(2) a 12' × 33' deck is proposed on the west side of the house. presently the house sits on concrete block piers. A full foundation is proposed. (4) enlargement of the existing second ~loor is proposed. A dormer on the north side of the house as' well as a second floor area over [he existing screened porch is proposed. (5) the existing screened porch ~s proposed to be enclosed to p~-ovide space for the relocated kitchen. The existing kitchen area will become a dining a cove off the livin9 room. The CAC recommends denial due to the scope of-the project and feel a permit is~ absolutely required. They are concerned about the sediment into the creek and concerned about the sanitary system. Dear Sirs: My office represented Mt. and Mrs. William Childs in the purchase of their property on Peconic Bay Blvd. in Laurel, NY on March 29, 1991. The property has 23.97 feet frontage on Brushes Creek. There is a bulkhead and a small fixed dock, as more fully set forth in your file No. 9-88-145-4~2,1 (Marie Nersoyan). The adjacent neighbor, James Murray, apparently is conducting a marina business and rents out 8 to 10 mooring spaces to neighboring owners in the vicinity. I assttme he has the sufficient permits and approvals for such. Omc main concern is that the boat in the end slip (Grady White) infi'inges on the property of Mr. Childs, making it hazardous for Mr. Childs to use his dock without doing damage to the respective boats. Mr. Childs has requested Mr. Murray to move the mooring pole a little to.the left but, so far, he has been adamant about it and has refused to cooperate. It does not seem like a major problem, but we do need your assistance in resolving the difficulty between the '?¢o-'~,~ you please a~ange to have the Bay Constable look into the matter and perhaps have Mr. MUrray move the moo.ring away from Mr. Childs' dock? For your records, I have enclosed a copy of the Survey and tried to depict the situation as it presently exists. I am also enclosing photos o£ the boat which is clearly within the area which Mr. Childs has the right to use. Moreover, bulkhead removal and replace- menu in kind and in place are not subject even no the per fo~t charge. Therefore, as this projec~ eh,tails the removal and replacement of an existing bulkhead, it is my belief that the fee due will be based upon the square foot- age of the deck (4' x 20' 80 square feet) 80 x $1.50 sq. ft. $120. Three pilings no support the deck at $25 per pile = $75. Therefore the total is $195. ~ ~ ~ An interesting ~uestion arises, however, in that we are removing a 8' x 11' existing deck. Therefore, could non the "new" structure be considered a "replace- ment'', albein not inu-kind, in-place. The discussion on fees did non address this situation. The CAC approves with the stipulation that the proper gradient is maintained to prevent the distruction of the bank and grasses. Also, due to the large number of boats and the popular use of the marina the CAC feels the Southold Town Trustees should require a pumpout facility at the marina. MHI Road, 'Mattituck. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 669 of Marie Nerosyan to remove and replace (in same location and configuration) 23 I.f. of existing timber bulkhead and attach to existing bulkheads to north and south. Kruse to construct 45' of 4' catwalk, 80' of 6' dock, 8' x 40' float dock with a 201 ramp and related mooring pilings.
