to the nearest available pumpout station. There are fueling and pump out facilities for the based vessels at Pirates Cove Marina and at the adjacent Goose Island service center. All servicing and provisioning is accomplished at the New London Terminal. 4. Indicate on your plan view the distance to adjacent marine structures, if any are proximate and show the locations and dimensions of such structures. The application drawings Sheet 1 shows the spatial relationship between the proposed work and adjacent peripheral dock facilities in this corner of West Harbor, including the mooring field east of these dock facilities. 5. Discuss the ied for wave protection at the p nosed facility. Please be advised that if a permit is issued, you would be required to recognize that the mooring facility may be subject to Wave action from wakes of passing vessels, whose operations would not be required to be modified. Issuance of a permit would not relieve you of ensuring the integrity of the authorized structure(s) and the United States would not be held responsible for damages to the structure(s) and vessel(s) moored thereto from wakes from passing vessels. Wave protection for north to northeast waves from Fishers Island Sound is not practical. Shape of the Harbor provides. some wave protection for strong wind induced wave conditions from northwest. When wind induced wave conditions are so strong as to be an operational impediment, boats are hauled or put on moorings. BULKHEAD/NG/BANK STABILIZA TION/FILLING ACTIVITIES Answer the following if your project includes construction of bulkheading (also - retaining walls and seawalls) with backfill, filling of waters/wetlands, or any other bank stabilization fills such as riprap, revetments, gabions, etc. 1. Indicate the total volume of fill (including backfill behind a structure such as a bulkhead) as well as the volume of fill to be placed into waters of the United States. The amount of fill in waters of the United States can be determined by calculating the amount of fill to be placed below the plane of spring high tide in tidal areas and below ordinary high water in non-tidal areas. This type of work is not required. 3. Indicate the sources) and type(s) of fill material. Bulkhead backfill not be required. 4. Indicate the method of fill placement (i.e. by hand, bulldozer, crane, etc.). Would any temporary fills be required in waterways or wetlands to provide access for construction equipment? If so, please indicate the area of such waters and/or wetlands to be filled, and show on the plan and sectional views. Bulkhead backfill not be required The foregoing requests basic information on the most common types of projects requiring Department of the Army permits. It is intended to obviate or reduce the need for requesting additional information; however, additional information may be requested above and beyond what is requested in this form. Please feel free to add any additional information regarding your project which you believe may facilitate our review. t NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION FISHERS ISLAND YACHT CLUB,FISHERS ISLAND MARINA,LLC WEST HARBOR,FISHERS ISLAND MODIFICATION OF WEST DOCK FACILITIES GENERAL The project is at parcel 1000-010-1-9, owned by the Fishers Island Development Company, off of Central Avenue located along the west shore of West Harbor on Fishers Island. The site is flat to gently sloped; sandy, gravel earthen materials, vegetated with grass, brush, ground cover and trees. A dock facility has existed and been operated at this site for recreational boating and transportation to and from the mainland since the 1930's. The frontage of the property is approximately 300 feet along West Harbor abutted by the fully developed Goose Island Corporation commercial property to the north and Trevor & McPherson residential land to the west. The waterfront consists of a rock revetment lined shore along the east, tidal wetlands fringe vegetation at the base of the gently sloped tree-lined terrace to the south and west of the dock facilities. The Goose Island property is developed shoreline with marine fuel dock and berthing accommodations. The objective of this project is to optimize the geometry and usefulness of the dock facilities including minor modifications to the dock facilities at the west dock. Attached are application drawings prepared for this project. This project is basically a reinstatement of previous Town of Southold Permits 8125 and 8125C to a point similar to the original approval and a modification to NYS DEC Permit 1-4738-01110/00009 and US Army Corps of Engineers Permit No. NAN-2013- 01160 with the exception of the very minor dock modifications. Authorization is again requested for all of the previously approved dock modifications since the permits were issued and, in the case of Southold Permit 8125 retention of the sailing program dock. