Dear Mr. D'Angelis: The following action was taken by the Board of Town Trustees during its regular meeting held on July 26, 1990 regarding the above matter: WHEREAS, STV/SAI~DERS & THOMAS IN BEHALF OF USDA at Orient applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 15, 1990 and, WHEREAS said application was referred~ to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on July 26, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not-affect the health, safety and general welfare of the people of the town, NOW, TP~EREFORE BE IT RESOLVED THAT STV/SANDERS & THOMAS IN BEHALF OF USDA at Orient BE AND HEREBY IS GRANTED PERMISSION UNDER THEWETLANDOPCDINANCE TO: install replacement of existing bulkheads along approximately 200 feet of northern end of OrientPoint Harbor Facility, removal and replacement of an earthen finger pier at the north end of the harbor with a wooden finger pier; and install mooring piles and a maneuvering dolphin associated with the pier. © © This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to ~be notified upon completion of said project. Box 848 Greenport, NY 11944 RE: Permit ~ 38478 Bulkhead Replacement Dear Mr. Hassildine: This letter will confirm our conversations of April 1, 1991, my conversations with fellow Town Trustees on March 28, 1991, the official minutes cf the public hearing in the matter of the Plum Island Animal Disease Center (PIADC) wetland permit application % 5-2-90-15-9-9 of September 26, 1990 and the Town wetland permit issued by virtue of the unanimous Board vote of that date. In reviewing and discussing the permitting aspects of the above referenced bulkhead replacement, the Town Trustees recognized the potential impracticability of completely capturing all .on-site drainage during the bulkhead replacement phase of what will eventually be a parking lot-boat basin upgrade. Accordingly, at the public hearing, we discussed the possibility that some direct runoff discharge to surface waters (including re-creating temporary drains into the basin) could be an allowable short term (3-4 year maximum) drainage resolution pending final correction when the parking area is re-designed/re-built. At the public hearing, Mr. Escarcega, representing PIADC, presented what we believe to be PIADC's good faith representation to discontinue all direct stormwater discharge to the boat basin in the near future (hopefully within 3-4 years). Further, it is/was our understanding that the drainage improvements wouldbe linked solely to the parking lot re-surfacing. This is because we believe this correction is a matter most closely related to the practical aspect of rebuilding and resurfacing the parking area. (which is probably the major contributor of site specific stormwater runoff discharge to Gardiners Bay). I must emphasize that the Board of Trustees was very pl~ase~ to Seethe eliminati~n of all drains through the bulkhead in the submitted plans. However, sufficient discussion was had u_~. It should be noted that information submitted by mail is considered just as carefully in the permit decision process and bears the same weight as that furnished at a public hearing. Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect any Federally endangered or threatened species or their critical habitat. However, pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting with the appropriate Federal agency to determine the presence of and potential impacts to listed species in the project area or their critical habitat. Based upon a review of the latest published version of the National Register of Historic Places~ there are no known sites eligible for, or included in, the Register within the permit area. Presently unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the required permit. Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of the guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority of Section 404 (b) of the Clean Water Act and the applicant will obtain a water quality certificate or waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior m a permit decision. Pursuant to Section 307 (c) of th9 Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be conducted in a manner that is consistent with, the approved state coastal zone management program. By this public notice, we are requesting the state's concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be made until one of these actions occur. Describe Known Prior Operations Conducted on Premises: The USDA operates ferry service between the Orient Point ~arbor and Plum Island Facility for the purpose of supply and transporting employees and official visitors to and from the Plum rsland Animal Disease Center. 'Describe Fully the Rehabilitation of the Property: The scope of work proposed is restorative of the harbor function cnroug~ relqabilitation of a portion of the bulkhead with minimal bulkhead movemens, finger pier replacement, and installation of mooring piles and a maneuvering dolphin associated with the pier. As such, expeditious performance of the proposed work is necessary to assure continued, safe operation of the USDA ferry service without interruption of research facility operations at Plum Island. Describe Proposed Condition of ~erty After Work is Completed: As a result of the work, kO c~a~ge~in the harbor design or function will result.
