Work Session
Present: Supervisor Joshua Y. Horton, Justice Louisa P. Evans,
Councilman Thomas H. Wickham.

Supervisor Horton presented the Town Board with a proposed resolution for the sale of the Whitaker
House. A lengthy discussion by the Town Board followed. Councilman Romanelli said that he would
not be afraid to knock it down and rebuild it with the historic streetscape but with efficient office space
inside for town offices. Supervisor Horton advised that the town has received an offer on it with the
covenants and restrictions. He feels that town hall could be expanded from the back out to Traveler
Street. He also wants to review the costs and estimates of moving to North Fork Bank. Councilman
Wickham advised that his agreement to move to the bank was a short term solution. Supervisor
Horton stated that he thought that they are all in agreement on this, but it would behoove them to know
the dollar amount of the move to compare it against what it could get them here at town hall. He feels
that the back of Town Hall could be built out to Traveler Street. Councilman Romanelli asserted that
you still must have someplace to go during an addition or renovation. Councilman Wickham reiterated
that his agreement to move to the bank was a short term solution. Supervisor Horton declared that
everyone was in agreement on the move, but, he feels that it behooves everyone to know the dollar
amount of the move and what this amount could get us here at town hall. Supervisor Horton said that
he has asked the Town Engineer Jamie Richter to put together a package for the costs of moving
infrastructures, telephone and computer lines, etc. Councilman Romanelli said that it is necessary to
know these costs just for the operation of business, but it shouldn't hold up the lease of the bank. We
need some place to put the people to work while the space problem is being solved. Supervisor
Horton advised that he has Lloyd Reisenberg of the Data Processing department putting together the
dollar numbers of the cost to move the communications and Light Path. Town Comptroller John
Cushman already did a dollar estimate on the lease numbers and Town Engineer Jamie Richter is
putting it together. Councilman Romanelli stated that at this time he would vote no to any resolution to
sell the Whitaker House. He is of the opinion that it is just not a good business wise decision to sell an
adjoining piece of property. He would like to knock down the house that is there and build a replica of

the street scape original Whitaker house with functional office space on the inside. He feels that there
is a value to the Town of keeping the historical look and street scape. Supervisor Horton's proposed
resolution was not placed on the agenda at this time.
9:30 AM Appointment Melissa Spiro, Land Preservation Department Head appeared before the
Town Board to discuss several properties for open space and farmland development purchases. The
first parcel owned by Zoumas Contracting Corp. (open space) SCTM # 1000-79-4-17.17 consisting of
approximately 32 acres (resolution no. 456). The second parcel owned by John Q. Adams (open
space) SCTM# 1000-56-1-8.1 and SCTM#1000-56-1-10 consisting of approximately 27.9 acres
(resolution no. 457). The third parcel owned by Robert Webber (farmland development rights) this is
a standard PDR at Orient east of Narrow River Road, 8.9 acres cutting out the house SCTM#1000-19-
1-11.3 (resolution no. 458). The fourth parcel is the Ciacia piece to the south of Ashamomaque
Preserve and the Levin/Bloom piece. It is currently owned by Suffolk County for tax arrears. SCTM
#1000-45-1-10. They are asking the County to transfer it back to the Town so that the Town can use it
for municipal park purposes and manage it. Executive Administrator James McMahon drafted a
resolution which Mr. Spiro read to the Board. The Town Board directed that this resolution be added to
the agenda (resolution no. 473). The last item Ms. Spiro apprised the Town Board of was the Federal
Farmland Grant under the Federal Farm and Ranch Lands Protection Program FY2003. It is a 50/50
match program where the Town of Southold received a $294,000. grant notification for five farms. It
will be necessary for the Town to file a specific application for a grant for these funds. A resolution
was placed on the agenda to authorize the Supervisor to execute this grant application (resolution no.
467). Ms. Spiro advised the Town Board that the total number of acres in the pipeline is 953. These
are things that are actively being worked on by the Town or the Peconic Land Trust and that people are
reasonably expecting to close on, not just a phone call or an inquiry. She said that she thinks that all the
Town Board has to know is the totals. What is under contract in acres? What is still being pursued?
The number changes every two weeks. Ms. Spiro will be back for Executive Session this afternoon to
discuss some potential property acquisitions.
The Town Board recessed at 10:00 AM for a short break.
The Town Board reconvened at 10:16 AM and discussed IV. For Discussion Items. IV. 1.
Domestic Partnership Registry proposed local law was presented to the Town Board. The Town
Board referred it to the Anti-Bias Task Force for their input. IV. 2. Request for Special Legislation
from State re: Ferry User Fee (Safety environmental Fund) Supervisor Horton advised that this
would be a tax for a ferry user fee and it would go to the Town. It would have to be adopted by the
New York State Legislature. The Supervisor questioned if the site plan issue had been resolved. The
Town Attorney replied that there have been questions on compliance with their site plans. Councilman
Romanelli advised that they completed the site plan, but the Town should follow-up and be certain that
they actually "do it according to the approved plan". The Planning Board will be asked to do a status
report; code enforcement has been working on it and will give us a memo on it. Justice Evans stated
that she doesn't have a problem with it as long as it is limited to the Cross Sound Ferry and not the
Fishers Island Ferry. Councilman Wickham questioned the proposed shuttle service between a parking
area at Riverhead and the Cross Sound Ferry. Supervisor Horton said that the State and County are
working with him on those proposals. A discussion was also held on the hazardous conditions created
by cars parking along side of the road at the terminus of Route 25 in front of the ferry terminal. The
Town contacted the State to request "no parking signs" there, but they refused to do. Supervisor

