SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 14,399 square foot parcel located in a R-40 Zoning District. The parcel runs 121.00 feet along South Harbor Road, runs 172.00 feet on the North side, 95.94 feet on the West side, and 112.52 feet on the South side. The parcel is improved with a one-story frame residence and a shed. All is shown on a survey by Michael W. Minto,L.L.S., dated October 4, 2023. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's October 31, 2023, Notice of Disapproval based on ani application for a permit to construct a sunroom addition to an existing single-family dwelling; at 1) located less than the code required minimum side yard setback of 10 feet; located at 2600 South Harbor Road, Southold,NY. SCTM No. 1000-75-7-7.1. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to a dwelling,to create a four-season sunroom,that will result in a non-conforming side yard setback of 8.6 feet where town code requires a minimum 10 fee side yard setback. ADDITIONAL INFORMATION: The dwelling has the benefit of pre-existing Certificate of Occupancy Z31183, stating the house was built before Town of Southold's zoning codes were established in 1957. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 4, 2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1 Page 2,January 18, 2024 #7866, Stalzer SCTM No. 1000-75-7-7.1 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood consisting of single family homes built before zoning. The existing house has a non-conforming side yard setback of 8.4 feet and maintaining that side yard setback with an addition measuring 8.6 feet side yard setback will be imperceptible and will not change the character of the neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing side yard setback is non-conforming at 8.4 feet and any extension matching the existing side yard setback will require the benefit of variance relief. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 14% relief from the code. However,the proposed non-conformity matches the pre-existing non-conforming setback. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new sunroom while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to GRANT the variance as applied for,and shown on the Architectural plans prepared by John J.Condon,LPE,labeled GI, G2, A 101 and A201 and dated August 20, 2023; and the survey prepared by Michael W. Minto, L.L.S., last revised October 4,2023. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this.decision null and void That the above conditions be written into the Building'Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
