AGREEMENT
THIS AGREEMENT made on the~ day of ~6~ ,
between the SHELTER ISLAND FIRE DISTRICT, having its
principal office at 49 North Ferr~ Road. Shelter Island. Suffolk
County, New York, and the SHELTER ISLAND HEIGHTS FIRE DISTRICT,
having its principal office at 2 Prospect Avenue, Shelter Island
Heights. Suffolk County, New York, parties of the first par~3 and
the TOWN OF SOUTHOLD, a municipal corporation of the State of New
Y6rk, having its principal office at Main Road, Southeld, Suffolk
County, New York. party of the second part.
WHEREAS, pursuant to a certain agreement dated June 16,
1975, the parties of the first part jointly operate, maintain and
use a fire alarm system within the Town of Shelter Island.
consisting, in part, of plectrons, pagers, sirens, and air horns,
and
WHEREAS. the parties of the first part do not man a
radio transmission base station twenty-four hours per day as a
part of said fire alarm system, and
WHEREAS. said radio transmission base station can
receive radio communications from fire vehicles and transmit
'"--radio communications to home alerters and pagers in the Town of
Shelter Island without undo burden to the party of the second
part, and
W~EREAS, in view of the foregoing, all parties are
desirous of entering into an agreement whereby fire ~larms may be
received and dispatched at the police department headquarEers of
the TOWN OF SOUTHOLD on behalf of the SHELTER ISLAND FIRE
DISTRICT and the SHELTER ISLAND HEIGHTS FIRE DISTRICT.
NOW, THEREFORE, IT IS AGREED, AS FOLLOWS:
1. Southold Town Police Department radio operators
shall answer all Fire Alarms on beha]f of the SHELTER ISLAND FIRE
DISTRICT and the SHELTER ISLAND HEIGHTS FIRE DISTRICT and shall
dispatch all necessary information to aforesaid Districts;
2. Aforesaid radio operators shall test the complete
fire alarm system of the DISTRICTS one (1). time per week;
3. The Southold Town Police Department shall keep
proper ann adequate records of all fire alarms and shall make
them available to representatives of the DISTRICTS at all times;
4. The Erahanced-911 system shall be incorporated into
aforesaid fire alarm system and made a park of this Agreement
upon becoming operational at no additional cost to the DISTRICTS;
5. The DISTRICTS agree to pay the TOWN OF SOUTHOLD an
annual fee of TWENTY FIVE HUNDRED ($2500.00) DOLLARS for the
aforesaid services, said fee to be paid no later than~
of each year;
6. The DISTRICTS shall defend, indemnify and hold
harmless the TOWN OF SOUTHOLD as to any and all claims, actions,
suits and liabilities arising from this agreement as a result of
their negliigence or carelessness in responding, answering or
handling any such radio transmissions from the TOWN OF SOUTHOLD
police department;
7. The TOWN OF SOUTHOLD shall defend, indemnify and
hold harmless the DISTRICTS as To any and all claims, actions,
suits, and liabilities arising from this agreement as a result of
its negligence or carelessness in receiving and transmitting fire
alarm calls to the DISTRICTS;
8. Either party shall have the right to terminate this
Agreement at the end of any calendar year by sending written
notice to the other party, by certified mail, no less than ninety
(90) days prior to the end of such year; ~-~-
'9. This Agreement shall become effective on the first
day of ~[~h~-- 1988.