Horton will send a letter to NYS Assemblywoman Acampora and Senator LaValle regarding initiating
this special tax. IV. 3. DGEIS Build-Out. Councilman Romanelli stated he put this on the agenda in
order to start the ball rolling. A lengthy discussion ensued regarding the setting of Town Board goals
for the number of available houses or dwelling units, preservation of single and separate lots,
preservation goals for farmland, affordable housing, diversity of housing options, etc. However, no
decisions were made. Further information from the moratorium team is needed to continue the
discussion on the build-out.
The Town Board reviewed the resolutions to be voted upon at the regular meeting this evening.
This work session recessed at 11:40 AM to be reconvened at 1:00 PM
The Town Board was of the opinion that they probably would not vote on the local laws that are the
subject of public hearings this evening, other than the 90 day extension of the Moratorium on
Subdivisions.
On motion by Councilman John Romanelli, seconded by Justice Louisa Evans, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into Executive Session at
1:09 PM for the purpose of discussing property acquisitions~ contracts~ and personnel - a
particular person.
Vote of the Town Board: Ayes: Councilman Wickham, Councilman Richter, Councilman Romanelli,
Councilman Moore, Justice Evans, Supervisor Horton.
This resolution was declared duly ADOPTED.
On motion by Councilman John Romanelli, seconded by Councilman Thomas Wickham, it was
RESOLVED that the Town Board of the Town of Southold hereby exits from this executive session
at 2:50 PM.

A General Meeting of the Southold Town Board was held Tuesday, July 29, 2003 at the
Southold Town Hall, Southold, New York. Supervisor Horton opened the meeting at 4:30 P.M. with
the Pledge of Allegiance to the Flag.

SPECIAL PRESENTATION-OFFICER ROBERT J. CONWAY
SUPERVISOR HORTON: Robert J. "Bobby" Conway, a most dedicated police officer, is retiring
after thirty-six years of service to the people of Southold; and
WHEREAS: Bobby began his association with the Southold Town Police Department in June of
1967 as a Seasonal Police Officer and became full time in December of that same year, consistently
going out of his way to protect and serve those who have called upon him for assistance; and
WHEREAS: esteemed by the public and his fellow officers alike and appreciated for his strength of
character, in 1998 Bobby was selected as the American Legion Griswold-Terry-Glover Post 803 Police
Officer of the Year, noting his bravery and quick response to a house fire without concern for his own
safety; and
WHEREAS Bobby has become part of the fabric of the Southold Town Police Department, and his
dedicated and selfless service will be sorely missed by those for whom he has made a difference for so
many years; now, therefore, be it
RESOLVED: that the Town Board of the Town of Southold hereby congratulates Police Officer
Robert J. Conway on a job well done, and extends heartfelt warm wishes for a happy and healthy
retirement filled with fishing, traveling and spending time with family.

SUPERVISOR HORTON: It is the policy of the Town Board to offer the floor to the public two times
over the course of the Town Board meeting. The first is prior to the reading and voting on any of the
resolutions that are on the printed agenda, you may address the Board on any of the specific resolutions
and the second time that we also offer the floor to the public is at the conclusions of the resolutions, if
you would like to address the Town Board on any town related issues or town issues. As well, we
have a number of public hearings, there will be time to address the Town Board on those specific
public hearings as soon as those public hearings are opened up. Would any one like to address the
Town Board on these resolutions?
KATHY TOLL: Good afternoon, Kathy Toll, Greenport. Could you just give a brief explanation on
#466, what easements and whether or not the reputed parcel owners have been given due notice by the
Town and by what means was that notice given? And my second question is regarding #472,
Community Preservation Fund expenditure for improvements of the Custer Preserve Site, I am curious
as to whether Capital Improvement type items are permissible under the Community Preservation
Fund legislation.
COUNCILMAN ROMANELLI: I will answer the first one for you. #466, those are temporary
easements for capping the landfill. Those were all the properties owned on the perimeter of the landfill
that we got the easements for the County to process, where we are coming to the closure of the
capping, we are extinguishing the easements, we don't need them anymore, along the perimeter of the
landfill. That is what they are.
MS. TOLL: So it wasn't the property owners having access to Town property, it was the Town having
access to their property?
COUNCILMAN ROMANELLI: Right.
MS. TOLL: Okay, thank you.

