Laing Associates, Inc. 130 Fort Salonga Road Fort Salonga, NY 11768 RE: ISLAND VIEW LANE HOME OWNERS ASSOCIATION, LLC Conklin Point Beach off of Island View Lane, Greenport SCTM# 1000-57-2-37.2 Dear Mr. Bontje: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 17, 2024 regarding the above matter: WHEREAS, Michael Bontje on behalf of ISLAND VIEW LANE HOME OWNERS ASSOCIATION, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 29, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 4, 6, and 9 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the proposed project was modified to be less invasive on the property, wetland areas, and wildlife; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 14, 2024, and again on April 17, 2024, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action,to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of ISLAND VIEW LANE HOME OWNERS ASSOCIATION, LLC to replenish the storm eroded eastern barrier beach area to a height of 18" to 20" above the current depressed beach surface consisting of installing temporary construction access matting (20) 3,000sq.ft.; install an approximately 9'x180' native stone cobble area using 4" to 12" in diameter stone wrapped in jute matting and coir coconut fiber logs to aid in beach grass establishment and sand trapping; add ±600 cubic yards of gravel fill (3/4"'-2' in diameter) up to 18" deep over large cobble and taper north/south to 4.2' grade; plant American beach grass (Ammophilla brevigulata) plugs on the crest and westerly slope of the replenished area; and to remove construction mats and place up to 3" gravel on existing private lane; and as depicted on the site plan prepared by B. Laing Associates, received on April 16, 2024, and stamped approved on April 17, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. In recent years (the last 10 -12), the referenced barrier beach (see attached Figure 1, which forms Conklin Point and is now owned by the Island View Homeowners Association, Inc. WHOA) has experienced more frequent "wash-overs" at Spring (i.e., full moon) and storm tides when accompanied by strong, easterly winds. The wash-overs have increased both the volume and velocity of waters on the interior portion of the barrier beach.The peak tidal velocities in the adjacent Shelter Island Sound north can reach 6 to 7 knots. The wash-overs have resulted in"smothering"of some of the vegetated and unvegetated marsh (IM, HM and SM), erosion of some of the vegetated marsh (SM, HM and IM) and erosion of the shallow marine sediments (SM), erosion of Endangered and Threatened species' nesting habitats (i.e., significantly lowering the elevation of same) and eroding beach itself((i.e.,significantly towering the elevation of same)in several locations.The wash- over of the easterly beach (owned by the IVHOA) occurred at an area several hundred feet south of the most southerly house(readily identified as being on pilings). If the pattern continues and if no action is taken, the over-wash area of eastern beach will likely transition to an inlet of some size. Even greater erosion of the westerly beach and loss of wetlands and endangered species' nesting habitats is anticipated to occur. In addition, flood and ebb tidal flows willthen transit through the interior of the now quiescent marsh to existing,inlet on the western side of same (or perhaps create another or additional inlet). This will result in the destruction of at Least 10 acres of vegetated wetland and soft benthic bottom marine habitats over time. The quiescent wetlands between the two beaches and north of Conklin Point are VERY productive for dozens of bird and marine species. If the beach declines further and becomes an inlet,the resulting daily current will rip out/erode at least half of the quiescent wetlands behind/north of the point. This area will be converted to a marine habitat similar to Shelter Island sound North. While that habitat is productive, it is not nearly as productive as the existing quiescent wetlands, especially for birds feeding, roosting and nesting. For the above reasons,the need to conduct a replenishment and stabilization project on the eastern beach is evident. The following is a categorized list of the relevant Town of Southold LWRP policies and how the project(as opposed to no action)will comply with these policies. NATURAL COAST POLICIES Policy 4 Minimize loss of life,structures, and natural resources from flooding and erosion. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. Compliance with Policies 4 and 6: The wash-overs have reduced the height of the eastern beach by approximately one foot This has resulted in MOVING waters transiting the marsh behind the beach in high tides with easterly winds and/or full moons Usually, the velocity in the vegetated wetlands and shallow marine habitats away from the western inlet is approximately 0 0 knots As above, the tide flow on both the flood and ebb in Shelter Island Sound North exceeds 6 knots This moving water over the eastern beach has smothered the western marsh with the eroded beach materials, dropped the western beach's crest by about a foot and nearly eliminated sand on the western beach This flow process repeats itself from west to east on the ebbing tide In my experience, the last effect has never happened before The combination has also dropped the western beach crest I2yapproximatelya foot A. If this is allowed to continue unhindered, the overtopping of the eastern (IVHOA) beach will cause a full breach and create a new inlet It is only a matter of time(which seems to be accelerating in the past 2 to 3 years) The tidal flows will short-circuit a significant portion Shelter Island Sound North's flows and divert them, with the velocity (which can reach 6.5 knots)directly through the IVHOA marshlands(and others) from the breach to the existing, western inlet. B. The direct, high velocity flows in the marsh will erode the bottom sediments and vegetated wetland areas over time (probably pretty quickly) The areas north of Conklin Point total some 30 acres(of which IVHOA owns approximately20 aces) Flowing waters rarely move in a straight line The new flows will develop a sinuous pattern overtime and there is no predicting where the channel/erosion will stop This higher velocity flood and ebb tidal flows will erode and eliminate at least 10 acres of shallow marine and vegetated wetlands plus thek will further erode the western beach and it will eliminate it as suitable shorebird-endangered species nesting habitat C. The eastern beach (and to some extent, the western beach) now works to intercept waves before they come into the marsh Even when the beach is below water, it acts like a reef and the waves that occur topple if their height is greater than the depth of water. With the increased depth of water at a newly created, eastern breach/inlet wave action also will substantially increase in the marsh This will be especially true for western beach. AP;, 202 D. PUBLIC COAST POLICIES Policy 9 Provide for public access to, and recreational use of, coastal waters, public resources of the Town of Southold. E. While the IVHOA beach is owned as private property, kayakers and paddle boarders who are not IVHOA members frequently cross the eastern beach to avoid the peak flows in Shetler Island Sound North These flows also frequently create standing waves of up to 2 feet in height in Shetler Island Sound North. In New York State, this"trespass"is allowed on private property if it is ephemeral and occurs to avoid a serious hazard to navigation If the beach wash-overs are allowed to egress to form an inlet(as described above), the now quiescent waters north of Conklin Point will disappear and be replaced by waters flowing at 6-7 knots, equivalent to Shetler Island Sound North Thus, the now "simple," quiescent and less hazardous alternative to avoid Shetler Island Sound North's peak flood and ebb by kayakers and paddle boarders will be eliminated. In sum, the proposed beach replenishment and stabilization project for Conklin Point's eastern beach will comply with the Town's LWRP Coastal Policies. These areas are subject to high fluctuations in salinity and moisture, but generally the sand is noticeably wetter than the adjacent maritime beach sand. A relatively low diversity community, it is perhaps best characterized by the benthic invertebrate fauna including polychaetes (Spiophanes bombyx, Pygospio elegans, Clymenella torquata, Scoloplos fragilis, Nephtys incisa), amphipods (Protohaustorius deichmannae, Acanthohaustorius millsi), and mole crabs (Emerita spp.). This community provides feeding grounds for migrant shorebirds, such as sanderling (Calidris alba) and semipalmated plover (Charadrius semipalmatus), and breeding shorebirds, such as piping plover (Charadrius melodus). Box 1179 Southold, NY 11971 RE: CONKLIN POINT BEACH—SOUTHOLD NY—REPLENISHMENT The Island View Lane Home Owners Association, LLC is hereby proposing a beach replenishment project for CONKLIN POINT BEACHin the Town of Southold, New York(just west of Greenport, NY). In recent years(the last 10-12),the referenced barrier beach (see attached Figure 1,which forms Conklin Point and is now owned by the Island View Lane Home Owners'Association, LLC(HOA), has experienced more frequent "wash-overs" at Spring (i.e., full moon) and storm tides when accompanied by strong, easterly winds. The wash-overs have increased both the volume and velocity of waters on the interior portion of the barrier beach.The peak tidal velocities in the adjacent Shelter Island Sound north can reach 6 to 7 knots. The wash-overs have resulted in "smothering"of some of the vegetated marsh(IM and HM), erosion of some of the vegetated marsh (HM and IM)and erosion of the shallow marine sediments(SM), erosion of Endangered and threatened species' nesting habitats (i.e., significantly lowering the elevation of same) and eroding beach itself((Le., significantly lowering the elevation of