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, and the Waterfront Revitalization Program related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for-review by the New York State Department of State and Department of Environmental Conservation. DESCRIPTION OF WORK This proposed project is to maintain the existing 1000+/-SF sailing program float and two accessory floats and install four 4'x20' floating fingers east side of the west floating main dock, and one fixed wood pile and timber finger pier off the west main pier, each with associated support, restraint and fender/tie off piles, and all seaward of the Apparent High Water line in Waters of West Harbor. MOORING FACILITIES AND DOCK MODIFICATIONS In accordance with the U. S. Army Corps of Engineers Environmental Questionnaire, the following additional information is provided. 1. There is one change proposed to the existing and previously permitted dock facilities as shown on the attached drawings, and that is the installation of new finger piers to replace pulley tie- off lines on the middle and-south docks. 2. The application drawings depict some berthed boats to the extent possible at various facilities around the site possible without interfering with the necessary call-outs and dimensions for the various structures. 1 t , 3. The Fishers Island Yacht Club operates this dock facility; there are no repair or storage services at the site. There are pump-out facilities at Pirates-Cove providing service and fueling on Fishers Island as well as marinas along the Connecticut shoreline. There is also a pump- out boat from Connecticut near the mouth of the Mystic River serving boats in the mooring field, which can and does serve the Club patrons as well. It is believed that no new or additional pump-out facilities are necessary at the Fishers Island Marina and the Town of Southold and the NYS DOS have agreed to that in past and present permits. 4. Adjacent marine structures including piers, docks, wharves, bulkheads and moorings are shown on the attached application drawings both sheets 1 and 2. 5. Wave protection is not considered to be necessary at this site. Because of the natural protection provided by West Harbor. Nor'easters and strong northeasterly winds can generate significant waves in West Harbor however it has been generally agreed that a wave attenuator in West Harbor would not be justified to protect existing waterfront facilities. This facility has operated at this site since the mid-1930's. Wave erosion protection is provided to the shoreline at the site by the revetment along the lawn and the bulkhead to the north and no further changes to the revetment are considered necessary at this time. 6. There is no bulkheading, bank stabilization, or filling activities associated with this project; revetment and non-vegetated buffer improvements were already permitted and are substantially complete. DREDGING-NOT APPLICABLE There is no dredging required at this time to provide for the historic boating needs at this docking facility. LOCAL WATERFRONT REVITALIZATION POLICIES The Town of Southold LWRP policies that are applicable to the Fishers Island Yacht Club dock operation are a local refinement of the Long Island Sound Regional Coastal Management Program policies that apply throughout Long Island Sound under the Coastal Zone Management program administered by the NYS Department of State. The site is in West Harbor on Fishers Island and is characterized as.Developed Coast on the east shore at this site, as well as to the parcel north. The land west and south along shore is currently undeveloped coast or natural coast. The developed coast policies are applicable as follows: ➢ Policy 1 is to foster a pattern of development that enhances community character and preserves natural resources to the maximum extent and minimizes adverse impacts on the environment, ➢ Policy 2 is to preserve historic resources, ➢ Policy 3 is to enhance and protect scenic resources and visual quality. The dock modifications are consistent with waterfront development in coastal areas on Fishers Island. The existing "Sea Stretcher" dock modifications were for a very special emergency use. This project is to improve west side dock accommodations to maintain"maximum safe access consistent with other adjacent dock facilities consistent with characteristics for the visual and scenic considerations in the harbor. The encroachment has been minimized to remain within the existing footpirnt to be consistent with DEC policies. The existing structures are as low profile as possible, consistent with the safe and efficient use of the waters and consistent with the boating season tidal range of this site and the special requirements of the four permitting agencies. 