COUNCILMAN WICKHAM: And I can address your second question. The Custer Preserve had a
proposal for the installation of a water tank, irrigation well and support building. And there is a
manager that identified with that and the total thing would cost $13,800. The Land Preservation
Committee recommended that funds be used from the 2% fund to help finance that. It was proposed,
recommended and adopted by the Committee and also recommended by the Tree Committee. And it
comes to the Town Board for approval.
SUPERVISOR HORTON: Essentially what that open portion of that is going to be used for is
planting and maintaining trees that will be used in a .... and when trees are dedicated throughout Town,
through the tree dedication program, that will be a place where trees are kept and maintained for that
program.
MS. TOLL: The program sounds wonderful, I commend all the improvement of property. I was just
curious as to whether this has been researched as to whether this is an appropriate expenditure under
the Community Preservation Fund legislation, has that been examined by the Town Attorney?
SUPERVISOR HORTON: Yes. That has been a question that many of us have asked as well on prior
projects. That has been researched as being legal and permissible.
MS. TOLL: Okay, thank you.
SUPERVISOR HORTON: Are there other questions on any of the resolutions? Yes, sir.
DAVE BAKOWSKI: I don't know if I am jumping the gun here. My name is Dave Bakowski, I live
in Cutchogue. It is in reference to the open discussion for #4 and #2.
JUSTICE EVANS: Do you mean the public hearings?
MR. BAKOWSKI: Well, it says for discussion. I am the (inaudible) for the general manager for the
Cross Sound Ferry and ! would just like to drop off a letter to the Town. Can ! present that to you?
SUPERVISOR HORTON: You can bring that right here and we will make sure that it becomes part of
the public record. Thank you.
MR. BAKOWSKI: Thank you.
SUPERVISOR HORTON: Are there other questions on any of the resolutions? Mrs. Egan.
JOAN EGAN: Yes, good evening or good afternoon, Mr. Horton, Mr. Richter, Mr. Romanelli, Mrs.
Evans, Mr. Wickham, Mrs. Neville and Mr. Yakaboski. ! have quite a few things. So, relax and don't
rush me. It seems like you are rushing through a lot of things. You must have a hot date tonight.
Now, #445 and this is addressed to Mr. Horton. Would it be more prudent to hire more Safety
Dispatchers or to pay overtime because some of them get very tired and they don't do a good job.

SUPERVISOR HORTON: The answer to that question is it is more prudent to hire more full-time
Dispatchers and while we are in the process of canvassing, interviewing and hiring- this will get us
through that, over the hump. While we have the shortage.
MS. EGAN: Well, I would be very careful there. I take a great deal, I don't know what the correct
word is, #447, when they determine that Supervisor Horton or his successor, I don't think that that
phrase successor, I think that is a rather rude thing to say. That is to me that implying that Mr. Horton
will not be his own successor. That was wrong and rude. Now, on #448, we are going to be sending
Connie Solomon to training, will she be staying overnight and we have to pay her travel expenses ....
will that be a day trip, will she be staying up there or not? I am speaking to Mr. Horton.
SUPERVISOR HORTON: These will be day trips, during the workday.
MS. EGAN: Good. And she will be paid expenses, she should be. Alright, now on #449, why are we
changing the student intern?
SUPERVISOR HORTON: One has departed and we have .....
MS. EGAN: So now we have to break someone else in? I congratulate you on #451, now this
Strawberry Fields fairground, I get concerned about chemicals, so we will leave that alone. Now, on
#459, now, Mrs. Neville is the Town Head Clerk. I would presume that this is for another office?
SUPERVISOR HORTON: That is correct.
MS. EGAN: Which one?
SUPERVISOR HORTON: That would be the Building Department.
JOAN EGAN: #460. Now, what is that all about?
SUPERVISOR HORTON: #460 is to pay for welding supplies, tires, a Ford Tractor, tire repair and
glass removal.
MRS. EGAN: So, what do you mean by modification? Spend money?
SUPERVISOR HORTON: Moving it from one budget line to another, within the budget of that
department.
MRS. EGAN: But that would be more money spent, of course. Now, item 463, I would imagine that
that was what you mentioned before that the head clerk in the Building Department, those should have
been put together. Oh, this one really bothered me, maybe I think I read it in the paper. #465,
authorize and direct Supervisor Horton to execute a loss statement for Kemper Insurance. The loss is
sustained in the Human Resource Center. Now, did I not read in the paper that something was broken
or stolen up there?
SUPERVISOR HORTON: Mrs. Egan, this is ....

