Pursuant to 15 CFR Section 930.63, and based upon the project information submitted, the Department of State concurs with your consistency certification subject to the condition that no dredging shall take place during the period June 15 to September 30. This condition will minimize any adverse effects that the proposed dredging will have upon the spawning of bay scallops and hard clams. This concurrence is without prejudice to, anddoes not obviate the need to obtain all other applicable licenses, permits, and approvals required under existing State statutes. Smith applied to the Southold Town Trustees for a permit under the provisions.~ of the Wetland Ordinance of the Town of Southold, application dated September 11, 1985 and, WHEREAS, sai.d application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations and, WHEREAS, a public hearing was held by the town Trustees with respect to said application on December 26, 1985 at which time all interested persons were given an opportunity to be heard, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and WHEREAS, the Board considered all testimony and documentation submitted concerning this application; and it is noted for the record that there has been no public opposition~ and W~EREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED that the Land Use Company on behalf of Henry P. Smith be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application. This permit will expire on December 26, 1986 if work has not commenced by said date. There shall be two inspections required; and the Trustees shall be notified when the projecu is complete. At the Council's request, Henry Smith was in astendance to answer the questions raised a~ the previous meeting regarding his Wetland Application No. 313. Regarding the amount of dredging to take place, Mr Smith informed the Council that the application had been amended from the original 1000 c.y. of dredging to 96 c.y. When questioned about the placement of dredge spoils, he explained the dredge spoils would be loaded on a barge and unloaded ax Goldsmith's, then trucked away. The Council also wished to know if there had been any dredging done in the same area in the historic pasv. According To Mr. Smith, the CounTy had dredged in the area up to the park a~ the end of Youngs Avenue. REPORTS: Heather Cusack, the Council's STOP representative reported the program for 1986 would begin organizing in February and star5 getting information out To the public with special attention being given To businesses. Ms. Cusack-also reported un a request received from Councilman Paul Stoutenburgh. Councilman Stout~nburgh woul~ like the CAC to ~ '~ * Pa~e 2 make up a map showing all the places in the area with drainage pipes going into creeks. It would help pinpoint sensitive areas. The Council felt that it was a worthwhile project. Council Chairman Martin Garrell will contact Paul Stoutenburgh to ~et up organizing and financing the project.