2 ( i NATURAL COAST POLICIES The Natural Coastal Policies are 4 through 8 and require consideration as follows: ➢ Policy 4—Minimize loss of life, structures and natural resources from flooding and erosion, ➢ Policy 5 —Protect and improve water quality, ➢ Policy 6—Protect and restore the quality and function of the eco-system, ➢ Policy 7—Protect and improve air quality, ➢ Policy 8 Minimize environmental degradation primarily from solid waste and hazardous substances. The dock facility fixed pier section has existed in the current configuration for decades. As such, it provides adequate height to clear environmental resources of concern and the materials to be utilized are consistent with Town of Southold's Local Law#6 regarding environmental quality. There will be no adverse impacts on environmental quality as a result of these modifications to existing dock facilities. PUBLIC COAST POLICIES Policy 9 sets forth a priority to provide for public access and recreational use of coastal waters, public lands and public resources of the Town. This project maintains recreational boating facilities and provides sailing instruction for hundreds of Island families and so is consistent with this policy. WORKING COAST POLICIES The policies of this section relate to the following: ➢ Policy 10 — Protection of the Town's water-dependent uses and promoting new water- dependent uses in suitable locations, ➢ Policy.l l —Promoting sustainable use of living marine resources, ➢ Policy 12—Protect agricultural lands, ➢ Policy 13 —Promote appropriate use and development of energy and mineral resources. While most of the Working Coast Policies are not applicable to this site or this type of project, Policy 10, promoting water-dependent uses and the siting of water-dependent uses in appropriate areas is applicable and the proposed project makes the most beneficial use of the land and dock facilities. This project has been laid out with specific reference to and review of the Waterfront Revitalization Program policies and is considered to be consistent. In summary, the docks are typical of recreational boating facilities throughout the area and all along coastal New England. The structures have been minimized in size, height, and structure so as to be consistent with other facilities of a similar nature and the minimum necessary components to accommodate safe and efficient boating operations and limited services from this site. This project does not change existing encroachment or accommodations and does not interfere with public access or use of Public Trust Waters and Lands of the State, it does not interfere with navigation, it will not create soil loss or sedimentation and will not create erosion problems. The piers do not adversely affect environmental resources in the area where the facility must span the shallow sub-tidal zone at the shore line, the facility retains its alignment in the area where environmental resources are naturally minimal so as not to worsen any of these conditions. The height of various access piers allows 3 r ( 1 vegetation growth along the shoreline by tidal wetlands plants if other conditions are conducive to such growth. There is almost no vegetation on the muddy sandy and gravelly bottom sediments within the confines of the dock facility as shown in the attached aerial photos. The benthic habitat is annually stressed due to boating activity, as most marina basins are. While the bottom.will be disrupted during the boating season, it is anticipated, based on our experience on other projects, that benthic dwellers including mollusks and crustaceans will re-establish the area seasonally; but the benthos will probably only return to its current levels of productivity and diversity. Thus it is anticipated that there will be no long term loss of valuable marine and wetland habitat and no water quality degradation as a result of this project. No natural protective features or processes will be adversely impacted as a result of the proposed dock work. This project is consistent with zoning policies and ordinances for the Town. There will be no development of the upland related to this dock facility that will create point sources of pollution or drainage. The previously established 10-FT non-vegetated buffer along the lawn will continue to help filter rainfall runoff. The floating docks are the minimal size for operational needs and stability considerations especially acknowledging the eccentricities of boat loading and prevailing waves from West Harbor acknowledging that the floating docks are skewed, not broadside to those waves during coastal storms. The floats are suitably sized and adequately stable for ramp landings and the ramp has been made no longer than necessary in order to minimize the pier structure yet provide a means to boating access. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW NO 6,2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental,or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town of Southold and its officers. The permittee gives consent to the Town and its officers, employees and federal and state agencies to enter upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, the following additional information is offered. 1. Permit modifications for the work are being applied for through the US ACOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. 4 2. There are only very minimal changes to the dock facilities as a part of this project; otherwise the configuration requested is very much the same as in prior Town of Southold Permits 8125 and 8125C. The 15-foot property line clearance specified in this paragraph should not be an issue because the reconstruction and expansion is basically parallel to shore and does not project into the navigation way for other boaters in the harbor or adjacent docks. 