MRS. EGAN: That would lead me to believe that it isn't being taken care of properly.
SUPERVISOR HORTON: Okay.
MRS. EGAN: Oh, oh. This is a very important one, #467, now these credit card companies are
getting even stricter than they had before, which is important. Do the people that have credit cards
know their pin number? If they don't know their pin number and they have a problem .....
SUPERVISOR HORTON: This isn't a credit card.
MRS. EGAN: Oh, it is not? But people up here do have a credit card, ! believe.
SUPERVISOR HORTON: Yes.
MRS. EGAN: Well, make sure they know their pin number because if they don't .....
SUPERVISOR HORTON: Okay.
MRS. EGAN: .... excuse me, ! am not finished. It can take four to six weeks because they cannot
verbalize that over the telephone. Now, we have another resignation here, on #471. Now are we going
to have to appoint somebody else or are we just accepting the resignation and filling in...
SUPERVISOR HORTON: We will fill that position.
MRS. EGAN: You will fill that position. Now, ! will briefly say here, the public hearings: five
minutes for this one, five minutes for this one, five minutes for this one, five minutes for this one and
five minutes for this one. It ain't gonna happen that way. Thank you.
SUPERVISOR HORTON: Thank you, Mrs. Egan. Would anyone else care to address the Board on

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Joshua Y. Horton to sign an agreement between the Town of Southold and CSEA
relative to Public Safety Dispatcher overtime extending said period to December 31, 2003.

Moved by Justice Evans, seconded by Councilman Wickham,
WHEREAS, The Town of Southold herein called the "Municipality", after thorough consideration of
the various aspects of the problem and study of available data, has hereby determined that certain
work, as described in its application and attachments, herein called the "Project", is desirable, is in the
public interest, and is required in order to implement the Project; and
WHEREAS, Article 56 of the Environmental Conservation Law authorizes State assistance to
municipalities for water quality improvement projects by means of a contract and the Municipality
deems it to be in the public interest and benefit under this law to enter into a contract therewith;
NOW, THEREFORE, BE IT RESOLVED BY The Town Board of the Town of Southold
1. That Supervisor Joshua Y. Horton or such person's successor in office~ is the
representative authorized to act in behalf of the Municipality's governing body
in all matters related to State assistance under ECL Article 56~ Title 3. The
representative is also authorized to make application, execute the State Assistance
Contract, submit Project documentation, and otherwise act for the Municipality's
governing body in all matters related to the Project and to State assistance;
1. That the Municipality agrees that it will fund its portion of the cost of the Project and that
funds will be available to initiate the Project's field work within twelve (12) months of
written approval of its application by the Department of Environmental Conservation;
2. That one (1) certified copy of this Resolution be prepared and sent to the Albany office of
the New York State Department of Environmental Conservation
3. That this Resolution take effect immediately.

RESOLVED that the Town Board of the Town of Southold hereby authorizes Deputy Town
Comptroller~ Connie D. Solomon~ to attend the Basic Accounting School training seminar for
Government Employees given by the Office of the State Comptroller on Tuesday, September 9
through Thursday, September 11, 2003 in Hauppauge, and be it further
RESOLVED that Connie Solomon be authorized to use a Town vehicle for travel and the cost of
registration materials shall be a legal charge to the Accounting & Finance Department's 2003 budget
(A. 1310.4.600.200).
SUPERVISOR HORTON: Just let the record note that the date is September 9 through September 11.

RESOLVED that the Town Board of the Town of Southold hereby accepts the resignation of Bonnie
Aldcroft from her position of Student intern in the Town Clerk's office, and be it further
RESOLVED that the Town Board of the Town of Southold hereby appoints Michael W. Doroski to
the position of student intern in the Town Clerk's office, effective immediately at a rate of $
9.54/hour.

RESOLVED that the Town Board of the Town of Southold hereby appoints Sally Paukhurst to the
position of part-time Assistant Cook for the Southold Town Human Resource Center, at a salary
of $13.18 per hour, effective July 30, 2003.

some direction on this and to get her thoughts on this, as she is the closest residential neighbor. I don't
want to speak for her but the sense that she conveyed to me was that this would not negatively impact
her, as there is already a business located adjacent to her. So that is something that I wanted to convey
to the Board and also to the public that this is not a parcel that is within the Church Lane or within the
heart of the Church Lane community that we are looking to address. Are there further comments from

