JOHN T. LUSCHER, residing at 3416 Sunset Key Circle, Punta Gorda, FL 33955, party of the first part, and
PATRICK J. BURKE AND CLAIRE V. BURKE, husband and wife, residing at 345 Colonial Road, Southold,
NY 11971, party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the Town of Southold, County of Suffolk and State of New York, more particularly bounded and
described in Schedule "A" attached hereto and made a part hereof.
BEING AND INTENDED TO BE the same premises described in the deed made by Charles B. Luscher,
Jr.,as Executor of the Last Will and Testament of Maud C. Luscher dated April 25`h, 1988 and recorded
May 27`h, 1988 in Liber 10613 Page 17 in the office of the Clerk of the County of Suffolk.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read "parties'' whenever the sense of this indenture so requires.

situate, lying and being iri the Hamlet of East Marion, Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a monument on the southerly line of a 16 foot private road known as "Rabbit Lane",
789.28 feet easterly along said southerly line from Bay Avenue; from said point of beginning;
RUNNING along said southerly line, North 51 degrees 24 minutes 40 seconds East, 2.07 feet to
land conveyed by Oak Grove Beach Realty Corporation to John F. Brown by deed dated April 21,
1951, recorded in Liber 3207 page 279;
THENCE along said land, South 34 degrees 12 minutes 40 seconds East, 0.21 feet to land
conveyed by Trolan to John F. Brown by deed dated December 15, 1942, recorded in Liber 2271

BEGINNING at a point on the southerly line of a 15 foot private road known as "Rabbit Lane",
820.51 feet easterly along said southerly line from Bay Avenue, said point of beginning being the
northeasterly corner of land conveyed by the Oak Grove Beach Realty Corporation to John F.
Brown by deed dated April 21, 1951 recorded in Liber 3207 page 279; from said point of beginning;
RUNNING along said southerly line, North 51 degrees 24 minutes 50 seconds East, 1.77 feet to an
iron pipe and land conveyed by Oak Grove Beach Realty Corporation to Schmietz, South 34
degrees 12 minutes 40 seconds East, 103 feet, more or less, to ordinary high water mark of
Gardiners Bay;
THENCE southwesterly along said high water mark, 1.7 feet, more or less, to land conveyed by
