HomeMy WebLinkAboutNYS Police NYSPIN STATE OF NEW YORK EXECUTIVE DEPARTMENT - DMSION OF STATE POLICE NEW YORK STATEWIDE POLICE IN-FORMATION NETWORK STATE CAMPUS, ALBANY, NEW YORK NYSPIN CONNECTION AGREEMENT Pursuant to Sections 217 through 220 ofthe New York State Executive Law, the Town of Southold .Police Department, a gov~rnme~tal agency lawfully maintained by authority of the statutes of the State of New York, Albany County, N.Y., hereby applies to the Superintendent of the Division of State Police ofthe State of New York for permission to implement a computer-to-c6mputer interface with the New York Statewide Police Information Network (NYSPIN), and requests that said system be made available for use by criminal justice agencies/terminals listed in Appendix A, subject to all of the provisions of Sections 217 through 220 of the New York State Executive Law and to all orders, rules or regulations which have been made and issued or whicli may hereafter be made an issued by the Superintendent of the Division of State Police for the use and operation of said systems. When, in the discretion of the Super'mtendent of the Division of State Police, the connection of aforesaid interface is requisite and necessary for the best interest of the entire system, and upon approval of this application by the Superintendent of the Division of State Police, NYSPIN HEREBY AGREES: Te furnish to the Town of Southold Police Departmenl , telecomm~mications facilities for the exchange of criminal justice and criminal justice related information through interface facilities subject to the following provisions: Town of Southold Police Department agrees that in its use of NYSPIN telecommunications services, it will abide by all present rules, policies and procedures of NYSPIN, as approved by the Superintendent of the Division of State Police as well as any approved rules, policies and procedures hereinafter adopted by NYSPIN. The Town of Southotd Police Department fi. trther agrees that, acting as a control term'xnat agency for participating agencies/terminals as listed in Appendix A, it will restrict access to NYSPIN telecommunications facilities to only those agencies authorized by rules, policies and procedures of NYSPIN as approved by the Superintendent of the Division of State Police, and will enforce these same rules, policies and procedures with respect to use of NSYPIN telecommunications facilities, by authorized agencies on the Town of Southold Police Department system. NYSPIN reserves the right to suspend telecommunications services to the Town of Southold Police Department when rules, policies or procedures of NYSPEN have been violated. NYSPIN will reinstate services in such instance upon receipt of satisfactory assurances that such violation has been correcmd to the satisfaction of NYSP[N. The Town of Southold Police Deparrmem, agrees to indemnify and save harmless NYSPIN, the Superintendent of the Division of State Police, its Advisory Committee, and employees from and against any and all claims, demands, actions, suits, and proceedings by others; agaimt all liability m others in the exercise or enjoyment of this Agreement. THE APPLICANT FURTHER AGREES, upon approval of this application, to permit the Superintendent of the Division of State Police or his authorized representative, ar any an all times ro enter any room, building or other places where said equipment is installed for the purpose of making an inspection thereof or for such other purposes in connection with the system as may be deemed necessary. -3- THIS AGREEMENT shall begin on the day of ,2 , and continue thereafter, within the appropriations made and provided for such purposes, unti} it shall be terminated by written .n0fice, given by the: Superintendent of the Division of State Police. Cochran Jr. Town of Southoid Police Department Peconic, New York 11958 Dear Lieutenant Cochran: Thank you for your correspondence of February 4, 2000, expressing your agency interest in establishing a computer interface with NYSPIN. To participate, your agency will be required to pay the cost of the data communications circuit and equipment associated with the interface. Your obligation would include the recurring service and maintenance costs. Maintenance support will be provided on a 24 hour-a-day, 7 days-a-week coverage with a guaranteec 4 hour repair of the NYSPIN data communications hardware. The following estimate of the data communications costs, associated with linking your computer system with NYSPIN, is provided for your consideration: Data Communications Circuit Installation No Additional Cost Data Communications Circuit $ 211:00 $ 2,532.00 Maintenance Support $110,00 $1,320.00 TOTALS $ 321.00 $ 3,852.20 - Any additional costs incurred to provide NYSPIN service including the physical connection from your interface equipment to the location of the NYSPIN data facilities are the responsibility of your agency. Cochran, Jr. October 12, 2000 Page 2 If you wish to pursue a computer interface with NYSPIN and are willing to absorb the data communications costs as estimated above, please advise us so that we can provide you with the necessary contracts and agreements. Your agency will be billed by the Division of State Police one year in advance for the monthly data communications circuit and maintenance support costs. Please include your projected timetable for completing the interface. Presently, NYSPIN is undergoing a major upgrade that includes replacement of data circuits, data communications faci!jtie$, f~IYSPIN workstations and networkwide s~ftware replacements.