Town of Southold
BE IT ENACTED BY, the Town Board of the Town of Southold as follows:
Section 1. PURPOSE
Moratorium Extension
I. Legislative Intent
A Town-wide moratorium was enacted by the Town Board of the Town of Southold on August 20,
2002. The moratorium was intended to provide sufficient time for the Town to consider the
recommendations of the Blue Ribbon Commission and to comprehensively review Town planning
issues such as affordable housing, completion of the Local Waterfront Revitalization Plan (LWRP) and
understand needed public infrastructure including consideration of hamlet areas and transportation
systems.
The Town Board established a moratorium planning team consisting of the Town attorney, Town
planner and land preservation coordinator, as well as two planning consultants and two legal
consultants. The team was directed to review Town planning goals, past planning studies, and studies
that assist the Town Board in achieving the goals of the Town. The moratorium planning team
established a schedule of tasks which included past plan review, synthesis of planning
recommendations, obtaining input from Committees and Boards, assessment of Town planning and
zoning policies, and utilization of a Generic Environmental Impact Statement (GELS) procedure to
inform the Board, involved agencies and the public of the Town's initiative. In addition, the GElS was
intended to take a "hard look" at the implications and potential impacts of the comprehensive
implementation strategy, allow for review of mitigation and alternatives, and provide a procedure to
allow a rational and logical implementation strategy to evolve from an organized process. The Town
Board authorized the moratorium planning team to proceed with the task and schedule provided to the
Town Board of October 8, 2002.
The moratorium planning team has met on a weekly or as-needed basis to advance the tasks and
schedule as authorized by the Town Board. The team has completed a number of important tasks to
date, including:
· review of past studies;
· synthesis of past planning recommendations;
· review of Town Code, policies and definitions;
· preparation of Geographic Information System (GIS) resource maps in cooperation with Town
data processing staff to document Town characteristics;
· review of technical information and facts to be used in completing the GElS and planning
initiative review;
· initial review of Town affordable housing policies;
· initial review of hamlet centers, transition zones and rural areas of the Town;

· meetings and interviews with Town staff and department heads;
· preparation of materials and updates of ongoing activities that were placed on the Town's
website for public information purposes;
· public informational meetings, Town Board updates and dialogue with the Town Board
regarding policy considerations;
· preparation of draft documents for Town Board implementation and conformance with State
Environmental Quality Review Act (SEQRA) procedures;
· preparation of a build-out analysis;
· preparation of the Draft GELS; and
· three public hearings on the Draft GELS.
The Town Board recognizes the need to comply with SEQRA, and understands the value of this
process. The action is of Town-wide significance and is considered to be a Type I action which is more
likely to require an environmental impact statement. As a result, the Town Board has adopted a
number of documents in conformance with SEQRA, including the following important steps:
· classification of the action as a Type I action;
· designation of the Town Board as lead agency;
· preparation of an environmental assessment form;
· issuance of a Positive Declaration;
· receipt of a Draft Scope of the Draft GElS and setting of the public hearing;
· acceptance of a Draft GELS; and
· three public hearings on the Draft GELS.
Since the last extension of the moratorium the Town ahs adopted a final scope, completed and
accepted the Draft GELS, scheduled and held public hearings on the Draft GElS on three separate
dates. Recognizing the significance of the action, the need and desirability to comply with SEQRA
through the use of a GElS process, and the subsequent need to determine the ultimate series of
recommendations to be implemented, the Town Board seeks to ensure that sufficient time is set aside
to complete the SEQRA process, meet legal mandates and accommodate social needs. Due to public
interests in the DGEIS document, the Town Board held three public hearings and kept the hearing
process open until July 15th in order to facilitate greater public review and comment. Additional time is
needed beyond the expiration of the six (6) month extension of moratorium enacted by the Town
Board on February 4, 2003.
As a result, the Town Board of the Town of $outhold seeks to extend the moratorium for an additional
ninety (90) day period for the purpose of completing the Final Environmental Impact Statement
adopting Findings pursuant to SEQRA, allowing the Town Board to determine how to implement the
Comprehensive Implementation Strategy and permitting the Town Board time to implement those
actions needed to address the issues covered by this moratorium.
Section 2. ENACTMENT OF TEMPORARY MORATORIUM
For a period of Ninety (90) Days following the effective date of this Local Law after which date this
Local Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the Ninety (90) Day period:
1) the Planning Board shall not accept for review, continue review, hold a hearing or
make any decision upon any application for a subdivision, whether that subdivision
application was submitted prior to or after the effective date of this law. This law
applies to subdivisions (whether major subdivisions or minor subdivisions) as defined
in $outhold Town Code § A-106-13. The statutory and locally-enacted time periods
for processing and making decisions on all aspects of subdivision applications

