Base~i ~upon?ail testimony documentation, personal inspection of the property, and otiie'r,evidence, the Zoning BO~ird finals the following facts to be true and. relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to obtain building permits and certificates ofdocupancy for existing building construction consisting of a detached shed, ¢ccesso~ J~ool storage house, and~adcessory deck structures are located in the northerly f~ont yard area as ~hown on th~7/t'6/03 .~i~8 plan, revised 8/11/03 prepared by Rchard H {3tr(~use L.S. The one-story accessory garden shed ~s 12 3 ft..yb 23 6 at a. height of' 9"1¢' to' the. rbof peak, as shown on applicant's diagrams date-stamped by the Board of Appeais October 1, 20'03, REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal ir~spect ohs, the Board makes the following findings: 1. The granting of the reief requested w not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties, with the location of an "as built" garden shed. pool equipment building, and wooden deck. The applicant's property is a 6.6+- acre wated:ront Page 2 - January 8, 2004 AppL No. 5442 - David Strupp 3-3-5 at Fishers Island parcel overlooking Fishers Island Sound, with only one neighboring dwelling, situated on another large parcel, along the front yard area affected by this variance. The applicant's [approx. t0 ft. x 16 ft.] accessory building, built for pool equipment storage, was constructed in 1989 under Town of Southold Building Permit #18142, issued 05/26/89. Building Permit #17999 had also been issued one month eadier, in 04/10/89, for an application to construct an open,, unenclosed, irregular shaped, wooden deck platform, adjacent to the northwestern side of the pool. Both the in-ground pool, and the adjacent, surrounding patio area on this site, were constructed many years eadier by a previous owner. During approximately the same period, the applicant had constructed another accessory structure within a designated front yard area on this same property, without securing a Building Permit. This "as built" shed structure is approximately 22 ft. x 12+ ft., and is noted on the site survey dated 07/16/03 submitted by the applicant with a setback of 32+- ft. from the front yard lot line. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance. The adjacent dead-end private road creates a second front yard, with setback requirements that~ cannot be conformed to, in the situating of these accessory structures. The structures are surrdunded by a gate and 4' high chain link fence to screen the structures from view from adjacer,~ properties or from the streets. The rear yard is a wetland area and the opposite available ys;.rd is adjacent to the beach and wetland area of the Fishers Island Sound, which are not feasible. 3. The requested variance is not substantial because the un-surfaced private road that defines the applicant's nonconformity to setback requirements serves only as a second driveway or service road for the applicant, and as a driveway for one adjacent neighbor. 4· Total lot coverage will remain at less than 20 percent, including all existing structures, and the "as built" garden shed. 5. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because the nearest neighboring house is +200 feet from applicant's existing pool house and deck, and the applicant maintains an evergreen hedgerow along the affected driveway area. The structures are surrounded by a gate and 4' high chain-link fence to screen the structures from view from adjacent properties or from the streets. The rear yard is a wetland area and the opposite available yard is adjacent to the beach and wetland area of the Fishers Island Sound, which are not feasible. 6. The difficulty for the applicant is self-created, since a Building Permit was not issued for the garden accessory structure that is the subject of this decision. 7. The relief granted is the minimum determined necessary for the owner to enjoy the benefit of a garden shed, accessory deck and. pool equipment storage building, while at the same time · Page 3 - January 8, 2004 · '" AppL NO; 5442 - David Strupp 3-3-5 at Fishers Isiand protecting and preserving the character of the neighborhood, as well as the health safety, and welfare of the surrounding community.
