FINDINGS OF FACT
The Zoning Board of Appeals field a public hearing on this application on December 18, 2003; at
which time written and oral'ovidence were presented. Based upon all,testimony,'documentation,
personal inspection of the property, and other evidence, the Zoning Bdard finds the following facts to
be true and relevant:
AREA VARIANCE BELIEF REQUESTED: Applicant wishes to obtain 'building permits and
certificates of occupancy for existing building construction consisting of a detached shed, accessory
pooh storaqp7 house, and accessory deck structures are located in the`noitherly front'yard area, as
shown on the 7116/03 site plan,` revised 8/11/03; prepared by Richard H. Strouse, L.S. The pool
storage house is 9'1'/2"by 13 ft. ,in size, 11 ft. in height; the open deck is semi-circle, 30 ft. deep by
19 ft: radiusk�and-is unenclosed. The one-story accessory garden shed is 121' ft. by 23'6", at a
height of,g;1d' to the roof peak, as shown-on,applicanfs diagrams date-stamped by the Board of
Appeals Oetoberl;2003.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections; the Board makes the following findings:
1. The granting of the relief requested will not produce an undesirable change in the character of
the ndighborhoodzor a detriment to nearby properties, with the location of an "as'builf' garden shed,
pool equipment building, and wooden deck. The applicant's property'is a 6.6+- acre'°waterfront

parcel overlooking Fishers Island Sound,with only one neighboring dwelling, situated on another
large parcel, along the front yard area affected by this variance. The applicant's [approx. 10 ft, x 16
ft.] accessorybuilding, built for pool equipment storage, was constructed in 1989 under Town of
°'Southold Building Permit #18142, issued 08/26/89, Buiiding,Permit #17999 had also been issued
one`'month earlier, in, 04/10/89,.:for.an. application to construct an open, unenclosed, irregular
shaped, wooden deckplatforrn, adjacent to the'northwestem,side of the pool. Both the in-ground
pool,and the adjacent,surrounding patio area on tf➢s site, were constructed;mpayyears earlier by a
prevLous owner.,

garden accessory structure that is the subject of this decision.