(including, but not limited to, sketch plans, preliminary and final subdivision plats)
are suspended and stayed while this Local Law is in effect;
2) the Planning Board shall not accept for review, continue review, hold a hearing or
make any decision upon any application for a site plan containing DWELLING
UNIT(S), whether submitted prior to or after the effective date of this law, and shall
not be subject to the time periods specified in Town Law § 274-a and Article XXV
of the $outhold Town Code, including without limitation, provisions relating to the,
processing, reviewing, holding of hearings and the rendering of decisions. The
statutory and locally-enacted time periods for processing and making decisions on all
aspects of site plan applications containing dwelling unit(s) are suspended and stayed
while this Local Law is in effect
3) The Zoning Board of Appeals shall not accept for review, continue review, hold a
hearing on, continue a hearing or make any decision upon any application for a
special use permit which application is also subject to Planning Board approval
pursuant to the $outhold Town Code where the Planning Board is prohibited from
reviewing, processing, holding hearings on and making decisions on because of the
provisions of this local law, whether said application was submitted prior to or after
the effective date of this local law.
Section 3. APPLICATION
This local law shall apply to ALL [new or pending] applications for either subdivision approval or
special exception use permits and site plans containing dwelling unit(s) within the Town of Southold.
Section 4. EXCLUSIONS
This Local Law shall not apply to:
1) subdivisions for which final plat or conditional final plat approval was granted by the
Planning Board prior to the effective date of this local law;
2) setoffs as defined in the definition of "Subdivision" in Southold Town Code section A106-
13;
3) Lot line applications;
4) new or pending applications for the subdivision of a parcel of property where interests or
rights in real property (the fee or any lesser interest, development rights, easement,
covenant, or other contractual right ) to a portion of that parcel have been sold or gifted (for
purposes of permanent preservation) to either the Town of Southold (pursuant to either
chapter 6, 25 or 59 of the $outhold Town code); the County of Suffolk; the Peconic Land
Trust or the Nature Conservancy, prior to the effective date of this local law;
5) new or pending applications for the subdivision of a parcel of property where an executed
contract (dated prior to the effective date of this local law) exists to either sell or gift
interests or rights in real property (the fee or any lesser interest, development rights,
easement, covenant, or other contractual right ) to a portion of that parcel (for purposes of
permanent preservation) to either the Town of $outhold (pursuant to either chapter 6, 25 or
59 of the $outhold Town code); the County of Suffolk; the Peconic Land Trust or the
Nature Conservancy;
6) new subdivision applications where an applicant has entered into a contract (dated after the
effective date of this local law) to either sell or gift interests or rights in real property (the
fee or any lesser interest, development rights, easement, covenant, or other contractual
right) to a portion of that parcel(for purposes of permanent preservation) to either the Town
of Southold (pursuant to either chapter 6, 25 or 59 of the Southold Town code); the

County of Suffolk; the Peconic Land Trust or the Nature Conservancy; provided that that
portion of the property on which the interests or rights to property are being sold or gifted
encompasses at least seventy five percent (75%) of the entire parcel. The following areas
are not to be included in the calculation of the 75% threshold: that portion of the parcel
which is wetlands (as defined by Chapter 97 of the Southold Town Code), streams, creeks,
ponds, slopes over 15%, underwater land, land encumbered by easements or other
restrictions preventing use of such land for construction of buildings or development or
land within the coastal erosion hazard area as defined by Chapter 37 of the Southold Town
Code.;
7) a site plan application for a two-family dwelling;
8) a site plan application for a bed-and-breakfast;
9) a site plan application for an accessory apartment(s);
Section 5. CONFLICT WITH STATE STATUTES AND AUTHORITY TO SUPERSEDE
To the extent that any provisions of this Local Law are in conflict with or are construed as inconsistent
with the provision of New York State Town Law this Local Law supersedes, amends and takes
precedence over NYS Town Law pursuant to the Town's municipal home rule powers, pursuant to
Municipal Home Rule Law {} 10(1)(ii)(d)(3); {} 10(1)(ii)(a)(14) and {} 22 to supercede any inconsistent
authority.
In particular, this local law supersedes Town Law {} 276, Town Law {} 278, and Southold Town Code
{}{}{} A106-21, A106-22, A106-23 and A106-24, which require that the planning board act upon, hold
hearings on, and make decisions concerning subdivision applications (including, but not limited to,
sketch plans, preliminary and final subdivision plats) within specified time periods. This local law
suspends and stays the running of time periods for processing, acting upon, holding hearings on,
making decisions and taking action on such subdivision applications (including, but not limited to,
sketch plans, preliminary and final subdivision plats) provided for in those laws.
And, to the extent and degree any provisions of this Local Law are construed as being inconsistent
with the provisions of Town Law {}{}{}{} 267, 267-a, 267-b, 267-c or 282 relating to the authority to
grant variances, waivers or other relief from this Local Law, this Local Law is intended to supersede
and amend any said inconsistent authority.
And, to the extent and degree any provisions of this Local Law are construed as being inconsistent
with the provisions of Town Law {} 274-a and the provisions and requirements set forth in Article
XXV of the Southold Town Code, which require that the Planning Board process, review, hold
hearings on, and act upon applications for site plans within specified time periods, this local law
suspends and stays the running of time periods for processing, review, holding hearings on, making
decisions, and taking action on such applications provided for in those laws and is intended to
supersede and amend any said inconsistent authority.
And to the extent and degree any provisions of this Local Law are construed as being inconsistent with
the provisions of Town Law {}{} 267-a and 274-b and the provisions of Article XXVI of the Southold
Town Code, which require that the Zoning Board of Appeals act upon applications for special
exception use permits within specified time periods, this local law suspends and stays the running of
time periods for processing, reviewing, holding hearings on and making decisions on such applications
provided for in those laws and is intended to supercede and said inconsistent authority.
Section 6. APPEAL PROCEDURES
a. The Town Board shall have the authority to vary or waive the application of any
provision of this Local Law, in its legislative discretion, upon its determination, that such variance or
waiver is required to alleviate an extraordinary hardship affecting a parcel of property. To grant such