3. Upon receipt of the permit for this project, appropriate permit numbers and a Town permit placard will be affixed to the most seaward face of the dock facilities for identification from the water. 4. There are no proposed permanent structures located above the pier decking, nor are any planned at this time other than the power posts, hinged ramps and railing which are fixed by function and designed for this environment and user safety. 5. It is currently possible to provide a passage way to the upland via the south ramp to get around the pier and that access ability will be retained. There is approximately four feet of clearance to walk under the main pier at low tide, however, foot traffic in this area is rare, if at all, due to the number of slips, dock and bulkhead configuration and boulders and tidal wetlands near the west shore and the muddy and rocky characteristics of the bottom sediments. NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason forconsistency associated with this project is outlined in each respective case. Policy 2—Water Dependent Uses—This project is to improve a fully functional water dependent use, a recreational boating dock facility at this site in support of recreational boating, emergency response and sailing instruction. Policy 5 — Use of Existing Developed Shorefront — There is developed shoreline on this site. This project utilizes existing shorefront which has been altered by the long-standing and well-used facilities. The project will make dock access safe and reliably usable in most weather conditions. Policy 7 — Significant Fish & Wildlife Habitat— Protection of significant fish and wildlife habitat has been considered in the development of this project layout. The pier to the shoreward point of beginning is over the rocky, un-vegetated shoreline fringe and above the rocky intertidal sediments and should not pose a deminishment of existing vegetation to the west. Vegetation beneath the pier is scarce, primarily rockweed. Typically there is a slight environmental benefit to the project because of the structure in the water column which barnacles, algae and crustaceans will inhabit and the structures provide protection primarily for juvenile fish. Policy 8 —Protection & Preservation of Habitat— Protection and preservation of habitat has also been considered in this project and the dock structure is being kept to its minimal configuration and of materials consistent with standards of the industry and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. 5 _Polio 11 —Minimize Damage to Natural Resources - The dock facilities exist, laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. The existing pier and floating dock facilities have existed for decades. Policy 14 — No Measurable Increase in Flooding_ This project consists of dock modifications. The dock facility begins as an open wood pile and timber pier and floating dock system which in no way adversely affects water flow and circulation in West Harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound, Fishers Island Sound and Block Island Sound all driven by the Atlantic Ocean and the structures will have no adverse influence on those levels. Policy 15—No New Dredging=No dredging is proposed in this project. Policv 19 —Impact on Public Access —Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the Public Trust Lands or Waters at this site. The intertidal zone in the dock facility area is significantly covered by boulders with tidal wetlands fringe marsh vegetation to the south. The Fishers Island Yacht Club pier and floats occupy far less than the landward 25% of the waterway (West Harbor) width in accordance with US ACOE policies. Thus, public access to the State's lands and waters will not be adversely affected by the project. Policy 20 — Public Trust Compatibility with Existing_Adjoining Properties and Land Uses Public Trust compatibility with existing adjoining properties and land uses have also been considered in this project. Several nearby properties have small docking facilities and this docking facility will not interfere with existing or the likely configuration of future facilities on immediately adjoining properties or the logical allocation of littoral development rights .in this part of West Harbor. These facilities are longstanding structures. Policy 21 —Water Dependent Recreation—This project is consistent with water-dependent recreational opportunities policies set forth in this section. This is a high priority water dependent recreation site. Policy 24 —Scenic Resources Impairment or Loss - This policy is designed to prevent impairment or loss of scenic resources. This dock facility has hosted recreational boating, transit access and other high priority opportunities for the better part of a hundred years. The float construction and reconfiguration and will not represent a new encroachment or structure which would create a loss of scenic resources. The one property owner most likely to be impacted is the cottage of