same) in several locations. The wash-over of the easterly beach (owned by the HOA) has occurred at an area several hundred feet south of the most southerly house(readily identified as being on pilings). If the wash overs continue,the area of beach Will likely transition to an inlet of some size. Flows will then transit through the interior of the now quiescent`marsh to existing inlet on the western side of same. Even greater erosion and loss of wetlands and endangered species' nesting habitats is anticipated to occur if no action is taken to replenish the easterly beach. The objective of the project will be to add "replenishment" to the wash-overs area of the eastern beach to a height which minimizes or eliminates the current and future"wash-overs." The replenishment should be as gravel (3/4") placed above cobble-sized (4") native stone in 12" deep Gabion mats. The re- established gravel will re-set the natural condition of the eastern beach and the Gabion blanket beneath the replenished materials to allow it to last (and perhaps accumulate sand) for some time'. (up to 300 cu. yd. may be recovered from the westerly, beach surface):: 45 Gabion Cages (12" by 36" by 144"each)to cover an area 180 feet north to south and 9 feet wide(west to east):: Beach Grass Planting 4,200 on the peak and westerly slope of the replenished sand and gravel:: Withdraw construction mats and place 3" gravel on private lane. Withdraw construction staging area. The construction is anticipate to require 2 months(possibly 3 months)and will occur between September 30 and April 15 of the calendar year(2023 to 2024 anticipates at this juncture). The purpose of the project is: A. to ensure the continued protection of the vegetated HM-IM-SM marsh and B. to ensure the continuance of endangered and threatened species' nesting habitats to the west and C. to ensure the continued protection of homes along the shoreline of Island View Lane. Per the Town of Southold Chapter 275, these areas are designated as Wetlands and Shorelines. They are further designated as High Marsh (HM), Intertidal Marsh (IM) and Littoral Zone (LZ) per Title 6 NYCRR Part 661 (New Yok State's Tidal Wetland, Land Use Regulations). Finally, they are also defined as Estuarine Wetlands per the US Army Corps'40 CFR Parts 320,et seq.(pursuant to Clean Water Act Sections 401 and 404). These types of vegetated wetlands are considered to have an especially high environmental value. So, with this action there is a dramatically increased chance of successfully maintaining these wetlands and endangered species'nesting habitats and preserving those environmental "values." at peak tide in the adjacent Shelter Island Sound North)have caused the beach at this location to be denuded and remain as such for some time. IVLHOA01-01 Cover Report Trustees The permitting process will only require approval for transit and excavation, gabions, re-filling/covering, and planting of beach grasses in Adjacent Area to Tidal Wetlands (Title 6 NYCRR Part 661.4).Thus, permitting will be required by two Agencies: I. New York State Department of Environmental Conservation (NYSDEC) and II. The Town of Southold,Trustees. The wash-over area several hundred feet south of the most southerly house (readily identified as being on pilings) house is an urgent and "important" locations. If the"wash-over"can be stopped at location 1 it will also reduce the flow and velocity at the beach just northeast of the current Conklin Point inlet(the "Sage" beach). This project is readily accomplished. The HOA owns this property. The easterly beach extending south to the "wash-over" area is currently NOT wetlands as it is gravel with American beach grass, maritime rose, "wild" bush clover, etc. The "wash-over" area is currently above the mean spring high water line and unvegetated. The project site has a road/graveled access right up to the beach. The remaining area will be accessed by use of wooden or composite matting, as it can stay just to the west of the red maple tree next to last house's deck). The site is readily accessible by smaller(5 to 10 cubic yard) trucks and a tracked piece of excavation equipment for spreading the cobble, gravel and sand in the replenishment area. The travel-way from the south end of the gravel area to the beach replenishment could be accomplished with "minimal" disruption using temporary truck matting'. The HOA apparently has a(2020) recent Young and Young survey of the entire property it owns and the project location and accessway in particular. This survey included placing know corner pins with known elevations. This information allowed B. Laing Associates, Inc. and Registered Architect Gary Mingus to accurately measure out and create a project "base" map for the permitting Agencies (See Sheet 1 attached). In October 2022, "topographic"data was collected to illustrate the decline in the height of the beach south of the most southerly house. The wash over area is evident in the 12-14" rapid decline in