POLICY: At scheduled Town Board meetings, the attending public is encouraged to briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be given time at the conclusion of the regularly scheduled business agenda to address the Board on any given topic. Call to Order. Pledge of Allegiance. Approval of the Audit of Bills of January 6, 2004. Approval of the Minutes of the December 2, 2003 Meeting. RESOLUTIONS Special Note: At the start of the Town Board Meeting the Supervisor will invite the public to speak on the following resolutions. 1. Authorize and direct Supervisor Horton to sign a proposed Letter of Agreement with Brookhaven Town for the disposal of construction and demolition materials. 2. Authorize and direct the Town Attorney to send a Letter of Release from Claims to be submitted by Terry Contraction and Materials. 3. Establish the rate of pay for the combined position of Driver/Traffic Control Officer/School Crossing Guard. 4. Authorize modification to the General Fund Whole Town 2003 budget to appropriate funds for a fax machine. Set 8:10 p.m., January 20, 2004, Southold Town Hall, as the time and place for a public hearing on the purchase of development rights on agricultural lands ofDubner, SCTM #1000-84-1-8 and 24515 CR 48. Set 8:15 p.m., January 20, 2004, Southold Town Hall, as the time and place for a public hearing on the purchase of development rights on agricultural lands ofDubner, SCTM #1000-84-4-6.1 and 3670 Cox Lane. 7. Accept the bid of Charles Greenblatt, Inc. to supply police uniforms to the Police Department for 2004. 8. Accept the bid of Hoppy's Cleaners to clean police uniforms for the Police Department for 2004. 9. Authorize and direct Supervisor Horton to execute an agreement with the Village of Greenport for half the cost of moving the telecommunications equipment building. Promote Stacey Norklun to the position of full-time Data Processing Equipment Operator. Authorize and direct Supervisor Horton to execute an agreement with PhoneReview for reduced rate calling and access plan. Authorize modification to the Highway Fund 2003 budget to appropriate FEMA and SEMO revenue for snowstorm disaster relief. Appoint Bonnie Aldcroft as a part-time Student Intern in the Town Clerk's office. Accept the resignation of John Ford, part-time Mini Bus Driver with the Human Resource Center. Authorize modification to the General Fund Whole Town 2003 budget for contracted services, Programs for the Aging. Authorize modification to the 2003 Solid Waste District budget for various supplies and materials. Authorize Michael Verity, Damon Rallis and Patricia Conklin of the Building Department to attend a Wind Resistant Construction Seminar on February 11, 2004 in Lindenhurst. Authorize modification to the 2003 Planning budget to cover overdrawn environmental and moratorium budget lines. Create a "Risk Retention Fund" and authorize modification to the General Fund Whole Town, Part Town and Solid Waste District 2004 budgets to establish said fund. Authorize modification to the Whole Town 2003 budget for over-expended appropriation lines. Authorize modification to the 2003 Solid Waste District budget for various over-expended appropriations. Authorize modification to the General Fund Whole Town 2004 budget, a capital transfer to reduce the amount needed to borrow for the Waterways Improvement project. 25. Authorize the Southold Town Justices to provide judicial services to the Town of Shelter Island until a replacement for the late Justice Hannabury can be appointed. 26. Determine that the purchase of development rights of approximately 4.6 acres of agricultural property of NYS Federation of Growers & processors Assoc., Inc., a/k/a Grace's Place, SCTM #1000-74-4-4.9, is an Unlisted Action pursuant to SEQRA, 6NYCRR 617.1, and that there will be no significant negative impact on the environment. 27. Determine that the purchase of development rights of agricultural property of Manzi Trust, Robert Arnone & Others as Trustees, SCTM #1000-83-2-9.1, is an Unlisted Action pursuant to SEQRA, 6NYCRR 617.1, and that there will be no significant negative impact on the environment 28. Authorize and direct the Town Clerk to advertise for the position of Construction Equipment Operator. 29. Determine that the proposed "A Local Law in Relation to a Sixty (60) day extension of the Temporary Moratorium on the Processing, Review of, and making Decisions on certain applications (new or pending) made to the Board of Trustees pursuant to Chapter 97 Wetlands of the Code of the Town of Southold" is a Type II Action pursuant to SEQRA, 6NYCRR Section 617.5 and is not subject to review. 30. Determine that the proposed "A Local Law In Relation to a One Hundred and Eighty (180) Day Extension of the Temporary Moratorium on the Processing, Review of, and making Decisions on applications for Major Subdivisions, Minor Subdivisions and Special Exception Use Permits and Site Plans containing Dwelling Unit(s) in the Town of Southold" is a Type II Action pursuant to SEQRA, 6NYCRR Section 617.5 and is not subject to review. 31 Authorize and direct Supervisor Horton to sign a contract with Cornell Cooperative Extension for work on the Wetlands Code. 32. Direct the Southold Town Building Department to conduct an inspection of the structure and property at 11155 Route 25, Mattituck, in accordance with Chapter 90 of the Southold Town Code to be completed and filed by January 16, 2004. 33 Set 5:00 p.m., February 3, 2004, Southold Town Hall, as the time and place for a public hearing on "A Local Law in relation to Amendments to the Ethics Code". Adopt the amended Solid Waste Management District Fee Structure as follows: Municipal Solid Waste $110/ton, Brush $60/ton, Leaves $10/ton, Refrigerant items $20/unit. 35. Approve the offering for sale, subject to permissive referendum, of the property located at 52875 Main Road, Southold, SCTM #1000-61-1-5, known as the "Whitaker House", subject to a "Declaration of Covenants and Restrictions" designed to preserve the unique and historically important nature of the property and the architectural character of the building. 36. Declare that the structures located at 495 Linnet Street, Greenport, are unsafe and direct that service of this notice be made on the owner of the premises in accordance with Chapter 90 of the Southold Town Code. 37. Approve the purchase of a development rights easement on agricultural lands of Manzi Trust, Robert Arnone & Others as Trustees, SCTM #1000-83-2-9.1. 38. Approve the purchase of a development rights easement on agricultural lands of NYS Federation of Growers & Processors Assoc. (a/k/a Grace's Place), SCTM #1000-74-4-4.9. 39.