Trevor- McPherson just west of the Club and they have not objected to Fishers Island Yacht Club activities in the past. Policy 25—Enhance Overall Scenic Ouality-The existing pier and floats are consistent with the scenic quality of the area and will not diminish scenic resources as described in Policy 24 above. They will not be changed in this project. Policy 44—Preserve and Protect Tidal Wetlands—It is acknowledged that the fringe marsh of spartina alterniflora along the west shorefront is a valuable resource. The floating dock and fixed wood pile and timber pier emanates from the shore at the existing.un-vegetated strip of the shoreline. The height of the pier does not deprive opportunities for the growth of tidal vegetation but that has not thus far occurred in this area naturally. No changes to the pier are proposed that might adversely affect tidal wetlands growth nearby. 6 1 SUMMARY This project proposes berthing improvements in the footprint of an existing, longstanding facility for community-wide recreational boating access with no changes in clip counts, boat types, usage or activity. A copy of NYS DEC permit and NYS DOS consistency determination will be forwarded as substantiation for and in support of the previous project. The NYS DEC has issued their permit for this project and will be processing a modification thereto for this work. The NYS DOS has issued their consistency determination for the past project as well and will be processing this as well. All of this work qualifies for the US ACE General Permit for New York and Long Island in particular. This project complies with applicable standards of the New York State Coastal Management Act, NYS/DEC Tidal Wetland Regulations and criteria for approval, the Town of Southold Waterfront Revitalization Program and Local Ordinance No. 6, 2004, and its approval is respectfully requested. Neilson, P.E Step 1. Use the Habitat Conservation Division EFH webpage,Guide to Essential Fish Habitat Designations in the Northeastern United States to generate the list of designated EFH for federally-managed species for the geographic area of interest(http://www.nero.noaa.gov/hcd/index2a.htm). Use the species list as part of the initial screening process to determine if EFH for those species occurs in the vicinity of the proposed action. Attach that list to the worksheet because it will be,used in later steps. Make a preliminary determination on the need to conduct an EFH Consultation. Is the action located in or adjacent to EFH designated for eggs? x Is the action located in or adjacent to EFH designated for larvae? x Is the action located in or adjacent to EFH designated for juveniles? x Is the action located in or adjacent to EFH designated for adults? x Is the action located in or adjacent to EFH designated for spawning adults? x If you answered no to all questions above, then EFH consultation is not required -go to x Section 5. If you answered yes to any of the above questions proceed to Section 2 and complete remainder of the worksheet. Step 2.In order to assess impacts,it is critical to know the habitat characteristics of the site before the activity is undertaken. Use existing information,to the extent possible, in answering these questions. Please note that, there may be circumstances in which new information must be collected to appropriately characterize the site and assess impacts. Is the site intertidal,sub-tidal,or Shallow subtidal water column? What are the sediment The existing inter-tidal and shallow sub-tidal sediments are fine- characteristics? grained muddy sand and approximately 25%gravel with occasional exposed stone. Is Habitat Area of Particular The site is an existing shallow cove protected from prevailing climatic Concern (HAPC)designated at conditions but wide open to north and northeast winds. The or near the site? If so what escarpment that surrounds the cove is eroding due to exposure to type, size, characteristics? normal tidal and climatic conditions, despite the moderate to heavy vegetative cover. Is there submerged aquatic There is no eel grass (SAV) in the shallow sub-tidal waters seaward of vegetation (SAV)at or adjacent the mean low water line but there is no SAV detritus on the foreshore. to project site? If so describe The dock facilities are clear of SAV. the spatial extent. What is typical salinity and Salinity varies somewhat seasonally but is typically in the 25-30 ppt. temperature regime/range? Temperature varies seasonally from approximately 30 degrees in the winter to 70 degrees in the summer. What is the normal frequency of Varies seasonally but there is regular boating access to and from the site disturbance, both natural dock facilities in the cove. Most boating activity is between April and and man-made? November and is attributable to recreational boating. Severe storm disturbances are 5 to 10 per year and are usually moderate, occasionally severe. What is the area of proposed Approximately 0.03 acre will be directly impacted by this dock impact(work footprint&far modification project and the continued use of the dock. afield)? Step 3. This section is used to describe the anticipated impacts from the proposed action on the physical/chemical/biological environment at the project site and areas adjacent to the site that may be affected. 