Isaken Jr.dated July, 1999. BASIS OF APPEAL: Building Department Notice of Disapproval dated November 30, 2001, denying a permit to construct a porch addition to an existing single family dwelling because the proposed construction indicates a front yard setback of 38.7+- ft., instead of the code-required 40-foot minimum front yard setback, pursuant to Article XXIV Section 244B. i AREA VARIANCE REQUESTED: Applicant wishes to construct a 41ft. 11 in. long by 6 ft. 6 in. (on the north side) and 4 ft. 6 in. (on flit south side) wide covered front porch addition to the existing house. The porch addition would leave a front yard setback of 38.3'(+-) on the northeast side and 39.5` (+-) on the southeast side from the front yard property line. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267-b3 "Area Variances"' -v Board has considered the benefit to the applicant if the variance is granted, as weighed i' against the detriment to the health,safety and welfare of the neighborhood and community by such grant, and determines t aft 1. Grant of the area.variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The porch addition is modest in size and the 1 ft. to 2 ft. variance granted p, herein will not,appear out-of-keeping with the front yard setbacks of nearby residences. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's house has an existing front yard setback of 45.3' on the north side and 44'1' on the south side. Without a variance, the applicant would be unable to construct any L sort of covered porch addition to the front of the house. i, 3. The variance granted herein is not substantial and represents a one to two foot reduction in the code's 40- foot minimum front yard set back. 4. The alleged difficulty has been self-created and is due to the applicant's reasonable desire to enjoy the �, benefits of a covered porch. 28, 2002 ZBA Appl.
