Box 1179 Eric Sepenoski J J Southold, New York 11971 Liz Gillooly Telephone (631) 765-1892 Elizabeth Peeples ® �® Fax(631) 765-6641 ®lyC®U ,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD June 26, 2024 Pablo Leon 1095 Verbena Avenue Merrick, NY 11566 RE: 1400 SALT MARSH LANE, PECONIC SCTM# 1000-68-3-2 Dear Mr. Leon: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 20, 2024 regarding the above matter: WHEREAS, PABLO LEON applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 25, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator did not issue a recommendation within 30 days of receipt of the application, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 14, 2024, and again on March 20, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees APPROVE the application of PABLO LEON for the existing dwelling with a 40.2'x24.5' basement level; existing 40'2"x24'5" (1,163.03sq.ft.) first floor with a 9'11"x18'5" den and ±4'x12' wood entry platform and steps to remain; existing ±'6x5' wood entry platform and steps off north side of dwelling to remain; a proposed 822.94sq.ft. (36.2'x24.5' "L" shape) second story addition with a 24.5'x8' (±195.20sq.ft.) open terrace with 4' of terrace to be cantilevered on the seaward side of the dwelling; total gross area to be 2,966.85sq.ft.; install an I/A OWTS system-on the landward side of the dwelling; and to establish and perpetually maintain a 15' wide vegetated non-turf buffer area along the landward edge of the top crest of the bluff; with the condition that only native vegetation is to be planted within the non-turf buffer area; permanently close PVC pipe for drainage; and as depicted on the site plan prepared by PL Engineering, P.C., received June 18, 2024, and stamped approved on June 25, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. The subject parcel is improved with a one-story wood frame house with garage Underneath,an enclosed entry porch,wood landing and access steps, brick entry walk and gravel parking area, a small waterside landing and stairs, and the remains of wood beach stairs running down the face of the bluff to the beach below, as shown on the survey prepared by Nathan Taft Corwin, 111, Licensed Land Surveyor, and dated July 24, 2012. ADDITIONAL INFORMATION: Improvements on the subject parcel are covered by the following Certificate of Occupancy: #Z-2539 dated October 17, 1966 covering the construction of a single-family dwelling. #Z-3160 dated July 18, 1966 covering the construction of the addition of a porch. The applicant provided construction drawings including a site plan, existing and proposed floor plans, Gross Floor Area plans and calculations, elevations and a Pyramid Law diagram, labeled A-100, A-101, and A-102 prepared by Pablo Alfonso Leon, and dated December 8, 2022. While the majority of work proposed falls outside of the scope of the Zoning Board of Appeals,the applicant proposes to add a full second floor, 36.2 feet by 24.5 feet, which is partially cantilevered over the waterside fagade of the existing residence. The structure presently maintains an existing bluff setback of 50.9 feet. With the addition of the cantilevered second floor containing an owner's suite with full bath, a walk-in closet, sitting area, stairwell and a waterside terrace, approximately 8 feet wide (5 feet of which is cantilevered over the existing first floor) the bluff setback is reduced to 45.9 feet. There is no proposed expansion of the foundation or the first floor. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 7,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The right of way, known as Salt Marsh Lane, services several sound front residences and terminates just past the subject property. Lands on the southside of the roadway are undeveloped, owned and `preserved' by the Peconic Land Trust. The majority of the residences in this wooded neighborhood were built in the mid-201h century, many of which do not conform to current bluff setbacks where the bluff is known to severely erode. While the house is existing, the applicant does not propose any encroachment or the reduction of the existing bluff setback, however, proposes to cantilever a second-floor addition, 5 feet over the existing home, thereby triggering the required relief. As a result of cantilevering the second floor, 5 feet, with no disruption to the foundation or expansion towards the bluff there will be no undesirable change in the character of the neighborhood or detriment to nearby properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could step the second floor back to the existing 50.9 feet existing bluff setback and design a waterside balcony within the existing footprint of the residence, However, in the proposed plan, the applicant is able to incorporate a greater amount of interior living space without encroaching on the Gross Floor Area or the Pyramid Law, and proposes a modest 5 feet cantilever allowing for an 8 feet wide waterside terrace, which is reasonable for the scale of the existing home and neighborhood. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 54.1%relief from the code. However, the existing residence has a bluff setback of 50.9 feet and the applicant is not proposing to expand the footprint of the house or the primary floor;the applicant is proposing to cantilever a second-floor balcony that is 8 feet deep, necessitating 5 feet of relief for a second story addition, from the existing non-conforming bluff setback. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install a Suffolk County Board of Health approved Innovative and Alternative Onsite Wastewater Treatment System. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reduced second floor bluff setback of 50.9 feet, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