11 Nov Nature and duration of 41 It is anticipated that the adverse impacts from this project will activity(s) be small because of the nature of the work. The project can J take place in as little as a week but will likely take three weeks I ?.'>' tid tide and weather permitting. Barge access will be at high tide. The docks will remain open wood pile and timber structure., Will benthic community be X The benthic community will be only marginally disturbed by disturbed? the marine construction barge repairing the dock facility. No excavation or"in water"filling is proposed. Pile contact area will be less than I OSF. Will SAV be impacted? X No SAV,eel grass has been observed in the project area but the SAV fringe bed is in the open water beyond the main pier. Will sediments be altered and/or X Sedimentation rates in the shallow sub tidal zones will not sedimentation rates change? increase as a result of this project, the sediments Will remain stressed by boating access operations. Will t I urbidity increase? X Turbidity, on a day to day basis, will not change significantly from existing conditions. (See attached Narrative Statement) Will water depth change? X No changes in water depth are proposed by or for construction equipment access or for boating operations. Will contaminants be released X Piles treated with CCA will release small amounts of arsenic into sediments or water and copper into the water column however the NYS DEC Study column? from 2000 finds those releases acceptable and warranted in view of the need to protect and preserve the marine construction timbers. Will tidal flow, currents or wave X No. The pier and floating docks are open-pile and timber patterns be altered? construction. Will ambient salinity or X This project will have no impact on water-flow and temperature regime change? circulation or drainage and will not affect salinity. Will water quality be altered? X Water quality should not change to a significant extent as a result of this project beyond the bottom sediment disturbances resulting from marine equipment repositioning during construction and normal boating operations. Step 4. This section is used to evaluate the consequences of the proposed action on the functions and values of EFH as well as the vulnerability of the EFH species and their life stages. Identify which species from the EFH species list (generated in Step 1) will be adversely impacted from the action. Assessment of EFH impacts should be based upon the site characteristics identified in Step 2 and the nature of the impacts described within Step 3. The Guide to EFH Descriptions webpage(http://www.nero.noaa.govlhcd/list.htm)should be used during this assessment to determine the ecological parameters/preferences associated with each species listed and the potential impact to those parameters. No alterations of the benthos or underwater habitat are proposed. This project should have no impact on submerged aquatic vegetation. Nursery X The shallow sub-tidal zone and inter-tidal zone are currently sandy gravel with a nearby eel grass fringe colony and will remain so as a result of this project. No alterations of the benthos or underwater habitat are proposed or anticipated. Nursery function should remain unchanged. Forage X The shallow subtidal zone and intertidal zone are currently sandy gravel and will remain so as a result of this project. No adverse impact to submerged aquatic vegetation is anticipated if it does exist in nearby waters. The pier structure piles spanning the water column should provide new habitat and foraging opportunities as barnacles and algae colonize the structure in the water column. Shelter X The shallow subtidal zone and intertidal zone are currently sandy gravel and will remain so as a result of this project. No adverse impact to submerged aquatic vegetation is anticipated. ' Itis envisioned that any construction impacts experienced as a result of Will impacts be temporary or this project will be temporary and not permanent but the new structure permanent. spanning the water column will be seasonal. The area of coverage of the proposed piles is small compared to the area of the cove and of no consequence compared to the overall fringe habitat and coastal shoreline of Fishers Island. Will Compensatory mitigation be X No compensatory mitigation is proposed for this dock modification used? project. The finger pier and floats are fairly standard for dock facilities and similar to adjacent shoreline characteristics along Fishers Island's coastal perimeter. The west dock has existed at this site for approximately 50 years. Step 5. This section provides the Federal agency=s determination on the degree of impact to EFH from the proposed action. The EFH determination also dictates the type of EFH consultation that will be required with NOAA Fisheries. ;,2& 'xy"f.i-'4: ,. i, <f:•'3d?.;:i,.,'v'aYu": .""'ay. +,'^.P.^A., g li. ... „"' ' b`^ ' •':'•. a=,.n x"^,,, 'd,•.