request, the Town Board must find that a variance or waiver will not adversely effect the purpose of
this local law, the health, safety or welfare of the Town of Southold or any comprehensive planning
being undertaken in the Town. The Town Board shall take into account the existing land use in the
immediate vicinity of the property and the impact of the variance or waiver on the water supply,
agricultural lands, open and recreational space, rural character, natural resources, and transportation
infrastructure of the Town. The application must comply with all other applicable provisions of the
Southold Town Code.
b. Any request for a variance or waiver shall be filed with the Town Clerk and shall
include a fee of five hundred ($250.00) dollars for the processing of such application, along with
copies of such plat showing all required improvements in accordance with the procedures of {}Al 06-25
, {} A106-27 and Articles lll and 1V of Chapter Al06 of the Southold Town Code.
c. All such applications shall, within five (5) days be referred to the Planning Board,
which shall have thirty (30) days following receipt to make a recommendation to approve or
disapprove a variance or waiver of this Local Law. The application and recommendation shall be
transmitted to the Town Board which may conduct a public_hearing and make a final decision on the
application, with or without conditions. Final approval is reserved to the absolute legislative discretion
of the Town Board
Section 7. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not effect the validity of this law as a whole or
any part thereof other than the part so decided to be unconstitutional or invalid.
Section 8. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by
law.
COUNCILMAN WICKHAM: 1 am voting for this although I believe that three months is inadequate.
But three months is better than nothing, so I am voting for it.

GEORGE PENNY: Good evening again, George Penny, Southold. I don't have my GElS and all my
paperclips or any of my maps with me this time but I would like to pass on to the Board a conversation
that I had just a few days ago with our retired Chief of Police, in his backyard as he was, I was on a
lunch break and he was retired so we all know what that is about. He told me, which really disturbed
me, that he came down to the Town Hall in the Town of Southold regarding a parcel of property which
is in his mother's name, which has been in the Conway family forever, I believe it is a AC or R-80
zone, probably AC zone. He found out by coming into the Town Hall, that the town had identified this
as being held by an investor. Now, that kind of surprised me, so I did a little checking around myself.
I said, I am just wondering what the criteria is and I was told that what the criteria is is: if you don't
farm the property yourself, you are listed as an investor. Although you own the land, your family has
owned the land and it could be for 100 or 200 years but you are still listed as an investor. So I checked
on my good friend, retired Trustee John Tuthill in Orient, who owns 120 acres. Once again, an

investor. And then there is, I guess everybody here, I don't think that there is anybody here that doesn't
know Walter Krupski, from North Fork Bank. His father who has lived on Bridge Lane ever since I
was a kid and probably before, I would assume. He is an investor also. Now, I went to a meeting the
other night at the school which was attended by many of the people who are right up here on the
Board, it was non-political, although this issue has become political. But I heard how Southampton
and East Hampton referred to their farm community and I think that we are doing a disservice to the
local people by calling them investors. You are feeding the frenzy by not telling the people who they
really are. If the Conway's and if the Tuthill's and if the Krupski's, who owned this property for 100-
150 years or whatever are regarded callously by the Town in its reports then it is easy for somebody to
stand up here and make a statement like I heard the other night, well, it is no big deal, 60-70% of the
real estate, the AC and the R-80 zones in $outhold Town is in the hands of speculators. That statement
becomes absolutely true. $o we have a little time now, and I have my zoning map and I have already
started so if somebody wants to start putting names on the map, let's find out who these people really
are. Because a lot of them, I went to school with their kids. They have owned the property since, well,
I have got out of school in 1961 and that is when property went up to $1,000 per acre and believe you
me, a lot of people got out and a lot of the farm kids didn't come back. But the land is still there and a
lot of it is still held by their families. $o let's put names on it and let's tell them what they are. They
are residents of the Town of $outhold. They are not necessarily investors and also, they are listed as
investor if their tax bill is sent out of Town. So, if somebody sends it to a Trust or if they send it to
their attorney in another town, the minute the tax bill goes out of Town, that person becomes an
investor. I don't think that is any way for the Town to treat its people. It is a lot harder to take away
people's property when you know who the people really are. Thank you.
SUPERVISOR HORTON: Would anyone else care to address the Town Board on town related
business? Yes, you have waited patiently.
STEVE HUSAK: Steve Husak, Mattituck. We have got a situation over on Breakwater Road in the
Breakwater Beach over there. There has been a ton of vandalism lately. There was a party over the
July 4th weekend where they went around with a four-wheel drive pickup, ripped out all the street
signs, they have damaged mailboxes every weekend nonstop since then. I, continually every Saturday
and Sunday morning pickup between 1 dozen and 2 dozen beer bottles off my front lawn. ! have
complained to Mattituck Park District, ! have complained to the Police Department. Any time that !
complain, all ! get is one cop car, one cop who is afraid to get out of his car and ! don't blame him
because he is surrounded by 60 or 70 kids down at the beach, these kids are down there drinking and
smoking pot and nothing is being done about it. ! work hard, ! live in a house that my family has
owned since 1945 and ! am fed up and ! want to know if we had a joint task force last week with the
Coast Guard and the Town Police to crack down on boating while intoxicated, why we can't go
undercover with some of these young cops, this happens at every road that ends up at a beach. We
have drag racing and something has got to be done. Something has got to be done to crack down.
They used to lock the beaches up but the Park District doesn't seem to have the money up any more to
lock the beaches up and if you talk to them, they tell you it is a police matter. If you talk to the police,
they tell you it is a Park District matter. ! talked to a lot of my customers who have expensive homes
across the town, who live on the water, live by the beaches and they tell me the same thing. They have
drag racing up and down their streets. Get these cops off of Rt. 48 in the morning, giving guys tickets
for doing 60 in a 55 on their way to work, put them down there at night. Nighttime is when the drug
dealers are coming from Riverhead to sell our kids their drugs, that is when they are down there

