In the Matter of the Petition of: DECISION Edward Dart For a Variance to the New York State PETITION NO. 2001-1029 Uniform Fire Prevention &Building Code Upon the application of Edward Dart,flied pursuant to 19 NYCRR 450 or, October 31, 2001,and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a new building of an Al (single family dwelling) occupancy, two stories in height, of type 5 (wood frame) construction, approximately 2,400 square feet in area; located at Main Bayview Road, Peconic, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow a bathroom built into the roof area of the second story with a ceiling height of,8 feet 1'/s inches sloping down to 5 feet 8 inches on the opposite side.] FINDINGS OF FACT 1-- As part of-proposed-new-dwelling,a bathroom is to be constructed into the roof area of the second floor of the building that is the subject of this petition. 2.` The ceiling height of 8 feet 1'/a inches slopes down to 5 feet 8 inches on the opposite side. 3. —With the placement of the fixtures the ceiling height is adequate for normal usage. 4. The petitioner has proposed to install a fire and smoke detecting devices throughout the entire building as required by the Uniform Code. 5, The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a bathroom built into the roof area of the second story with a ceiling height of 8 feet 11/8 inches sloping down to 5 feet 8 inches on the opposite side, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That thepetitionerinstalls fire and smoke detecting devices throughout the entire building in conformance with the Uniform Code. This DECISION is issued under 19.NYCRR 450:6.. Main Bayview Road and Willow Pond Lane, Southold 78-1-10.23 DATE OF PUBLIC HEARING: >April 5, 2001 FINDINGS OF FACT PROPERTY FACTS: Applicant's property comprises 17.5 acres with frontage of 396.75 feet on. I Main Bayview Road in Southold. It is planted in Christmas trees, and improved with an old barn that is used in the tree farm business. The bam is about 155 feet from the road. The property is zoned R-40 Low-Density Residential. BASIS OF APPEAL:Building Inspector's Notice of Disapproval, dated January 17, 2001,denying a permit to construct a new building on the property because it will be the primary building and its location 240 feet from the road will put the existing barn in the front yard in violation of Code section 100-30A.4. RELIEF REQUESTED: Applicant requests a variance authorizing construction of the new building in the proposed location 240 feet from Main Bayview Road. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materialssubmitted and personal inspection, the Board makes the following findings: (1) Applicant testified that the proposed building will serve two purposes: it will provide a better bam for the Christmas tree farm, and it will have an upstairs apartment for the farm manager. Drawings submitted show that the building will have the appearance of a bam. (2) Construction in the proposed location will not significantly affect the appearance of the farm. Although the existing old barn will be in the "front yard" of the new building, its location and appearance will be unchanged. For these reasons, grant of the requested variance will not. produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (3) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (4) The action set forth below is the minimum necessary and adequate to enable applicant to construct a'bam with living quarters in an efficient location on the property while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Melville,NY 11747 Dear Mr. Smith, Mr Michael Verity, the recently appointed head of the Southold Town Building Department,has referred me to you for consideration in gaining relief under the Building Code for minimum side wall height in the bathroom of my new proposed building on my farm. A full set of plans is enclosed for your review. The Project Construct a new barn-style building on farm with a garage area on the first floor and an apartment on the second floor to provide housing for a farm employee and his family. This proposed building will be cedar shingle siding and roof and of a design consistent with a historic 200 year old barn in close proximity on an adjacent parcel. Relief Requested With regards to the three front facing rooms on the second floor apartment, it is my understanding from Mr.Verity that the code will allow a wall height of less than 7'0" in both the bedroom and the living room,but that it is an issue in the bathroom While the enclosed plans do still indicate a 5' 8"wall height in the bathroom we have now(since Mr.Verity has seen it), located the vanity fi,rther from the wall to better allow for adequate headroom at the sink in hopes that this could enable an exception to the 7ft code requirement. I do not wish to have to put a dormer on the front of the building to increase the wall height as it would ruin the clean lines of the colonial barn I am trying to have. I respectfully request relief from the 7'0"wall height requirement in the bathroom. Thank you for your consideration.