beach elevation beginning some 250 feet south of he most southerly house and then continuing to the beach's"shoulder"as it turns westerly to from Conklin Point itself. The same data above were then also used to create the proposed replenishment plan shown on Sheet 2, attached. Alternatives: The project has been designed to use existing paved roads to access a gravel-packed private lane. A small portion of the paved, Island View Lane roadway will be used as a construction staging area. The equipment will travel from the southern edge of the gravel lane to the "work surface' via wooden construction"mats." This is the only land access to the over wash location and is to be located on Adjacent Area to wetlands. The eastern beach's shorelines are extremely shallow and so, marine deliveries of equipment and materials would occur directly in SM wetlands. This would have a greater impact than the proposed mats. 2B.Laing Associates,Inc.has proposed and contractors have used this method many times in the past 43 years and it has worked well,even on much softer beach surfaces than occurs here. IVLHOA01-01 Cover Report Trustees Erosion Controls: Since the project will include the deposition of native sand,gravel and cobbles,erosion control is not deemed necessary. Only very limited excavation (and then replacement) of beach gravel to implant the Gabion mat 6" into the existing surface will be needed. Further, a small portion of the paved, Island View Lane roadway will be used as a construction staging area. The staging area will be only used for gabion baskets, truck-transit matting and equipment storage overnight. The equipment will travel down the private, gravel accessway and then, from the southern edge of the private gravel lane to the "work surface'via wooden construction "mats." No deposition of sand or gravel materials will occur until the trucks reach the "working face" on the beach proper. The HOA and I would request that I be present at any field inspection and meeting on site. I have known this beach intimately.foi-some 35 years and I am a professional wetland scientist practicing for some 43 years on Long Island(with nation-and world-wide experience). I knowthat I could provide valuable insight into the existing and proposed beach conditions and further re-enforce my conviction in this case that the Proposed Action is the proper course to take at this time for numerous reasons. The objective of the project will be to add "replenishment"to the wash-overs area of the eastern beach to a height which minimizes or eliminates the current and future"wash-overs." The purpose of the project is: A. to ensure the continued protection of the vegetated HM-IM-SM marsh and B. to ensure the continuance of endangered and threatened species' nesting habitats to the west and C. to ensure the continued protection of homes along the shoreline of Island View Lane. D. to allow continued avoidance of full force tidal flows is Shelter Island Sound North for small, unmotorized craft. The wash-overs have increased the volume and velocity of waters on the interior portion of the barrier beach. Peak tidal velocities in the adjacent Shelter Island Sound north can reach 6 to 7 knots. The wash- over of the easterly beach(owned by the HOA)has occurred at an area several hundred feet south of the most southerly house(readily identified as being on pilings). If the wash overs continue,the area of beach will likely transition to an inlet of some size. Flows will then transit through the interior of the now quiescent marsh to existing inlet on the western side of same. Even greater erosion and loss of wetlands and endangered species' nesting habitats is anticipated to occur if no action is taken to replenish the easterly beach. This means more erosion and, in some cases, sedimentation of the vegetated marsh (dominated by Spartina spp.). Per Town of Southold Code -Chapter 275,these areas are designated as Wetlands and Shorelines. These areas are also designated as High Marsh (HM), Intertidal Marsh (IM)and Littoral Zone IVLHOA01-02 Fee request TRUSTEES (LZ) per Title 6 NYCRR Part 661 (New Yok State's Tidal Wetland, Land Use Regulations). It is also defined as Estuarine Wetlands per the US Army Corps' 40 CFR Parts 320, et seq. (pursuant to Clean Water Act Sections 401 and 404). These types of vegetated wetlands are considered to have an especially high environmental value. So, with this action there is a dramatically increased chance of successfully maintaining these wetlands and endangered species'nesting habitats and preserving those environmental "values:' APPLICATION FEE Since the purpose of the project is not commercial and is being funded by an HOA, I believe the fee for a multi-family project ($500) should be applied. It will help keep our beach from eroding further.Also,the Piping Ploves come each year during mating season. As I'm sure you know the Piping Plovers are an endangered species and the improvements will help keep them coming back.