drinking, that is where the problem is. The problem isn't on Rt. 48. By the time that the cops get them
up there, the accident has happened already. Nip it in the bud down there and prevent our mailboxes
from being destroyed and our property from being destroyed, please.
SUPERVISOR HORTON: Thanks, Mr. Husak. I appreciate you coming in and sharing that with us.
Would anybody else care to address the Board on town related business? Mr. Dinizio.
JIM DINIZIO: Jim Dinizio, Greenport. I could sympathize with that fellow because I live at 67 steps
and we have had our problems, too. I don't want to say something here, I don't know if I should but
about 10 minutes ago, I should have said something but I didn't. And that was concerning the
moratorium and the Church Lane people. I should have stood up and encouraged you to vote against
it. That particular thing. Not because Mr. Mohr is any different than anybody else or even that it is
you know, one commercial building away from what we are trying to do. And that wasn't the reason
that I didn't stand up. I didn't stand up because the last time that I stood up for these people, I was
called a white man. And by that same person; I was called a liar. So I felt a little intimidated by that
but as I sat there, you know, I shouldn't let that person intimidate me into doing the things that I think
are right. And ifI understand you right, it lost. Am I correct?
SUPERVISOR HORTON: That is correct.
MR. D1NIZIO: I just hope that none of you took the easy way out. Because you need to vote how you
feel. It is important, it is important to all the people. And that includes the next set of whatever people
come up with, you have got to vote for how you feel and not how somebody else tells you to do or how
you think other people are. Find out how they feel and this little world that you live in, this room right
here, is not the real world. Believe me, the amount of time that ! come up here, ! don't represent that
many people. Okay? But ! do feel like ! felt that and ! thought to myself, you guys have got to feel the
same way. So, ! just wanted you to know that there is someone in this room that didn't feel right about
standing up for what he thought was right and there is a person in this room that caused that. So, thank
you for voting on that. ! know that you probably voted your conscience. A moratorium is a
moratorium is a moratorium. You should take it seriously and ! think that you did. Thank you very

from him in that regard?
SUPERVISOR HORTON: No, we haven't discussed it.
MRS. EGAN: Great, that is great. When do you think that might be done?
SUPERVISOR HORTON: I don't have an answer for you, Mrs. Egan.
MRS. EGAN: You don't have an answer for me. That is great. Now, also, the, there is a word that
would like to throw at you. ! think that you can all, you don't have to go to the dictionary for this one
tonight. That is wonderful. That is integrity. Of which ! don't see very much of around here. Now,

MRS. EGAN: Excuse me, ! am not finished. ! would like to tell you that the road to hell is paved with
good intentions. And ! am sure Mr. Romanelli, ! don't need you mouthing what ! am saying. You
haven't done anything since you came into office. Even have you Mr. Richter. Now, ! also requested
that for the Maritime Festival, which ! have already sent a letter to your mother, Josh, that ! think that
it should be cancelled because it is a mess down there. That we at least have some more police there
and at Mattituck. Have you been able to address that issue?

think there is anything that the Town can do about it but all this building and all these trucks ain't

nothing has been done. Now also, I believe I had asked Mr. Romanelli almost two years ago or
whatever, that where buildings and excavations are that that orange meshing be put around. I believe
that you told me that you would be getting in contact with the Building Department to see that that
when permits were granted, that that would happen. Has that happened, Mr. Romanelli? And the
answer to that is yes or no.
COUNCILMAN ROMANELLI: No.
MRS. EGAN: Great. You know how to say that pretty good. You don't seem to say no when it
comes to spending our tax money. Bye.
